<official-title>To provide for the cancellation of debts owed to international financial institutions by poor countries, and for other purposes.</official-title>

<section id="H28041BAFD7B84D7D98D8A5E2C71C722E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Justice and Understanding By International Loan Elimination and Equity Act of 2005</short-title></quote> or the <quote><short-title>JUBILEE Act of 2005</short-title></quote>. </text></section> 
<section id="HB51E6656B8C249A4878C46214736A732"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">The Congress finds the following:</text> 
<paragraph id="H538EFBBC3C15486B98FD00E906ECC8F3"><enum>(1)</enum><text>Many poor countries have been struggling under the burden of international debts for many years.</text></paragraph> 
<paragraph id="H6A4E768A6EC64F3BA994D16CE2284BB4"><enum>(2)</enum><text>Many poor countries have debts that are odious because they were incurred by dictatorships that did not use the funds in ways that benefitted the population of the country.</text></paragraph> 
<paragraph id="HA8E36EADD92A474CB284AE38F91E3B44"><enum>(3)</enum><text>The international Jubilee coalitions have been working to raise awareness of the needs of these impoverished countries for full debt cancellation.</text></paragraph> 
<paragraph id="H465CAA16603D40CAB1F0DAE329B56860"><enum>(4)</enum><text>The International Monetary Fund (IMF) has imposed onerous structural adjustment requirements on many poor countries as a condition of past loans and of participation in debt relief programs.</text></paragraph> 
<paragraph id="H96DB7572109A455787E002DC8E69030"><enum>(5)</enum><text>Justice requires that these countries receive full cancellation of their debts.</text></paragraph></section> 
<section id="H1DEFC6055BFA408C858F2CA02B000056"><enum>3.</enum><header>Cancellation of debt owed by eligible poor countries</header><text display-inline="no-display-inline">Title XVI of the <act-name parsable-cite="IFIA">International Financial Institutions Act</act-name> (22 U.S.C. 262p—262p–8) is amended by adding at the end the following:</text>

<section id="HAC0442245AEF497FA256BFBF4560DF45"><enum>1626.</enum><header>Cancellation of debt owed by eligible poor countries</header> 
<subsection id="H0C1674C06C5840579242386195392FC8"><enum>(a)</enum><header>In general</header> 
<paragraph id="H4AEE40831B9640FCA22DE32F24598054"><enum>(1)</enum><header>Cancellation of debt</header><text>In order to achieve multilateral debt cancellation and promote human and economic development and poverty alleviation in eligible poor countries, the Secretary of the Treasury shall commence immediate efforts, within the Paris Club of Official Creditors, the International Monetary Fund (IMF), the International Bank for Reconstruction and Development (World Bank), and the other international financial institutions (as defined in section 1701(c)(2)), to accomplish the following:</text> 
<subparagraph id="H8A2AB176F3DD4F9AA8A3E0E111A3761"><enum>(A)</enum><text>Each international financial institution shall cancel all debts owed to the institution by eligible poor countries. To the extent possible, each institution shall finance the debt cancellation from their ongoing operations, procedures, and accounts.</text></subparagraph> 
<subparagraph id="HAE3B71E1E5CE4FA5A37C51D16691E4A4"><enum>(B)</enum><text>Any waiting period before receiving debt cancellation shall not exceed 1 month from the date of an eligible poor country’s application for debt cancellation.</text></subparagraph> 
<subparagraph id="H7E591698D028497B88107C006404EAA4"><enum>(C)</enum><text>The government of each eligible poor country shall be encouraged to allocate at least 20 percent of its national budget, including the savings from the cancellation of debt, for the provision of basic health care services, education services, and clean water services to individuals in the country. In providing such services, the government should seek input from a broad cross-section of members of civil society.</text></subparagraph></paragraph> 
<paragraph id="H017A5ED83E2B47579F10EB2498A48C1D"><enum>(2)</enum><header>Establishment of framework for creditor transparency</header><text>In order to ensure that creditor activity is known and assessed by all stakeholders, the Secretary of the Treasury shall commence immediate efforts, within the Paris Club of Official Creditors, the International Monetary Fund (IMF), the International Bank for Reconstruction and Development (World Bank), and the other international financial institutions (as so defined), to ensure that each of such institutions—</text> 
<subparagraph id="H49FCE16A02C541BDB131C76438793CBE"><enum>(A)</enum><text>continues to make efforts to promote greater transparency regarding the activities of the institution, including project design, project monitoring and evaluation, project implementation, resource allocation, and decisionmaking; and</text></subparagraph> 
<subparagraph id="H39CC2EE74408400F9D04AFFD28A605B7"><enum>(B)</enum><text>supports continued efforts to allow informed participation and input by affected communities, including translation of information on proposed projects, provision of information through information technology application, oral briefings, and outreach to and dialogue with community organizations and institutions in affected areas.</text></subparagraph></paragraph> 
<paragraph id="H8C2AAE457B6949FABB8D8D723C5984A7"><enum>(3)</enum><header>Availability on treasury department website of remarks of United States Executive Directors at meetings of international financial institutions’ boards of directors</header><text>The Secretary of the Treasury shall make available on the website of the Department of the Treasury the full record of the remarks of the United States Executive Director at meetings of the Board of Directors of the International Monetary Fund (IMF), the International Bank for Reconstruction and Development (World Bank), and the other international financial institutions (as so defined), about cancellation or reduction of debts owed to the institution involved, with redaction by the Secretary of the Treasury of material deemed too sensitive for public distribution, but showing the topic, amount of material redacted, and reason for the redaction.</text></paragraph> 
<paragraph id="H656F881DA1604730B9245B24E3364BE0"><enum>(4)</enum><header>Report from the comptroller general</header><text>Within 1 year after the date of the enactment of this section, the Comptroller General of the United States shall prepare and submit to the Committee on Financial Services of the House of Representatives and the Committee on Banking, Housing, and Urban Affairs of the Senate a report on the availability of the ongoing operations, procedures, and accounts of the International Monetary Fund (IMF), the International Bank for Reconstruction and Development (World Bank), and the other international financial institutions (as so defined) for canceling the debt of eligible poor countries.</text></paragraph> 
<paragraph id="H53F3C04F347842BD80AEA7FE1C204485"><enum>(5)</enum><header>Annual reports from the President</header><text>Not later than December 31 of each year, the President shall submit to the Committees on Financial Services and on International Relations of the House of Representatives and the Committees on Foreign Relations and on Banking, Housing, and Urban Affairs of the Senate a report, which shall be made available to the public, on the activities undertaken under this section, and other progress made in accomplishing the purposes of this section, for the prior fiscal year. The report shall include a list of the countries that have received debt cancellation, a list of the countries whose request for such debt cancellation has been denied and the reasons therefor, and a list of the countries whose requests for such debt cancellation are under consideration.</text></paragraph></subsection> 
<subsection id="HDC7627962E924D6FAC96066FC123ECC1"><enum>(b)</enum><header>Promotion of equitable burden sharing</header><text>In order to promote equitable burden sharing by bilateral, multilateral, and private creditors, the Secretary of the Treasury shall commence immediate efforts to ensure that such creditors draw upon their own resources to finance debt reduction to the extent possible without diverting funds from other high-priority poverty alleviation programs.</text></subsection> 
<subsection id="H8C48DB017AEA4A2FA0786797351512CA"><enum>(c)</enum><header>Eligible poor country defined</header><text>In this section, the term <term>eligible poor country</term> means Angola, Bangladesh, Benin, Bolivia, Botswana, Burkina Faso, Burundi, Cambodia, Cameroon, Central African Republic, Chad, Cote d’Ivoire, Democratic Republic of Congo, Ethiopia, Gambia, Ghana, Guinea, Guinea-Bissau, Guyana, Haiti, Honduras, Jamaica, Kenya, Lao PDR, Liberia, Madagascar, Malawi, Mali, Mauritania, Morocco, Mozambique, Namibia, Nepal, Nicaragua, Niger, Nigeria, Peru, Philippines, Republic of Congo, Rwanda, Sao Tome and Principe, Senegal, Sierra Leone, South Africa, Tanzania, Togo, Uganda, Vietnam, Yemen, and Zambia, but not if—</text> 
<paragraph id="H4D0EB26FB85A487E8C5E94B214EC3E75"><enum>(1)</enum><text>the government of the country has an excessive level of military expenditures;</text></paragraph> 
<paragraph id="H10F7EC7088514C81005CFFAC692BE221"><enum>(2)</enum><text>the government of the country has repeatedly provided support for acts of international terrorism, as determined by the Secretary of State under section 6(j)(1) of the <act-name parsable-cite="EAA79">Export Administration Act of 1979</act-name> (<external-xref legal-doc="usc-appendix" parsable-cite="usc-appendix/50/2405">50 U.S.C. App. 2405(j)(1)</external-xref>), or section 620A(a) of the <act-name parsable-cite="FAA61">Foreign Assistance Act of 1961</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/22/2371">22 U.S.C. 2371(a)</external-xref>);</text></paragraph> 
<paragraph id="H7A8E52266DB746E89B69750100F4DD8B"><enum>(3)</enum><text>the government of the country is failing to cooperate on international narcotics control matters;</text></paragraph> 
<paragraph id="H59AB4B06F81742BDA0B724774246BF41"><enum>(4)</enum><text>the government of the country (including its military or other security forces) engages in a consistent pattern of gross violations of internationally recognized human rights; or</text></paragraph> 
<paragraph id="H9B48D90CA979425CB4576EDB06FB49"><enum>(5)</enum><text>in the case of Haiti, the government of the country has not been elected through free and fair elections.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="HAFF35C438703465EB601F8B8F10708E1"><enum>4.</enum><header>Prohibition of structural adjustment programs</header><text display-inline="no-display-inline">Title XVI of the <act-name parsable-cite="IFIA">International Financial Institutions Act</act-name> (22 U.S.C. 262p—262p–8) is further amended by adding at the end the following:</text>

<section id="H4D96BF26448C46D0A4A83997E4A4E2C"><enum>1627.</enum><header>Prohibition of structural adjustment programs</header> 
<subsection id="H4A1B1B32837F4B1AA86DCDFC88857FD2"><enum>(a)</enum><header>Prohibition of structural adjustment conditions</header><text>In order to promote human and economic development and poverty alleviation in eligible poor countries (as defined in section 1626(c)), the Secretary of the Treasury shall commence immediate efforts within the Paris Club of Official Creditors, as well as the International Monetary Fund (IMF), the International Bank for Reconstruction and Development (World Bank), and the other international financial institutions (as defined in section 1701(c)(2)), to ensure that the provision of debt cancellation to the countries is not conditioned on any agreement by such a country to implement or comply with policies that deepen poverty or degrade the environment, including any policy that—</text> 
<paragraph id="H052E0B0AA70B4A2B9C5E14B491B65408"><enum>(1)</enum><text>implements or extends user fees on primary education or primary health care, including prevention and treatment efforts for HIV/AIDS, tuberculosis, malaria, and infant, child, and maternal well-being;</text></paragraph> 
<paragraph id="HDCD51C7F210D42C8ABD4C7FE0058A87"><enum>(2)</enum><text>provides for increased cost recovery from poor people to finance basic public services such as education, health care, or sanitation;</text></paragraph> 
<paragraph id="HD45E9A2F367147E3919B5DB730905DF8"><enum>(3)</enum><text>would have the effect of increasing the cost to consumers with incomes of less than $2 per day for access to clean drinking water through—</text> 
<subparagraph id="H6903710127B74089ACC432C6A09B2672"><enum>(A)</enum><text>decreased public subsidy for water supply, treatment, disposal, distribution, or management;</text></subparagraph> 
<subparagraph id="HA8D98CBC71C746E0BD19DD4870F8CAD"><enum>(B)</enum><text>reduced intrasectoral or intersectoral subsidization of residential water consumers with incomes of less than $2 per day;</text></subparagraph> 
<subparagraph id="HA579574C0FAD4D0600B0792B5BE2C3FF"><enum>(C)</enum><text>reduced government ability to regulate; or</text></subparagraph> 
<subparagraph id="H0F79DA01E91D4C29B9DBD0C8E34DD289"><enum>(D)</enum><text>mandated privatization of water; or</text></subparagraph></paragraph> 
<paragraph id="H24842D8A6D054E68BEB09E08FB54E5B"><enum>(4)</enum><text>undermines workers’ ability to exercise effectively their internationally recognized worker rights, as defined under section 526(e) of the Foreign Operations, Export Financing and Related Programs Appropriations Act, 1995 (<external-xref legal-doc="usc" parsable-cite="usc/22/262p-4p">22 U.S.C. 262p–4p</external-xref>).</text></paragraph></subsection> 
<subsection id="HD72C020BB8B5428C9B483403DDFF8EDC"><enum>(b)</enum><header>Annual reports to the Congress</header><text>Not later than December 31 of each year, the President shall submit to the Committees on Financial Services and on International Relations of the House of Representatives and the Committees on Foreign Relations and on Banking, Housing, and Urban Affairs of the Senate a report, which shall be made available to the public, on the activities undertaken under this section, and other progress made in accomplishing the purposes of this section, for the prior fiscal year.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section>
