<section id="H7B0DFEF151224BCEBC000195FA4EE6B" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Terrorist Apprehension and Record Retention Act of 2005</short-title></quote> or the <quote><short-title>TARR Act of 2005</short-title></quote>.</text></section> 
<section id="HADC08CBF0B67443EB4EACCAE805971D3"><enum>2.</enum><header>Identification of terrorists</header> 
<subsection id="H82177A6490644A88A9798FE5109CF06"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/922">Section 922(t)</external-xref> of title 18, United States Code, is amended by inserting after paragraph (6) the following:</text> 
<quoted-block display-inline="no-display-inline" id="H418BD828BCED49CEA064243531D51248" style="OLC"> 
<paragraph id="H090AD7002E554669A8DAB5346174A43B"><enum>(7)</enum><text>If the national criminal background check system indicates that a person attempting to purchase a firearm or applying for a State permit to possess, acquire, or carry a firearm is identified as a known or suspected member of a terrorist organization in records maintained by the Department of Justice or the Department of Homeland Security, including the Violent Gang and Terrorist Organization File—</text> 
<subparagraph id="H1950E32863BD45CD97CFF9FE3D6541BA"><enum>(A)</enum><text>all information related to the prospective transaction shall automatically and immediately be transmitted to the appropriate Federal and State counterterrorism officials, including the Federal Bureau of Investigation;</text></subparagraph> 
<subparagraph id="H266CFE6E9617474CB9F5B9903C16BD54"><enum>(B)</enum><text>the Federal Bureau of Investigation shall coordinate the response to such an event; and</text></subparagraph> 
<subparagraph id="H26E2C9BDCFD047910027989F431B2BF7"><enum>(C)</enum><text>all records generated in the course of the check of the national criminal background check system, including the ATF Form 4473, that are obtained by Federal and State officials shall be retained for a minimum of 10 years.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H25CD2431F59E43B380C0522500C549E4"><enum>(b)</enum><header>Conforming amendments</header> 
<paragraph id="HBC2B242213694C40961682D42444447"><enum>(1)</enum><header>Title 18</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/922">Section 922(t)(2)(C)</external-xref> of title 18, United States Code, is amended by inserting after <quote>transfer</quote> the following: <quote>, except as provided in paragraph (7)</quote>.</text></paragraph> 
<paragraph id="HBE575544D050438DAFEDE6FDB94C80CB"><enum>(2)</enum><header>Other law</header><text>Section 617(a)(2) of the Departments of Commerce, Justice, and State, the Judiciary, and Related Agencies Appropriations Act, 2004 (118 Stat. 95) is amended by inserting after <quote>or State Law</quote> the following: <quote>, except for information required to be maintained by <external-xref legal-doc="usc" parsable-cite="usc/18/922">section 922(t)(7)</external-xref> of title 18, United States Code</quote>.</text></paragraph></subsection></section>
