<subsection id="H78EB3D71C55C4AA490B4B7058DF58600"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subchapter II of Chapter 99 of the Harmonized Tariff Schedule of the United States is amended by inserting in numerical sequence the following new heading:</text>

<subsection id="H114D281CA2B54F8DA6F2E369D35E88B"><enum>(b)</enum><header>Effective date</header> 
<paragraph id="H3A4AFEAB68D44707AD1177958B07041D"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The amendments made by subsection (a) shall apply to goods entered, or withdrawn from warehouse for consumption, on or after January 1, 2005.</text></paragraph> 
<paragraph id="H5AB1D08C53864A07B59E774941718900"><enum>(2)</enum><header>Retroactive application</header><text>Notwithstanding section 514 of the Tariff Act of 1930 or any other provision of law, and subject to paragraph (4), the entry of any article—</text> 
<subparagraph id="HB6A70A97A704443F92268E529D9B3B60"><enum>(A)</enum><text>that was made on or after January 1, 2005, and</text></subparagraph> 
<subparagraph id="H320168A7FA5441D1BA42ACA506A518CA"><enum>(B)</enum><text>to which duty-free treatment would have applied if the amendment made by this section had been in effect on the date of such entry,</text></subparagraph><continuation-text continuation-text-level="paragraph">shall be liquidated or reliquidated as if such duty-free treatment applied, and the Secretary of the Treasury shall refund any duty paid with respect to such entry.</continuation-text></paragraph> 
<paragraph id="H5D45A1821CE946B8AF64DD44B1065D1B"><enum>(3)</enum><header>Entry</header><text>As used in this subsection, the term <quote>entry</quote> includes a withdrawal from warehouse for consumption.</text></paragraph> 
<paragraph id="H8FF500F657864A05A98724F30001D6A1"><enum>(4)</enum><header>Requests</header><text display-inline="yes-display-inline">Liquidation or reliquidation may be made under paragraph (2) with respect to an entry only if a request therefor is filed with the Bureau of Customs and Border Protection, within 180 days after the date of the enactment of this Act, that contains sufficient information to enable the Bureau of Customs and Border Protection—</text> 
<subparagraph id="HA4C589C0E90E4BCB9DCBBD422E365FC9"><enum>(A)</enum><text>to locate the entry; or</text></subparagraph> 
<subparagraph id="HCFA3C94500CF4881B1ACF0D7285086C7"><enum>(B)</enum><text>to reconstruct the entry if it cannot be located.</text> </subparagraph></paragraph></subsection></section>
