<section section-type="section-one" id="H8ED17D8E824A48DE8EDE766DE05421C8" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Universal Prekindergarten and Early Childhood Education Act of 2005</short-title></quote>.</text></section> 
<section id="H4E7E8115678445F2ADC9B39DED31698B"><enum>2.</enum><header>Use of community learning center funds for prekindergarten programs</header><text display-inline="no-display-inline">Section 4205 of the <act-name parsable-cite="ESEA">Elementary and Secondary Education Act of 1965</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/20/7175">20 U.S.C. 7175</external-xref>) is amended—</text> 
<paragraph id="HC4CBDD83E2954F54A4BB01FFB262EDCB"><enum>(1)</enum><text>by redesignating subsection (b) as subsection (c); and</text></paragraph> 
<paragraph id="H930E6DC9899A41BD83E11EDDE14ECFEE"><enum>(2)</enum><text>by inserting after subsection (a) the following:</text>

<subsection id="H38B4D96710A044C484A2E4DBC113D900"><enum>(b)</enum><header>Prekindergarten programs</header> 
<paragraph id="HC68CF761B9C444A39BB593C18870091"><enum>(1)</enum><header>Authorization</header><text>In addition to the activities authorized under subsection (a), a local educational agency that receives an award under this part may use the award for educational activities for children 4 years of age or younger if the agency agrees to phase in, where possible, a prekindergarten program.</text></paragraph> 
<paragraph id="H50067F1E1B1F44D3A9E105CDFC00C1B0"><enum>(2)</enum><header>Definition</header><text>For purposes of this subsection, the term <term>prekindergarten program</term> means a program that—</text> 
<subparagraph id="H548E895DFE71429985DE3185E6DAA1AD"><enum>(A)</enum><text>provides a prekindergarten curriculum in classrooms at public elementary schools for students 4 years of age or younger; and</text></subparagraph> 
<subparagraph id="HC5AB13E772E14D77BA23C3B405EC7AE"><enum>(B)</enum><text>is taught by teachers who possess equivalent or similar qualifications to those of teachers of other grades in the school involved.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section>
