<section section-type="section-one" id="H825830BDC3D0485BA83660000034371F" display-inline="no-display-inline"><enum>1.</enum><header>Authority to extend the SSI program to American Samoa</header><text display-inline="no-display-inline">Title XVI of the <act-name parsable-cite="SSA">Social Security Act</act-name>, as in effect pursuant to the amendment made by section 301 of the Social Security Amendments of 1972, (<external-xref legal-doc="usc" parsable-cite="usc/42/1381">42 U.S.C. 1381–1383f</external-xref>) is amended by adding at the end the following:</text>

<part id="H2FDA38BE803343FABF2CF199EF245049"><enum>C</enum><header>Authority to extend SSI to American Samoa</header> 
<section id="H026549DF9E57488C8559D3418B24CA3F"><enum>1641.</enum><header>Authority to extend SSI to American Samoa</header> 
<subsection id="H1F7E8B66F9FB45E0833D05857236CD8C"><enum>(a)</enum><header>Authority to extend program</header> 
<paragraph id="HB999E9F56D134FB8982BC7FB881F9057"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (3), the Commissioner of Social Security may extend the supplemental security income program under this title (in this section referred to as the <quote>SSI program</quote>) to any territory, and, to the extent so extended, shall carry out the SSI program in cooperation with the government of the territory, in accordance with a memorandum of understanding between the government of the territory and the Commissioner of Social Security.</text></paragraph> 
<paragraph id="H28972D5CA050456A98CBC7C5BE4DBE7B"><enum>(2)</enum><header>Waiver authority</header><text>Subject to paragraph (3), the Commissioner of Social Security may waive or modify any statutory requirement relating to the provision of benefits under the SSI program in a territory, to the extent that the Commissioner deems it necessary in order to adapt the program to the needs of the territory.</text></paragraph> 
<paragraph id="HDDDCBB1B3F9F4AB7BA958D61AEA0DD10"><enum>(3)</enum><header>Congressional notice required</header><text>Not less than 60 days before extending the SSI program to a territory under paragraph (1) or waiving or modifying a statutory requirement under paragraph (2), the Commissioner of Social Security shall notify the Committee on Ways and Means of the House of Representatives and the Committee on Finance of the Senate of the proposed action together with an explanation of why the action is necessary and the anticipated benefits to the territory involved.</text></paragraph></subsection> 
<subsection id="H26D2A8EEB3D74688830034F24B418E4B"><enum>(b)</enum><header>Program review</header><text>The Commissioner of Social Security shall provide for the review of the SSI program, to the extent extended under this section.</text></subsection> 
<subsection id="HE405EF9EAA744632AA39BF6660B5AB1F"><enum>(c)</enum><header>Technical assistance</header><text>The Commissioner of Social Security may provide technical assistance with respect to the extension of the SSI program under this section.</text></subsection> 
<subsection id="H00C055D69518434D93CE00FEBDD91153"><enum>(d)</enum><header>Territory defined</header><text>In this section, the term <term>territory</term> means American Samoa.</text></subsection></section></part><after-quoted-block>.</after-quoted-block></quoted-block></section>
