<official-title>To establish a National Marine Scholarship Program to recruit and prepare graduate students for careers in the fields of marine science, and for other purposes.</official-title>

<section id="H22BACE667E0440D4906C7EDF03EDDA80" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline"> This Act may be cited as the <quote><short-title>National Marine Scholarship Act of 2005</short-title></quote>.</text></section> 
<section id="HC6FB258659F24B84A30005681CEA40A2"><enum>2.</enum><header>National Marine Scholarship Program</header> 
<subsection id="HA17D4A6DFB284FF293A48F76EF670088"><enum>(a)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="H8C430EF2FBED4981B780E063F3A030A6"><enum>(1)</enum><header>Administration</header><text>The term <quote>Administration</quote> means the National Oceanic and Atmospheric Administration.</text></paragraph> 
<paragraph id="HA74030ABF0184880934DD869DDB7C5E1"><enum>(2)</enum><header>Administrator</header><text>The term <quote>Administrator</quote> means the Administrator of the National Oceanic and Atmospheric Administration.</text></paragraph> 
<paragraph id="H7399D7D02C9B420BB048BECA9DBE5B19"><enum>(3)</enum><header>Institution of higher education</header><text>The term <quote>institution of higher education</quote> has the meaning that term has under section 101(a) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001(a)</external-xref>).</text></paragraph> 
<paragraph id="H1F694342FE434AD8BD95154760789698"><enum>(4)</enum><header>Program</header><text>The term <quote>Program</quote> means the National Marine Scholarship Program established by the Administrator under this section.</text> </paragraph></subsection> 
<subsection id="H72F0875BC4444FF5B325F87C1B00B2C9"><enum>(b)</enum><header>Establishment of program</header> 
<paragraph id="H91A75B708A3C4F8892067E6769CDA1F"><enum>(1)</enum><header>Requirement</header><text>The Administrator shall establish a National Marine Scholarship Program that is designed to recruit and prepare students for careers in the fields of marine science. Under the program, the Secretary shall award scholarships for those academic programs and fields of study described in the list made available under subsection (d).</text> </paragraph> 
<paragraph id="H4E21BBFBE9074E1CA225BE81FBBAF48B"><enum>(2)</enum><header>Employment obligation</header><text display-inline="yes-display-inline">As a condition of the award of each scholarship under the Program, the Administrator shall require the recipient to enter into a contractual agreement under which the individual is obligated to serve as a full-time employee of the Administration in a position needed by the Administration and for which the individual is qualified, for a period of time to be determined by the Administrator and stated in the contractual agreement. If a full-time equivalent position is not available within the Administration at the time the scholarship recipient is obligated begin their employment, the scholarship recipient may fulfill such employment obligation in a full-time position in another Federal agency with administrative jurisdiction over programs relating to the marine environment that is approved by the Administrator. </text> </paragraph></subsection> 
<subsection id="H305006BC65A94353B21B1CF476647EDB"><enum>(c)</enum><header>Eligibility criteria</header><text>In order to be eligible for a scholarship under the program, an individual must—</text> 
<paragraph id="HCB8B758F1B2A428DA501A07422C1CCAC"><enum>(1)</enum><text>be enrolled or accepted for enrollment as a full-time graduate student at an institution of higher education in an academic program and field of study described in the list made available under subsection (d);</text></paragraph> 
<paragraph id="H8118920C7E9D41E39B73A9475F7ED024"><enum>(2)</enum><text>be a United States citizen or national or a permanent resident of the United States; and</text></paragraph> 
<paragraph id="H44017E3E05D64A6B80A9BF3401C0147E"><enum>(3)</enum><text>at the time of the initial scholarship award, not be an employee of the Administration.</text></paragraph></subsection> 
<subsection id="H41DD2946D00A4424ACA8F903C4E3BB72"><enum>(d)</enum><header>Eligible academic programs and fields of study</header><text>The Administrator shall make publicly available a list of academic programs and fields of study for which scholarships under this section may be used, and shall update the list as necessary.</text> </subsection> 
<subsection id="HA3C595481C8B4538BF4B5C5263759FF4"><enum>(e)</enum><header>Competitive award process</header> 
<paragraph id="HA131963DC40B4C7C9CE48400771D5D78"><enum>(1)</enum><header>In general</header><text>Under the Program, the Administrator shall award scholarships to individuals who are selected through a competitive process—</text> 
<subparagraph id="H28A283667B8E4A49BC00773EAEFEAC00"><enum>(A)</enum><text>under which awards are made primarily on the basis of academic merit;</text></subparagraph> 
<subparagraph id="H4DB664AFD6D648E2A1866429FADEDFA0"><enum>(B)</enum><text>in which consideration is given to promoting the participation in the Program by individuals referred to in section 33 or 34 of the Science and Engineering Equal Opportunities Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1885a">42 U.S.C. 1885a</external-xref>, 1885b); and</text></subparagraph> 
<subparagraph id="H33DF29B5FE0C4A08A93405E06E82D8AB"><enum>(C)</enum><text display-inline="yes-display-inline">in which consideration may be given to financial need.</text> </subparagraph></paragraph> 
<paragraph id="HEBE579C9CF8644FBA2A657E0F1A8D54C"><enum>(2)</enum><header>Application</header><text>An individual seeking a scholarship under this section shall submit an application to the Administrator at such time, in such manner, and containing such information, agreements, or assurances as the Administrator may require.</text></paragraph> </subsection> 
<subsection id="HCE5A55895CFA462BB19D45204758384C"><enum>(f)</enum><header>Scholarship limits</header> 
<paragraph id="H7C299C5437E14720973B6E1EF0B5F7A8"><enum>(1)</enum><header>Number of academic years</header><text>An individual may not receive a scholarship under this section for a masters degree program for more than 2 academic years, or for a doctorate program for more than 4 academic years, except as specifically authorized by a waiver issued by the Administrator.</text></paragraph> 
<paragraph id="HFFD20EFDD61C4214A8D792357675F073"><enum>(2)</enum><header>Dollar amount</header><text>The dollar amount of a scholarship under this section shall not exceed the cost of attendance, as such cost is determined in accordance with section 472 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1087">20 U.S.C. 1087</external-xref>).</text> </paragraph> 
<paragraph id="HC160F2A5F38E4448879584CD4FC81BD"><enum>(3)</enum><header>Use</header><text>Amounts received as a scholarship under this section may be expended only for tuition, fees, and other expenses authorized by regulations issued by the Administrator.</text></paragraph> 
<paragraph id="H46D726A469454D9E94C1B31BEC65D400"><enum>(4)</enum><header>Payment of scholarship amounts</header><text>The Administrator may enter into a contractual agreement with an institution of higher education with respect to which a scholarship is provided under this section, under which the amounts provided as the scholarship for tuition, fees, and other authorized expenses are paid directly to the institution.</text></paragraph></subsection> 
<subsection id="H2C22514BD558423B9D38F400787CECBA"><enum>(g)</enum><header>Period of service under employment obligation</header> 
<paragraph id="H6F6C8ACC94A543F482F5B6A35053C300"><enum>(1)</enum><header>General requirement</header><text>Except as provided in subsection (i)(2), the period of service for which an individual shall be obligated to serve as an employee of the Administration pursuant to this section shall be determined by the Administrator in accordance with subsection (b)(2).</text> </paragraph> 
<paragraph id="H8BDB1BB1D99042658761F8F7AA49A3BA"><enum>(2)</enum><header>Beginning of service</header> 
<subparagraph id="HDC824F4DC8BD43BA9BA75CB411925B6C"><enum>(A)</enum><header>General rule</header><text>Except as provided in subparagraph (B), obligated service under subsection (b)(2) shall begin not later than 60 days after the date on which individual obtains the educational degree for which the scholarship was provided.</text> </subparagraph> 
<subparagraph id="H21B8DBDDA19B4114A071B956899757FA"><enum>(B)</enum><header>Deferral</header><text>The Administrator may defer the beginning of obligated service under subsection (b)(2) if the Administrator determines that such a deferral is appropriate. The Administrator shall by regulation prescribe the terms and conditions under which a service obligation may be deferred under this subparagraph.</text></subparagraph></paragraph></subsection> 
<subsection id="HC9A40AD8EB2D4AD8BC62F505712BD32"><enum>(h)</enum><header>Repayment</header> 
<paragraph id="HF2F6360882BA40C297B06165A6AEEBE"><enum>(1)</enum><header>Failure to perform academically</header> 
<subparagraph id="H04FDA681E2254314B10058C9810075C8"><enum>(A)</enum><header>Breach of obligation</header><text>A recipient of a scholarship under this section shall be in breach of the recipient’s contractual agreement under this section if the recipient—</text> 
<clause id="H580AB28B07C94F4DBAC0031CAD81313D"><enum>(i)</enum><text>fails to maintain a high level of academic standing, as defined by the Administrator by regulation;</text></clause> 
<clause id="H0521FAE2EA6843BC89E2795716003DE6"><enum>(ii)</enum><text>is dismissed from the recipient’s educational institution for disciplinary reasons; or</text></clause> 
<clause id="HF3C76C235DB0435DB156EC8C5E87CD92"><enum>(iii)</enum><text>voluntarily terminates academic training before graduation from the educational program for which the scholarship was awarded.</text></clause></subparagraph> 
<subparagraph id="H8319EBB08FE741B9A684D40786B35FA"><enum>(B)</enum><header>Penalty</header><text>A recipient of a scholarship who under subparagraph (A) is in breach of the recipient’s contractual agreement—</text> 
<clause id="H12C3FC9778BB41F1913FE4489334E426"><enum>(i)</enum><text>shall be liable to the United States for repayment, within 2 years after the date of the breach, of all amounts paid under the scholarship to the recipient or to an institution of higher education on the recipient’s behalf; and</text> </clause> 
<clause id="H6D73F294A4E74E6DAAFBEED741F24965"><enum>(ii)</enum><text>shall not be required to fulfill any employment obligation under such agreement.</text></clause></subparagraph> </paragraph> 
<paragraph id="H65349B69DA914E76B5BECE00D32CC804"><enum>(2)</enum><header>Failure to fulfill employment obligation</header> 
<subparagraph id="H974A6F0844BE499CBECD3F370327274B"><enum>(A)</enum><header>Breach of obligation</header><text>A recipient of a scholarship under this section shall be in breach of the recipient’s contractual agreement under this section if the recipient—</text> 
<clause id="H741379B6FF734557912641DE86D7A3DF"><enum>(i)</enum><text>fails to begin or complete the recipient’s employment obligation under this section; or</text> </clause> 
<clause id="HC9EB6FB738DA4F3980693D3F64E97947"><enum>(ii)</enum><text>fails to comply with the terms and conditions of deferment established by the Administrator pursuant to subsection (g)(2)(B).</text></clause></subparagraph> 
<subparagraph id="HC48A24BA3DB7415FAA21118E3BBA0476"><enum>(B)</enum><header>Penalty</header><text>A recipient of a scholarship who under subparagraph (A) is in breach of the recipient’s contractual agreement shall be liable for payment to the United States, within 3 years, of an amount equal to—</text> 
<clause id="H4ED4628E6CA44E239D0032C03397FB9C"><enum>(i)</enum><text>the total amount of scholarships received by such individual under this section; plus</text></clause> 
<clause id="HA695F8B508E94989AF53216200793344"><enum>(ii)</enum><text display-inline="yes-display-inline">interest on the total amount of such scholarships at a rate that is equivalent to the rate of interest that would apply under section 427A of the Higher Education Authorization Act of 1965 if the scholarships were loans to cover the cost of education (as that term is used in that section).</text> </clause></subparagraph></paragraph></subsection> 
<subsection id="H45A2CB6A0443471B9669E5EE8DF7EECE"><enum>(i)</enum><header>Cancellation or waiver</header> 
<paragraph id="H50C4D168CDE04AE8AEE9B25931038E6B"><enum>(1)</enum><header>In general</header><text>Any obligation of an individual incurred under this section for service or payment shall be canceled upon the death of the individual.</text> </paragraph> 
<paragraph id="HACAFF49BD33145B99810A59DA8D7300"><enum>(2)</enum><header>Waiver or suspension of any obligation by Administrator</header><text>The Administrator shall by regulation provide for the partial or total waiver or suspension of any obligation of employment or payment incurred by an individual under this section (including any contractual agreement under this section), if—</text> 
<subparagraph id="H1FFD2EA23E1C44A2BD4C26A6EB351929"><enum>(A)</enum><text>compliance by the individual is impossible or would involve extreme hardship to the individual; or</text></subparagraph> 
<subparagraph id="H610916D04E58447E9EB88F7D2B5AD82"><enum>(B)</enum><text>enforcement of such obligation with respect to the individual would be contrary to the best interests of the Government.</text></subparagraph> </paragraph></subsection> 
<subsection id="H0EDCB338EDA0422084C3EDD76EADA39D"><enum>(j)</enum><header>Report to Congress</header><text display-inline="yes-display-inline">Not later than 2 years after the date of the enactment of this Act, and every 2 years thereafter, the Administrator shall transmit a report to the Congress that addresses each of the following:</text> 
<paragraph id="HBE58C862F2534FE299013626F568073B"><enum>(1)</enum><text>The effectiveness of the National Marine Scholarship Program established under this section in increasing the number of marine science-related service professionals.</text></paragraph> 
<paragraph id="HB470F7112BCC4A449CC78E8245D6CAA9"><enum>(2)</enum><text>The effectiveness of such program in preparing scholarship recipients for temporary jobs within the Administration or other marine-related Federal agencies.</text> </paragraph></subsection> 
<subsection id="H65CC124F4F334FA1967419557FAF8407" display-inline="no-display-inline"><enum>(k)</enum><header>Deadline for regulations</header><text>The Administrator shall issue such regulations as are necessary to carry out this section by not later than 90 days after the date of the enactment of this Act.</text></subsection> 
<subsection id="H8EAECBC1A08F44D485E1652CE5FDA8BA"><enum>(l)</enum><header>Authorization of appropriations</header><text>Of the amounts authorized for each of fiscal years 2005 through 2010 for programs administered by the National Oceanic and Atmospheric Administration, $5,000,000 shall be available for the National Marine Scholarship Program established under this section.</text></subsection> </section>
