<official-title>To require the Secretary of Transportation to develop and implement an environmental review process for safety emergency highway projects.</official-title>

<section section-type="section-one" id="HFF782DCC0F4A47FA006DC937EC465DE0" display-inline="no-display-inline"><enum>1.</enum><header>Environmental review process for safety emergency projects</header> 
<subsection id="H85011EC4264149F30045947754D8903"><enum>(a)</enum><header>In general</header><text>Notwithstanding any other law, the Secretary of Transportation shall develop and implement a process for the expedited environmental review and approval of safety emergency highway construction or maintenance projects that correct or improve hazardous locations on a highway.</text></subsection> 
<subsection id="H72AABD858EE34A9EAD83C12815530434"><enum>(b)</enum><header>Regulations</header><text>The Secretary shall issue regulations that—</text> 
<paragraph id="H7DA54C76452D49848F2BE37EAAB174D3"><enum>(1)</enum><text>allow the use of the expedited environmental review process for any project correcting or improving hazardous locations on a highway within the boundaries of a State where the motor vehicle accident rate at that location is at least 50 percent higher than the statewide average for similar classes of highways if the project only includes roadway safety improvements that have a high potential to reduce the number of motor vehicle accidents; and</text></paragraph> 
<paragraph id="H18EF44F67CB94FE00061B9D8AC8C50B8"><enum>(2)</enum><text>establish criteria for approving deviations from procedures established in regulations issued by the Secretary implementing the <act-name parsable-cite="NEPA69">National Environmental Policy Act of 1969</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>).</text></paragraph></subsection> 
<subsection id="HD67E4E7A77DD4E2E007EB5B078B6B85B"><enum>(c)</enum><header>Use by other Federal agencies</header><text>Each Federal agency that—</text> 
<paragraph id="HBBA2A4B4C7AF496195B120829D7574AD"><enum>(1)</enum><text>has jurisdiction by law over environmental-related issues that may be affected by a project described in subsection (b) and the analysis of which would be part of any environmental document required by the <act-name parsable-cite="NEPA69">National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>)</act-name>; or</text></paragraph> 
<paragraph id="H09EC6C65A3614C26AFC13F3DB122D9BE"><enum>(2)</enum><text>may be required by Federal law to independently—</text> 
<subparagraph id="HEEDB271595AF46CFAB15D95C697BDFC7"><enum>(A)</enum><text>conduct an environmental-related review or analysis for a project described in <internal-xref idref="H72AABD858EE34A9EAD83C12815530434" legis-path="1.(b)">subsection (b)</internal-xref>;</text></subparagraph> 
<subparagraph id="H08071901B3D44FE8828741BDF1D983E2"><enum>(B)</enum><text>determine whether to issue a permit, license, or approval for the project; or</text></subparagraph> 
<subparagraph id="HB6E15ACD98524F109E6CA31501E189AA"><enum>(C)</enum><text>render an opinion or recommendation on the environmental impact of the project, </text></subparagraph></paragraph><continuation-text continuation-text-level="subsection">shall issue regulations providing for the expedited processing of, and approval of deviations for, the project by such agency.</continuation-text></subsection> 
<subsection id="HBC0DF4248E6C4D7D866651333D4277FB"><enum>(d)</enum><header>Involvement of Council on Environmental Quality</header><text>A Federal agency approving a deviation under this section shall not be subject to the requirement to consult with the Council on Environmental Quality under <external-xref legal-doc="regulation" parsable-cite="cfr/40/1506.11">section 1506.11</external-xref> of title 40, Code of Federal Regulations.</text></subsection></section>
