		<official-title>To direct the Secretary of Energy to make incentive
		  payments to the owners or operators of qualified desalination facilities to
		  partially offset the cost of electrical energy required to operate such
		  facilities, and for other purposes.</official-title>

		<section display-inline="no-display-inline" id="HDE93DCF9DC1946FD89D1A603A4367B2B" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Desalination Water Supply Shortage
			 Prevention Act of 2005</short-title></quote>.</text>
		</section><section display-inline="no-display-inline" id="H49C0E66A41514F32BFCE6421BDFA339"><enum>2.</enum><header>Definitions</header>
			<subsection id="H1BA7E2AE7070403C9F4C00D86FF1F9FA"><enum>(a)</enum><header>Qualified desalination
			 facility</header><text>The term <quote>qualified desalination facility</quote>
			 means a facility that—</text>
				<paragraph id="H3D7A0257A5A447EFB842C41FC3FB0956"><enum>(1)</enum><text>produces for sale to
			 domestic customers desalinated seawater, brackish groundwater, or surface water
			 whose source water is greater than 1000 parts per million total dissolved
			 solids; and</text>
				</paragraph><paragraph id="H8D214F22F93341339145648813669482"><enum>(2)</enum><text>is owned or operated
			 by—</text>
					<subparagraph id="HBA17FCD113DE471AA062550200C3CD9"><enum>(A)</enum><text display-inline="yes-display-inline">a State or any political subdivision,
			 agency, authority, or instrumentality of a State;</text>
					</subparagraph><subparagraph id="H020E63BC157F478D9F1D723EEBB52043"><enum>(B)</enum><text display-inline="yes-display-inline">an Indian tribe; or</text>
					</subparagraph><subparagraph id="H61DBBD5590DB4515B4A3C51EE3D9FA86"><enum>(C)</enum><text>a corporation responsible
			 for providing municipal water service pursuant to State or tribal law;</text>
					</subparagraph></paragraph><paragraph id="H7784A7050ADC43AA8DCAB0DE2F43B8BB"><enum>(3)</enum><text>is first used to produce
			 commercial desalinated water for sale during the 10-year period beginning on
			 October 1 of the first fiscal year occurring after the date of the enactment of
			 this Act; and</text>
				</paragraph><paragraph id="H5B6B69BE1D6F474E9404FA2EB32C8718"><enum>(4)</enum><text>uses the best available
			 technology as determined by the Secretary.</text>
				</paragraph></subsection><subsection id="HC4D14A4EDC494640967962B4C6B8B24D"><enum>(b)</enum><header>Indian
			 tribe</header><text>The term <quote>Indian Tribe</quote> means with respect to
			 the contiguous 48 states, any federally recognized Indian tribe, organized
			 band, pueblo, or community and with respect to Alaska, the Metlakatla Indian
			 Community.</text>
			</subsection><subsection id="H3C6343CAE16F4D5B87948100247FB1F2"><enum>(c)</enum><header>Secretary</header><text display-inline="yes-display-inline">The term <quote>Secretary </quote> means
			 the Secretary of Energy.</text>
			</subsection><subsection id="HCC529B3C2AE146F28BCFC9FB9D26B793"><enum>(d)</enum><header>State</header><text>The
			 term <quote>State</quote> means the several States, the District of Columbia,
			 Puerto Rico, American Samoa, the Virgin Islands, Guam, and the Northern Mariana
			 Islands.</text>
			</subsection></section><section id="H3B3D3E5F8F324DEA95BF759452D0640"><enum>3.</enum><header>Desalinated water
			 production incentive payments</header>
			<subsection id="H2A0D04434B1A4EEAAEC2B5FCF335F582"><enum>(a)</enum><header>Incentive
			 Payments</header><text display-inline="yes-display-inline">The Secretary shall
			 make incentive payments in an amount determined under subsection (d) to the
			 owners or operators of qualified desalination facilities to partially offset
			 the cost of electrical energy required to operate such facilities.</text>
			</subsection><subsection id="H9FC3B014CAC847A8A93F39ABE2F4832B"><enum>(b)</enum><header>Agreement;
			 deadline</header><text>The Secretary may not make any payment to the owner or
			 operator of a qualified desalination facility under this section, unless, not
			 later than the end of fiscal year 2016, the Secretary enters into a written
			 agreement with the owner or operator to make such payment.</text>
			</subsection><subsection id="HC78637C4C79B4B57A0C09123C2CDCAD0"><enum>(c)</enum><header>Payment
			 period</header><text>The Secretary may make payments to the owner or operator
			 of a qualified desalination facility under this section for a period not to
			 exceed 10 years—</text>
				<paragraph id="HA7E3B1C7116A49DFBD621CC7D307C96"><enum>(1)</enum><text>beginning on the date on
			 which the facility is first used to produce desalinated water; and</text>
				</paragraph><paragraph id="HD34EF406CF5A4953006F58A438A37462"><enum>(2)</enum><text>ending not later than
			 September 30, 2026.</text>
				</paragraph></subsection><subsection id="H26AEA7357923448EB9002BC7885F6543"><enum>(d)</enum><header>Amount of
			 Payment</header>
				<paragraph id="H89D0EA85249F43D9A540541D7602EF11"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Payments made by the
			 Secretary under this section to the owner or operator of any qualified
			 desalination facility shall be based on the amount of desalinated water
			 produced by the facility during the payment period described in subsection (c).
			 For any facility, the amount of such payment shall be 62 cents for every
			 thousand gallons of desalinated water produced and sold, adjusted as provided
			 in paragraph (2).</text>
				</paragraph><paragraph id="HF9CCE8C7884F463A001B8CDD4F3F0024"><enum>(2)</enum><header>Adjustments</header><text>The
			 amount of the payment made to any person under this subsection as provided in
			 paragraph (1) shall be adjusted for inflation for each fiscal year beginning
			 after calendar year 2006 in the same manner as provided in the provisions of
			 <external-xref legal-doc="usc" parsable-cite="usc/26/29">section 29(d)(2)(B)</external-xref> of the Internal Revenue Code of 1986 (26 U.S.C.
			 29(d)(2)(B)), except that in applying such provisions the calendar year 2006
			 shall be substituted for calendar year 1979.</text>
				</paragraph></subsection><subsection id="H6FD02D696B51496098DB1F40C83B793C"><enum>(e)</enum><header>Application</header><text>The
			 Secretary may not make a grant to the owner or operator of a qualified
			 desalination facility under this section unless the facility submits an
			 application to the Secretary in such form, at such time, and containing such
			 information and assurances as the Secretary may require.</text>
			</subsection><subsection id="H4FE773A5B2B8407500FABF89FA7303D"><enum>(f)</enum><header>Limitation</header><text>In
			 any fiscal year not more than 60 percent of the funds made available by the
			 Secretary under this section shall be made available to the owners or operators
			 of qualified desalination facilities that obtain source water directly from the
			 sea, an estuary, or from in-bank extraction wells that are of seawater
			 origin</text>
			</subsection><subsection id="H428FA3A578674B8DA805C9AB41443E93"><enum>(g)</enum><header>Priority</header><text display-inline="yes-display-inline">In awarding incentive payments under this
			 section, the Secretary shall give priority to any application for a project
			 that—</text>
				<paragraph id="H2C049A840BE54BC4B9F2233E85020062"><enum>(1)</enum><text>uses innovative
			 technologies to reduce the energy demand of the project;</text>
				</paragraph><paragraph id="H65D5363FADFD42C98926A710BBEB36C5"><enum>(2)</enum><text>uses renewable energy
			 supplies in the desalination process;</text>
				</paragraph><paragraph id="HD33DC6779C4249599B086C7D00331843"><enum>(3)</enum><text>provides regional water
			 supply benefits;</text>
				</paragraph><paragraph id="HFDE8CE4B3C2C401DB474BE82E29756AC"><enum>(4)</enum><text>provides a secure source
			 of new water supplies for national defense activities;</text>
				</paragraph><paragraph id="HE4CA625E5DEE4259B384757D56D879F1"><enum>(5)</enum><text>reduces the threat of a
			 water supply disruption as a result of a natural disaster or acts of terrorism;</text>
				</paragraph><paragraph id="H91AC2B84AEA04FE298FB9EEB5F91D39"><enum>(6)</enum><text>uses technologies that
			 minimize the damage to marine life; or</text>
				</paragraph><paragraph id="H09444D3419244E1EA9BDAB1F2B5B6CE"><enum>(7)</enum><text>provides significant
			 water quality benefits.</text>
				</paragraph></subsection><subsection id="HB192A1B9A7A24F8ABF46FD77D0B9FA80"><enum>(h)</enum><header>Budget act
			 compliance</header><text>The authority provided by this section may be
			 exercised only in such amounts or to such extent as provided in advance in
			 appropriations Acts.</text>
			</subsection><subsection id="H37DD7C98A3B0425397A958E52DD51CF4"><enum>(i)</enum><header>Authorization of
			 Appropriations</header><text>There are authorized to be appropriated to the
			 Secretary $200,000,000 to carry out this section from fiscal year 2006 through
			 fiscal year 2016.</text>
			</subsection></section><section id="H8F5592C0120C4480904C1F9932BBD2D5"><enum>4.</enum><header>Novel desalination
			 technology</header>
			<subsection id="HE5548138C23F40A081D578ED5D62E6AD"><enum>(a)</enum><header>In
			 general</header><text>The Secretary shall support research and development of
			 promising novel technology approaches for the cost-effective desalination of
			 water.</text>
			</subsection><subsection id="H104337BB3BD44C128952A20014E200D4"><enum>(b)</enum><header>Authorization of
			 appropriation</header><text display-inline="yes-display-inline">There are
			 authorized to be appropriated to the Secretary for carrying out this section
			 $10,000,000 from fiscal year 2006 through fiscal year 2016.</text>
