<official-title>To amend the Social Security Act to provide each American child with a KidSave Account, and for other purposes.</official-title>

<section section-type="section-one" id="H6843F3F83F71433A9083E897053369F6" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Social Security KidSave Accounts Act</short-title></quote>.</text></section> 
<section id="HBD7A302D0384463585E63476E654D565"><enum>2.</enum><header>Social Security KidSave Accounts</header> <text display-inline="no-display-inline">Title II of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/401">42 U.S.C. 401 et seq.</external-xref>) is amended—</text> 
<paragraph id="H8DC534BF61644352BAF7B2734E378500"><enum>(1)</enum><text>by inserting before section 201 the following:</text>

<paragraph id="H2126DC7E2B044FC3ADCFB0BD4CF2CF41"><enum></enum><text>and</text></paragraph> 
<paragraph id="H8DEB643778E643DBB25E6D5BD9A464A5"><enum>(2)</enum><text>by adding at the end the following:</text>

<part id="H62A7E89973E24F30B213F227303939A0"><enum>B</enum><header>KidSave Accounts</header> 
<section id="H038199C8761A40498D71836444E6C7B3"><enum>251.</enum><header>Establishment of KidSave Accounts</header> 
<subsection display-inline="yes-display-inline" id="H49EEC0CA50C04BCCB895BF13D2903800"><enum>(a)</enum><header>In general</header><text>The Commissioner of Social Security, through the Federal Retirement Thrift Investment Board, shall establish in the name of each individual born on or after January 1, 2006, a KidSave Account in the Thrift Savings Fund under subchapter III of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/84">chapter 84</external-xref> of title 5, United States Code, upon the later of—</text> 
<paragraph id="HED9917B274B14C879F03F8D1C2430475"><enum>(1)</enum><text>the date of enactment of this part; or</text></paragraph> 
<paragraph id="HE5D1562005A64B6C82F512871C4BA8D"><enum>(2)</enum><text>the date of the issuance of a social security account number under section 205(c)(2) to such individual.</text></paragraph></subsection> 
<subsection id="H3C9D63F8156240D3BF1EF37B00D767C0"><enum>(b)</enum><header>Identification of Account</header><text>The KidSave Account shall be identified to the account holder by means of the account holder’s social security account number.</text></subsection></section> 
<section id="HC38CC225CBCA4131AA206519FCBC10D"><enum>252.</enum><header>Treatment of KidSave Accounts</header> 
<subsection display-inline="yes-display-inline" id="HB14208F299CE4239BDFC2F0099FDDC2B"><enum>(a)</enum><header>In general</header><text>For purposes of this part, except as provided in subsection (b), a KidSave Account described in section 251(a) shall be treated in the same manner as an account in the Thrift Savings Fund under subchapter III of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/84">chapter 84</external-xref> of title 5, United States Code.</text></subsection> 
<subsection id="HDB70957378184ABD9601BF13A2B84200"><enum>(b)</enum><header>Exceptions</header> 
<paragraph id="H1046FF9C5CCE4F189100674017822202"><enum>(1)</enum><header>Contribution rules</header> 
<subparagraph id="H5732E7C1E742455183A0F400B476CBC2"><enum>(A)</enum><header>Loan contributions</header> 
<clause id="HAFC022F9523F40409C0918AE6C0015F2"><enum>(i)</enum><header>In general</header><text>In addition to any contributions to a KidSave Account by or on behalf of an individual described in subparagraph (B), the Secretary of the Treasury shall transfer $2,000 to such Account from the Federal Old-Age and Survivors Insurance Trust Fund on the date of the establishment of such Account under subsection (a).</text></clause> 
<clause id="HA857E90C4483432100FA75D52C56EA51"><enum>(ii)</enum><header>Adjustment for inflation</header><text>For any calendar year after 2013, the dollar amount under clause (i) shall be increased by the cost-of-living adjustment determined under section 215(i) for the calendar year.</text></clause></subparagraph> 
<subparagraph id="H385486ADCEA1435B89F1D119E9876867"><enum>(B)</enum><header>Other contributions</header> 
<clause id="HCE627427812D4D859BCA1453C31EDF10"><enum>(i)</enum><header>Contribution limit</header><text>The aggregate amount of contributions by or on behalf of an individual (including rollover contributions) for any taxable year to the KidSave Account of such individual shall not exceed $500 for such year (determined without regard to the amount of the contribution made pursuant to subparagraph (A)).</text></clause> 
<clause id="H650CB931735342CCB35CA91541D8AFD7"><enum>(ii)</enum><header>Rollover contributions</header><text>No rollover contribution may be made to a KidSave Account of an individual unless it is from an eligible retirement plan described in clause (i), (ii), or (iii) of <external-xref legal-doc="usc" parsable-cite="usc/26/402">section 402(c)(8)(B)</external-xref> of the Internal Revenue Code of 1986 of such individual or of a parent or grandparent of such individual. For purposes of chapters 12 and 13 of the Internal Revenue Code of 1986 (relating to gift tax and tax on generation-skipping transfers), in no event shall a rollover contribution under this clause be treated as a taxable gift.</text></clause> 
<clause id="H1BA9AF386E6D42039D46B49908986597"><enum>(iii)</enum><header>No contributions past the age of 18</header><text>No contribution (including rollover contribution) may be made to a KidSave Account of an individual after the date on which such individual attains the age of 19.</text></clause> 
<clause id="HEA421B6BBAC446579E2419BE2100F933"><enum>(iv)</enum><header>Direct deposits</header><text>The Secretary of the Treasury shall, under regulations, provide for the direct deposit of any overpayment of Federal tax of an individual or of a parent or grandparent of such individual as a contribution to the KidSave Account of such individual.</text></clause></subparagraph></paragraph> 
<paragraph id="HF4C5B0A65C3C4D40AE00F9EBCF40150"><enum>(2)</enum><header>Designations regarding KidSave Account investments</header> 
<subparagraph id="H695E31B2B7564B29B6DB014216892F"><enum>(A)</enum><header>Initial designations of investment Fund</header><text>A person described in subsection (c) shall, on behalf of the individual described in section 251(a), designate 1 or more investment funds (established under <external-xref legal-doc="usc" parsable-cite="usc/5/8438">section 8438</external-xref> of title 5, United States Code) for the KidSave Account to which contributions by or on behalf of such individual are to be deposited. Such designation shall be made on the application for such individual’s social security account number.</text></subparagraph> 
<subparagraph id="H8BB424C29D1E407183DE78EBFBCE6390"><enum>(B)</enum><header>Default designation</header><text>In the absence of any designation under subparagraph (A), the contributions by or on behalf of an individual described in section 251(a) shall be deposited—</text> 
<clause id="H8E2296B027474F77A1648315CBB30669"><enum>(i)</enum><text>60 percent in the Common Stock Index Investment Fund established under <external-xref legal-doc="usc" parsable-cite="usc/5/8438">section 8438(b)(1)(C)</external-xref> of title 5, United States Code;</text></clause> 
<clause id="HDB1AD4B4960F47539ECDBA54AAF9DC65"><enum>(ii)</enum><text>20 percent in the Fixed Income Investment Fund established under section 8438(b)(1)(B) of such title; and</text></clause> 
<clause id="H92E0A5C37A3B4C88BC181E46CDDFAE18"><enum>(iii)</enum><text>20 percent in the Government Securities Investment Fund established under section 8438(b)(1)(A) of such title.</text></clause></subparagraph> 
<subparagraph id="H350DBB926E3D46D29EE01BB56E69B1B1"><enum>(C)</enum><header>Changes in designations</header><text>An individual who has attained age 18 or a person described in subsection (c) on behalf of such individual may change 1 or more investment designations for a KidSave Account of such individual at the same time and in the same manner as provided under subchapter III of chapter 84 of such title.</text></subparagraph></paragraph> 
<paragraph id="HE36D5BBFEB97422CA611EAF22DF862EE"><enum>(3)</enum><header>Distributions</header> 
<subparagraph id="H09C712BBE7E144769C76F54BAAEF38E5"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), distributions may only be made from a KidSave Account of an individual on or after the earlier of—</text> 
<clause id="H986D3BC705CC457191B6A856DF02C420"><enum>(i)</enum><text>the date on which the individual begins receiving benefits under part A; or</text></clause> 
<clause id="H3AECE2CFA8E64BFAB1E4DE00C9160079"><enum>(ii)</enum><text>the date of the individual’s death.</text></clause></subparagraph> 
<subparagraph id="HD78D50049671421186D2AAD56F31F6FA"><enum>(B)</enum><header>Repayment of contribution loan</header> 
<clause id="HFDFCDF6A32A44C2C93CBDC69E6252B81"><enum>(i)</enum><header>In general</header><text>On the date on which an individual described in section 251(a) attains age 30 and on such date in each succeeding calendar year (as necessary), the Federal Retirement Thrift Investment Board shall transfer from the KidSave Account of such individual to the Federal Old-Age and Survivors Insurance Trust Fund an amount equal to the least of the following amounts:</text> 
<subclause id="H14504D0568914AD0909894EDD96509E6"><enum>(I)</enum><text>20 percent of the applicable amount.</text></subclause> 
<subclause id="H9EA011EB7F744E3F94F6E70103182F08"><enum>(II)</enum><text>20 percent of the balance in such KidSave Account.</text></subclause> 
<subclause id="H6B5ABD2FC12D45A1ACC9F3ED22DE4982"><enum>(III)</enum><text>An amount equal to the excess of the applicable amount over the aggregate amount deducted under this clause in all preceding calendar years with respect to such individual.</text></subclause></clause> 
<clause id="H9B1C597799E14CADB881A553F23B1051"><enum>(ii)</enum><header>Applicable amount</header><text>With respect to any individual described in clause (i), the applicable amount is equal to the amount transferred by the Secretary of the Treasury to such KidSave Account under paragraph (1)(A).</text></clause></subparagraph></paragraph></subsection> 
<subsection id="H16EC2D5939214F3B845B54BEF95B286C"><enum>(c)</enum><header>Treatment of minors and incompetent individuals</header> 
<paragraph id="H40A16CF23B454D0F8549E34FC48EF249"><enum>(1)</enum><header>Designations</header><text>Any designation under subsection (b)(2) to be made by a minor, or an individual mentally incompetent or under other legal disability, may be made by the person who is constituted guardian or other fiduciary by the law of the State of residence of the individual or is otherwise legally vested with the care of the individual or his estate.</text></paragraph> 
<paragraph id="H0569EA66F49C494A9700AC8EEA71F4B4"><enum>(2)</enum><header>Distributions</header><text>Payment under this part due a minor, or an individual mentally incompetent or under other legal disability, may be made to the person who is constituted guardian or other fiduciary by the law of the State of residence of the claimant or is otherwise legally vested with the care of the claimant or his estate.</text></paragraph> 
<paragraph id="HAA0BB5DA24494DBC004685CCBC65CD00"><enum>(3)</enum><header>Other persons designated</header><text>In any case in which a guardian or other fiduciary of the individual under legal disability has not been appointed under the law of the State of residence of the individual, if any other person, in the judgment of the Commissioner, is responsible for the care of such individual, any designation under subsection (b)(2) which may otherwise be made by such individual may be made by such person, any payment under this part which is otherwise payable to such individual may be made to such person, and the payment of an annuity payment under this part to such person bars recovery by any other person.</text></paragraph></subsection></section> 
<section id="HA4A6955D619A45E1819B00A3D4ED8F4"><enum>253.</enum><header>Treatment of Thrift Savings Fund</header><text display-inline="yes-display-inline">For purposes of subchapter III of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/84">chapter 84</external-xref> of title 5, United States Code, the KidSave Accounts established in the Thrift Savings Fund under section 251 shall be separately maintained and accounted for by the Federal Retirement Thrift Investment Board from the accounts established under such subchapter in such Fund.</text></section></part><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="H6F90C44B3FFB4F54BBAD3092E6C400D3"><enum>3.</enum><header>Conforming amendments</header> 
<subsection id="HBE4D1AF39DDA4FD1AC6853AEC4597C9B"><enum>(a)</enum><header>Amendments relating to rollovers</header> 
<paragraph id="HD55D51D524C64DB5003997B00D5C794"><enum>(1)</enum><text><external-xref legal-doc="usc" parsable-cite="usc/26/402">Section 402(c)(1)</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following new sentence: <quote>For purposes of the preceding sentence, a rollover contribution to a KidSave Account under section 252(b)(1)(B)(ii) of the <act-name parsable-cite="SSA">Social Security Act</act-name> with respect to an employee who is a parent or grandparent of the beneficiary of such account shall be treated as a distribution to such employee.</quote>. </text></paragraph> 
<paragraph id="H1A20EA824DB14B7196DEBC4E867EE2D"><enum>(2)</enum><text>Section 402(c)(5) of such Code is amended by striking <quote>(i) or (ii)</quote> and inserting <quote>(i), (ii), or (vii)</quote>.</text></paragraph> 
<paragraph id="H45C16A58F9C44546B4952EF8F69854C1"><enum>(3)</enum><text>Section 402(c)(8)(B) of such Code is amended by striking <quote>and</quote> at the end of clause (v), by striking the period at the end of clause (vi) and inserting <quote>, and</quote>, and by adding at the end the following new clause:</text>

<paragraph id="H5B6AA14DBD804EB1A180F0FF10D87581"><enum>(4)</enum><text>Section 408(d)(3)(A)(i) of such Code is amended by inserting <quote>, or is paid into a KidSave Account of a beneficiary under section 252(b)(1)(B)(ii) of the <act-name parsable-cite="SSA">Social Security Act</act-name> with respect to whom such individual is the parent or grandparent,</quote> after <quote>such individual</quote>.</text></paragraph></subsection>
