<section section-type="section-one" id="HDAC546A4C9764757AEB0637ED500BFA0" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Ombudsman Reauthorization Act of 2005</short-title></quote>.</text></section> 
<section id="HDB35C796448F444EA665A75CBDF8713"><enum>2.</enum><header>Office of Ombudsman</header><text display-inline="no-display-inline">The <act-name parsable-cite="SWDA">Solid Waste Disposal Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/6901">42 U.S.C. 6901 et seq.</external-xref>) is amended by striking section 2008 (<external-xref legal-doc="usc" parsable-cite="usc/42/6917">42 U.S.C. 6917</external-xref>) and inserting the following:</text>

<section id="H9E2CDBB1941B498EBCA5DDD20670C332"><enum>2008.</enum><header>Office of Ombudsman</header> 
<subsection id="H1231FC64A3C642D6B2A46FCD8729272"><enum>(a)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="HB644DC5C710C49FCAA4227F466379164"><enum>(1)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator of the Environmental Protection Agency. </text></paragraph> 
<paragraph id="H54B53A80FD124A8A981B468BE29DFA87"><enum>(2)</enum><header>Agency</header><text>The term <term>Agency</term> means the Environmental Protection Agency.</text></paragraph> 
<paragraph id="H3AE8AF92E3134025A0B9A31D99A2BF8B"><enum>(3)</enum><header>Deputy Ombudsman</header><text>The term <term>Deputy Ombudsman</term> means any individual appointed by the Ombudsman under subsection (e)(1)(A)(i).</text></paragraph> 
<paragraph id="HFC62D29655EC479E99D71789A3248143"><enum>(4)</enum><header>Office</header><text>The term <term>Office</term> means the Office of the Ombudsman established by subsection (b)(1).</text></paragraph> 
<paragraph id="HF6D455362FBF49AAA69C872CF42BDD9E"><enum>(5)</enum><header>Ombudsman</header><text>The term <term>Ombudsman</term> means the director of the Office.</text></paragraph></subsection> 
<subsection id="HB6F7A36DA2B74C7CB0BF74257C6634A9"><enum>(b)</enum><header>Establishment</header> 
<paragraph id="HDC8B7B815D18428BB180BA95ADD16794"><enum>(1)</enum><header>In general</header><text>There is established within the Agency an office to be known as the <quote>Office of the Ombudsman</quote>.</text></paragraph> 
<paragraph id="HA4AEC3FCA49347CA9FA600A8453442D0"><enum>(2)</enum><header>Oversight</header> 
<subparagraph id="H9C45347E58574F1E954B52F36FF1CBF3"><enum>(A)</enum><header>In general</header><text>The Office shall be an independent office within the Agency.</text></subparagraph> 
<subparagraph id="H19E662AC7D6F4C35AE1C3923023BBE72"><enum>(B)</enum><header>Structure</header><text>To the maximum extent practicable, the structure of the Office shall conform to relevant professional guidelines, standards, and practices.</text></subparagraph></paragraph> 
<paragraph id="H6C22C1A295574981B13FDB6602E2918F"><enum>(3)</enum><header>Head of Office</header> 
<subparagraph id="HD46E219857EE47B1004BC273F242CD92"><enum>(A)</enum><header>Ombudsman</header><text>The Office shall be directed by an Ombudsman, who shall be appointed by and report directly to the Administrator.</text></subparagraph> 
<subparagraph id="HF289D3C84C64466CB41026DED5E7504"><enum>(B)</enum><header>Applicability of certain civil service laws</header><text>The Ombudsman shall be appointed subject to the provisions of title 5, United States Code, governing appointments in the competitive service, and shall be paid at the rate of basic pay for GS–15 of the General Schedule.</text></subparagraph> 
<subparagraph id="HE5874DB3B0F34594B06FB51353B8DE59"><enum>(C)</enum><header>Qualifications for and restrictions on employment</header><text display-inline="yes-display-inline">A person appointed as Ombudsman—</text> 
<clause id="H2BCC042D3C0B4DAFBCB999A4159B275"><enum>(i)</enum><text>shall be a person of recognized judgment, objectivity, and integrity who is well-equipped to analyze problems of law, administration, and public policy;</text></clause> 
<clause id="H1DB3EDA7BA6047EBA3E9C272B9BD0651"><enum>(ii)</enum><text>shall not have been an employee of the Agency at any time during the 1-year period before the date of appointment;</text></clause> 
<clause id="HD45E125B8346461982FFC8B04DED1359"><enum>(iii)</enum><text>shall not have received any grant, loan, or contract (other than an employment contract permissible under clause (ii)) from the Agency during the 5-year period before the date of appointment; and</text></clause> 
<clause id="H41251E7E924B4EC59FE33674091121D3"><enum>(iv)</enum><text>while serving as Ombudsman, shall not—</text> 
<subclause id="HE1AAC65EC1C843CA94A6B120B12988B6"><enum>(I)</enum><text>be actively involved in political party activities or publicly endorse, solicit funds for, or make contributions to political parties or candidates for elective office;</text></subclause> 
<subclause id="H46448096288D471780469EAEFD3FC777"><enum>(II)</enum><text>be a candidate for or hold any other elective or appointive public office; or</text></subclause> 
<subclause id="H66BF105C4CE94B5D8B65F668D700F200"><enum>(III)</enum><text>engage in any other occupation, business, or profession likely to detract from the full-time performance of his or her duties as Ombudsman or to result in a conflict of interest or an appearance of impropriety or partiality.</text></subclause></clause></subparagraph> 
<subparagraph id="H9985BD1118144D4A8E0998D0B2BCE885"><enum>(D)</enum><header>Term</header><text>The Ombudsman—</text> 
<clause id="HFCFC4A883257401EAB10B6A3003E00F"><enum>(i)</enum><text>shall serve for a term of 5 years; and</text></clause> 
<clause id="H4C90662FFB7E481399731B6FB2AF79F4"><enum>(ii)</enum><text>may be reappointed for not more than 1 additional term.</text></clause></subparagraph> 
<subparagraph id="H088E0691A049423FBE5B5E95007DA6AC"><enum>(E)</enum><header>Removal</header> 
<clause id="H3261D05A355E4B569000A4B375146DBF"><enum>(i)</enum><header>In general</header><text>The Administrator may remove or suspend the Ombudsman from office only for neglect of duty or malfeasance in office.</text></clause> 
<clause id="H103094E6ED9545889F004571D61B4260"><enum>(ii)</enum><header>Communication to Congress</header><text>If the Administrator removes or suspends the Ombudsman, the Administrator shall communicate the reasons for the removal or suspension to Congress.</text></clause></subparagraph></paragraph></subsection> 
<subsection id="H16C39DC4DAFF4E1B846296AD5171BED4"><enum>(c)</enum><header>Duties</header><text>The Ombudsman shall—</text> 
<paragraph id="HCE9A3237C7884713A03F62352480B093"><enum>(1)</enum><text>receive, and render assistance concerning, any complaint, grievance, or request for information submitted by any person relating to any program or requirement of the Agency; and</text></paragraph> 
<paragraph id="HA8BBAC9218954BB19230AF0040E34F40"><enum>(2)</enum><text>conduct investigations, make findings of fact, and make nonbinding recommendations to the Administrator concerning the program or requirement of the Agency.</text></paragraph></subsection> 
<subsection id="HE5C4196120634C2494F782434088D99"><enum>(d)</enum><header>Powers and responsibilities</header><text>In carrying out this section, the Ombudsman—</text> 
<paragraph id="H7FB6B2460B79493BBDFF91D109D3AC2E"><enum>(1)</enum><text>may investigate any action of the Agency without regard to the finality of the action;</text></paragraph> 
<paragraph id="H569F0F508679427092A73881B2ADC49"><enum>(2)</enum><text>may select appropriate matters for action by the Office;</text></paragraph> 
<paragraph id="H5057103DCE514AAC8D3ED2E223B804C"><enum>(3)</enum><text>may—</text> 
<subparagraph id="H3CAB93C024B7442D83F8F2A2F38ED600"><enum>(A)</enum><text>prescribe the methods by which complaints shall be made to, and received and addressed by, the Office;</text></subparagraph> 
<subparagraph id="H1A38D05CE24241A3BE00A83FD5BE9B6C"><enum>(B)</enum><text>determine the scope and manner of investigations made by the Office; and</text></subparagraph> 
<subparagraph id="H59FF959D61FC4A8C92C0004F22683885"><enum>(C)</enum><text>determine the form, frequency, and distribution of conclusions and recommendations of the Office;</text></subparagraph></paragraph> 
<paragraph id="H5D8CBDD924BB49F6AF6F17159208F2D5"><enum>(4)</enum><text>may request the Administrator to provide the Ombudsman notification, within a specified period of time, of any action taken on a recommendation of the Ombudsman;</text></paragraph> 
<paragraph id="HF5F88E8023D242EBB09BCE8398271901"><enum>(5)</enum><text>may request, and shall be granted by any Federal agency or department, assistance and information that the Ombudsman determines to be necessary to carry out this section;</text></paragraph> 
<paragraph id="HA8E0DA0D59B64BFDAD4706DC2B669D57"><enum>(6)</enum><text>may examine any record of, and enter and inspect any property under the administrative jurisdiction of—</text> 
<subparagraph id="H0FA86C8C3C2241BC921E87A914DD0424"><enum>(A)</enum><text>the Agency; or</text></subparagraph> 
<subparagraph id="HF3FF5F59FEDB40F7BEEC5F28E4740C"><enum>(B)</enum><text>any other Federal agency or department involved in a matter under the administrative jurisdiction of the Agency;</text></subparagraph></paragraph> 
<paragraph id="H250039B88428461E9EEFAF41E0338C00"><enum>(7)</enum><text>may—</text> 
<subparagraph id="H39A582A51CF645EC864CD6A569B1F868"><enum>(A)</enum><text>issue a subpoena to compel any person to appear to give sworn testimony concerning, or to produce documentary or other evidence determined by the Ombudsman to be reasonable in scope and relevant to, an investigation by the Office; and</text></subparagraph> 
<subparagraph id="H412A47EFA3B348E8BCF81419DA6157BA"><enum>(B)</enum><text>seek enforcement of a subpoena issued under subparagraph (A) in a court of competent jurisdiction;</text></subparagraph></paragraph> 
<paragraph id="H048AB76E31E14074B13E0034FB7E92E3"><enum>(8)</enum><text>may carry out and participate in, and cooperate with any person or agency involved in, any conference, inquiry on the record, public hearing on the record, meeting, or study that, as determined by the Ombudsman—</text> 
<subparagraph id="HD223399EB29C443990533E1FDBF53317"><enum>(A)</enum><text>is material to an investigation conducted by the Ombudsman; or</text></subparagraph> 
<subparagraph id="H95C88107AE7F4868AE6C1B1995DE00F3"><enum>(B)</enum><text>may lead to an improvement in the performance of the functions of the Agency;</text></subparagraph></paragraph> 
<paragraph id="H5E1D76CB5BB94214B03F073288E108AF"><enum>(9)</enum><text>may administer oaths and hold hearings in connection with any matter under investigation by the Office;</text></paragraph> 
<paragraph id="HB58C259A386E4035B29D0085E7FAB9E"><enum>(10)</enum><text>may engage in alternative dispute resolution, mediation, or any other informal process that the Ombudsman determines to be appropriate to carry out this section;</text></paragraph> 
<paragraph id="H627486C93BA14EA19EB8EDDD34C52A"><enum>(11)</enum><text>may communicate with any person, including Members of Congress, the press, and any person that submits a complaint, grievance, or request for information under subsection (c)(1); and</text></paragraph> 
<paragraph id="H6A07BB2132E74DA9B8C5B9B71C008C9E"><enum>(12)</enum><text>shall administer a budget for the Office.</text></paragraph></subsection> 
<subsection id="H090780D3BAF64174B1786D4236D6EC95"><enum>(e)</enum><header>Administration</header> 
<paragraph id="H1425886C0D3E457FA0B6FADB01BD00F0"><enum>(1)</enum><header>In general</header><text>The Ombudsman shall—</text> 
<subparagraph id="H7152903AB3ED4617938B73009F611B29"><enum>(A)</enum> 
<clause display-inline="yes-display-inline" id="HEAAE251852F84A21BABC06D3FF865A2"><enum>(i)</enum><text>appoint a Deputy Ombudsman for each region of the Agency; and</text></clause> 
<clause indent="up1" id="H65BAECB9A83F470FB8237D97945BD8FB"><enum>(ii)</enum><text>hire such other assistants and employees as the Ombudsman determines to be necessary to carry out this section; and</text></clause></subparagraph> 
<subparagraph id="H54C674C5E1AD44C1BE52075537898103"><enum>(B)</enum><text>supervise, evaluate, and carry out personnel actions (including hiring and dismissal) with respect to any employee of the Office.</text></subparagraph></paragraph> 
<paragraph id="H754C53D0A31F4A238B5E25D82CD09F13"><enum>(2)</enum><header>Delegation of authority</header><text>The Ombudsman may delegate to other employees of the Office any responsibility of the Ombudsman under this section except—</text> 
<subparagraph id="H1295B57AE2B743C1B357102CDB54D44"><enum>(A)</enum><text>the power to delegate responsibility;</text></subparagraph> 
<subparagraph id="HBD41CACB24854D2CAFD1580022B31D07"><enum>(B)</enum><text>the power to issue subpoenas; and</text></subparagraph> 
<subparagraph id="H2BDE5754D5834EED8B233CC7460625B0"><enum>(C)</enum><text>the responsibility to make recommendations to the Administrator.</text></subparagraph></paragraph> 
<paragraph id="HC73B77D450B444F589250081BCA27763"><enum>(3)</enum><header>Contact information</header><text>The Ombudsman shall maintain, in each region of the Agency, a telephone number, facsimile number, electronic mail address, and post office address for the Ombudsman that are different from the numbers and addresses of the regional office of the Agency located in that region.</text></paragraph> 
<paragraph id="HDF33F4E83424402A99F48FAEF9D4F"><enum>(4)</enum><header>Reports</header><text>The Ombudsman—</text> 
<subparagraph id="HF46BB9BAA26D49CFB8745CD8806CA1B1"><enum>(A)</enum><text>shall, at least annually, publish in the Federal Register and submit to the Administrator, the President, the Committee on Energy and Commerce of the House of Representatives, and the Committee on Environment and Public Works of the Senate a report on the status of health and environmental concerns addressed in complaints and cases brought before the Ombudsman in the period of time covered by the report;</text></subparagraph> 
<subparagraph id="H679750E3C3454E2A99D6C6A823B273ED"><enum>(B)</enum><text>may issue reports, conclusions, or recommendations concerning any other matter under investigation by the Office;</text></subparagraph> 
<subparagraph id="HBC93EE2E175142A194ABA2DCEC56121C"><enum>(C)</enum><text>shall solicit comments from the Agency concerning any matter under investigation by the Office; and</text></subparagraph> 
<subparagraph id="H3CDB16F89A5C4B4A9274FBD73D95E891"><enum>(D)</enum><text>shall include any comments received by the Office in written reports, conclusions, and recommendations issued by the Office under this section.</text></subparagraph></paragraph></subsection> 
<subsection id="H77705A8930DC4A34AAFEC2C276431B4"><enum>(f)</enum><header>Penalties</header><text>An investigation conducted by the Ombudsman under this section constitutes—</text> 
<paragraph id="HE89E34CE9E1442CB8006F7DC709638F3"><enum>(1)</enum><text>a matter under <external-xref legal-doc="usc" parsable-cite="usc/18/1001">section 1001</external-xref> of title 18, United States Code; and</text></paragraph> 
<paragraph id="H082DC4EC0B2C43768486A33385E64406"><enum>(2)</enum><text>a proceeding under <external-xref legal-doc="usc" parsable-cite="usc/18/1505">section 1505</external-xref> of title 18, United States Code.</text></paragraph></subsection> 
<subsection id="H3EB5132B562140C3AB1B6B231C7C7538"><enum>(g)</enum><header>Employee protection</header> 
<paragraph id="HA64D5E90B8DC4380B8ED69403288D4B7"><enum>(1)</enum><header>In general</header><text>No employer may discharge any employee, or otherwise discriminate against any employee with respect to compensation, terms, conditions, or privileges of employment of the employee, because the employee (or any person acting at the request of the employee) complied with any provision of this section.</text></paragraph> 
<paragraph id="H983E18940155458DA6C702A8E0AE3169"><enum>(2)</enum><header>Complaint</header><text>Any employee that, in the opinion of the employee, is discharged or otherwise discriminated against by any person in violation of paragraph (1) may, not later than 180 days after the date on which the violation occurs, file a complaint in accordance with section 211 of the Energy Reorganization Act of 1974.</text></paragraph></subsection> 
<subsection id="H6CF454AB6A5241738F2EE217F59DF631"><enum>(h)</enum><header>Applicability</header> 
<paragraph id="HC1D9289941514EA9A40000B2537E5B93"><enum>(1)</enum><header>In general</header><text>This section—</text> 
<subparagraph id="H4D941B697D6E4A5381458C61C8F0B0E8"><enum>(A)</enum><text>does not limit any remedy or right of appeal; and</text></subparagraph> 
<subparagraph id="HC70DAA2DE9904FAA95ED785CDE07748"><enum>(B)</enum><text>may be carried out notwithstanding any provision of law to the contrary that provides that an agency action is final, not reviewable, or not subject to appeal.</text></subparagraph></paragraph> 
<paragraph id="HF7BB7E3D2FF741CA9985DCD5A66F2B00"><enum>(2)</enum><header>Effect on procedures for grievances, appeals, or administrative matters</header><text>The establishment of the Office does not affect any procedure concerning grievances, appeals, or administrative matters under this Act or any other law (including regulations).</text></paragraph></subsection> 
<subsection id="H849C420DC6AD49B5B68886C4E298D65B"><enum>(i)</enum><header>Separate line item</header><text>In submitting the annual budget for the Federal Government to Congress, the President shall include a separate line item for the funding for the Office.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section>
