<section id="HC7770EF3D9C34BCD97001904F0087A7" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Plant Breeders Equity Act of 2005</short-title></quote>.</text></section> 
<section id="H930D81B3D73B4CC9927565BD8CE6A0FC" section-type="subsequent-section"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text> 
<paragraph id="H0ED82B3A5EC847419D848B9C13AF04F2"><enum>(1)</enum><text>Since 1930, the Plant Patent Act has benefited the public by encouraging innovation and development of new varieties of asexually reproduced plants, including trees, shrubs, flowers, and fruit-producing plants.</text></paragraph> 
<paragraph id="HA85AFFCB1ED6414D83BD483FC851D67F"><enum>(2)</enum><text>The United States is a signatory to the International Union for the Protection of New Varieties of Plants (UPOV) Convention; however, the plant patent system has not been modernized to incorporate important provisions of UPOV, placing breeders of asexually reproduced plants in a position of inequity with breeders of other types of plants in the United States and with foreign breeders.</text></paragraph> 
<paragraph id="H9314CC14ACB2416CAC3B41DC75AA8D08"><enum>(3)</enum><text>Closer harmonization of the plant patent system with UPOV will restore equity and ensure continued innovation and development of horticultural plant varieties.</text></paragraph></section> 
<section id="H7D2A8142DB344ABF8749A13F52E35077"><enum>3.</enum><header>Amendments to title 35, United States Code</header> 
<subsection id="H2CABE2AEF3864548B33E5CAB2B6B4607"><enum>(a)</enum><header>Novelty</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/35/162">Section 162</external-xref> of title 35, United States Code, is amended—</text> 
<paragraph id="HD10CF20F7D2D44B2A57EF29F834E1B55"><enum>(1)</enum><text>by striking the section heading and inserting the following:</text>

<section id="H6B336620EB5043649D8CB14FC62B74C2"><enum>162.</enum><header>Description, claim, novelty</header></section><after-quoted-block>;</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H3D45952CEBE74D9392A6BC3E9EB08FFC"><enum>(2)</enum><text display-inline="yes-display-inline">in the first undesignated paragraph, by striking <quote>No plant</quote> and inserting the following: <quote>(a) <header-in-text level="subsection">Description</header-in-text>.—No plant</quote>;</text></paragraph> 
<paragraph id="H1874ED4C006147F1851142009E6369BF"><enum>(3)</enum><text>in the second undesignated paragraph, by striking <quote>The claim</quote> and inserting the following: <quote>(b) <header-in-text level="subsection">Claim</header-in-text>.—The claim</quote>; and </text></paragraph> 
<paragraph id="HCFB295513F424E0A897DEE6F93AB5CA8"><enum>(4)</enum><text>by adding at the end the following:</text>

<subsection id="H7F742D605D844BBF832EC7A627E77123"><enum>(c)</enum><header>Novelty</header> 
<paragraph id="HF6191E45DB3648C2BF50DAF6FCFCCB00"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in paragraph (2), no plant patent application shall be denied, nor shall any issued plant patent be invalidated, on the grounds that the invention was sold or otherwise disposed of.</text></paragraph> 
<paragraph id="H958CAACE98D347CDA0241B26B2CBF8A4"><enum>(2)</enum><header>Exceptions</header><text>Paragraph (1) shall not apply if—</text> 
<subparagraph id="HF7990B25455D4EC0954C24D669C41C62"><enum>(A)</enum><text>more than 1 year prior to the date of the application for patent in the United States, the invention was sold or otherwise disposed of to other persons in the United States, by or with the consent of the inventor or discoverer, or the successor in interest of the inventor or discoverer, for purposes of exploitation of the invention;</text></subparagraph> 
<subparagraph id="H0239485CF47D4A7EB421C0041DAE4892"><enum>(B)</enum><text>except as provided in subparagraph (C), more than 4 years prior to the date of the application for patent in the United States, the invention was sold or otherwise disposed of to other persons in a foreign country, by or with the consent of the inventor or discoverer, or the successor in interest of the inventor or discoverer, for purposes of exploitation of the invention; or</text></subparagraph> 
<subparagraph id="HD975A3F744CA4C7FAA68F3A2E88E18F"><enum>(C)</enum><text>more than 6 years prior to the date of the application for patent in the United States, in the case of a tree or vine, the invention was sold or otherwise disposed of to other persons in a foreign country, by or with the consent of the inventor or discoverer, or the successor in interest of the inventor or discoverer, for the purposes of exploitation of the invention.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HAAE4684CB2B946BCB6311B00094207EB"><enum>(b)</enum><header>Plant patent grant</header><text><external-xref legal-doc="usc" parsable-cite="usc/35/163">Section 163</external-xref> of title 35, United States Code, is amended—</text> 
<paragraph id="H161A98D5C51F435C80B7FEFB806FEF00"><enum>(1)</enum><text>by striking <quote>In the case</quote> and inserting the following: <quote>(a) <header-in-text level="subsection">In general</header-in-text>.—In the case</quote>; and</text></paragraph> 
<paragraph id="H60AB10E25A814DCF9E95A15DCE674D60"><enum>(2)</enum><text>by adding at the end the following:</text>

<subsection id="HBC5F40B961724695BDF5FD54C96C9631"><enum>(b)</enum><header>Application</header><text>Subsection (a) applies equally to any plant that is not clearly distinguishable from a protected plant.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HC7136727FBDE433E8E365D8408E009B"><enum>(c)</enum><header>Conforming amendment</header><text>The chapter analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/35/15">chapter 15</external-xref> of title 35, United States Code is amended by striking the item relating to section 162 and inserting the following:</text>

<paragraph id="HB78BE0B1ABC34E5AB605ABD179CA119"><enum>(1)</enum><text>all applications for plant patents filed on or after the date of enactment of this Act, or pending on that date; and</text></paragraph> 
<paragraph id="H99F027CF2EDF4A53A07F60E102F788B2"><enum>(2)</enum><text>in the case of the amendments made by subsection (a), all plant patents in force on the date of enactment of this Act. </text></paragraph></subsection></section>
