<section id="HAC702AF658204709873E0043E45F0529" section-type="section-one"><enum>1.</enum><header>Acquisition of rail lines; rail line relocation projects</header> 
<subsection id="H32C3FA02A4584D8FA600005627FD5E09"><enum>(a)</enum><header>Purposes</header><text>The purposes of this section are to—</text> 
<paragraph id="H67A50FA55867494C924C8760D481C218"><enum>(1)</enum><text>facilitate and support freight and passenger rail transportation initiatives at the State and local levels in order to increase economic efficiency and improve productivity by facilitating the movement of people and goods by rail and to mitigate congestion and improve safety on highways located in the area of rail lines;</text></paragraph> 
<paragraph id="HA1B1C5BDD3354EC890B1F900D4A84C27"><enum>(2)</enum><text>mitigate the adverse effects of rail traffic on safety, motor vehicle traffic flow, or economic development in urbanized areas; and</text></paragraph> 
<paragraph id="H1032435F514A4F6DA107E2B785B77408"><enum>(3)</enum><text>provide funding to address infrastructure and operational needs identified in the initiatives referred to in paragraph (1).</text></paragraph></subsection> 
<subsection id="H085425667954468486876996CB4FA24D"><enum>(b)</enum><header>Acquisition of rail lines and rail line relocation projects</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/23/3">Chapter 3</external-xref> of title 23, United States Code, is amended by adding at the end the following:</text> 
<quoted-block style="USC" id="H3A3B664B22E84928B3A7780A1495BD2" display-inline="no-display-inline"> 
<section id="H5A9FC5B0745F4D14B9EDDBDA51413C4F"><enum>325.</enum><header>Rail line acquisitions and relocation projects</header> 
<subsection id="HD1F376CB66A841E5A7CAAFB102BEDE74"><enum>(a)</enum><header>Use of surface transportation program funds</header><text display-inline="yes-display-inline">A State may obligate funds apportioned to the State under section 104(b)(3) for—</text> 
<paragraph id="H9EFEB10FAB1046D19EEE104041000017"><enum>(1)</enum><text>the acquisition by the State transportation department or a local transportation agency of passenger or freight rail facilities (including railroad track, related track structures, rights-of-way, stations, and bridges), for the purpose of rehabilitating, preserving, or improving the rail facilities; and</text></paragraph> 
<paragraph id="H330B1B26D05945A8852F623211A46D80"><enum>(2)</enum><text> the relocation of passenger and freight rail lines (including the construction of rail facilities in the new location).</text></paragraph></subsection> 
<subsection id="H7601A4A4269043469CEC3DCEC78D0995"><enum>(b)</enum><header>Eligible projects</header><text display-inline="yes-display-inline">A project is eligible for funding under subsection (a)—</text> 
<paragraph id="H59816731036941618683BD4999C63391"><enum>(1)</enum><text> the acquisition of rail facilities by the State transportation department or local transportation agency provides congestion relief and improved safety on highways located in the area of the rail facilities; or</text></paragraph> 
<paragraph id="HA9F6A6F13A5443E19849933353CE623B"><enum>(2)</enum><text>the rail line to be relocated is publicly owned or, if privately owned, the relocation provides a public benefit, including facilitating the construction and operation of publicly owned rail and highway projects in the former location of the rail line.</text></paragraph></subsection> 
<subsection id="H01D666D7AD684F7EA8A06FEDF704CAC"><enum>(c)</enum><header>Period of availability</header><text display-inline="yes-display-inline">Funds allocated for a project by a State under this section shall remain available until expended.</text></subsection> 
<subsection id="HF7F11B411BAF490B8DA916B2A038FB8B"><enum>(d)</enum><header>Federal share</header><text>The Federal share of the cost of a project under this section shall be determined in accordance with section 120(b).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H5F1454B50BA8485BB7000765554FAA32"><enum>(c)</enum><header>Eligibility for surface transportation program funds</header><text>Section 133(b) of such title is amended by inserting after paragraph (11) the following:</text>

<subsection id="HC17B9A2724FE4A20B067349D33609942"><enum>(d)</enum><header>Conforming amendment</header><text>The analysis for chapter 3 of such title is amended by adding at the end the following:</text>
