<official-title>To reauthorize the renewable energy production incentive and to provide that a qualified renewable energy facility shall not be assigned a priority for eligibility or allocation of appropriated funds on the basis of the energy source used at such facility.</official-title>

<section id="HE81FF1A719A44604B6FB21A7CBC2E98D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Renewable Energy Production Incentive Reform and Reauthorization Act</short-title></quote>.</text></section> 
<section id="HDA5577C42ACB4C1DA95D6E08006B4315" section-type="subsequent-section" display-inline="no-display-inline"><enum>2.</enum><header>Renewable energy production incentive</header> 
<subsection id="H9CC64DBD3EF54E06AA4F4937E6C9557B"><enum>(a)</enum><header>Incentive payments</header><text display-inline="yes-display-inline">Section 1212(a) of the Energy Policy Act of 1992 (<external-xref legal-doc="usc" parsable-cite="usc/42/13317">42 U.S.C. 13317(a)</external-xref>) is amended to read as follows:</text>

<subsection id="HCA913FAF82154CF28E1921A5DFE4FAB"><enum>(a)</enum><header>Incentive payments</header><text display-inline="yes-display-inline"></text> 
<paragraph id="H5626B972A5A841178277AF6FD9385BA0"><enum>(1)</enum><header>Secretary of Energy</header><text>For electric energy generated from solar, wind, or geothermal energy and sold by a qualified renewable energy facility during the incentive period, the Secretary of Energy shall make, subject to the availability of appropriations, incentive payments to the owner or operator of such facility.</text></paragraph> 
<paragraph id="H00BC2614FE3F467AB2455182B7B8B8D8"><enum>(2)</enum><header>Secretary of Agriculture</header><text>For electric energy generated from biomass and sold by a qualified renewable energy facility during the incentive period, unless the electric energy is generated from heat derived from landfill gases, the Secretary of Agriculture shall make, subject to the availability of appropriations, incentive payments to the owner or operator of such facility.</text></paragraph> 
<paragraph id="HAB3AB7F14085402DB7CC59318052006C"><enum>(3)</enum><header>Administrator of the Environmental Protection Agency</header><text>For electric energy generated from heat derived from landfill gases and sold by a qualified renewable energy facility during the incentive period, the Administrator of the Environmental Protection Agency shall make, subject to the availability of appropriations, incentive payments to the owner or operator of such facility.</text></paragraph> 
<paragraph id="H8A7F14BE782940BFB7162E393B66C922"><enum>(4)</enum><header>Payments</header><text>The amount of the payment made to any owner or operator under this section shall be as determined under subsection (e). Payments under this section may only be made upon receipt by the Secretary of Energy, the Secretary of Agriculture, or the Administrator of the Environmental Protection Agency, as applicable, of an incentive payment application which establishes that the applicant is eligible to receive such payment.</text></paragraph> 
<paragraph id="H76836F4E79D74106921DE54F27416997"><enum>(5)</enum><header>Assignment of priority</header><text>The Secretary of Energy, the Secretary of Agriculture, and the Administrator of the Environmental Protection Agency shall not establish any criteria or procedures that have the effect of assigning to a qualified renewable energy facility that is eligible for payments under this section a higher or lower priority for eligibility or allocation of payments on the basis of the energy source used at such facility.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HAC3E6DCB509B48C1BBE9E32D2D21C08E"><enum>(b)</enum><header>Eligibility window</header><text>Section 1212(c) of the Energy Policy Act of 1992 (<external-xref legal-doc="usc" parsable-cite="usc/42/13317">42 U.S.C. 13317(c)</external-xref>) is amended by striking <quote>during the 10-fiscal</quote> and all that follows through <quote>enactment of this section</quote> and inserting <quote>before October 1, 2016</quote>.</text></subsection> 
<subsection id="H675049E9617C4050B7B11C683C3D77FC"><enum>(c)</enum><header>Amount of payment</header><text>Section 1212(e)(1) of the Energy Policy Act of 1992 (<external-xref legal-doc="usc" parsable-cite="usc/42/13317">42 U.S.C. 13317(e)(1)</external-xref>) is amended—</text> 
<paragraph id="HCB4634FAEC6049358C62ED375CF19FBB"><enum>(1)</enum><text>by striking <quote>Secretary</quote> and inserting <quote>Secretary of Energy, the Secretary of Agriculture, or the Administrator of the Environmental Protection Agency</quote>; and</text></paragraph> 
<paragraph id="HFD5DEA5AFCD7481CB513B55CFA00295B"><enum>(2)</enum><text>by striking <quote>1.5</quote> and inserting <quote>1.8</quote>. </text></paragraph></subsection> 
<subsection id="HF2AC957C69A24DB79FF0284DF67068C5"><enum>(d)</enum><header>Sunset</header><text display-inline="yes-display-inline">Section 1212(f) of the Energy Policy Act of 1992 (<external-xref legal-doc="usc" parsable-cite="usc/42/13317">42 U.S.C. 13317(f)</external-xref>) is amended by striking <quote>the expiration of</quote> and all that follows through <quote>enactment of this section</quote> and inserting <quote>September 30, 2026</quote>.</text></subsection> 
<subsection id="HB2D17AC2F36A4182B39002629EE5ECFE"><enum>(e)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">Section 1212(g) of the Energy Policy Act of 1992 (<external-xref legal-doc="usc" parsable-cite="usc/42/13317">42 U.S.C. 13317(g)</external-xref>) is amended to read as follows:</text>

<subsection id="H27C0B4CAFAD14FD1A9C4C379001C8898"><enum>(g)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">For the purpose of carrying out this section, there are authorized to be appropriated— </text> 
<paragraph id="HA4AD1DB14ECB4A5B9E09257E74978E93"><enum>(1)</enum><text>$25,000,000 to the Secretary of Energy;</text></paragraph> 
<paragraph id="HC15E9BDAF8A14D36B2587D93A602F07C"><enum>(2)</enum><text>$5,000,000 to the Secretary of Agriculture; and</text></paragraph> 
<paragraph id="HB12B7040B2FE4847B1611455C6747950"><enum>(3)</enum><text>$5,000,000 to the Administrator of the Environmental Protection Agency,</text></paragraph><continuation-text continuation-text-level="subsection">for each of fiscal years 2006 through 2026.</continuation-text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H7B8025703B3644A19B1D29F4CDDFF3D"><enum>(f)</enum><header>Definition</header><text display-inline="yes-display-inline">Section 1212 of the Energy Policy Act of 1992 (<external-xref legal-doc="usc" parsable-cite="usc/42/13317">42 U.S.C. 13317</external-xref>) is amended by adding at the end the following new subsection:</text>

<subsection id="H0F0E5B301752428ABD9F5C6966E600F8"><enum>(h)</enum><header>Definition</header><text>For purposes of this section, the term <quote>biomass</quote> includes livestock biomass.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> 
<section id="HDFA8084E6A624F5BACC143430512E897"><enum>3.</enum><header>Advisory Committee</header><text display-inline="no-display-inline">Section 6(b)(4)(A) of the Renewable Energy and Energy Efficiency Technology Competitiveness Act of 1989 (<external-xref legal-doc="usc" parsable-cite="usc/42/12005">42 U.S.C. 12005(b)(4)(A)</external-xref>) is amended—</text> 
<paragraph id="H106E34CB50A8415F9977314608BFAAC2"><enum>(1)</enum><text>by redesignating clauses (iii) through (ix) as clauses (iv) through (x), respectively; and</text></paragraph> 
<paragraph id="HE933E7056FEE40B38B7F1FCDEDBF100"><enum>(2)</enum><text>by inserting after clause (ii) the following new clause:</text>
