<official-title>To require the Federal Trade Commission to study the rating system of the video game industry and assess their labeling practices to determine if such practices are unfair or deceptive.</official-title>

<section id="HAB93B8CC4D4E458ABB8F680136544B8E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Software Accuracy and Fraud Evaluation Rating Act</short-title></quote> or the <quote><short-title>SAFE Rating Act</short-title></quote>.</text></section> 
<section id="H087764020A94485AB8DAAA92006B4100"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text> 
<paragraph id="H01D1B5636C334486B3DF70074D6393F0"><enum>(1)</enum><text>The Entertainment Software Rating Board is a self-regulatory body for the interactive entertainment software industry established in 1994 by the Entertainment Software Association.</text></paragraph> 
<paragraph id="HCFBC897B9A714E7491D8EB32A51E11BB"><enum>(2)</enum><text>The Entertainment Software Rating Board independently applies and enforces ratings, advertising guidelines, and online privacy principles adopted by the computer and video game industry.</text></paragraph> 
<paragraph id="HFA30858565F74973BB71EEB7DA143EF6"><enum>(3)</enum><text>Questions and concerns have arisen regarding the accuracy of video game ratings via the Entertainment Software Rating Board’s rating system. </text></paragraph> 
<paragraph id="H71F86A97D7634B81B03B15CC4994D04E"><enum>(4)</enum><text>Parents have the right to accurate information in making purchasing decisions for their children. </text></paragraph> 
<paragraph id="H2866A1AE65414CF08267A496AA03AE25"><enum>(5)</enum><text>The Entertainment Software Association has previously released surveys indicating a high degree of accuracy of the Entertainment Software Rating Board’s ratings, but, in light of continued parental concerns, it is appropriate to have a thorough and impartial government evaluation of the rating system.</text></paragraph> 
<paragraph id="H8DE02B4187F043AC9936AFB12C590A6"><enum>(6)</enum><text>The Federal Trade Commission’s Bureau of Consumer Protection is charged with protecting consumers against unfair or deceptive acts or practices in or affecting commerce. </text></paragraph> 
<paragraph id="H0A7D687421C44AADADB821005FFE94C8"><enum>(7)</enum><text>The Federal Trade Commission’s Bureau of Consumer Protection corrective actions include industry-wide investigations, possible litigation, and consumer education.</text></paragraph></section> 
<section id="H2D23D7B62CC94FD0AC4973268039B014"><enum>3.</enum><header>FTC review of video game rating system</header> 
<subsection id="HCA745E3403774D2CACE5B556D9B2EF4"><enum>(a)</enum><header>Study</header><text display-inline="yes-display-inline">Not later than 180 days after the enactment of this Act, the Federal Trade Commission shall study the video and computer game rating system of the Entertainment Software Rating Board that was adopted by the video game industry to determine if the rating system used by such industry accurately characterizes video game content or if such ratings constitute an unfair or deceptive act or practice affecting parents and other consumers in making purchasing decisions.</text></subsection> 
<subsection id="HC53C399D1D1540A8B4C204D67B81AF2F"><enum>(b)</enum><header>Further FTC action</header><text>If, pursuant to the study required by subsection (a), the Federal Trade Commission finds such rating system to be an unfair or deceptive act or practice within the meaning of section 5 of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/45">15 U.S.C. 45</external-xref>), the Commission shall, pursuant to subsection (b) of such section, conduct a hearing and issue and serve a complaint (including notice of such a hearing) upon any person, partnership, or corporation that the Commission shall have reason to believe has been or is using such an unfair or deceptive act or practice.</text></subsection> 
<subsection id="H5924980C2E8B4D02B1BDD45A0C2F545"><enum>(c)</enum><header>Report to Congress</header><text>Not later than 1 year after commencing the study required by subsection (a), the Federal Trade Commission shall transmit to Congress a report of the findings of such study, including any recommendations for legislation.</text> </subsection></section>
