<official-title>To amend the Internal Revenue Code of 1986 to allow individuals to designate any portion of a refund for use by the Secretary of Health and Human Services in providing catastrophic health coverage to individuals who do not otherwise have health coverage.</official-title>

<section id="HA4F05FA1B9EC48D7961113134ED83C00" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>American LIFE Fund for the Medical Treatment of the Uninsured Act of 2005</short-title></quote>.</text></section> 
<section id="H79D4E72143A34E2283B910183623F0C8" section-type="subsequent-section"><enum>2.</enum><header>Designation of overpayments for Health Coverage for uninsured</header> 
<subsection id="H23EDE32446834E85BD721FD400B123C1"><enum>(a)</enum><header>In general</header><text>Subchapter A of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/61">chapter 61</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following new part:</text>

<toc-entry level="section">Sec. 6097. Designation</toc-entry></toc> 
<section id="H099BB28A96124F95B9D3CB13FD1891B1"><enum>6097.</enum><header>Designation</header> 
<subsection id="H7A6A2EA7CB15455E9D4372BFBB2908A8"><enum>(a)</enum><header>In general</header><text>In the case of an individual, with respect to each taxpayer’s return for the taxable year of the tax imposed by chapter 1, such taxpayer may designate that a specified portion (not less than $1) of any overpayment of tax for such taxable year be paid over to the Health Coverage for the Uninsured Trust Fund.</text></subsection> 
<subsection id="H1796BC74A21A41B4B16359EA8480D809"><enum>(b)</enum><header>Manner and time of designation</header><text>A designation under subsection (a) may be made with respect to any taxable year only at the time of filing the return of the tax imposed by chapter 1 for such taxable year. Such designation shall be made in such manner as the Secretary prescribes by regulations except that such designation shall be made either on the first page of the return or on the page bearing the taxpayer’s signature.</text></subsection> 
<subsection id="HB17FB0A633064C298C250187BBFBECBC"><enum>(c)</enum><header>Overpayments treated as refunded</header><text>For purposes of this title, any portion of an overpayment of tax designated under subsection (a) shall be treated as being refunded to the taxpayer as of the last date prescribed for filing the return of tax imposed by chapter 1 (determined without regard to extensions) or, if later, the date the return is filed.</text></subsection></section></part><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HD308A6568F264E1C00D14253274B0333"><enum>(b)</enum><header>Clerical amendment</header><text>The table of parts for subchapter A of chapter 61 of such Code is amended by adding at the end thereof the following new item:</text>

<subsection id="HCAFC758E8F9C4A18B211846F007D952D"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall apply to taxable years beginning after December 31, 2004.</text></subsection></section> 
<section id="HD8B1E86DB9EB43D4A8FEB4C1595F17F0"><enum>3.</enum><header>Health Coverage for the Uninsured Trust Fund</header> 
<subsection id="H9E1F76DDD74C4377ADEDDC9435707E6E"><enum>(a)</enum><header>In general</header><text>Subchapter A of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/98">chapter 98</external-xref> of the Internal Revenue Code of 1986 (relating to trust fund code) is amended by adding at the end the following new section:</text>

<section id="H1E73F2A5A44144119D847DC5A9515B40"><enum>9511.</enum><header>Health Coverage for the Uninsured Trust Fund</header> 
<subsection id="HE53C8F8952A64B2F88BC6B035930BFE3"><enum>(a)</enum><header>Creation of Trust Fund</header><text>There is established in the Treasury of the United States a trust fund to be known as the <quote>Health Coverage for the Uninsured Trust Fund</quote>, consisting of such amounts as may be appropriated or credited to such Trust Fund as provided in this section or section 9602(b).</text></subsection> 
<subsection id="HF8A58EC4716E488896AF29A412BA3F28"><enum>(b)</enum><header>Transfers to Trust Fund</header><text>There are hereby appropriated to the Health Coverage for the Uninsured Trust Fund amounts equivalent to the amounts designated under section 6097 (relating to designation of overpayments for health coverage for uninsured).</text></subsection> 
<subsection id="HD7AC342C82A24F05004CCB3C00700056"><enum>(c)</enum><header>Expenditures</header><text>Amounts in the Health Coverage for the Uninsured Trust Fund shall be available to the Centers for Medicare and Medicaid Services to carry out a program which provides health coverage for catastrophic illnesses and injuries of individuals who otherwise have no health coverage.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HDAD24C68F6074380BB6100DA447E007E"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections for such subchapter is amended by adding at the end thereof the following new item:</text>
