<section id="H56B3E4205D33460795106BA4B3D4883C" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Pitkin County Land Exchange Act of 2005</short-title></quote>.</text></section> 
<section id="H02A307B37EA0486599135FFAD8580947"><enum>2.</enum><header>Purpose</header><text display-inline="no-display-inline">The purpose of this Act is to authorize, direct, expedite, and facilitate the exchange of land between the United States, Pitkin County, Colorado, and the Aspen Valley Land Trust.</text></section> 
<section id="H373D9473A714429598E82CCCD6DD66FC"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> 
<paragraph id="HF98171879427409391082792A5BA763C"><enum>(1)</enum><header>Aspen valley land trust</header> 
<subparagraph id="H1D8FF8C105944811A49F4F6EB2E84000"><enum>(A)</enum><header>In general</header><text>The term <term>Aspen Valley Land Trust</term> means the Aspen Valley Land Trust, a nonprofit organization as described in <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)(3)</external-xref> of the Internal Revenue Code of 1986.</text></subparagraph> 
<subparagraph id="H4413A0740A484F6F8B76D3E941E0886"><enum>(B)</enum><header>Inclusions</header><text>The term <term>Aspen Valley Land Trust</term> includes any successor, heir, or assign of the Aspen Valley Land Trust.</text></subparagraph></paragraph> 
<paragraph id="HDC4929FE11224F12A531EAD0BA002CD7"><enum>(2)</enum><header>County</header><text>The term <term>County</term> means Pitkin County, a political subdivision of the State of Colorado.</text></paragraph> 
<paragraph id="H35F6AD8FACBB4FDD80F535E2488038D"><enum>(3)</enum><header>Federal land</header><text>The term <term>Federal land</term> means the land directed for exchange between the United States Forest Service, the Bureau of Land Management, and Pitkin County under this Act that is comprised of the following parcels:</text> 
<subparagraph id="HF210D9B3B8024344A900D88F68B765B9"><enum>(A)</enum><text>The approximately 5.5 acres of National Forest System land located in the County, as generally depicted on the map entitled <quote>Ryan Land Exchange-Wildwood Parcel Conveyance to Pitkin County</quote> and dated August 2004.</text></subparagraph> 
<subparagraph id="H6E4CF845357447AE8ECA79763FE7B88F"><enum>(B)</enum><text>The 12 parcels of National Forest System land located in the County totaling approximately 5.92 acres, as generally depicted on the map entitled <quote>Ryan Land Exchange-Smuggler Mountain Patent Remnants Conveyance to Pitkin County</quote> and dated August 2004.</text></subparagraph> 
<subparagraph id="H090D625645A64711B651FB979F3FD5FF"><enum>(C)</enum><text>The approximately 40 acres of Bureau of Land Management land located in the County, as generally depicted on the map entitled <quote>Ryan Land Exchange-Crystal River Parcel Conveyance to Pitkin County</quote> and dated August 2004.</text></subparagraph></paragraph> 
<paragraph id="H1F7CF4839DFD4B0A00914CA7FA0000A8"><enum>(4)</enum><header>Non-federal land</header><text>The term <term>non-Federal land</term> means the land directed for exchange between Pitkin County and the United States Forest Service under this Act that is comprised of the following parcels:</text> 
<subparagraph id="H4C64253BBB3349D6AA33BFFC0054794B"><enum>(A)</enum><text>The approximately 35 acres of non-Federal land in the County, as generally depicted on the map entitled <quote>Ryan Land Exchange-Ryan Property Conveyance to Forest Service</quote> and dated August 2004.</text></subparagraph> 
<subparagraph id="H62AE8648E7D948A6B1413F6051B5D86"><enum>(B)</enum><text>The approximately 18.2 acres of non-Federal land located on Smuggler Mountain in the County, as generally depicted on the map entitled <quote>Ryan Land Exchange-Smuggler Mountain-Grand Turk and Pontiac Claims Conveyance to Forest Service</quote>.</text></subparagraph></paragraph> 
<paragraph id="H245AB4208CD44616837DF7EF89A79F66"><enum>(5)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Agriculture.</text></paragraph></section> 
<section id="H6D05EB14315F4800992E40A7EAAA3856"><enum>4.</enum><header>Land exchange</header> 
<subsection id="H9E9708D271294F24A31707461CEDA7D5"><enum>(a)</enum><header>In general</header><text>If the County offers to convey to the United States title to the non-Federal land that is acceptable to the Secretary, the Secretary and the Secretary of the Interior shall—</text> 
<paragraph id="HD0D7E5F57277454C93B33E319A36603"><enum>(1)</enum><text>accept the offer; and</text></paragraph> 
<paragraph id="H88F993B651DE4537BEF3A2C5002B9907"><enum>(2)</enum><text>on receipt of acceptable title to the non-Federal land, simultaneously convey to the County, or at the request of the County, to the Aspen Valley Land Trust, all right, title, and interest of the United States in and to the Federal land, subject to all valid existing rights and encumbrances.</text></paragraph></subsection> 
<subsection id="H1B4040E3142A49C9B81D76F296E164F4"><enum>(b)</enum><header>Timing</header> 
<paragraph id="HAF5BF382C1154FA289A1DC3DFAEBB1E"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), it is the intent of Congress that the land exchange directed by this Act shall be completed not later than 1 year after the date of enactment of this Act.</text></paragraph> 
<paragraph id="H41A81958CD4D4B0DA629884FC68078D3"><enum>(2)</enum><header>Exception</header><text>The Secretary, the Secretary of the Interior, and the County may agree to extend the deadline specified in paragraph (1).</text></paragraph></subsection></section> 
<section id="H24585ADE16544E0A852831D5A6C6F88C"><enum>5.</enum><header>Exchange terms and conditions</header> 
<subsection id="H7D2F44FC2FC24F16BC22E03B024EDD0"><enum>(a)</enum><header>Equal value exchange</header><text>The value of the Federal land and non-Federal land directed to be exchanged under this Act—</text> 
<paragraph id="HA6222B9ED1024B9BB815B4A9BA18A1B3"><enum>(1)</enum><text>shall be equal; or</text></paragraph> 
<paragraph id="H84077D01F0F14E158009CAF2FB58738D"><enum>(2)</enum><text>shall be made equal in accordance with subsection (c).</text></paragraph></subsection> 
<subsection id="H3E500D8BC11641E98F7C2B354DF92021"><enum>(b)</enum><header>Appraisals</header> 
<paragraph id="H0DA57554EDB74F4B8BF743E259092C6"><enum>(1)</enum><header>In general</header><text>The value of the Federal land and non-Federal land shall be determined by the Secretary through appraisals conducted in accordance with—</text> 
<subparagraph id="H5DA3590BEEA242CFAB23D71411FE0568"><enum>(A)</enum><text>the Uniform Appraisal Standards for Federal Land Acquisitions;</text></subparagraph> 
<subparagraph id="HF584B887B4A84B42911572506FA2EF80"><enum>(B)</enum><text>the Uniform Standards of Professional Appraisal Practice; and</text></subparagraph> 
<subparagraph id="H6CC820EBEBEE40DC99CE57D798B7979C"><enum>(C)</enum><text>Forest Service appraisal instructions.</text></subparagraph></paragraph> 
<paragraph id="HA9A32C6D224C4C9186228D359DFCC1B3"><enum>(2)</enum><header>Value of certain federal land</header><text>In conducting the appraisal of the parcel of Federal land described in section 3(3)(C), the appraiser shall not consider the easement required for that parcel under subsection (d)(1) for purposes of determining the value of that parcel.</text></paragraph></subsection> 
<subsection id="H37CCD802387C46C8AC169EF803C79F92"><enum>(c)</enum><header>Equalization of values</header> 
<paragraph id="H0909F6826E584BBFB8346E097680FC00"><enum>(1)</enum><header>Surplus of non-federal land</header><text>If the final appraised value of the non-Federal land exceeds the final appraised value of the Federal land, the County shall donate to the United States the excess value of the non-Federal land, which shall be considered to be a donation for all purposes of law.</text></paragraph> 
<paragraph id="HB5A81524E28248CF91F2DB62E4F6D88"><enum>(2)</enum><header>Surplus of federal land</header> 
<subparagraph id="HF4DB66D1D54F4EF5B42D2E0705736300"><enum>(A)</enum><header>In general</header><text>If the final appraised value of the Federal land exceeds the final appraised value of the non-Federal land, the value of the Federal land and non-Federal land may be equalized by the County—</text> 
<clause id="H5B86E270BA5F435C94EA4FBF3CC955C"><enum>(i)</enum><text>making a cash equalization payment to the Secretary;</text></clause> 
<clause id="HCA140C2837B743E5BDC3B34C273D9FC5"><enum>(ii)</enum><text>conveying to the Secretary certain land located in the County, comprising approximately 160 acres, as generally depicted on the map entitled <quote>Sellar Park Parcel</quote> and dated August 2004; or</text></clause> 
<clause id="HEDF1D4B634AD48E5B223256E9094F9E8"><enum>(iii)</enum><text>using a combination of the methods described in clauses (i) and (ii), as the Secretary and the County determine to be appropriate.</text></clause></subparagraph> 
<subparagraph id="H37EAD4A3A52D4D7489B04052227E868"><enum>(B)</enum><header>Disposition and use of proceeds</header> 
<clause id="H5FD97E2C78804E9896A20648C1DDFAF"><enum>(i)</enum><header>Disposition of proceeds</header><text>Any cash equalization payment received by the Secretary under subparagraph (A)(i) shall be deposited in the fund established by <external-xref legal-doc="public-law" parsable-cite="pl/90/171">Public Law 90–171</external-xref> (commonly known as the <quote>Sisk Act</quote>) (<external-xref legal-doc="usc" parsable-cite="usc/16/484a">16 U.S.C. 484a</external-xref>).</text></clause> 
<clause id="H72FDF268F98A44C99766CE67B7DF709C"><enum>(ii)</enum><header>Use of proceeds</header><text display-inline="yes-display-inline">Amounts deposited under clause (i) shall be available to the Secretary, without further appropriation, for the acquisition of land or interests in lands in Colorado for addition to the National Forest System.</text></clause></subparagraph></paragraph></subsection> 
<subsection id="H456F37A7EF194385AAAC5E7BBFB7334C"><enum>(d)</enum><header>Conditions on certain conveyances</header> 
<paragraph id="HD57AF284D5FB422E984C00A6BE0C3AC"><enum>(1)</enum><header>Conditions on conveyance of crystal river parcel</header> 
<subparagraph id="HE339F63697D64810A1F35469C2109600"><enum>(A)</enum><header>In general</header><text>The Secretary of the Interior shall not convey to the County the parcel of land described in section 3(3)(C) until the County grants to the Aspen Valley Land Trust, the Roaring Fork Conservancy, or any other entity acceptable to the Secretary of the Interior and the County, a permanent conservation easement to the parcel, the terms of which—</text> 
<clause id="H2A40A1376F40430800B4BE3DE3E99893"><enum>(i)</enum> 
<subclause id="HFF13A76B235143309884095759D37B45" display-inline="yes-display-inline"><enum>(I)</enum><text>provide public access to the parcel; and</text></subclause> 
<subclause id="H8304E338C7E04EB7B403E3004945FA00" indent="up1"><enum>(II)</enum><text>require that the parcel shall be used only for recreational, fish and wildlife conservation, and open space purposes; and</text></subclause></clause> 
<clause id="H03781C90AEBB4B9BAAD1EF00CD175500"><enum>(ii)</enum><text>are acceptable to the Secretary of the Interior.</text></clause></subparagraph> 
<subparagraph id="H98F8C9B320AB44A087055704865CB3A2"><enum>(B)</enum><header>Reversion</header><text display-inline="yes-display-inline">In the deed of conveyance that conveys the parcel of land described in section 3(3)(C) to the County, the Secretary of the Interior shall provide that title to the parcel shall, at the discretion of the Secretary of the Interior, revert to the United States at no cost to the United States if—</text> 
<clause id="H1BD1077855EF4C9DBD802FFEC9C0C8B"><enum>(i)</enum><text>the parcel is used for a purpose other than that described in subparagraph (A)(i)(II); or</text></clause> 
<clause id="HCDAA6E7C38DD4CAD8FE687D7ADE81C06"><enum>(ii)</enum><text>the County or the entity holding the conservation easement elect to discontinue administering the parcel.</text></clause></subparagraph></paragraph> 
<paragraph id="H0FF070B71A0648710047A17EBD6D6358"><enum>(2)</enum><header>Conditions on conveyance of wildwood parcel</header><text display-inline="yes-display-inline">In the deed of conveyance of the parcel described in section 3(3)(A) to the County, or at the request of the County, to the Aspen Valley Land Trust, the Secretary shall, as determined appropriate by the Secretary in consultation with the County, reserve to the United States a permanent easement to the parcel for the location, construction and public use of the East of Aspen Trail.</text></paragraph></subsection></section> 
<section id="HEDC5FA6E6DA147AA9EABB40B768077D"><enum>6.</enum><header>Miscellaneous provisions</header> 
<subsection id="HC47463F819F745E6BD4C5E0081B52F2F"><enum>(a)</enum><header>Incorporation, management, and status of acquired land</header> 
<paragraph id="HA92FFBA630644CD4ADFC5CEF7F068132"><enum>(1)</enum><header>In general</header><text>Land acquired by the Secretary under this Act shall become part of the White River National Forest.</text></paragraph> 
<paragraph id="H6A3CB465529344518CBB0095389C8ED7"><enum>(2)</enum><header>Management</header><text>On acquisition, land acquired by the Secretary under this Act shall be administered in accordance with the laws (including rules and regulations) generally applicable to the National Forest System.</text></paragraph> 
<paragraph id="H37007B9C799743E09D7B78417681A475"><enum>(3)</enum><header>Land and water conservation fund</header><text>For purposes of section 7 of the Land and Water Conservation Fund Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/16/460l-9">16 U.S.C. 460l–9</external-xref>), the boundaries of the White River National Forest shall be deemed to be the boundaries of the White River National Forest as of January 1, 1965.</text></paragraph></subsection> 
<subsection id="H523DFEE6BD364A7F86ED00D1A1CDC3F"><enum>(b)</enum><header>Revocation of orders and withdrawal</header> 
<paragraph id="H8D0B00466DA84810A0DEB7E415A34588"><enum>(1)</enum><header>Revocation of orders</header><text>Any public orders withdrawing any of the Federal land from appropriation or disposal under the public land laws are revoked to the extent necessary to permit disposal of the Federal land.</text></paragraph> 
<paragraph id="H8F68691BFF5D40C8BE8FE1A33DA8377"><enum>(2)</enum><header>Withdrawal of federal land</header><text>On the date of enactment of this Act, if not already withdrawn or segregated from entry and appropriation under the public land laws (including the mining and mineral leasing laws) and the Geothermal Steam Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/30/1001">30 U.S.C. 1001 et seq.</external-xref>), the Federal land is withdrawn, subject to valid existing rights, until the date of the conveyance of the Federal land to the County.</text></paragraph> 
<paragraph id="H74DC0B9272F7477BB7AAE7DF3B74002E"><enum>(3)</enum><header>Withdrawal of non-federal land</header><text>On acquisition of the non-Federal land by the Secretary, the non-Federal land is permanently withdrawn from all forms of appropriation and disposition under the public land laws (including the mining and mineral leasing laws) and the Geothermal Steam Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/30/1001">30 U.S.C. 1001 et seq.</external-xref>).</text></paragraph></subsection> 
<subsection id="H721CBC03F7AA4242005FF358F15BBD5E"><enum>(c)</enum><header>Boundary adjustments</header><text>The Secretary with jurisdiction over the land and the County may agree to—</text> 
<paragraph id="H4BED0906BAF94CAAAD1335F35FADBB64"><enum>(1)</enum><text>minor adjustments to the boundaries of the Federal land and non-Federal land parcels; and</text></paragraph> 
<paragraph id="H63210DC7300C44B4B5C38EDA6245488"><enum>(2)</enum><text>modifications or deletions of parcels and mining claim remnants of Federal land or non-Federal land to be exchanged on Smuggler Mountain.</text></paragraph></subsection> 
<subsection id="H5248F1DE69E14BBAB91841990082016C"><enum>(d)</enum><header>Map</header><text>If there is a discrepancy between a map, acreage estimate, and legal or other description of the land to be exchanged under this Act, the map shall prevail unless the Secretary with jurisdiction over the land and the County agree otherwise.</text></subsection></section>
