<section id="H41D25D90614C4AAE80C37E7BC56CFB23" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Toll credits</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/23/120">Section 120(j)(1)</external-xref> of title 23, United States Code, is amended—</text> 
<paragraph id="HB454904A913F497291F53F0065CE8971"><enum>(1)</enum><text>by striking <quote>A State</quote> and inserting the following:</text> 
<quoted-block style="OLC" id="H80D84CB04C19429EB947EFD459328C41" display-inline="no-display-inline"> 
<subparagraph id="H95B4EC25CCFA4559B5DD6DCCB2FA499D"><enum>(A)</enum><header>In general</header><text>A State</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HFA960355B3234665B64152FC40398FD0"><enum>(2)</enum><text>by striking the last sentence and inserting the following: </text> 
<quoted-block style="OLC" id="H9C4A1A09E35C4AEC0023774794793DE2" display-inline="no-display-inline"> 
<subparagraph id="HDBF7F134D2F64A6FBBA305903F620162"><enum>(B)</enum><header>Special rule for use of Federal funds</header><text display-inline="yes-display-inline">If the public, quasi-public, or private agency has built, improved, or maintained the facility using Federal funds, the credit under this paragraph shall be reduced by a percentage equal to the percentage of the total cost of building, improving, or maintaining the facility that was derived from Federal funds.</text></subparagraph> 
<subparagraph id="H3085C21802E742EFB3BD9E00B3A6F0FA"><enum>(C)</enum><header>Federal funds defined</header><text> In this paragraph, the term <quote>Federal funds</quote> does not include loans of Federal funds or other financial assistance that must be repaid to the Government.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section>
