<official-title>To amend the Consumer Credit Protection Act to prevent credit card issuers from taking unfair advantage of full-time, traditional-aged, college students, to protect parents of traditional college student credit card holders, and for other purposes.</official-title>

<section section-type="section-one" id="HCC468C8B50264E468DA133D13295FEA8" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>College Student Credit Card Protection Act</short-title></quote>.</text></section> 
<section id="H2E3442FDC02D4BB0BE50A03DF1DA8649"><enum>2.</enum><header>Issuance of credit cards to full-time, traditional-aged, college students</header><text display-inline="no-display-inline">Section 127 of the Truth in Lending Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1637">15 U.S.C. 1637</external-xref>) is amended by adding at the end the following new subsection:</text>

<subsection id="H63AFEAE3FD024B2CB8E14D0D4627FFE"><enum>(h)</enum><header>Provisions applicable with regard to the issuance of credit cards to full-time, traditional-aged, college students</header> 
<paragraph id="H7D36E20733FD4C9884AAD83700E10800"><enum>(1)</enum><header>Definitions</header><text>For purposes of this section, the following definitions shall apply:</text> 
<subparagraph id="H7D8D27DC26434261983EF97763ACDA71"><enum>(A)</enum><header>Traditional college student credit card account defined</header><text>For purposes of this subsection, the term <term>traditional college student credit card account</term> means a credit card account under an open end consumer credit plan established or maintained for or on behalf of any full-time, traditional-aged, college student.</text></subparagraph> 
<subparagraph id="H0C0FC2EB4ECF4F2CB1DCC09AEBA5514"><enum>(B)</enum><header>Full-time, traditional-aged, college student</header><text>The term <term>full-time, traditional-aged, college student</term> means an individual—</text> 
<clause id="HA299F62FB34B4A21B801CE9851A7AB8B"><enum>(i)</enum><text>who is a student described in subparagraphs (A) and (B) of section 484(b)(3) of the <act-name parsable-cite="HEA65">Higher Education Act of 1965</act-name> at an institution of higher education; and</text></clause> 
<clause id="HE7A981CE34634C53A1AE3D474FB68959"><enum>(ii)</enum><text>whose age falls within the age cohort defined by such institution of higher education as the age cohort of traditional-aged students.</text></clause></subparagraph> 
<subparagraph id="HC071CE5377C54797ACBDB7600C4007F"><enum>(C)</enum><header>Institution of higher education</header><text>The term <term>institution of higher education</term> has the meaning given to such term in section 101(a) of the <act-name parsable-cite="HEA65">Higher Education Act of 1965</act-name>.</text></subparagraph></paragraph> 
<paragraph id="H8156280DEBAF4965A6AC7F750920E7BB"><enum>(2)</enum><header>Maximum amount limitation</header><text>Unless a parent or guardian of a full-time, traditional-aged, college student assumes joint liability for debts incurred by the student in connection with a traditional college student credit card account, the total amount of credit extended under a traditional college student credit card account to such student may not exceed the greater of—</text> 
<subparagraph id="H7E2781AB2FC449AA8D871D29E4482B00"><enum>(A)</enum><text>20 percent of the annual gross income of the student in the most recently completed calendar year; or</text></subparagraph> 
<subparagraph id="H07410FCE2C504FB6A6C157AB916B6C57"><enum>(B)</enum><text>the product of $500 and the number of full years which have elapsed since the traditional college student credit card account was opened, not to exceed $2,000.</text></subparagraph></paragraph> 
<paragraph id="H8D6F618763F64B8DAF47B33CF2EC2AF"><enum>(3)</enum><header>Parental approval required to increase credit lines for accounts for which parent is jointly liable</header><text>No increase may be made in the amount of credit authorized to be extended under a traditional college student credit card account for which a parent or guardian of the consumer has assumed joint liability for debts incurred by the consumer in connection with the account before the consumer attains the upper limit of the age cohort described in paragraph (1)(B)(ii) with respect to such consumer, unless the parent or guardian of the consumer approves, in writing, and assumes joint liability for, such increase.</text></paragraph> 
<paragraph id="H92CFDD242AB34E0784D300C000AC0082"><enum>(4)</enum><header>Prohibition on more than 1 credit card account for any full-time college student without independent income</header><text>No creditor may open a credit card account for, or issue any credit card to, any full-time, traditional-aged, college student who—</text> 
<subparagraph id="HC90EF447DBD94685A922EDDF60888912"><enum>(A)</enum><text>has no annual gross income; and</text></subparagraph> 
<subparagraph id="HF1C628CDE41C46F89EDB46ED5574977"><enum>(B)</enum><text>already maintains a credit card account under an open end consumer credit plan.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section>
