<legis-type>A BILL</legis-type> 
<official-title>To establish a mechanism for developing uniform United States positions on issues before the Basel Committee on Banking Supervision at the Bank for International Settlements, to require a review on the most recent recommendation of the Basel Committee for an accord on capital standards, and for other purposes.</official-title>

<section section-type="section-one" id="H2A07F3DDCB504B23A14284D4FBCC84" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>United States Financial Policy Committee For Fair Capital Standards Act</short-title></quote>.</text></section> 
<section id="HE1E7DC164FD644A29451F937B1C73071"><enum>2.</enum><header>United States Financial Policy Committee</header> 
<subsection id="H77B9401A4FA3463E8817486B7D5269EC"><enum>(a)</enum><header>Establishment</header><text>There is hereby established an inter-agency committee, to be known as the <quote>United States Financial Policy Committee</quote> (hereafter in this Act referred to as the <quote>Committee</quote>), which shall consist of—</text> 
<paragraph id="HF8D30CF05CAB4BCC8703F93E26ECB1A6"><enum>(1)</enum><text>the Secretary of the Treasury, who shall serve as the Chairperson of the Committee;</text></paragraph> 
<paragraph id="H528BB966909F455D90E3C62EBDC66DB7"><enum>(2)</enum><text>the Chairman of the Board of Governors of the Federal Reserve System;</text></paragraph> 
<paragraph id="H52AD01452A4D46ED9E6812EBB526EC3D"><enum>(3)</enum><text>the Comptroller of the Currency;</text></paragraph> 
<paragraph id="H89940F2527284EA193A69BFC597E0BB"><enum>(4)</enum><text>the Chairperson of the Federal Deposit Insurance Corporation; and</text></paragraph> 
<paragraph id="H2834B56E38D54927AC3F63FBBC98D1AF"><enum>(5)</enum><text>the Director of the Office of Thrift Supervision.</text></paragraph></subsection> 
<subsection id="H75A4573F263A4835971B9EEE88E5026D"><enum>(b)</enum><header>Purpose</header><text>The purpose of the Committee is to develop uniform United States positions on proposals made to, and issues before, the Basel Committee on Banking Supervision that, if implemented, may directly or indirectly affect United States financial institutions.</text></subsection> 
<subsection id="H8B39B54823D54090A2DB93981E2844FC"><enum>(c)</enum><header>Meetings</header><text>The Committee shall meet before any meeting of the Basel Committee on Banking Supervision that is related to, or is expected to involve a discussion of, capital standards and at any other time the Chairperson or any member of the Committee calls for a meeting.</text></subsection> 
<subsection id="H236B1C103AC34217BBFE86E987C1F457"><enum>(d)</enum><header>Adherence to Committee position</header> 
<paragraph id="H74EC35EECD06471CBAAF46A755BDE58"><enum>(1)</enum><header>In general</header><text>Each member of the Committee that is a participant on the Basel Committee on Banking Supervision shall adhere to the positions of the Committee in any negotiations of the Basel Committee on Banking Supervision.</text></paragraph> 
<paragraph id="H1C89CB1E67A64C83B2C5574CCBCD00BF"><enum>(2)</enum><header>Lack of uniform position</header><text>If the members of the Committee that are participants on the Basel Committee on Banking Supervision are unable to agree on a uniform position on an issue, the position of the Secretary of the Treasury shall be determinative for purposes of paragraph (1) with respect to such issue.</text></paragraph></subsection> 
<subsection id="H310A0DEF85754A759332D5C7F418C839"><enum>(e)</enum><header>Reports to the Congress</header> 
<paragraph id="HBB336BD7424E4B4BAAD557B230D6E1F1"><enum>(1)</enum><header>Annual report</header> 
<subparagraph id="H81508F58E66B48BD86C2D4994BC301A0"><enum>(A)</enum><header>In general</header><text>The Committee shall submit an annual report to the Congress on the proceedings of the Committee during the period covered by the report.</text></subparagraph> 
<subparagraph id="H890D422D65304CCE97F7E7D5AAABC441"><enum>(B)</enum><header>Contents of report</header><text>The report shall include—</text> 
<clause id="H5EDE98CFF55440D5BC678DBD6C9F77B9"><enum>(i)</enum><text>a brief description of issues that were addressed by the Committee;</text></clause> 
<clause id="HC2FA614ED3134C8F9710E35ECB21CDC"><enum>(ii)</enum><text>a brief description of the uniform positions developed by the Committee with respect to such issues; and</text></clause> 
<clause id="H172166C182FE4B479816942CF09526E"><enum>(iii)</enum><text>in the case of any issue for which a uniform policy was not agreed to, a brief description of the positions of the parties to the disagreement and an explanation of the reasons why the parties could not reach an agreement.</text></clause></subparagraph></paragraph> 
<paragraph id="HB64268270AA547338EB300FE879B527"><enum>(2)</enum><header>Reports to the Congress prior to agreement on any basel accord</header> 
<subparagraph id="H5AA394B07C064870B89CD03C33A816EF"><enum>(A)</enum><header>In general</header><text>No Federal banking agency (as defined in section 3(z) of the <act-name parsable-cite="FDIA">Federal Deposit Insurance Act</act-name>) may agree to any proposed recommendation of the Basel Committee on Banking Supervision before the agency submits a report on the proposed recommendation to the Congress.</text></subparagraph> 
<subparagraph id="H880FFF75836F4A6DB38800F81090E774"><enum>(B)</enum><header>Consultations</header><text>The head of any Federal banking agency that submits a report to the Congress under subparagraph (A) shall consult with the Congress concerning the proposal.</text></subparagraph></paragraph> 
<paragraph id="H55181D022A6143BF8FEEE1E2AB7A622"><enum>(3)</enum><header>Evaluation of New Basel Capital Accord</header><text>The Federal banking agencies (as defined in section 3(z) of the <act-name parsable-cite="FDIA">Federal Deposit Insurance Act</act-name>), in consultation with the Secretary of the Treasury, shall evaluate the impact of the revised Capital Accord, taking into account the following factors, and shall include such evaluation in the report:</text> 
<subparagraph id="H9F44104725854936A879AA2522C99C64"><enum>(A)</enum><text>The cost and complexity of the proposal.</text></subparagraph> 
<subparagraph id="H10AD15AED1FF4EC28E554CB22B0047EA"><enum>(B)</enum><text>The impact of the proposal on small, medium, and large financial institutions.</text></subparagraph> 
<subparagraph id="H8BD901484DF84DCC83DBEFB4916F78B"><enum>(C)</enum><text>The impact of the proposal on real estate markets.</text></subparagraph> 
<subparagraph id="HFD13E45EE8884B91A37D00BFCC10BC03"><enum>(D)</enum><text>The effect of an operational risk capital standard on the resilience of the Nation’s financial system and competition.</text></subparagraph> 
<subparagraph id="H041F71D6EB994EABBDFF7D7986EFB1C"><enum>(E)</enum><text>The impact of the proposal on competition between banks and other financial institutions.</text></subparagraph> 
<subparagraph id="H544805DD89B54579A15208A901E62513"><enum>(F)</enum><text>The need for additional training for supervision and examination personnel.</text></subparagraph> 
<subparagraph id="H2A94D0EC72544FBE8924DC84F38175E7"><enum>(G)</enum><text>Any comments filed by the public after notice and an opportunity to comment for a period of not less than 60 days.</text></subparagraph> 
<subparagraph id="H6A74A120B2754178A3005F2C26CECF91"><enum>(H)</enum><text>The relative impact of compliance by domestic banks.</text></subparagraph></paragraph></subsection> 
<subsection id="HEFE3F17856584F8FAB31C8EC1F778874"><enum>(f)</enum><header>Administrative support services</header><text>Each agency represented on the Committee shall provide such administrative support services as may be necessary for the Committee to carry out its responsibilities under this Act.</text></subsection></section> 
<section id="H6FBEA504E4964C81B4078FA6CEE37C2C"><enum>3.</enum><header>Representation on Basel Committee on Banking Supervision for the Director of the Office of Thrift Supervision</header> 
<subsection id="HA91592F3E7FA46189536A29CE0701570"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 912 of the International Lending Supervision Act of 1983 (<external-xref legal-doc="usc" parsable-cite="usc/12/3911">12 U.S.C. 3911</external-xref>) is amended—</text> 
<paragraph id="H8D7AC96B73914C97B948003764C0E000"><enum>(1)</enum><text>by striking <quote><header-in-text level="section" style="traditional">Sec. 912. </header-in-text> As one of the three</quote> and inserting the following:</text> 
<quoted-block style="OLC" id="HC71817573A3C42A48B6E34DE530085B" display-inline="no-display-inline"> 
<subsection id="HBF171C8C31DF497599BCD475C749978F"><enum>(a)</enum><header>FDIC</header><text>As one of the 4</text></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H763DB18EE69844A988BEC603F3DEB6C"><enum>(2)</enum><text>by adding at the end the following new subsection:</text> 
<quoted-block style="OLC" id="H0681DF95F0AE4C3E85E65E78B749D914" display-inline="no-display-inline"> 
<subsection id="HD39E0DAA66EE4CDEA8EC48EA7897C49D"><enum>(b)</enum><header>Director of the Office of Thrift Supervision</header><text display-inline="yes-display-inline">As 1 of the 4 Federal bank regulatory and supervisory agencies, the Director of the Office of Thrift Supervision shall be given equal representation with the Board of Governors of the Federal Reserve System, the Comptroller of the Currency, and the Federal Deposit Insurance Corporation on the Committee on Banking Regulations and Supervisory Practices of the Group of Ten Countries and Switzerland.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HB32BEE5EA53F44F78DFF3CAA81B85BBF"><enum>(b)</enum><header>Technical and Conforming Amendment</header><text display-inline="yes-display-inline">The heading for section 912 of the International Lending Supervision Act of 1983 (<external-xref legal-doc="usc" parsable-cite="usc/12/3911">12 U.S.C. 3911</external-xref>) is amended to read as follows:</text>
