<section id="H6455F11FCC564DEDBB4B33FA712F4FC5" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Tools for Community Initiatives Act</short-title></quote>.</text></section> 
<section id="HC3D1574426854B179200A7B610002B36"><enum>2.</enum><header>Establishment</header><text display-inline="no-display-inline">There is established in the Executive Office of the President the Office of Faith-Based and Community Initiatives (hereafter referred to as <quote>the Office</quote>).</text></section> 
<section id="HB8F8B01171174923BEB9CB83B4581C2E"><enum>3.</enum><header>Director</header> 
<subsection id="HD6EEDD3CBDDC4B47BE53103FDEA66050"><enum>(a)</enum><header>Director</header><text>The head of the Office shall be the Director of the Office of Faith-Based and Community Initiatives, who shall be appointed by the President.</text></subsection> 
<subsection id="H35C1CA0FCD404C3BBEB1302037869404" indent="up1"><enum>(b)</enum><header>Pay of Director</header><text><external-xref legal-doc="usc" parsable-cite="usc/5/5314">Section 5314</external-xref> of title 5, United States Code, is amended by inserting after the item relating to the Administrator of the Centers for Medicare &amp; Medicaid Services the following new item:</text> 
<quoted-block style="OLC" id="H9EA698C492A6437CA8939B3437373333" display-inline="no-display-inline"><list level="paragraph"><list-item>Director of the Office of Faith-Based and Community Initiatives.</list-item></list><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HE2983938395844D3B9F4D57D28B01FB4"><enum>(c)</enum><header>Interim Director</header><text>The individual serving as the Director of the Office of Faith-Based and Community Initiatives on the date of the enactment of this Act may serve as Interim Director until such time as a Director is appointed by the President in accordance with subsection (a).</text></subsection></section> 
<section id="HF008C18DB2B64FEA8E65C500965BB433"><enum>4.</enum><header>Responsibilities</header> 
<subsection id="H3B46B9C4474F4A1FB5F6C0D866C3D0DB"><enum>(a)</enum><header>In general</header><text>The Director shall encourage faith-based and community initiatives and work to eliminate improper Federal barriers so as to allow faith-based and community entities to compete for Federal funding to the fullest opportunity permitted by law. </text></subsection> 
<subsection id="HD74D22C97D604E92BAAAC2E16020CBB0"><enum>(b)</enum><header>Specific duties</header><text>In carrying out the responsibilities of the Office, the Director shall—</text> 
<paragraph id="H33010B1FA6884F7493A91CF72C8EBF82" display-inline="no-display-inline"><enum>(1)</enum><text>develop, lead, and coordinate policies with respect to faith-based and community initiatives;</text></paragraph> 
<paragraph id="H29F4B3B43B48412599E9E78C9179825E"><enum>(2)</enum><text display-inline="yes-display-inline">support faith-based and community initiatives, especially those serving at-risk youth, ex-offenders, the homeless and hungry, substance abusers, those with HIV and AIDS, and welfare-to-work families;</text></paragraph> 
<paragraph id="HC2F3BC64F7A04F2EABC2D0B61662C08C"><enum>(3)</enum><text>work to expand the role of faith-based and community initiatives through executive action, legislation, regulation, and Federal and private funding;</text></paragraph> 
<paragraph id="H00F0467F872F45A9844457B1257934C"><enum>(4)</enum><text>ensure that the policy decisions made by the administration and the Federal Government are consistent with stated goals with respect to faith-based and community initiatives;</text></paragraph> 
<paragraph id="H431B2AE435824C68B818EE1200757277"><enum>(5)</enum><text>help to integrate policies affecting faith-based and other community organizations across the Federal Government;</text></paragraph> 
<paragraph id="H27D3C7B94B6A452B9E6B5BB1DC3DE542"><enum>(6)</enum><text>coordinate public education activities designed to mobilize public support for faith-based and community initiatives by encouraging volunteerism, special projects, demonstration pilots, and public-private partnerships;</text></paragraph> 
<paragraph id="HF8A75EF2CABE46408128D38D6B50A9E2"><enum>(7)</enum><text>encourage private charitable giving to support faith-based and community initiatives;</text></paragraph> 
<paragraph id="H9887922CB6A7411888DBCC5B0FFC7E5"><enum>(8)</enum><text>advise the President on options and ideas to assist, strengthen, and replicate successful faith-based and community initiatives;</text></paragraph> 
<paragraph id="HA204237B24604734A4AE00B9A86F12E"><enum>(9)</enum><text>provide policy and legal education to State, local, and community policymakers and public officials seeking ways to support and encourage faith-based and community initiatives;</text></paragraph> 
<paragraph id="H0ECC5B95A1D34B66B4E84FC0C9AB5E00"><enum>(10)</enum><text>develop and implement strategic initiatives in keeping with policies that will strengthen families, communities, and the institutions of civil society;</text></paragraph> 
<paragraph id="HB0CE7CD3C86F49D497C5EAF4ED3DA0C3"><enum>(11)</enum><text>showcase and herald innovative grassroots nonprofit organizations and civic initiatives;</text></paragraph> 
<paragraph id="HBB7B9CA7A1A24971A92200A746149317"><enum>(12)</enum><text>work to eliminate unnecessary legislative and regulatory barriers which impede the efforts of faith-based and community initiatives to solve social problems;</text></paragraph> 
<paragraph id="HD4D4F0FDCD934DD79387A62DD0F811A8"><enum>(13)</enum><text display-inline="yes-display-inline">monitor the implementation of policies with respect to faith-based and community initiatives by the Centers for Faith-Based and Community Initiatives established within certain departments and agencies of the Federal Government; and</text></paragraph> 
<paragraph id="H9405F10B5A18462FB91403FA75B31F72"><enum>(14)</enum><text>work to establish high standards of excellence and accountability for faith-based and community initiatives.</text></paragraph></subsection></section> 
<section id="H5A6FF77A29334532B3055289B7B032E0"><enum>5.</enum><header>Administration</header> 
<subsection id="HC09D692EE1DC421A96315C71F96D4166"><enum>(a)</enum><header>Officers</header><text>The President shall assign to the Office such officers in addition to the Director, if any, as the President, in consultation with the Director, considers appropriate to discharge the responsibilities of the Office.</text></subsection> 
<subsection id="H43AAD06E1A554411855363F29EBEF4C"><enum>(b)</enum><header>Staff</header><text>The Director may appoint such employees as necessary to carry out the functions of the Office.</text></subsection> 
<subsection id="H9618381051EE433FAA3FA06024E60FD"><enum>(c)</enum><header>Resources</header><text>The President shall, in consultation with the Director, assign or allocate to the Office such resources, including funds and other resources, as the President considers appropriate in order to facilitate the discharge of the responsibilities of the Office.</text></subsection> 
<subsection id="H7815D30FD014423899DBD9639CD452A8"><enum>(d)</enum><header>Obtaining official data</header><text>The Office may secure directly from any department or agency of the United States information necessary to enable it to carry out this Act. Upon request of the Director, the head of that department or agency shall furnish that information to the Office.</text></subsection> </section> 
<section id="H74A642171FC94AF2BA46E71D2DDA4375"><enum>6.</enum><header>Designated department or agency liaison</header> 
<subsection id="HB582CBADFD574AD7825CB8D5008668B4" display-inline="no-display-inline"><enum>(a)</enum><header>In general</header><text>The head of each designated department or agency shall designate a liaison who shall be responsible for coordinating the activities of that department or agency with the Office.</text></subsection> 
<subsection id="H9FF06EC8DF77438BA3F2C5CFB3EBE44"><enum>(b)</enum><header>Responsibilities of liaison</header><text>Each designated department or agency liaison shall—</text> 
<paragraph id="HD1A9F38057FD499ABD789430DA47BBFA"><enum>(1)</enum><text display-inline="yes-display-inline">conduct, in coordination with the Office, a review of the policies and procedures of the designated department or agency to identify any barriers to the participation of faith-based and community initiatives in the delivery of social services by such department or agency, including, but not limited to, regulations, rules, orders, procurement, outreach activities, and other internal policies and practices that either facially discriminate against or otherwise discourage or disadvantage the participation of faith-based and other community organizations in Federal programs; </text></paragraph> 
<paragraph id="H3F39855AFD1845D5876F81BC7DCB4EF5"><enum>(2)</enum><text>coordinate a comprehensive effort to incorporate faith-based and community initiatives in the programs and initiatives of the designated department or agency;</text></paragraph> 
<paragraph id="HB44DFB6513AD45D5A4566ED03257AD5E"><enum>(3)</enum><text>propose initiatives to remove barriers identified pursuant to the review conducted under paragraph (1); </text></paragraph> 
<paragraph id="H907AE3D1339B4E23946301B4C5000097"><enum>(4)</enum><text>propose the development of pilot and demonstration programs to increase the participation of faith-based and community initiatives in Federal, State, and local initiatives; and </text></paragraph> 
<paragraph id="HFECA985D838449F1B2668CD6E392DC44"><enum>(5)</enum><text>develop and coordinate the outreach efforts of the designated department or agency to disseminate information to faith-based and community initiatives with respect to programming changes, contracting opportunities, and other initiatives.</text></paragraph></subsection> 
<subsection id="H7DFD3C8D92F64E30B8D5B055CAEB153E"><enum>(c)</enum><header>Annual report</header><text>Not later than March 31 of each year, each designated department or agency liaison shall submit to the Office an annual report which shall include the following:</text> 
<paragraph id="HB81071E88904476AAEC86820C390F46B" display-inline="no-display-inline"><enum>(1)</enum><text>A description of the efforts by the designated department or agency liaison to carry out the responsibilities under subsection (b).</text></paragraph> 
<paragraph id="HF9FFBD4064B7450EADE0FB758133A97D"><enum>(2)</enum><text>A comprehensive analysis of the barriers to the full participation of faith-based and community initiatives in the delivery of social services pursuant to the review conducted under subsection (b)(1).</text></paragraph> 
<paragraph id="HDD55F6FF3BB8451D92DC27B5A9202E6C"><enum>(3)</enum><text>A summary of information made available to faith-based and community initiatives under subsection (b)(5).</text></paragraph></subsection> 
<subsection id="H9B93259D637B4189941199A7AA755379"><enum>(d)</enum><header>Designated department or agency</header><text>For the purposes of this subsection, <quote>designated department or agency</quote> means a department or agency of the Federal Government with a Center for Faith-Based and Community Initiatives, and shall include the following departments and agencies:</text> 
<paragraph id="HA431BBDEA8704624BC1DE0006934FA16"><enum>(1)</enum><text display-inline="yes-display-inline">The Department of Education.</text></paragraph> 
<paragraph id="H7F5ED488CAE042D19C6BB6C624209D61"><enum>(2)</enum><text>The Department of Labor.</text></paragraph> 
<paragraph id="HC272667769D94B5EBA6D0024A689882C"><enum>(3)</enum><text>The Department of Justice.</text></paragraph> 
<paragraph id="H6D79A606525A4451A2A750DD2686DC71"><enum>(4)</enum><text>The Department of Health and Human Services.</text></paragraph> 
<paragraph id="H545460B60E26417D8D96B121D85406E3"><enum>(5)</enum><text>The Department of Housing and Urban Development.</text></paragraph> 
<paragraph id="H1461B7F136F744B3B14C9508DAFAD64B"><enum>(6)</enum><text>The Department of Agriculture.</text></paragraph> 
<paragraph id="H283218EF7C8B4E7985B56D4CD7FA921"><enum>(7)</enum><text>The Agency for International Development.</text></paragraph> 
<paragraph id="HDAC56F0E66414B20BC65BD72F8117CF3"><enum>(8)</enum><text>The Department of Commerce.</text></paragraph> 
<paragraph id="H61AF0ACD0EF643FE008E14A310D29274"><enum>(9)</enum><text>The Department of Veterans Affairs.</text></paragraph> 
<paragraph id="H8DA28020ECFF4281966770F8C95C0023"><enum>(10)</enum><text>The Small Business Administration.</text></paragraph></subsection> </section> 
<section id="H816310C404FC487C875FE63D4FD2C00"><enum>7.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that—</text> 
<paragraph id="H1B537CC2D6B143A3A0C256E6667ED9BA"><enum>(1)</enum><text display-inline="yes-display-inline">Federal financial assistance for social service programs should be distributed in the most effective and efficient manner possible;</text></paragraph> 
<paragraph id="HCD9740C7662A4838B26636C05BCADB3"><enum>(2)</enum><text>the Nation's social service capability will benefit if all eligible organizations, including faith-based and other community organizations, are able to compete on an equal footing for Federal financial assistance used to support social service programs;</text></paragraph> 
<paragraph id="H15E530D335D847C1B73D4600C31DDCA"><enum>(3)</enum><text>in the administration or distribution of Federal financial assistance, no organization should be discriminated against on the basis of religion or religious belief; </text></paragraph> 
<paragraph id="H71F8EA9A02004DB7B8AAF19B14FEC5D3"><enum>(4)</enum><text>the Federal Government must implement Federal programs in accordance with the establishment clause and the free exercise clause of the first amendment of the Constitution;</text></paragraph> 
<paragraph id="H38154D8B252B4962943D75BC768D9715"><enum>(5)</enum><text>consistent with the free exercise clause and the free speech clause of the Constitution, faith-based organizations should be eligible to receive Federal financial assistance and to participate fully in any social service program supported with Federal financial assistance without impairing their independence, autonomy, expression, or religious character;</text></paragraph> 
<paragraph id="HE8F8468BCE1F4766B7D5EBD13EBFA677"><enum>(6)</enum><text display-inline="yes-display-inline">any organization that receives Federal financial assistance to provide social services should be prohibited from discriminating against beneficiaries or potential beneficiaries of the services it provides on the basis of religion, religious belief, refusal to hold a religious belief, or refusal to participate in a religious practice;</text></paragraph> 
<paragraph id="HA851900F3E754242A9F302204F779E8B"><enum>(7)</enum><text>an organization that engages in inherently religious activities, such as worship, religious instruction, and proselytization, should be eligible to receive Federal financial assistance, provided that the organization offers such religious activities separately in time or location from any program or service supported with direct Federal financial assistance, and that participation in any such religious activity must be voluntary for any beneficiary of a social service program supported with Federal financial assistance;</text></paragraph> 
<paragraph id="H2EFC8DC6AE85416DB38834F6CD2ECEA9"><enum>(8)</enum><text>any faith-based organization that receives Federal financial assistance should be able to retain its independence and to continue to carry out its mission, including the definition, development, practice, and expression of religious beliefs, provided that it does not use Federal financial assistance to support any inherently religious activity, such as worship, religious instruction, or proselytization;</text></paragraph> 
<paragraph id="H7F5D3FAF663647018776EFDB8238032B"><enum>(9)</enum><text>any faith-based organization that receives Federal financial assistance should be able to use its facilities to provide social services supported with Federal financial assistance, without removing or altering religious art, icons, scriptures, or other symbols from these facilities; and</text></paragraph> 
<paragraph id="H1A11755B571A42029F2F84906D67AE57"><enum>(10)</enum><text>any faith-based organization that receives Federal financial assistance should be able to retain any religious terms in the organization's name, take religion into account in selecting board members, and include religious references in any organization mission statements or other chartering or governing documents.</text></paragraph></section>
