<official-title>To amend titles XVIII and XIX of the Social Security Act to provide for coverage under the Medicare and Medicaid Programs of incontinence undergarments.</official-title>

<section id="H62398FEDD383461C900962A3483FC8FB" section-type="section-one"><enum>1.</enum><header>Medicare coverage of incontinence undergarments</header> 
<subsection id="H1E2223D5E3AB4CACA0274D9BEB73A4B3"><enum>(a)</enum><header>Coverage</header><text>Section 1861(s)(2) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(s)(2)</external-xref>) is amended—</text> 
<paragraph id="HFF2E3830C60B4BBEB9D845C95B9C6552"><enum>(1)</enum><text>in subparagraph (Y), by striking <quote>and</quote> at the end;</text></paragraph> 
<paragraph id="H01302D77F5F64F5B9C6660CF84F801C1"><enum>(2)</enum><text>in subparagraph (Z), by adding <quote>and</quote> at the end; and</text></paragraph> 
<paragraph id="H7E547B66FF9042AF8F76C760DEFC5FCF"><enum>(3)</enum><text>by inserting after subparagraph (Z) the following new subparagraph:</text>

<subparagraph indent="up1" id="H48D60216A1414F018D22001F2CCEE17C"><enum>(AA)</enum><text display-inline="yes-display-inline">incontinence undergarments (such as adult diapers);</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H451AB807045C458DA8739B67A6FA6CED"><enum>(b)</enum><header>Effective date</header><text>The amendments made by subsection (a) shall apply to items furnished on or after Janaury 1, 2006.</text></subsection></section> 
<section id="H86C5EA6E33144DD799D02B40A05448DD"><enum>2.</enum><header>Medicaid coverage of incontinence undergarments</header> 
<subsection id="H7B14837EF8ED46108E58A69D3FB294A3"><enum>(a)</enum><header>Requirement</header><text>The first sentence of section 1905(a) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1396d">42 U.S.C. 1396d(a)</external-xref>) is amended—</text> 
<paragraph id="H919E6806E66D45A2A5986FF46BA477F"><enum>(1)</enum><text>by striking <quote>and</quote> at the end of paragraph (27);</text></paragraph> 
<paragraph id="HD0E41293CE204CA783A95C7B005F7D1C"><enum>(2)</enum><text>by striking the period at the end of paragraph (28) and inserting <quote>; and</quote>; and</text></paragraph> 
<paragraph id="H3DBA178AF1DB40BCA837FB4B4FE34747"><enum>(3)</enum><text>by inserting after paragraph (28) the following new paragraph:</text>

<paragraph id="H1472EF6A10284CAA8E2D5C23ED4BA37C"><enum>(29)</enum><text display-inline="yes-display-inline">incontinence undergarments (such as adult diapers).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HC1B8620FBE3A4245850077A9E8F0947"><enum>(b)</enum><header>Effective date</header><text>The amendment made by subsection (a) shall apply to items furnished on or after January 1, 2006.</text></subsection> 
<subsection id="H33A9B454532844F7ADC9004EACD4E732"><enum>(c)</enum><header>State compliance</header><text>In the case of a State plan for medical assistance under title XIX of the <act-name parsable-cite="SSA">Social Security Act</act-name> which the Secretary of Health and Human Services determines requires State legislation (other than legislation authorizing or appropriating funds) in order for the plan to meet the additional requirement imposed by the amendment made by subsection (a), the State plan shall not be regarded as failing to comply with the requirements of such title solely on the basis of its failure to meet this additional requirement before the first day of the first calendar quarter beginning after the close of the first regular session of the State legislature that begins after the date of the enactment of this Act. For purposes of the previous sentence, in the case of a State that has a 2-year legislative session, each year of such session shall be deemed to be a separate regular session of the State legislature.</text></subsection></section>
