<section id="HB12555D0870645B29976EF2C0588DE72" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short Title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>United States Boxing Commission Act</short-title></quote>. </text></section> 
<section id="H5F2518D2617E4C0D8DEC1CCA5C30B042" commented="no"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">As used in this Act, the following definitions apply:</text> 
<paragraph id="HC08453BCC7DC4C419CCB5E00AA2FA2DE" commented="no"><enum>(1)</enum><header>Commission</header><text display-inline="yes-display-inline">The term <quote>Commission</quote> means the United States Boxing Commission established under section 3. </text></paragraph> 
<paragraph id="H4BD123A28ADE41E482243D724D1166D9" commented="no"><enum>(2)</enum><header>Boxer</header><text>The term <quote>boxer</quote> means an individual who fights in a professional boxing match. </text></paragraph> 
<paragraph id="HDE3EE361D3AA40FD894E3E86734D8663" commented="no"><enum>(3)</enum><header>Boxing commission</header><text>The term <quote>boxing commission</quote> means an entity authorized under State or tribal law to regulate professional boxing matches.</text></paragraph> 
<paragraph id="H8D8A8BC84A8E4282A8FE8E2B0448A95C" commented="no"><enum>(4)</enum><header>Indian lands</header><text>The term <quote>Indian lands</quote> has the meanings given that terms by paragraphs (4) of section 4 of the Indian Gaming Regulatory Act (<external-xref legal-doc="usc" parsable-cite="usc/25/2703">25 U.S.C. 2703</external-xref>).</text></paragraph> 
<paragraph id="H56AF24C5A7E44328AEE2142799BEEDC5"><enum>(5)</enum><header>Judge</header><text>The term <quote>judge</quote> means an official who scores a boxing match to determine the winner.</text></paragraph> 
<paragraph id="HEE4F06CE44224F02A514455F437C3494" commented="no"><enum>(6)</enum><header>Manager</header><text display-inline="yes-display-inline">The term <quote>manager</quote> means a person other than a promoter who, under contract, agreement, or other arrangement with a boxer, undertakes to control or administer, directly or indirectly, a boxing-related matter on behalf of that boxer, including a person who is a booking agent for a boxer.</text></paragraph> 
<paragraph id="HAB02A935C48F42B3AACA98D2E846CDC" commented="no"><enum>(7)</enum><header>Matchmaker</header><text>The term <quote>matchmaker</quote> means a person that proposes, selects, and arranges for boxers to participate in a professional boxing match. Such term does not include a hotel, casino, resort, or other commercial establishment hosting or sponsoring a professional boxing match, or a provider of cable, satellite, or network television programming, unless— </text> 
<subparagraph id="HB20122C39E464576916000F00EA37D8" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">the hotel, casino, resort, or other commercial establishment, or provider of cable, satellite, or network television programming is primarily responsible for proposing, selecting, and arranging for boxers to participate in the professional boxing match; and </text></subparagraph> 
<subparagraph id="H3B8766BAF47141D5B5091C3101952BE2" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">there is no other person primarily responsible for proposing, selecting, and arranging for boxers to participate in the match. </text></subparagraph></paragraph> 
<paragraph id="H49908E860EDD41ED80002764E76C50AB" commented="no"><enum>(8)</enum><header>Referee</header><text>The term <quote>referee</quote> means the official inside the boxing ring who supervises the boxing match. </text></paragraph> 
<paragraph id="H21F08AA4516140C800C57409963F5FBB"><enum>(9)</enum><header>Professional boxing match</header><text>The term <quote>professional boxing match</quote> means a boxing contest held in the United States between individuals for financial compensation. Such term does not include a boxing contest that is regulated by a duly recognized amateur sports organization, as approved by the Commission. </text></paragraph> 
<paragraph id="H9BA86E967A8C4FB0B721F793F2BDE63" commented="no"><enum>(10)</enum><header>Promoter</header><text>The term <quote>promoter</quote>—</text> 
<subparagraph id="HB17B7B85F74D4E8D81B2185CFA271603" commented="no"><enum>(A)</enum><text>means the person primarily responsible for organizing, promoting, and producing a professional boxing match; but </text></subparagraph> 
<subparagraph id="H2AA23DF4EB444C90BEDB96AB53D81CDB" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">does not include a hotel, casino, resort, or other commercial establishment hosting or sponsoring a professional boxing match, or a provider of cable, satellite, or network television programming, unless—</text> 
<clause id="H333816D7DC3A44AF90B007823DBDF3C1" commented="no"><enum>(i)</enum><text display-inline="yes-display-inline">the hotel, casino, resort, or other commercial establishment, or provider of cable, satellite, or network television programming is primarily responsible for organizing, promoting, and producing the match; and </text></clause> 
<clause id="H75EC0B3E19D74B608D8253B8B03E01A5" commented="no"><enum>(ii)</enum><text>there is no other person primarily responsible for organizing, promoting, and producing the match. </text></clause></subparagraph></paragraph> 
<paragraph id="HF4AD7136393347149633449B7690BDFD" commented="no"><enum>(11)</enum><header>State</header><text>The term <quote>State</quote> means each of the 50 States, Puerto Rico, the District of Columbia, and any territory or possession of the United States, including the Virgin Islands.</text></paragraph> 
<paragraph id="HDC952C37723D4217A478536612DC1350" commented="no"><enum>(12)</enum><header>Sanctioning organization</header><text>The term <quote>sanctioning organization</quote> means an organization, other than a boxing commission, that sanctions professional boxing matches, ranks professional boxers, or charges a sanctioning fee for professional boxing matches in the United States—</text> 
<subparagraph id="HD98EC4C5D201452D8633D2ADD69F12E" commented="no"><enum>(A)</enum><text>between boxers who are residents of different States; or </text></subparagraph> 
<subparagraph id="H69857652FB0444E484272BA87EDB5722" commented="no"><enum>(B)</enum><text>that are advertised, otherwise promoted, or broadcast (including closed circuit television) in interstate commerce. </text></subparagraph></paragraph> 
<paragraph id="HA598E4DBDCD24700A40258177EA4F8F5" commented="no"><enum>(13)</enum><header>Suspension</header><text>The term <quote>suspension</quote> includes within its meaning the temporary revocation of a boxing license.</text></paragraph> 
<paragraph id="H47C91C3A3B7B4DE88EF97BCBC62B2FDE" commented="no"><enum>(14)</enum><header>Tribal organization</header><text display-inline="yes-display-inline">The term <quote>tribal organization</quote> has the same meaning as in section 4(l) of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/450b">25 U.S.C. 450b(l)</external-xref>).</text></paragraph></section> 
<section id="H54AA226543AE4D0E8989B45F89EF7909"><enum>3.</enum><header>Establishment of United States Boxing Commission</header> 
<subsection id="HD7378E641E6448FAB5730594FA72327D"><enum>(a)</enum><header>In general</header><text>The United States Boxing Commission is established as a commission within the Department of Commerce.</text></subsection> 
<subsection id="HA413A8DE7AB541729FF6F1ABD448DF8D"><enum>(b)</enum><header>Members</header> 
<paragraph id="H9A1BE1BF5F4E4E778B90FDFD51CAE046"><enum>(1)</enum><header>In general</header><text>The Commission shall consist of 3 members appointed by the President, by and with the advice and consent of the Senate.</text></paragraph> 
<paragraph id="HC11352370CCB49B78EB740E2CA5600A9"><enum>(2)</enum><header>Qualifications</header><text>No member of the Commission may, while serving as a member of the Commission—</text> 
<subparagraph id="HFDA0648D0D2541149242034615610716" display-inline="no-display-inline"><enum>(A)</enum><text>be engaged as a professional boxer, boxing promoter, agent, fight manager, matchmaker, referee, judge, or in any other capacity in the conduct of the business of professional boxing;</text></subparagraph> 
<subparagraph id="H18E69A5D98CB496BBC88FBD0A8AD2B7B"><enum>(B)</enum><text>have any pecuniary interest in the earnings of any boxer or the proceeds or outcome of any boxing match; or</text></subparagraph> 
<subparagraph id="H2C494F4C5B0B4D5DBEB4D5A85CFA91CC"><enum>(C)</enum><text>serve as a member of a boxing commission.</text></subparagraph></paragraph> 
<paragraph id="H72F84387C27D4D30BD1910C61B92A110"><enum>(3)</enum><header>Bipartisan membership</header><text>Not more than 2 members of the Commission may be members of the same political party.</text></paragraph> 
<paragraph id="H6A06497A086C45A39D00910437190027"><enum>(4)</enum><header>Geographic balance</header><text>Not more than 2 members of the Commission may be residents of the same geographic region of the United States when appointed to the Commission. For purposes of the preceding sentence, the area of the United States east of the Mississippi River is a geographic region, and the area of the United States west of the Mississippi River is a geographic region.</text></paragraph> 
<paragraph id="H1A030DEA7B974845AE3462BED0E173DC"><enum>(5)</enum><header>Terms</header> 
<subparagraph id="H9DFF80FE9EB446B1AA655E6601BBE9BF"><enum>(A)</enum><header>In general</header><text>The term of a member of the Commission shall be 3 years. No member of the Commission shall serve more than 2 terms.</text></subparagraph> 
<subparagraph id="HECB6DC8C25BF41F3BECAAABD06FA9DDD"><enum>(B)</enum><header>Midterm vacancies</header><text>A member of the Commission appointed to fill a vacancy in the Commission occurring before the expiration of the term for which the member’s predecessor was appointed shall be appointed for the remainder of that unexpired term.</text></subparagraph> 
<subparagraph id="H6F13BC421F4145FEBF11E9DF6D6243AA"><enum>(C)</enum><header>Continuation pending replacement</header><text>A member of the Commission may serve after the expiration of that member’s term until a successor has taken office.</text></subparagraph></paragraph> 
<paragraph id="H1A4935D9048940BD92078F7687C3DF77"><enum>(6)</enum><header>Removal</header><text>A member of the Commission may be removed by the President only for cause.</text></paragraph></subsection> 
<subsection id="H0F6F911C0CAA45CEB625A8A2F8126B23"><enum>(c)</enum><header>Executive Director</header> 
<paragraph id="HB7EAB0D41D8B4A6486CBFEBD16407DCE"><enum>(1)</enum><header>In general</header><text>The Commission shall employ an Executive Director to perform the administrative functions of the Commission under this Act, and such other functions and duties of the Commission as the Commission shall specify.</text></paragraph> 
<paragraph id="HB2ED31F43DC942879C91E7E3BE95FFF7"><enum>(2)</enum><header>Discharge of functions</header><text>Subject to the authority, direction, and control of the Commission the Executive Director shall carry out the functions and duties of the Commission under this Act.</text></paragraph></subsection> 
<subsection id="HB41090200B314016823263009579421B"><enum>(d)</enum><header>General Counsel</header><text>The Commission shall employ a General Counsel to provide legal counsel and advice to the Executive Director and the Commission in the performance of its functions under this Act, and to carry out such other functions and duties as the Commission shall specify.</text></subsection> 
<subsection id="HC9A3273A338D418F98D026655636E0F8"><enum>(e)</enum><header>Staff</header><text>The Commission shall employ such additional staff as the Commission considers appropriate to assist the Executive Director and the General Counsel in carrying out the functions and duties of the Commission under this Act.</text></subsection> 
<subsection id="HAB145E18BD974E0CB7AE3751CCECF229"><enum>(f)</enum><header>Meetings</header><text>The Commission shall hold its first meeting no later than 30 days after all members shall have been appointed, and shall meet thereafter not less frequently than once every 60 days.</text></subsection> 
<subsection id="HB2D4DC6639014A9ABC48A2E93F4FE5BF"><enum>(g)</enum><header>Compensation</header> 
<paragraph id="H0D3D93A1BE7143B4B18E12FE43D4806C"><enum>(1)</enum><header>Members of Commission</header> 
<subparagraph id="HEBF652911685452FAAD0B7DC2CFEFAB9"><enum>(A)</enum><header>In general</header><text>Each member of the Commission shall be compensated at a rate equal to the daily equivalent of the annual rate of basic pay prescribed for level IV of the Executive Schedule under <external-xref legal-doc="usc" parsable-cite="usc/5/5315">section 5315</external-xref> of title 5, United States Code, for each day (including travel time) during which such member is engaged in the performance of the duties of the Commission.</text></subparagraph> 
<subparagraph id="HE52A97CABCF242CD962C521F00682EB4"><enum>(B)</enum><header>Travel expenses</header><text>The members of the Commission shall be allowed travel expenses, including per diem in lieu of subsistence, at rates authorized for employees of agencies under subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/57">chapter 57</external-xref> of title 5, United States Code, while away from their homes or regular places of business in the performance of services for the Commission.</text></subparagraph></paragraph> 
<paragraph id="H031E4985F5BD40958737C3CF86897F1B"><enum>(2)</enum><header>Executive Director and staff</header><text>The Commission shall fix the compensation of the Executive Director, the General Counsel, and other personnel of the Commission. The rate of pay for the Executive Director, the General Counsel, and other personnel may not exceed the rate payable for level V of the Executive Schedule under <external-xref legal-doc="usc" parsable-cite="usc/5/5316">section 5316</external-xref> of title 5, United States Code.</text></paragraph></subsection></section> 
<section id="HAF6776422884475CA13477293387C1E"><enum>4.</enum><header>Functions</header> 
<subsection id="H40045E50B336471E005F3D1EC4106638"><enum>(a)</enum><header>General functions</header><text>The general functions of the Commission are—</text> 
<paragraph id="H88771BE7A8E14318BBE9495609E90095"><enum>(1)</enum><text>to protect the general interests of boxers consistent with the provisions of this Act;</text></paragraph> 
<paragraph id="HD84E473D3D084467921F1591EC5ED163"><enum>(2)</enum><text>to ensure uniformity, fairness, and integrity in professional boxing; and </text></paragraph> 
<paragraph id="H0B0A29665CA94DB985055E8C2B773978"><enum>(3)</enum><text>except as otherwise determined by the Commission, oversee all professional boxing matches in the United States.</text></paragraph></subsection> 
<subsection id="H59640330A2AF4F928FDAE485E94D0013"><enum>(b)</enum><header>Initial rulemaking</header><text display-inline="yes-display-inline">Not later than 180 days after the date on which the Commission shall hold its first meeting, the Commission shall, by rule promulgate uniform standards for professional boxing in consultation with the Association of Boxing Commissions.</text></subsection> 
<subsection id="H8C7206EB765E4D69A56E000249CCFBB1"><enum>(c)</enum><header>Additional functions</header><text>In addition to its general functions under subsection (a), the Commission shall—</text> 
<paragraph id="HD589335E64F64FA9825FE818AD16E50"><enum>(1)</enum><text>work with the boxing commissions of the several States and tribal organizations to improve the status and standards of professional boxing in the United States;</text></paragraph> 
<paragraph id="H0506D7C57664402882F3274F7000519B"><enum>(2)</enum><text>ensure, in cooperation with the Attorney General (who shall represent the Commission in any judicial proceeding under this Act), the chief law enforcement officer of the several States, and other appropriate officers and agencies of Federal, State, and local government, that Federal and State laws applicable to professional boxing matches in the United States are vigorously, effectively, and fairly enforced;</text></paragraph> 
<paragraph id="HEBCCDDD191F74F389F7513047F0997BC"><enum>(3)</enum><text>review State boxing commission regulations for professional boxing and provide assistance to such authorities in meeting minimum standards prescribed by the Commission under this Act;</text></paragraph> 
<paragraph id="H3DF1A52BDB584D7FB65E7533D5367889"><enum>(4)</enum><text>if the Commission determines appropriate, publish a newspaper, magazine, or other publication and establish and maintain an Internet website consistent with the provisions of this Act; and</text></paragraph> 
<paragraph id="H8453EB816D714BB2B406EABAABE9FB2"><enum>(5)</enum><text>promulgate rules, regulations, and guidance, and take any other action necessary and proper to accomplish the purposes of, and consistent with, the provisions of this Act.</text></paragraph></subsection> 
<subsection id="H83604672E21D4A23A4A6CB015BD023CF"><enum>(d)</enum><header>Prohibitions</header><text>The Commission may not—</text> 
<paragraph id="H25FC8FB37DEF41D8947B863C47EB678F"><enum>(1)</enum><text>promote boxing events or rank professional boxers; or</text></paragraph> 
<paragraph id="H04EC69EAB82943ED93ED004CAC283449"><enum>(2)</enum><text>provide technical assistance to, or authorize the use of the name of the Commission by, boxing commissions that do not comply with requirements of the Commission.</text></paragraph></subsection></section> 
<section id="HBA524BBFE7F047D1AC1D97C476EBF78F"><enum>5.</enum><header>Licensing and registration of boxing personnel</header> 
<subsection id="H3A307A0506DE4BCF8EEAC2D25FB9A3D"><enum>(a)</enum><header>Licensing</header> 
<paragraph id="H8E97D9B213AF454BB3C951D966A37089"><enum>(1)</enum><header>Requirement for license</header><text display-inline="yes-display-inline">Beginning 1 year after the date of enactment of this Act, no person may compete in a professional boxing match or serve as a boxing manager, boxing promoter, matchmaker, judge, referee, or sanctioning organization for a professional boxing match except as provided in a license granted to that person under this subsection.</text></paragraph> 
<paragraph id="HCA5C281ECB9948798EB14F67C219A877" commented="no"><enum>(2)</enum><header>Application and term</header> 
<subparagraph id="HB45F34CABC3B42EF8DB7B21B79C0DA99" commented="no"><enum>(A)</enum><header>In general</header><text>The Commission shall—</text> 
<clause id="H34B8F3167CF84F8EA09DB3BF3B4E8BDC" commented="no"><enum>(i)</enum><text display-inline="yes-display-inline">establish application procedures, forms, and fees for licenses granted under this section;</text></clause> 
<clause id="HA570662FA1D246E7B41B64078500ABEF" commented="no"><enum>(ii)</enum><text>establish and publish appropriate standards for such licenses;</text></clause> 
<clause id="H06E198BD338640B6945F3169B4035253" commented="no"><enum>(iii)</enum><text>issue a license to any person who, as determined by the Commission, meets the standards established by the Commission under this Act; and</text></clause> 
<clause id="H1C110E09C33D4CDC00758365CCC07D3E" commented="no"><enum>(iv)</enum><text display-inline="yes-display-inline">begin issuing such licenses not later than 270 days after the date on which Commission holds its first meeting.</text></clause></subparagraph> 
<subparagraph id="H99AF36C8652547D097AE326DA56752B2" commented="no"><enum>(B)</enum><header>Duration</header><text>A license issued under this section shall be for a renewable—</text> 
<clause id="H45C3C1E5A02040529493F5E095B1B396" commented="no"><enum>(i)</enum><text>4-year term for a boxer; and</text></clause> 
<clause id="H0E2053015B484097B3A26523CF57981F" commented="no"><enum>(ii)</enum><text>2-year term for any other person.</text></clause></subparagraph> 
<subparagraph id="H61BB7431ABDD40F59EA553A0112F67F6" commented="no"><enum>(C)</enum><header>Procedure</header><text>The Commission may issue a license under this paragraph through boxing commissions or in a manner determined by the Commission.</text></subparagraph></paragraph></subsection> 
<subsection id="HEB250CC33EB04EF99BCB02805E72AC3E"><enum>(b)</enum><header>Licensing fees</header> 
<paragraph id="H62736B4777844C10B2EF742EE07132E7"><enum>(1)</enum><header>Authority</header><text>The Commission may prescribe and charge reasonable fees for the licensing of persons under this Act. The Commission may set, charge, and adjust varying fees on the basis of classifications of persons, functions, and events determined appropriate by the Commission.</text></paragraph> 
<paragraph id="HFE1859FEA33E4FE5ACB75F7C6D9138B1"><enum>(2)</enum><header>Limitations</header><text>In setting and charging fees under paragraph (1), the Commission shall ensure that, to the maximum extent practicable—</text> 
<subparagraph id="HE55D0FD2D3264CFC873EA76CC0736C24"><enum>(A)</enum><text>club boxing is not adversely effected;</text></subparagraph> 
<subparagraph id="HF3939326B2454DF7B5C9CE7F2876DBC4"><enum>(B)</enum><text>sanctioning organizations and promoters pay comparatively the largest portion of the fees; and</text></subparagraph> 
<subparagraph id="HBD7049A108F54801B000D2A7BF1F5E08"><enum>(C)</enum><text>boxers pay as small a portion of the fees as is possible.</text></subparagraph></paragraph></subsection></section> 
<section id="H62EC0532F2A0403BA7A0B5D91F00FBBC"><enum>6.</enum><header>National registry of boxing personnel</header><text display-inline="no-display-inline">The Commission shall establish and maintain (or authorize a third party to establish and maintain) a unified national computerized registry for the collection, storage, and retrieval of such information as the Commission shall prescribe by rule related to the performance of its duties.</text></section> 
<section id="H8155A74D0039408E80007825E607CA05"><enum>7.</enum><header>Consultation requirements</header><text display-inline="no-display-inline">The Commission shall consult with the Association of Boxing Commissions—</text> 
<paragraph id="H8A44ADBE96BB4672AA9218FD1DAF61D5"><enum>(1)</enum><text>before prescribing any regulation or establishing any standard under the provisions of this Act; and</text></paragraph> 
<paragraph id="HD3CC096F010B43FDBD15CEC8DE23F3C"><enum>(2)</enum><text>not less than once each year regarding matters relating to professional boxing.</text></paragraph></section> 
<section id="H062B580AD12A4E1FB1EBA1739854125B"><enum>8.</enum><header>Misconduct</header> 
<subsection id="HC5249ED1CED846DF00AA67AA6187F200"><enum>(a)</enum><header>Suspension and revocation of license or registration</header> 
<paragraph id="HB1A3F60E5634426BA61D9B858C8C2495"><enum>(1)</enum><header>Authority</header><text>The Commission may, after notice and opportunity for a hearing, suspend or revoke any license issued under this Act if the Commission—</text> 
<subparagraph id="H1A1E54E1830047758C8C64E97EB223CB"><enum>(A)</enum><text display-inline="yes-display-inline">finds that the license holder has violated any provision of this Act or a standard prescribed under this Act;</text></subparagraph> 
<subparagraph id="H992C3107AF284CACA3EEA239C8C94414"><enum>(B)</enum><text>reasonably believes that a standard prescribed by the Commission under this Act is not being met, or that bribery, collusion, intentional losing, racketeering, extortion, or the use of unlawful threats, coercion, or intimidation have occurred in connection with a license; or</text></subparagraph> 
<subparagraph id="HB964DD6E19C742489F6DA081FA7FB1F"><enum>(C)</enum><text display-inline="yes-display-inline">finds that the suspension or revocation is in the public interest.</text></subparagraph></paragraph> 
<paragraph id="H7507A29BE7E64A8D8C6CB38329259411"><enum>(2)</enum><header>Period of suspension</header><text>A suspension of a license under this section shall be effective for a period determined appropriate by the Commission.</text></paragraph> 
<paragraph id="HB32D99EC1D4C4D46AE79BB8E00A0BE99"><enum>(3)</enum><header>Period of revocation</header><text>In the case of a revocation of the license of a boxer, the revocation shall be for a period of not less than 1 year.</text></paragraph></subsection> 
<subsection id="H73C3B4DD78B1496B83B7ACE418D7F14D"><enum>(b)</enum><header>Investigations and Injunctions</header> 
<paragraph id="H92D955956E0249648213FEE2F9C5C87"><enum>(1)</enum><header>Authority</header><text>The Commission may—</text> 
<subparagraph id="H5412724B6B14431ABEF51731F3F0BA4B"><enum>(A)</enum><text>conduct any investigation that it considers necessary to determine whether any person has violated, or is about to violate, any provision of this Act or any regulation prescribed under this Act;</text></subparagraph> 
<subparagraph id="H1C498B67546041D0A4A1336E9DF67BBE"><enum>(B)</enum><text>require or permit any person to file with it a statement in writing, under oath or otherwise as the Commission shall determine, as to all the facts and circumstances concerning the matter to be investigated;</text></subparagraph> 
<subparagraph id="H72A91B7ADD1F4500AA827BF444EED8C"><enum>(C)</enum><text>in its discretion, publish information concerning any violations; and</text></subparagraph> 
<subparagraph id="H43DE94F1D4884B8EB0D75CF6092D379E"><enum>(D)</enum><text>investigate any facts, conditions, practices, or matters to aid in the enforcement of the provisions of this Act, in the prescribing of regulations under this Act, or in securing information to serve as a basis for recommending legislation concerning the matters to which this Act relates.</text></subparagraph></paragraph> 
<paragraph id="H167CBFB73F7B4B49A61E6863FE7FBBDC"><enum>(2)</enum><header>Powers</header> 
<subparagraph id="H49741AF5C4F74A668829C1BC928A477"><enum>(A)</enum><header>In general</header><text>For the purpose of any investigation under paragraph (1) or any other proceeding under this Act—</text> 
<clause id="H683DFF0EA12842DA99E459F0D3C6721E"><enum>(i)</enum><text>any officer designated by the Commission may administer oaths and affirmations, subpoena or otherwise compel the attendance of witnesses, take evidence, and require the production of any books, papers, correspondence, memoranda, or other records the Commission considers relevant or material to the inquiry; and</text></clause> 
<clause id="H103779466EED47B8A6B3FC9EF2A900F2"><enum>(ii)</enum><text>the provisions of sections <external-xref legal-doc="usc" parsable-cite="usc/18/6002">6002</external-xref> and <external-xref legal-doc="usc" parsable-cite="usc/18/6004">6004</external-xref> of title 18, United States Code, shall apply.</text></clause></subparagraph> 
<subparagraph id="H237AD805DDA349C1995687A0DC9E89E"><enum>(B)</enum><header>Witnesses and evidence</header><text>The attendance of witnesses and the production of any documents under subparagraph (A) may be required from any place in the United States, including Indian land, at any designated place of hearing.</text></subparagraph></paragraph> 
<paragraph id="H0920C22F577C468F87E008F56071DEC0"><enum>(3)</enum><header>Enforcement of subpoenas</header> 
<subparagraph id="HF85E38E956964C7FBA7DE2802822AFF"><enum>(A)</enum><header>Civil action</header><text>In case of contumacy by, or refusal to obey a subpoena issued to, any person, the Commission may file an action in any district court of the United States within the jurisdiction of which an investigation or proceeding is carried out, or where that person resides or carries on business, to enforce the attendance and testimony of witnesses and the production of books, papers, correspondence, memorandums, and other records. The court may issue an order requiring the person to appear before the Commission to produce records, if so ordered, or to give testimony concerning the matter under investigation or in question.</text></subparagraph> 
<subparagraph id="H09C68DE433A345CC8800E94792154D19"><enum>(B)</enum><header>Failure to obey</header><text>Any failure to obey an order issued by a court under subparagraph (A) may be punished as contempt of that court.</text></subparagraph> 
<subparagraph id="HEFE72D06CC01428DA9AB9B1E83864060"><enum>(C)</enum><header>Process</header><text>All process in any contempt case under subparagraph (A) may be served in the judicial district in which the person is an inhabitant or in which the person may be found.</text></subparagraph></paragraph> 
<paragraph id="H26B95DA95F234A1CA5C8F9F5B60015A1"><enum>(4)</enum><header>Evidence of criminal misconduct</header><text>No person may be excused from attending and testifying or from producing books, papers, contracts, agreements, and other records and documents before the Commission, in obedience to the subpoena of the Commission, or in any cause or proceeding instituted by the Commission, on the ground that the testimony or evidence, documentary or otherwise, required of that person may tend to incriminate the person or subject the person to a penalty or forfeiture.</text></paragraph> 
<paragraph id="H6CBF85C8950C47F2A7739ED74B7E7F52"><enum>(5)</enum><header>Injunctive relief</header><text>If the Commission or the Executive Director determines that any person is engaged or about to engage in any act or practice that constitutes a violation of any provision of this Act, or of any regulation prescribed under this Act, the Commission or the Executive Director may bring an action in the appropriate district court of the United States, the United States District Court for the District of Columbia, or the United States courts of any territory or other place subject to the jurisdiction of the United States, to enjoin the act or practice, and upon a proper showing, the court shall grant without bond a permanent or temporary injunction or restraining order.</text></paragraph> 
<paragraph id="H96DD949A87BA41C5ADFD268FB300BBAC"><enum>(6)</enum><header>Mandamus</header><text>Upon application of the Commission, the district courts of the United States, the United States District Court for the District of Columbia, and the United States courts of any territory or other place subject to the jurisdiction of the United States, shall have jurisdiction to issue writs of mandamus commanding any person to comply with the provisions of this Act or any order of the Commission.</text></paragraph></subsection> 
<subsection id="HB9E9511BF3F94231B6F765915F2BA2FC"><enum>(c)</enum><header>Intervention in civil Actions</header> 
<paragraph id="H396E6F8F3DD746A3ADC1701F1FD3B6E0"><enum>(1)</enum><header>In general</header><text>The Commission, on behalf of the public interest, may intervene of right as provided under rule 24(a) of the Federal Rules of Civil Procedure in any civil action relating to professional boxing filed in a district court of the United States.</text></paragraph> 
<paragraph id="H5C678DA989FB4A21AA93F61666951CAA"><enum>(2)</enum><header>Amicus filing</header><text>The Commission may file a brief in any action filed in a court of the United States on behalf of the public interest in any case relating to professional boxing.</text></paragraph></subsection> 
<subsection id="HF31092B6136F4E45821BD9CC3716F18"><enum>(d)</enum><header>Hearings by Commission</header><text>Hearings conducted by the Commission under this Act shall be public and may be held before any officer of the Commission. The Commission shall keep appropriate records of the hearings.</text></subsection></section> 
<section id="H74479ACB3700402D885367652C78A3F0"><enum>9.</enum><header>Noninterference with boxing Commissions</header> 
<subsection id="H1AF78168454D4CC300252E6D4C7EB7D7"><enum>(a)</enum><header>Noninterference</header><text>Nothing in this Act prohibits any boxing commission from exercising any of its powers, duties, or functions with respect to the regulation or supervision of professional boxing or professional boxing matches to the extent not inconsistent with the provisions of this Act.</text></subsection> 
<subsection id="HC4BDC09A022B41D2B3221DBE85C5BC81"><enum>(b)</enum><header>Minimum standards</header><text>Nothing in this Act prohibits any boxing commission from enforcing local standards or requirements that exceed the minimum standards or requirements promulgated by the Commission under this Act.</text></subsection></section> 
<section id="H633D6129432E43C3B613FD777161C7A0"><enum>10.</enum><header>Assistance from other agencies</header><text display-inline="no-display-inline">Any employee of any executive department, agency, bureau, board, commission, office, independent establishment, or instrumentality may be detailed to the Commission, upon the request of the Commission, on a reimbursable or nonreimbursable basis, with the consent of the appropriate authority having jurisdiction over the employee. While so detailed, an employee shall continue to receive the compensation provided pursuant to law for the employee’s regular position of employment and shall retain, without interruption, the rights and privileges of that employment.</text></section> 
<section id="HC7B038BAC5B2454C98E6BAEAE007506"><enum>11.</enum><header>Studies</header> 
<subsection id="HAF3F1376BEA746C182BBB079115208F7"><enum>(a)</enum><header>Health and safety study</header> 
<paragraph id="H7753B06EC01F4B94B0641E89ADAB30C4"><enum>(1)</enum><header>Study</header><text display-inline="yes-display-inline">The Commission shall conduct a study on the health and safety aspects of boxing, including an examination of—</text> 
<subparagraph id="HB8F08A228C2C4DA7BFCFFEB6414656C4"><enum>(A)</enum><text>the risks or serious injury and the nature of potential injuries, including risks particular to boxers of each sex;</text></subparagraph> 
<subparagraph id="H9504E62072EF42FEB8733C9B61515207"><enum>(B)</enum><text>the long term effect of boxing on the health of boxers;</text></subparagraph> 
<subparagraph id="HA12771A5D5DF4C3FAF695EEBA8A41728"><enum>(C)</enum><text>the availability of health insurance for boxers;</text></subparagraph> 
<subparagraph id="H84D1AAD944594860A4F08673D279D7C1"><enum>(D)</enum><text>the extent to which differences in equipment effect the risks of potential injury; and</text></subparagraph> 
<subparagraph id="H4CA8B675AE5749C5A219FC69EC615748"><enum>(E)</enum><text>the effectiveness of safety standards and regulations.</text></subparagraph></paragraph> 
<paragraph id="H3861033706A8416A930021A1BA487B9E"><enum>(2)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Commission shall submit a report on the study required by this section to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Energy and Commerce of the House of Representatives, including recommendations to improve the health and safety aspects of boxing.</text></paragraph></subsection> 
<subsection id="H05A0303F86D847ADA3C031F54BB7DCBB" commented="no"><enum>(b)</enum><header>Study on the definition of promoter</header> 
<paragraph id="H57B62F021B6844258D8EFE618B1042DC" commented="no"><enum>(1)</enum><header>Study</header><text display-inline="yes-display-inline">The United States Boxing Commission shall conduct a study on how the term <quote>promoter</quote> should be defined for purposes of the United States Boxing Commission Act.</text></paragraph> 
<paragraph id="H39AB4C0E565E4C249467FC54BC5C922B" commented="no"><enum>(2)</enum><header>Hearings</header><text display-inline="yes-display-inline">As part of that study, the Commission shall hold hearings and solicit testimony at those hearings from boxers, managers, promoters, premium, cable, and satellite program service providers, hotels, casinos, resorts, and other commercial establishments that host or sponsor professional boxing matches, and other interested parties with respect to the definition of that term as it is used in the United States Boxing Commission Act.</text></paragraph> 
<paragraph id="HF7F18BA46AFD4A1792C04EEC8B08014" commented="no"><enum>(3)</enum><header>Report</header><text>Not later than 1 year after the date of the enactment of this Act, the Commission shall submit to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Energy and Commerce of the House of Representatives a report on the study conducted under subsection (a). The report shall—</text> 
<subparagraph id="HBE9272F3FF0045C79BE53BBAE3EB9020" commented="no"><enum>(A)</enum><text>set forth a proposed definition of the term <quote>promoter</quote> for purposes of the United States Boxing Commission Act; and </text></subparagraph> 
<subparagraph id="HC4C1A429B05C473087A21171FDEBBAF" commented="no"><enum>(B)</enum><text>describe the findings, conclusions, and rationale of the Commission for the proposed definition, together with any recommendations of the Commission, based on the study.</text></subparagraph></paragraph></subsection></section> 
<section id="H9E70492D105449EB8D9245C2AD039EEA"><enum>12.</enum><header>Reports</header> 
<subsection id="HF5593489C0EB41139615B2B79004456"><enum>(a)</enum><header>Annual report</header><text display-inline="yes-display-inline">Not later than 2 years after the date of enactment of this Act, and each year thereafter, the Commission shall submit a report on its activities to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Energy and Commerce of the House of Representatives. The annual report shall include—</text> 
<paragraph id="H372E69C1ADFB4C4E812FDD398FB53886"><enum>(1)</enum><text>a detailed discussion of the activities of the Commission for the year covered by the report;</text></paragraph> 
<paragraph id="H3DD3BA922E454E63A39E3C6D58A58BB4"><enum>(2)</enum><text>an overview of the licensing and enforcement activities of the State and tribal organization boxing commissions; and</text></paragraph> 
<paragraph id="H0E0E8FA3506F4D87A382C23B035B2B00"><enum>(3)</enum><text>recommendations regarding additional persons or entities within the sport of boxing over whom to extend the licensing requirement established by this Act.</text></paragraph></subsection> 
<subsection id="H5D22019400AB49AD901B8C310032ADE"><enum>(b)</enum><header>Public report</header><text>The Commission shall annually issue and publicize a report of the Commission on the progress made at Federal and State levels and on Indian lands in the reform of professional boxing, which shall include comments on issues of continuing concern to the Commission.</text></subsection></section> 
<section id="HDF12358D4D704E1CB07DC0ECFFA87D18"><enum>13.</enum><header>Sunset Provision</header><text display-inline="no-display-inline">This Act shall cease to have effect 12 years after the date of enactment of this Act.</text></section> 
<section id="HB92773993FB94B319C736C29C93E42E9"><enum>14.</enum><header>Authorization of appropriations</header> 
<subsection id="H6E0F50398EF54FEF8E89AF3B7D87A4F6"><enum>(a)</enum><header>In general</header><text>There are authorized to be appropriated for the Commission for each fiscal year such sums as may be necessary for the Commission to perform its functions for that fiscal year.</text></subsection> 
<subsection id="H8F818FE43B994F1700BC1800A38F668C"><enum>(b)</enum><header>Receipts credited as offsetting collections</header><text>Notwithstanding <external-xref legal-doc="usc" parsable-cite="usc/31/3302">section 3302</external-xref> of title 31, United States Code, any fee collected under this Act—</text> 
<paragraph id="HF3EC3018383B480BB97540ACC8C1D34"><enum>(1)</enum><text>shall be credited as offsetting collections to the account that finances the activities and services for which the fee is imposed;</text></paragraph> 
<paragraph id="H0767B523D85D46A58DF1AC3B515FA6AD"><enum>(2)</enum><text>shall be available for expenditure only to pay the costs of activities and services for which the fee is imposed; and</text></paragraph> 
<paragraph id="H7D457A6472CF4F61A6F606911BE1A39E"><enum>(3)</enum><text>shall remain available until expended.</text></paragraph></subsection></section>

<section id="H8CE1F1B804E6479D849E1761AFAC918F" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short Title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>United States Boxing Commission Act</short-title></quote>. </text></section> 
<section id="H3C651A845F614D4E8ED9DCFDCB258290" commented="no"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">As used in this Act, the following definitions apply:</text> 
<paragraph id="HD7E27C53D03B462C92FEB165E40017A0" commented="no"><enum>(1)</enum><header>Commission</header><text display-inline="yes-display-inline">The term <quote>Commission</quote> means the United States Boxing Commission established under section 3. </text></paragraph> 
<paragraph id="HCA298506838A48CB9145EC7630459457" commented="no"><enum>(2)</enum><header>Boxer</header><text>The term <quote>boxer</quote> means an individual who fights in a professional boxing match. </text></paragraph> 
<paragraph id="H454118195E8D44618996AFBC4752497E" commented="no"><enum>(3)</enum><header>Boxing commission</header><text>The term <quote>boxing commission</quote> means an entity authorized under State or tribal law to regulate professional boxing matches.</text></paragraph> 
<paragraph id="H6AB3D8F3E9014650905070DFE898ED42" commented="no"><enum>(4)</enum><header>Indian lands</header><text>The term <quote>Indian lands</quote> has the meanings given that terms by paragraphs (4) of section 4 of the Indian Gaming Regulatory Act (<external-xref legal-doc="usc" parsable-cite="usc/25/2703">25 U.S.C. 2703</external-xref>).</text></paragraph> 
<paragraph id="HC3E2FF3D3B3449ADBDCDFB3B3FF227BF"><enum>(5)</enum><header>Judge</header><text>The term <quote>judge</quote> means an official who scores a boxing match to determine the winner.</text></paragraph> 
<paragraph id="H971429F248B34738821658858EA5AB5" commented="no"><enum>(6)</enum><header>Manager</header><text display-inline="yes-display-inline">The term <quote>manager</quote> means a person other than a promoter who, under contract, agreement, or other arrangement with a boxer, undertakes to control or administer, directly or indirectly, a boxing-related matter on behalf of that boxer, including a person who is a booking agent for a boxer.</text></paragraph> 
<paragraph id="H636C6551A6C640CC993B8F4DF85D89F0" commented="no"><enum>(7)</enum><header>Matchmaker</header><text>The term <quote>matchmaker</quote> means a person that proposes, selects, and arranges for boxers to participate in a professional boxing match. Such term does not include a hotel, casino, resort, or other commercial establishment hosting or sponsoring a professional boxing match, or a provider of cable, satellite, or network television programming, unless— </text> 
<subparagraph id="H90F8EC0B891143E100F18CF1F670A84B" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">the hotel, casino, resort, or other commercial establishment, or provider of cable, satellite, or network television programming is primarily responsible for proposing, selecting, and arranging for boxers to participate in the professional boxing match; and </text></subparagraph> 
<subparagraph id="H0FAFE1B4CF524F4990EB0836B0D9EDDC" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">there is no other person primarily responsible for proposing, selecting, and arranging for boxers to participate in the match. </text></subparagraph></paragraph> 
<paragraph id="H8ABB90ABF8914D4AAA43F3A1B174FB23" commented="no"><enum>(8)</enum><header>Referee</header><text>The term <quote>referee</quote> means the official inside the boxing ring who supervises the boxing match. </text></paragraph> 
<paragraph id="H76C6C531F6D2454D88C800C800051DD"><enum>(9)</enum><header>Professional boxing match</header><text>The term <quote>professional boxing match</quote> means a boxing contest held in the United States between individuals for financial compensation. Such term does not include a boxing contest that is regulated by a duly recognized amateur sports organization, as approved by the Commission. </text></paragraph> 
<paragraph id="H1C25CA80B75F4C22AC93CF003CE4AC0" commented="no"><enum>(10)</enum><header>Promoter</header><text>The term <quote>promoter</quote>—</text> 
<subparagraph id="H9A90FBBECEF045BAA4884B5100BC5B19" commented="no"><enum>(A)</enum><text>means the person primarily responsible for organizing, promoting, and producing a professional boxing match; but </text></subparagraph> 
<subparagraph id="H45895C10768A44B086CE602EBABB275C" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">does not include a hotel, casino, resort, or other commercial establishment hosting or sponsoring a professional boxing match, or a provider of cable, satellite, or network television programming, unless—</text> 
<clause id="HAC92B5035F0B4C36A8C52FD46637E9A2" commented="no"><enum>(i)</enum><text display-inline="yes-display-inline">the hotel, casino, resort, or other commercial establishment, or provider of cable, satellite, or network television programming is primarily responsible for organizing, promoting, and producing the match; and </text></clause> 
<clause id="H4D52CC2E987F423BA21F9958A7883693" commented="no"><enum>(ii)</enum><text>there is no other person primarily responsible for organizing, promoting, and producing the match. </text></clause></subparagraph></paragraph> 
<paragraph id="H8A9EDD6A3E3D4207BFD2E67D264FD00" commented="no"><enum>(11)</enum><header>State</header><text>The term <quote>State</quote> means each of the 50 States, Puerto Rico, the District of Columbia, and any territory or possession of the United States, including the Virgin Islands.</text></paragraph> 
<paragraph id="HDBD3F8B0F35F496C9B0369BAE8F7BD6B" commented="no"><enum>(12)</enum><header>Sanctioning organization</header><text>The term <quote>sanctioning organization</quote> means an organization, other than a boxing commission, that sanctions professional boxing matches, ranks professional boxers, or charges a sanctioning fee for professional boxing matches in the United States—</text> 
<subparagraph id="HAC6066D0721F43C8AF78E517F5CC8806" commented="no"><enum>(A)</enum><text>between boxers who are residents of different States; or </text></subparagraph> 
<subparagraph id="HBF83D46E834F45E8B460983DE032D988" commented="no"><enum>(B)</enum><text>that are advertised, otherwise promoted, or broadcast (including closed circuit television) in interstate commerce. </text></subparagraph></paragraph> 
<paragraph id="H4E5EE5B4A7DB4BF5907DD5B4DAF9B9D2" commented="no"><enum>(13)</enum><header>Suspension</header><text>The term <quote>suspension</quote> includes within its meaning the temporary revocation of a boxing license.</text></paragraph> 
<paragraph id="H7A258815D8B84959AC005E83313761BA" commented="no"><enum>(14)</enum><header>Tribal organization</header><text display-inline="yes-display-inline">The term <quote>tribal organization</quote> has the same meaning as in section 4(l) of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/450b">25 U.S.C. 450b(l)</external-xref>).</text></paragraph></section> 
<section id="HFF956C3E211A4F978DAF9854B13862D7"><enum>3.</enum><header>Establishment of United States Boxing Commission</header> 
<subsection id="H93F6EADE88164009A12D09745622DE05"><enum>(a)</enum><header>In general</header><text>The United States Boxing Commission is established as a commission within the Department of Commerce.</text></subsection> 
<subsection id="HB7DFFB34B93843D4AFA985942512AF77"><enum>(b)</enum><header>Members</header> 
<paragraph id="HA42A4B0EE0514E0CBF327773623D6691"><enum>(1)</enum><header>In general</header><text>The Commission shall consist of 3 members appointed by the President, by and with the advice and consent of the Senate.</text></paragraph> 
<paragraph id="HBE56EB2819C445998F0903FB3CDF0800"><enum>(2)</enum><header>Qualifications</header><text>No member of the Commission may, while serving as a member of the Commission—</text> 
<subparagraph id="HC6A9B71F16354BBCA069ED4E3E08FC92" display-inline="no-display-inline"><enum>(A)</enum><text>be engaged as a professional boxer, boxing promoter, agent, fight manager, matchmaker, referee, judge, or in any other capacity in the conduct of the business of professional boxing;</text></subparagraph> 
<subparagraph id="H07FD17F4C95549F08F81FDC32E001B91"><enum>(B)</enum><text>have any pecuniary interest in the earnings of any boxer or the proceeds or outcome of any boxing match; or</text></subparagraph> 
<subparagraph id="HC6C11FD2FFA84B74B492D0D24321C471"><enum>(C)</enum><text>serve as a member of a boxing commission.</text></subparagraph></paragraph> 
<paragraph id="H925999E5BB2F485F9C2325791554FD14"><enum>(3)</enum><header>Bipartisan membership</header><text>Not more than 2 members of the Commission may be members of the same political party.</text></paragraph> 
<paragraph id="HA453B89F2DFA44ACB1046779F4360292"><enum>(4)</enum><header>Geographic balance</header><text>Not more than 2 members of the Commission may be residents of the same geographic region of the United States when appointed to the Commission. For purposes of the preceding sentence, the area of the United States east of the Mississippi River is a geographic region, and the area of the United States west of the Mississippi River is a geographic region.</text></paragraph> 
<paragraph id="H9D85B8DCF2E44F8783FF3015CBAF2C49"><enum>(5)</enum><header>Terms</header> 
<subparagraph id="H66408BAC7D244A1C97D2599E1F003523"><enum>(A)</enum><header>In general</header><text>The term of a member of the Commission shall be 3 years. No member of the Commission shall serve more than 2 terms.</text></subparagraph> 
<subparagraph id="H69B1D77E32CF40799F296E420906AA79"><enum>(B)</enum><header>Midterm vacancies</header><text>A member of the Commission appointed to fill a vacancy in the Commission occurring before the expiration of the term for which the member’s predecessor was appointed shall be appointed for the remainder of that unexpired term.</text></subparagraph> 
<subparagraph id="HE9F402FEE3B346068D509372E6D05C79"><enum>(C)</enum><header>Continuation pending replacement</header><text>A member of the Commission may serve after the expiration of that member’s term until a successor has taken office.</text></subparagraph></paragraph> 
<paragraph id="H8D120E0F344B40F5991CA4F337E0C8C8"><enum>(6)</enum><header>Removal</header><text>A member of the Commission may be removed by the President only for cause.</text></paragraph></subsection> 
<subsection id="HBE265D808CB64D0C8600687E096D20C5"><enum>(c)</enum><header>Executive Director</header> 
<paragraph id="H8B6B00D678AF41108CC1635CF3E71FA9"><enum>(1)</enum><header>In general</header><text>The Commission shall employ an Executive Director to perform the administrative functions of the Commission under this Act, and such other functions and duties of the Commission as the Commission shall specify.</text></paragraph> 
<paragraph id="HE5A356522FE04D98BEEC17CBAA9163BF"><enum>(2)</enum><header>Discharge of functions</header><text>Subject to the authority, direction, and control of the Commission the Executive Director shall carry out the functions and duties of the Commission under this Act.</text></paragraph></subsection> 
<subsection id="HFB3F0AA252544B4BB74800149F508F31"><enum>(d)</enum><header>General Counsel</header><text>The Commission shall employ a General Counsel to provide legal counsel and advice to the Executive Director and the Commission in the performance of its functions under this Act, and to carry out such other functions and duties as the Commission shall specify.</text></subsection> 
<subsection id="HD503D2C9FC114490BB8087ECD8A80944"><enum>(e)</enum><header>Staff</header><text>The Commission shall employ such additional staff as the Commission considers appropriate to assist the Executive Director and the General Counsel in carrying out the functions and duties of the Commission under this Act.</text></subsection> 
<subsection id="H5AB76A3442B748390064DD00290089B"><enum>(f)</enum><header>Meetings</header><text>The Commission shall hold its first meeting no later than 30 days after all members shall have been appointed, and shall meet thereafter not less frequently than once every 60 days.</text></subsection> 
<subsection id="H33C1E8D31FF14D00B54CCC9E683F4181"><enum>(g)</enum><header>Compensation</header> 
<paragraph id="HC0ED7C43E3004C83924DF7FF151F1493"><enum>(1)</enum><header>Members of Commission</header> 
<subparagraph id="H458477544CB24263A5EB365CDAB1073D"><enum>(A)</enum><header>In general</header><text>Each member of the Commission shall be compensated at a rate equal to the daily equivalent of the annual rate of basic pay prescribed for level IV of the Executive Schedule under <external-xref legal-doc="usc" parsable-cite="usc/5/5315">section 5315</external-xref> of title 5, United States Code, for each day (including travel time) during which such member is engaged in the performance of the duties of the Commission.</text></subparagraph> 
<subparagraph id="H939A6D9D17004CB3A57E00D3776FB8B9"><enum>(B)</enum><header>Travel expenses</header><text>The members of the Commission shall be allowed travel expenses, including per diem in lieu of subsistence, at rates authorized for employees of agencies under subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/57">chapter 57</external-xref> of title 5, United States Code, while away from their homes or regular places of business in the performance of services for the Commission.</text></subparagraph></paragraph> 
<paragraph id="HFA0872A59FCC48A9B692826BBD5EB889"><enum>(2)</enum><header>Executive Director and staff</header><text>The Commission shall fix the compensation of the Executive Director, the General Counsel, and other personnel of the Commission. The rate of pay for the Executive Director, the General Counsel, and other personnel may not exceed the rate payable for level V of the Executive Schedule under <external-xref legal-doc="usc" parsable-cite="usc/5/5316">section 5316</external-xref> of title 5, United States Code.</text></paragraph></subsection></section> 
<section id="H5C570F25EB4C49DE00957873C804E256"><enum>4.</enum><header>Functions</header> 
<subsection id="HBB1F6601A8E746E700A4F5C68CB494DB"><enum>(a)</enum><header>General functions</header><text>The general functions of the Commission are—</text> 
<paragraph id="H630F4D5AC5B2487DAAECDB001318322B"><enum>(1)</enum><text>to protect the general interests of boxers consistent with the provisions of this Act;</text></paragraph> 
<paragraph id="HB2A142DBFB2149E0AC91076600C18F3F"><enum>(2)</enum><text>to ensure uniformity, fairness, and integrity in professional boxing; and</text></paragraph> 
<paragraph id="H70DCD2B9E63E410C92ABD6782548D239"><enum>(3)</enum><text>except as otherwise determined by the Commission, oversee all professional boxing matches in the United States.</text></paragraph></subsection> 
<subsection id="H951005FD023A4AEEA8B501B4723F196E"><enum>(b)</enum><header>Initial rulemaking</header><text display-inline="yes-display-inline">Not later than 180 days after the date on which the Commission shall hold its first meeting, the Commission shall, by rule promulgate uniform standards for professional boxing in consultation with the Association of Boxing Commissions.</text></subsection> 
<subsection id="H7B3E2B9B1FEF43E296611FF3B100CB1"><enum>(c)</enum><header>Additional functions</header><text>In addition to its general functions under subsection (a), the Commission shall—</text> 
<paragraph id="H6C0E1744C709462A974611C2F7E2D3A9"><enum>(1)</enum><text>work with the boxing commissions of the several States and tribal organizations to improve the status and standards of professional boxing in the United States;</text></paragraph> 
<paragraph id="H0583692DA648441B97682041D9B92CBF"><enum>(2)</enum><text display-inline="yes-display-inline">ensure, in cooperation with the Attorney General, or a designee of the Attorney General, (who shall represent the Commission in any judicial proceeding under this Act), the chief law enforcement officer of the several States, and other appropriate officers and agencies of Federal, State, and local government, that Federal and State laws applicable to professional boxing matches in the United States are vigorously, effectively, and fairly enforced;</text></paragraph> 
<paragraph id="H1127BF5F4166484999032D0382D1D0CD"><enum>(3)</enum><text>review State boxing commission regulations for professional boxing and provide assistance to such authorities in meeting minimum standards prescribed by the Commission under this Act;</text></paragraph> 
<paragraph id="HB04E9FD10C48476A89D49F83682F48F7"><enum>(4)</enum><text>if the Commission determines appropriate, publish a newspaper, magazine, or other publication and establish and maintain an Internet website consistent with the provisions of this Act; and</text></paragraph> 
<paragraph id="HA5A3C8447BDB4D07B8F0008D651B6168"><enum>(5)</enum><text>promulgate rules, regulations, and guidance, and take any other action necessary and proper to accomplish the purposes of, and consistent with, the provisions of this Act.</text></paragraph></subsection> 
<subsection id="H51F866CA4CB946B488EAE1B9AD0051DC"><enum>(d)</enum><header>Prohibitions</header><text>The Commission may not—</text> 
<paragraph id="H9306D840B731465794ADB8AB79C63B59"><enum>(1)</enum><text>promote boxing events or rank professional boxers; or</text></paragraph> 
<paragraph id="HBDEB30159AE148129BC044001E826FDB"><enum>(2)</enum><text>provide technical assistance to, or authorize the use of the name of the Commission by, boxing commissions that do not comply with requirements of the Commission.</text></paragraph></subsection></section> 
<section id="HEE3B6D6ECC354FADBAB2AECE3EF077F8"><enum>5.</enum><header>Licensing and registration of boxing personnel</header> 
<subsection id="H32BD68F8EAA141EC9365EBAB16911188"><enum>(a)</enum><header>Licensing</header> 
<paragraph id="HC24FC323CC6746C4BC50C1C8FE50F321"><enum>(1)</enum><header>Requirement for license</header><text display-inline="yes-display-inline">Beginning 1 year after the date of enactment of this Act, no person may compete in a professional boxing match or serve as a boxing manager, boxing promoter, matchmaker, judge, referee, or sanctioning organization for a professional boxing match except as provided in a license granted to that person under this subsection.</text></paragraph> 
<paragraph id="H6AADCAF9FDFF456184575B5914951EA5" commented="no"><enum>(2)</enum><header>Application and term</header> 
<subparagraph id="H850F3E9A3527426A85948B7448617CDF" commented="no"><enum>(A)</enum><header>In general</header><text>The Commission shall—</text> 
<clause id="HFE7AFDE1138B4636ABC9C8EFE565BFE7" commented="no"><enum>(i)</enum><text display-inline="yes-display-inline">establish application procedures, forms, and fees for licenses granted under this section;</text></clause> 
<clause id="H5C462817DF9E4A52A5887FA1CBCD0284" commented="no"><enum>(ii)</enum><text>establish and publish appropriate standards for such licenses;</text></clause> 
<clause id="H2B42CED811944A35AFF0EBA0DD31E4E1" commented="no"><enum>(iii)</enum><text>issue a license to any person who, as determined by the Commission, meets the standards established by the Commission under this Act; and</text></clause> 
<clause id="H3AC8BA087C464F10B9D37791B9306603" commented="no"><enum>(iv)</enum><text display-inline="yes-display-inline">begin issuing such licenses not later than 270 days after the date on which Commission holds its first meeting.</text></clause></subparagraph> 
<subparagraph id="HB5F045F532674214004400ABC45F9DB4" commented="no"><enum>(B)</enum><header>Duration</header><text>A license issued under this section shall be for a renewable—</text> 
<clause id="H246518F1F7C04DAEBE4B00F0F4211794" commented="no"><enum>(i)</enum><text>4-year term for a boxer; and</text></clause> 
<clause id="HC9241074F354448EAD4B67673CBA91BD" commented="no"><enum>(ii)</enum><text>2-year term for any other person.</text></clause></subparagraph> 
<subparagraph id="H9BEBD411F80D40A9B73CBA00B937E261" commented="no"><enum>(C)</enum><header>Procedure</header><text>The Commission may issue a license under this paragraph through boxing commissions or in a manner determined by the Commission.</text></subparagraph></paragraph></subsection> 
<subsection id="HFEF7C37A44ED4B2A9B3ED172462E68FD"><enum>(b)</enum><header>Licensing fees</header> 
<paragraph id="HE3BEDE237BEB464085DC7CD37F599362"><enum>(1)</enum><header>Authority</header><text>The Commission may prescribe and charge reasonable fees for the licensing of persons under this Act. The Commission may set, charge, and adjust varying fees on the basis of classifications of persons, functions, and events determined appropriate by the Commission.</text></paragraph> 
<paragraph id="H44BB32076DB94D7988A6BBF7D1EA564C"><enum>(2)</enum><header>Limitations</header><text>In setting and charging fees under paragraph (1), the Commission shall ensure that, to the maximum extent practicable—</text> 
<subparagraph id="HE1D949E586814CB08309E476D18ED856"><enum>(A)</enum><text>club boxing is not adversely effected;</text></subparagraph> 
<subparagraph id="HE7BF7A9D53C24E6185098DE17CF93035"><enum>(B)</enum><text>sanctioning organizations and promoters pay comparatively the largest portion of the fees; and</text></subparagraph> 
<subparagraph id="H8357AD97045544940014CA80DF8D4BDC"><enum>(C)</enum><text>boxers pay as small a portion of the fees as is possible.</text></subparagraph></paragraph></subsection></section> 
<section id="HEF9671A6EB8F4535B280D1004C26CC6F"><enum>6.</enum><header>National registry of boxing personnel</header><text display-inline="no-display-inline">The Commission shall establish and maintain (or authorize a third party to establish and maintain) a unified national computerized registry for the collection, storage, and retrieval of such information as the Commission shall prescribe by rule related to the performance of its duties.</text></section> 
<section id="H86DC7E6A6219447793FD8B6AA007C86"><enum>7.</enum><header>Consultation requirements</header><text display-inline="no-display-inline">The Commission shall consult with the Association of Boxing Commissions—</text> 
<paragraph id="HAFF5B06171954CDEBEAEB04B1F326EB8"><enum>(1)</enum><text>before prescribing any regulation or establishing any standard under the provisions of this Act; and</text></paragraph> 
<paragraph id="H001E825A096A44D4AF13401CECB2C811"><enum>(2)</enum><text>not less than once each year regarding matters relating to professional boxing.</text></paragraph></section> 
<section id="H5554794C8F134B6FB5C46BA68BB02369"><enum>8.</enum><header>Misconduct</header> 
<subsection id="HB64DD308E4064A51BED1AD7467671D29"><enum>(a)</enum><header>Suspension and revocation of license or registration</header> 
<paragraph id="HEC6E15836284485F83DE52275BCE164D"><enum>(1)</enum><header>Authority</header><text>The Commission may, after notice and opportunity for a hearing, suspend or revoke any license issued under this Act if the Commission—</text> 
<subparagraph id="HF4234988C90943528C239552008078C5"><enum>(A)</enum><text display-inline="yes-display-inline">finds that the license holder has violated any provision of this Act or a standard prescribed under this Act;</text></subparagraph> 
<subparagraph id="H130E304E8ABF4E14BA7767E27BF1A548"><enum>(B)</enum><text>reasonably believes that a standard prescribed by the Commission under this Act is not being met, or that bribery, collusion, intentional losing, racketeering, extortion, or the use of unlawful threats, coercion, or intimidation have occurred in connection with a license; or</text></subparagraph> 
<subparagraph id="HE919531FE13A412F8ED798F7033C83C"><enum>(C)</enum><text display-inline="yes-display-inline">finds that the suspension or revocation is in the public interest.</text></subparagraph></paragraph> 
<paragraph id="HC7B00D40E224477B9381604EB278ED27"><enum>(2)</enum><header>Period of suspension</header><text>A suspension of a license under this section shall be effective for a period determined appropriate by the Commission.</text></paragraph> 
<paragraph id="H49DF400655F843E4B1FE85C4BFFEEED3"><enum>(3)</enum><header>Period of revocation</header><text>In the case of a revocation of the license of a boxer, the revocation shall be for a period of not less than 1 year.</text></paragraph></subsection> 
<subsection id="HA9ECADA69ED0455AB463E52FD7738432"><enum>(b)</enum><header>Investigations and Injunctions</header> 
<paragraph id="H32CDBDE832EF42AE836C2900C41C79A6"><enum>(1)</enum><header>Authority</header><text>The Commission may—</text> 
<subparagraph id="H14872001ECDB47BE8BF78468093300DD"><enum>(A)</enum><text>conduct any investigation that it considers necessary to determine whether any person has violated, or is about to violate, any provision of this Act or any regulation prescribed under this Act;</text></subparagraph> 
<subparagraph id="H82C5ED0A02D14479836578E68EB1D163"><enum>(B)</enum><text>require or permit any person to file with it a statement in writing, under oath or otherwise as the Commission shall determine, as to all the facts and circumstances concerning the matter to be investigated;</text></subparagraph> 
<subparagraph id="H7BF9BBE712DE4AE7BE7CBD5F44C1EF73"><enum>(C)</enum><text>in its discretion, publish information concerning any violations; and</text></subparagraph> 
<subparagraph id="H2246BCA2882547CA8E22C54CE200008E"><enum>(D)</enum><text>investigate any facts, conditions, practices, or matters to aid in the enforcement of the provisions of this Act, in the prescribing of regulations under this Act, or in securing information to serve as a basis for recommending legislation concerning the matters to which this Act relates.</text></subparagraph></paragraph> 
<paragraph id="H126BAD74A8514322854F5C00C0C6F48"><enum>(2)</enum><header>Powers</header> 
<subparagraph id="HFD0BB88658D64C3E885D1C1BA3EFA9B6"><enum>(A)</enum><header>In general</header><text>For the purpose of any investigation under paragraph (1) or any other proceeding under this Act—</text> 
<clause id="H3D602898E2054E12BB2E65750263A493"><enum>(i)</enum><text>any officer designated by the Commission may administer oaths and affirmations, subpoena or otherwise compel the attendance of witnesses, take evidence, and require the production of any books, papers, correspondence, memoranda, or other records the Commission considers relevant or material to the inquiry; and</text></clause> 
<clause id="HF94C914C3FF34531B68200F2CB8DD5BE"><enum>(ii)</enum><text>the provisions of sections <external-xref legal-doc="usc" parsable-cite="usc/18/6002">6002</external-xref> and <external-xref legal-doc="usc" parsable-cite="usc/18/6004">6004</external-xref> of title 18, United States Code, shall apply.</text></clause></subparagraph> 
<subparagraph id="H7D30160666A1419A8EC2F0DCAE7021B6"><enum>(B)</enum><header>Witnesses and evidence</header><text>The attendance of witnesses and the production of any documents under subparagraph (A) may be required from any place in the United States, including Indian land, at any designated place of hearing.</text></subparagraph></paragraph> 
<paragraph id="HC72B8A6C731442FF9EC52E00EAC1DC98"><enum>(3)</enum><header>Enforcement of subpoenas</header> 
<subparagraph id="H3CAB2ECB1D644936BDA2E4BA98936FC9"><enum>(A)</enum><header>Civil action</header><text>In case of contumacy by, or refusal to obey a subpoena issued to, any person, the Commission may file an action in any district court of the United States within the jurisdiction of which an investigation or proceeding is carried out, or where that person resides or carries on business, to enforce the attendance and testimony of witnesses and the production of books, papers, correspondence, memorandums, and other records. The court may issue an order requiring the person to appear before the Commission to produce records, if so ordered, or to give testimony concerning the matter under investigation or in question.</text></subparagraph> 
<subparagraph id="H86DA7E096ABB47AAA67F5740F105AE03"><enum>(B)</enum><header>Failure to obey</header><text>Any failure to obey an order issued by a court under subparagraph (A) may be punished as contempt of that court.</text></subparagraph> 
<subparagraph id="H052749BC4ADB43DB8F614E38B5334FAB"><enum>(C)</enum><header>Process</header><text>All process in any contempt case under subparagraph (A) may be served in the judicial district in which the person is an inhabitant or in which the person may be found.</text></subparagraph> 
<subparagraph id="HBB130944E4B046B3912DE2EF2EB5BBB"><enum>(D)</enum><header>Administrative subpoenas</header><text>The requirements of <external-xref legal-doc="usc" parsable-cite="usc/18/3486">section 3486</external-xref> of title 18, United States Code, shall apply to the administration and enforcement of subpoenas under this Act.</text></subparagraph></paragraph> 
<paragraph id="HD62E163C72B240A7AC1C067661B52CFC"><enum>(4)</enum><header>Evidence of criminal misconduct</header><text>No person may be excused from attending and testifying or from producing books, papers, contracts, agreements, and other records and documents before the Commission, in obedience to the subpoena of the Commission, or in any cause or proceeding instituted by the Commission, on the ground that the testimony or evidence, documentary or otherwise, required of that person may tend to incriminate the person or subject the person to a penalty or forfeiture.</text></paragraph> 
<paragraph id="H19B84CCBEA2849D18227D4CAAD02D84"><enum>(5)</enum><header>Injunctive relief</header><text>If the Commission determines that any person is engaged or about to engage in any act or practice that constitutes a violation of any provision of this Act, or of any regulation prescribed under this Act, the Commission may bring an action in the appropriate district court of the United States, the United States District Court for the District of Columbia, or the United States courts of any territory or other place subject to the jurisdiction of the United States, to enjoin the act or practice, and upon a proper showing, the court shall grant without bond a permanent or temporary injunction or restraining order.</text></paragraph> 
<paragraph id="H214BE032C7494961918E3FE90011F2D3"><enum>(6)</enum><header>Mandamus</header><text>Upon application of the Commission, the district courts of the United States, the United States District Court for the District of Columbia, and the United States courts of any territory or other place subject to the jurisdiction of the United States, shall have jurisdiction to issue writs of mandamus commanding any person to comply with the provisions of this Act or any order of the Commission.</text></paragraph></subsection> 
<subsection id="HEC3C3A2EFAF74607A30027A3A5813535"><enum>(c)</enum><header>Intervention in civil Actions</header> 
<paragraph id="H50C713AF0573490A9C2B4D70C5DFA343"><enum>(1)</enum><header>In general</header><text>The Commission, on behalf of the public interest, may intervene of right as provided under rule 24(a) of the Federal Rules of Civil Procedure in any civil action relating to professional boxing filed in a district court of the United States.</text></paragraph> 
<paragraph id="HAE660A8487074CBABA54A54F22AA9DDD"><enum>(2)</enum><header>Amicus filing</header><text>The Commission may file a brief in any action filed in a court of the United States on behalf of the public interest in any case relating to professional boxing.</text></paragraph></subsection> 
<subsection id="HD38CF6B8942A49D193093CF0E115D00"><enum>(d)</enum><header>Hearings by Commission</header><text>Hearings conducted by the Commission under this Act shall be public and may be held before any officer of the Commission. The Commission shall keep appropriate records of the hearings.</text></subsection></section> 
<section id="H74C8E82978DC4664B87263BC43793652"><enum>9.</enum><header>Noninterference with boxing Commissions</header> 
<subsection id="HD925A3FC711A475999B93DA4F1D34AE"><enum>(a)</enum><header>Noninterference</header><text>Nothing in this Act prohibits any boxing commission from exercising any of its powers, duties, or functions with respect to the regulation or supervision of professional boxing or professional boxing matches to the extent not inconsistent with the provisions of this Act.</text></subsection> 
<subsection id="H4E383EDCFDAE4455AACDD78E0662ADB8"><enum>(b)</enum><header>Minimum standards</header><text>Nothing in this Act prohibits any boxing commission from enforcing local standards or requirements that exceed the minimum standards or requirements promulgated by the Commission under this Act.</text></subsection></section> 
<section id="H6EA12A8F79D949719B9DEF7595DE3492"><enum>10.</enum><header>Assistance from other agencies</header><text display-inline="no-display-inline">Any employee of any executive department, agency, bureau, board, commission, office, independent establishment, or instrumentality may be detailed to the Commission, upon the request of the Commission, on a reimbursable or nonreimbursable basis, with the consent of the appropriate authority having jurisdiction over the employee. While so detailed, an employee shall continue to receive the compensation provided pursuant to law for the employee’s regular position of employment and shall retain, without interruption, the rights and privileges of that employment.</text></section> 
<section id="H513C39D5C80843619F03300083539700"><enum>11.</enum><header>Studies</header> 
<subsection id="H7DA6A37DC1B64427009E9DEAD8C7DBC"><enum>(a)</enum><header>Health and safety study</header> 
<paragraph id="H5AC89CC362834B6182B4B5F98E65C900"><enum>(1)</enum><header>Study</header><text display-inline="yes-display-inline">The Commission shall conduct a study on the health and safety aspects of boxing, including an examination of—</text> 
<subparagraph id="H30831E3F5B7F4061B0588B07FD929791"><enum>(A)</enum><text>the risks or serious injury and the nature of potential injuries, including risks particular to boxers of each sex;</text></subparagraph> 
<subparagraph id="HF12A1AE84A4E45DA9740851902911336"><enum>(B)</enum><text>the long term effect of boxing on the health of boxers;</text></subparagraph> 
<subparagraph id="HFE099702B9DB4491972F526F16197F7D"><enum>(C)</enum><text>the availability of health insurance for boxers;</text></subparagraph> 
<subparagraph id="H1AC55E0F882E4CE194B0C4C292E719BF"><enum>(D)</enum><text>the extent to which differences in equipment effect the risks of potential injury; and</text></subparagraph> 
<subparagraph id="HA96FD08C89F9406FA4D72F002178FDAB"><enum>(E)</enum><text>the effectiveness of safety standards and regulations.</text></subparagraph></paragraph> 
<paragraph id="H57C73A982D424CEFA2D3E7D99F7ED5E"><enum>(2)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Commission shall submit a report on the study required by this section to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Energy and Commerce of the House of Representatives, including recommendations to improve the health and safety aspects of boxing.</text></paragraph></subsection> 
<subsection id="HDF4033DC4FDE49F09E006B9E83008F01" commented="no"><enum>(b)</enum><header>Study on the definition of promoter</header> 
<paragraph id="H9DB7AB023EE5434D938E0600ABE79934" commented="no"><enum>(1)</enum><header>Study</header><text display-inline="yes-display-inline">The United States Boxing Commission shall conduct a study on how the term <quote>promoter</quote> should be defined for purposes of the United States Boxing Commission Act.</text></paragraph> 
<paragraph id="HA697857FAC6F4A30AC27D9BC008E3CE" commented="no"><enum>(2)</enum><header>Hearings</header><text display-inline="yes-display-inline">As part of that study, the Commission shall hold hearings and solicit testimony at those hearings from boxers, managers, promoters, premium, cable, and satellite program service providers, hotels, casinos, resorts, and other commercial establishments that host or sponsor professional boxing matches, and other interested parties with respect to the definition of that term as it is used in the United States Boxing Commission Act.</text></paragraph> 
<paragraph id="H31CEDE647C1B44AAA3E166601BE725A3" commented="no"><enum>(3)</enum><header>Report</header><text>Not later than 1 year after the date of the enactment of this Act, the Commission shall submit to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Energy and Commerce of the House of Representatives a report on the study conducted under subsection (a). The report shall—</text> 
<subparagraph id="H28C9019C29F04469B024D48FC92C8840" commented="no"><enum>(A)</enum><text>set forth a proposed definition of the term <quote>promoter</quote> for purposes of the United States Boxing Commission Act; and </text></subparagraph> 
<subparagraph id="H4EB42248CE5F41098EDC33457B2F7821" commented="no"><enum>(B)</enum><text>describe the findings, conclusions, and rationale of the Commission for the proposed definition, together with any recommendations of the Commission, based on the study.</text></subparagraph></paragraph></subsection></section> 
<section id="H0A68E600FAD8420491C709BD848DB619"><enum>12.</enum><header>Reports</header> 
<subsection id="H19C51907CA584291B227D8DAD9003058"><enum>(a)</enum><header>Annual report</header><text display-inline="yes-display-inline">Not later than 2 years after the date of enactment of this Act, and each year thereafter, the Commission shall submit a report on its activities to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Energy and Commerce of the House of Representatives. The annual report shall include—</text> 
<paragraph id="H15878C3FCA964AEB824F823800DBEC23"><enum>(1)</enum><text>a detailed discussion of the activities of the Commission for the year covered by the report;</text></paragraph> 
<paragraph id="H8AA1CA0E365C47108D1C495CCDF4DDBE"><enum>(2)</enum><text>an overview of the licensing and enforcement activities of the State and tribal organization boxing commissions; and</text></paragraph> 
<paragraph id="H4BFDAC92D5264A9BA27775458BFA97B1"><enum>(3)</enum><text>recommendations regarding additional persons or entities within the sport of boxing over whom to extend the licensing requirement established by this Act.</text></paragraph></subsection> 
<subsection id="H88C566EDAD6047CA86A204D22EEF3F25"><enum>(b)</enum><header>Public report</header><text>The Commission shall annually issue and publicize a report of the Commission on the progress made at Federal and State levels and on Indian lands in the reform of professional boxing, which shall include comments on issues of continuing concern to the Commission.</text></subsection></section> 
<section id="H022557546A6A4A8C8D962B8CBCBB00C1"><enum>13.</enum><header>Sunset Provision</header><text display-inline="no-display-inline">This Act shall cease to have effect 12 years after the date of enactment of this Act.</text></section> 
<section id="HA7C0C76F7DDC4271BC167D1C462300C0"><enum>14.</enum><header>Authorization of appropriations</header> 
<subsection id="H80CC85D33A0248D4992F59AC90EF2913"><enum>(a)</enum><header>In general</header><text>There are authorized to be appropriated for the Commission for each fiscal year such sums as may be necessary for the Commission to perform its functions for that fiscal year.</text></subsection> 
<subsection id="H8545E276FEA9420F8BB4F481C25C6B87"><enum>(b)</enum><header>Receipts credited as offsetting collections</header><text>Notwithstanding <external-xref legal-doc="usc" parsable-cite="usc/31/3302">section 3302</external-xref> of title 31, United States Code, any fee collected under this Act—</text> 
<paragraph id="HE059618F18CB4F46BF05D42F44000072"><enum>(1)</enum><text>shall be credited as offsetting collections to the account that finances the activities and services for which the fee is imposed;</text></paragraph> 
<paragraph id="H5A427C2F35C64ACDBB8F98E934EDD23B"><enum>(2)</enum><text>shall be available for expenditure only to pay the costs of activities and services for which the fee is imposed; and</text></paragraph> 
<paragraph id="H95937B318CB44523B2DF68FCD08CE10"><enum>(3)</enum><text>shall remain available until expended.</text></paragraph></subsection></section>
