		<section id="ID7D098B49B2614109A4E247527949BAF9" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote>Copyright Royalty Judges Program Technical Corrections
			 Act</quote>.</text>
		</section><section id="IDA19BB6B27FDF457D9E0DA303C9374724"><enum>2.</enum><header>Reference</header><text display-inline="no-display-inline">Any reference in this Act to a provision of
			 title 17, United States Code, refers to such provision as amended by the
			 Copyright Royalty and Distribution Reform Act of 2004 (<external-xref legal-doc="public-law" parsable-cite="pl/108/419">Public Law 108–419</external-xref>) and
			 the Satellite Home Viewer Extension and Reauthorization Act of 2004 (title IX
			 of division J of <external-xref legal-doc="public-law" parsable-cite="pl/108/447">Public Law 108–447</external-xref>).</text>
		</section><section id="ID48636E3194B84274AC30BA5C96FF1100"><enum>3.</enum><header>Amendments to
			 chapter <enum-in-header>8</enum-in-header> of title
			 <enum-in-header>17</enum-in-header>, United States Code</header><text display-inline="no-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/17/8">Chapter 8</external-xref> of title 17, United States Code,
			 is amended as follows:</text>
			<paragraph id="ID97B1B1BEE4A147BA8D25BC94F18FCF23"><enum>(1)</enum><text>Section 801(b)(1)
			 is amended, in the matter preceding subparagraph (A), by striking <quote>119
			 and 1004</quote> and inserting <quote>119, and 1004</quote>.</text>
			</paragraph><paragraph id="ID46C31176075A4960A0A296B9803FEF70"><enum>(2)</enum><text>Section 801 is
			 amended by adding at the end the following:</text>
				<quoted-block id="IDED611137DD644D09BD3D2D5E702DAF78" style="OLC">
					<subsection id="ID7139FB709D2A4FE4A9C4761957F56349"><enum>(f)</enum><header>Effective Date
				of Actions</header><text>On and after the date of the enactment of the
				Copyright Royalty and Distribution Reform Act of 2004, in any case in which
				time limits are prescribed under this title for performance of an action with
				or by the Copyright Royalty Judges, and in which the last day of the prescribed
				period falls on a Saturday, Sunday, holiday, or other nonbusiness day within
				the District of Columbia or the Federal Government, the action may be taken on
				the next succeeding business day, and is effective as of the date when the
				period
				expired.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph><paragraph id="IDFD8F4BDD69F2410FA561C1F584803341"><enum>(3)</enum><text>Section
			 802(f)(1)(A) is amended—</text>
				<subparagraph id="ID2C236D4B768D46F39ED1FF74C8028104"><enum>(A)</enum><text>in clause (i), by
			 striking <quote>clause (ii) of this subparagraph and subparagraph (B)</quote>
			 and inserting <quote>subparagraph (B) and clause (ii) of this
			 subparagraph</quote>; and</text>
				</subparagraph><subparagraph id="ID1023B75DD635409C8E19262AD9162AA3"><enum>(B)</enum><text>by striking
			 clause (ii) and inserting the following:</text>
					<quoted-block id="ID9C81C48F58DF4AD688A2DE495CF845E5" style="OLC">
						<clause id="ID4E75D94B3E62421D81160F7A335A00C7" indent="up1"><enum>(ii)</enum><text>One or more Copyright Royalty
				Judges may, or by motion to the Copyright Royalty Judges, any participant in a
				proceeding may, request from the Register of Copyrights an interpretation of
				any material questions of substantive law that relate to the construction of
				provisions of this title and arise in the course of the proceeding. Any request
				for a written interpretation shall be in writing and on the record, and
				reasonable provision shall be made to permit participants in the proceeding to
				comment on the material questions of substantive law in a manner that minimizes
				duplication and delay. Except as provided in subparagraph (B), the Register of
				Copyrights shall deliver to the Copyright Royalty Judges a written response
				within 14 days after the receipt of all briefs and comments from the
				participants. The Copyright Royalty Judges shall apply the legal interpretation
				embodied in the response of the Register of Copyrights if it is timely
				delivered, and the response shall be included in the record that accompanies
				the final determination. The authority under this clause shall not be construed
				to authorize the Register of Copyrights to provide an interpretation of
				questions of procedure before the Copyright Royalty Judges, the ultimate
				adjustments and determinations of copyright royalty rates and terms, the
				ultimate distribution of copyright royalties, or the acceptance or rejection of
				royalty claims, rate adjustment petitions, or petitions to participate in a
				proceeding.</text>
						</clause><after-quoted-block>.</after-quoted-block></quoted-block>
				</subparagraph></paragraph><paragraph id="IDC6B3543BAFA34BDC818B161209DE02C1"><enum>(4)</enum><text>Section
			 802(f)(1)(D) is amended by inserting a comma after <quote>undertakes to consult
			 with</quote>.</text>
			</paragraph><paragraph id="IDACEC58B9943E4413AC0D1C4EBA93519D"><enum>(5)</enum><text>Section 803(a)(1)
			 is amended—</text>
				<subparagraph id="IDA73FC958A47C4E3C9AD9EBABA6912C42"><enum>(A)</enum><text>by striking
			 <quote>The Copyright</quote> and inserting <quote>The Copyright Royalty Judges
			 shall act in accordance with this title, and to the extent not inconsistent
			 with this title, in accordance with subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/5">chapter 5</external-xref> of title 5, in
			 carrying out the purposes set forth in section 801. The Copyright</quote>;
			 and</text>
				</subparagraph><subparagraph id="IDD5CEB5169F944135A004E02BD7371098"><enum>(B)</enum><text>by inserting
			 after <quote>Congress, the Register of Copyrights,</quote> the following:
			 <quote>copyright arbitration royalty panels (to the extent those determinations
			 are not inconsistent with a decision of the Librarian of Congress or the
			 Register of Copyrights),</quote>.</text>
				</subparagraph></paragraph><paragraph id="IDD1EAC45625EA4A14A18FCB1CD5143E10"><enum>(6)</enum><text>Section 803(b) is
			 amended—</text>
				<subparagraph id="ID75961105929547198D83D382525C1733"><enum>(A)</enum><text>in paragraph
			 (1)(A)(i)(V)—</text>
					<clause id="IDCDC119A5E36942CB98B6DCAF6701AA36"><enum>(i)</enum><text>by
			 striking <quote>in the case of</quote> and inserting <quote>the publication of
			 notice requirement shall not apply in the case of</quote>; and</text>
					</clause><clause id="ID9A2990DC00984A8E810DBBF24734E78B"><enum>(ii)</enum><text>by
			 striking <quote>, such notice may not be published.</quote>;</text>
					</clause></subparagraph><subparagraph id="ID564842BC15584ECA84DDC06203EE7434"><enum>(B)</enum><text>in paragraph
			 (2)—</text>
					<clause id="ID1FB6AB48252541628BDE87F196C434AB"><enum>(i)</enum><text>in
			 subparagraph (A), by striking<quote>, together with a filing fee of
			 $150</quote>;</text>
					</clause><clause id="ID1FAE7C1D5B124FC8B155433612ABC52B"><enum>(ii)</enum><text>in
			 subparagraph (B), by striking <quote>and</quote> after the semicolon;</text>
					</clause><clause id="IDABE19C667B394DB9A68DAB169AA45999"><enum>(iii)</enum><text>in subparagraph
			 (C), by striking the period and inserting <quote>; and</quote>; and</text>
					</clause><clause id="IDA666FCFA70E145028F2EF620C56F930E"><enum>(iv)</enum><text>by
			 adding at the end the following:</text>

							<subparagraph id="IDA5C0B38558AE4A72AB48E57A51177D45"><enum>(D)</enum><text>the petition to
				participate is accompanied by either—</text>
								<clause id="IDFE4F216947B048F880B6C17C648855F4"><enum>(i)</enum><text>in a proceeding
				to determine royalty rates, a filing fee of $150; or</text>
								</clause><clause id="ID355DD1C45DBE4F9289066A35F75C002B"><enum>(ii)</enum><text>in a proceeding
				to determine distribution of royalty fees—</text>
									<subclause id="IDB1BC2B90F26545EEA5A908A0852C14EB"><enum>(I)</enum><text>a filing fee of
				$150; or</text>
									</subclause><subclause id="IDE26ADB9437C8432AB24FDA9759597A4E"><enum>(II)</enum><text>a statement that
				the petitioner (individually or as a group) will not seek a distribution of
				more than $1000, in which case the amount distributed to the petitioner shall
				not exceed
				$1000.</text>
									</subclause></clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</clause></subparagraph><subparagraph id="IDECC448542D8A4077AFA6BE4CDD3BC549"><enum>(C)</enum><text>in paragraph
			 (3)(A)—</text>
					<clause id="ID0E9E1A2DACC7499A8CBF9D2FAD6E3306"><enum>(i)</enum><text>by
			 striking “(A) <header-in-text level="subparagraph" style="OLC">In
			 general</header-in-text>.—Promptly” and inserting “(A)

				Copyright Royalty Judges shall make available to all participants in the
				proceeding a list of such participants. The initiation of a voluntary
				negotiation period among the participants shall be set at a time determined by
				the Copyright Royalty
				Judges.</text>
							</clause><after-quoted-block>.</after-quoted-block></quoted-block>
					</clause></subparagraph><subparagraph id="IDC38822D32D39494191A42D9CE6283262"><enum>(D)</enum><text>in paragraph
			 (4)(A), by striking the last sentence; and</text>
				</subparagraph><subparagraph id="IDFF2007C69C994979810C24BB7CEDE00D"><enum>(E)</enum><text>in paragraph

			 amending clause (ii)(I) to read as follows:</text>

							<clause id="ID44ACD9923A644FDABE0D6E1B553979BB"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="IDDD36BEC4C3944146A3144709B5C71485"><enum>(I)</enum><text>Following the
				submission to the Copyright Royalty Judges of written direct statements and
				written rebuttal statements by the participants in a proceeding under paragraph
				(2), the Copyright Royalty Judges, after taking into consideration the views of
				the participants in the proceeding, shall determine a schedule for conducting
				and completing
				discovery.</text>
								</subclause></clause><after-quoted-block>;</after-quoted-block></quoted-block>
					</clause><clause id="ID7860BD7EEFBB4827ABB8AABE898E8213"><enum>(iii)</enum><text>by amending
			 clause (iv) to read as follows:</text>
						<quoted-block id="IDEDE78ECC620C49D79DBEABF24AA65510" style="OLC">
							<clause id="ID1CF0D6BB2E2548ADBB48A65BD3BA82BC"><enum>(iv)</enum><text>Discovery in
				connection with written direct statements shall be permitted for a period of 60
				days, except for discovery ordered by the Copyright Royalty Judges in
				connection with the resolution of motions, orders, and disputes pending at the
				end of such period. The Copyright Royalty Judges may order a discovery schedule
				in connection with written rebuttal
				statements.</text>
							</clause><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</clause><clause id="ID76B733A1513940F19805B3311E8FFC04"><enum>(iv)</enum><text>by
			 amending clause (x) to read as follows:</text>
						<quoted-block id="ID75D0BC59877B444AA6B67FDE4CB56F65" style="OLC">
							<clause id="ID79A1427C583F45C0864FA9DB11C5CC60"><enum>(x)</enum><text>The Copyright
				Royalty Judges shall order a settlement conference among the participants in
				the proceeding to facilitate the presentation of offers of settlement among the
				participants. The settlement conference shall be held during a 21-day period
				following the 60-day discovery period specified in clause (iv) and shall take
				place outside the presence of the Copyright Royalty
				Judges.</text>
							</clause><after-quoted-block>.</after-quoted-block></quoted-block>
					</clause></subparagraph></paragraph><paragraph id="ID73C56962EE564438B0E950E3D9D70B75"><enum>(7)</enum><text>Section
			 803(c)(2)(B) is amended by striking <quote>concerning rates and
			 terms</quote>.</text>
			</paragraph><paragraph id="ID4E24E96FBD8F4582B9EF2CCAA8B44F13"><enum>(8)</enum><text>Section 803(c)(4)
			 is amended by striking <quote>, with the approval of the Register of
			 Copyrights,</quote>.</text>
			</paragraph><paragraph id="ID67052FF97CA9449E8F9BB8875789E789"><enum>(9)</enum><text>Section 803(c)(7)
			 is amended by striking <quote>of Copyright</quote> and inserting <quote>of the
			 Copyright</quote>.</text>
			</paragraph><paragraph id="ID39F9468B75174681AF8E1976C4CE39F3"><enum>(10)</enum><text>Section
			 803(d)(2)(C)(i)(I) is amended by striking <quote>statements of account and any
			 report of use</quote> and inserting <quote>applicable statements of account and
			 reports of use</quote>.</text>
			</paragraph><paragraph id="IDCBB50374040047B5823EE64BD71886E4"><enum>(11)</enum><text>Section
			 803(d)(3) is amended by striking <quote>If the court, pursuant to section 706
			 of title 5, modifies</quote> and inserting <quote>Section 706 of title 5 shall
			 apply with respect to review by the court of appeals under this subsection. If
			 the court modifies</quote>.</text>

			 Royalty Fees</header><text><external-xref legal-doc="usc" parsable-cite="usc/17/111">Section 111(d)</external-xref> of title 17, United States Code, is
			 amended—</text>
				<paragraph id="ID1D0F1240E1EC401E89EA3A63D86B53B3"><enum>(1)</enum><text>in the second
			 sentence of paragraph (2), by striking all that follows <quote>Librarian of
			 Congress</quote> and inserting <quote>upon authorization by the Copyright
			 Royalty Judges.</quote>;</text>
				</paragraph><paragraph id="ID8F1EEF134A1846F48D50D802648504FC"><enum>(2)</enum><text>in paragraph
			 (4)—</text>
					<subparagraph id="ID1AE5CC5B94DF4B0DACCEF49184DC523D"><enum>(A)</enum><text>in subparagraph
			 (B)—</text>

			 striking the second sentence and inserting the following: <quote>If the
			 Copyright Royalty Judges determine that no such controversy exists, the

			 to distribute such fees to the copyright owners entitled to receive them, or to
			 their designated agents, subject to the deduction of reasonable administrative
			 costs under this section.</quote>; and</text>

					</subparagraph></paragraph></subsection><subsection id="IDD374F6087E524650B70AB145063CB742"><enum>(b)</enum><header>Sound
			 Recordings</header><text><external-xref legal-doc="usc" parsable-cite="usc/17/114">Section 114(f)</external-xref> of title 17, United States Code, is
			 amended—</text>
				<paragraph id="IDA4287B307FBD4AD79BE7CB1989B9F661"><enum>(1)</enum><text>in paragraph
			 (1)(A), in the first sentence, by striking <quote>except where</quote> and all
			 that follows through the end period and inserting <quote>except in the case of
			 a different transitional period provided under section 6(b)(3) of the Copyright
			 Royalty and Distribution Reform Act of 2004, or such other period as the
			 parties may agree.</quote>;</text>
				</paragraph><paragraph id="IDE28301C3663C4688BCC587DC3CBE80C1"><enum>(2)</enum><text>by amending

				chapter 8 shall determine reasonable rates and terms of royalty payments for
				public performances of sound recordings by means of eligible nonsubscription
				transmission services and new subscription services specified by subsection
				(d)(2) during the 5-year period beginning on January 1 of the second year
				following the year in which the proceedings are to be commenced, except in the
				case of a different transitional period provided under section 6(b)(3) of the
				Copyright Royalty and Distribution Reform Act of 2004, or such other period as
				the parties may agree. Such rates and terms shall distinguish among the
				different types of eligible nonsubscription transmission services and new
				subscription services then in operation and shall include a minimum fee for
				each such type of service. Any copyright owners of sound recordings or any
				entities performing sound recordings affected by this paragraph may submit to
				the Copyright Royalty Judges licenses covering such eligible nonsubscription
				transmissions and new subscription services with respect to such sound
				recordings. The parties to each proceeding shall bear their own
				costs.</text>
							</subparagraph></paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="IDA389B4101AF74CB2B55948CE7F169819"><enum>(3)</enum><text>in paragraph
			 (2)(B), in the last sentence, by striking <quote>negotiated under</quote> and
			 inserting <quote>described in</quote>.</text>
				</paragraph></subsection><subsection id="ID2893584768DA4408993A03B87EF92D67"><enum>(c)</enum><header>Phonorecords of
			 Nondramatic Musical Works</header><text><external-xref legal-doc="usc" parsable-cite="usc/17/115">Section 115(c)(3)</external-xref> of title 17, United
			 States Code, is amended—</text>
				<paragraph id="ID3D262742D25A4957A42760BC7C4BAFF7"><enum>(1)</enum><text>in subparagraph
			 (B), by striking <quote>subparagraphs (B) through (F)</quote> and inserting
			 <quote>this subparagraph and subparagraphs (C) through (E)</quote>;</text>
				</paragraph><paragraph id="IDD13598D2FE2B46B6B6EDD802C863539B"><enum>(2)</enum><text>in subparagraph
			 (D), in the third sentence, by inserting <quote>in subparagraphs (B) and
			 (C)</quote> after <quote>described</quote>; and</text>
				</paragraph><paragraph id="ID0CC06B4A784345C886AD4EC58652B21F"><enum>(3)</enum><text>in subparagraph
			 (E), in clauses (i) and (ii)(I), by striking <quote>(C) or (D)</quote> each
			 place it appears and inserting <quote>(C) and (D)</quote>.</text>
				</paragraph></subsection><subsection id="ID81AFA390754447ECAB7F76B80733A123"><enum>(d)</enum><header>Noncommercial
			 Broadcasting</header><text><external-xref legal-doc="usc" parsable-cite="usc/17/118">Section 118</external-xref> of title 17, United States Code, is
			 amended—</text>
				<paragraph id="ID3248D2EE5B1D449E864FB33F04533AE8"><enum>(1)</enum><text>in subsection
			 (b)(3), by striking <quote>copyright owners in works</quote> and inserting
			 <quote>owners of copyright in works</quote>; and</text>
				</paragraph><paragraph id="IDBF0CC6880C8E453AB09739147500ADD7"><enum>(2)</enum><text>in subsection
			 (c)—</text>
					<subparagraph id="ID2EA8CF9501E4419CBD67C867B9BD2756"><enum>(A)</enum><text>in the matter
			 preceding paragraph (1), by striking <quote>established by</quote> and all that
			 follows through <quote>engage</quote> and inserting <quote>established by the
			 Copyright Royalty Judges under subsection (b)(4), engage</quote>; and</text>
					</subparagraph><subparagraph id="ID24A4B7C36BDF44369109D12C1F75C2C0"><enum>(B)</enum><text>in paragraph (1),

					</subparagraph></paragraph></subsection><subsection id="ID803CF7A9A8EE40AF82345587EE545BB6"><enum>(e)</enum><header>Satellite
			 Carriers</header><text><external-xref legal-doc="usc" parsable-cite="usc/17/119">Section 119</external-xref> of title 17, United States Code, is
			 amended—</text>
				<paragraph id="ID44BCC40B57D542A78F3C0A11F374A1B4"><enum>(1)</enum><text>in subsection
			 (b)(4)—</text>
					<subparagraph id="ID33AA40B7B6B140B29375B9C389C18DDE"><enum>(A)</enum><text>in subparagraph
			 (B), by striking the second sentence and inserting the following: <quote>If the
			 Copyright Royalty Judges determine that no such controversy exists, the
			 Copyright Royalty Judges shall authorize the Librarian of Congress to proceed
			 to distribute such fees to the copyright owners entitled to receive them, or to
			 their designated agents, subject to the deduction of reasonable administrative
			 costs under this section.</quote>; and</text>
					</subparagraph><subparagraph id="ID8DFD05356CFD4607A9E5A438C4BBB61C"><enum>(B)</enum><text>by amending
			 subparagraph (C) to read as follows:</text>
						<quoted-block id="ID0251F8135B2F43B5968DB1E517EDFADF" style="OLC">
							<subparagraph id="IDB272758B969F49E39EA719050A6CDE35"><enum>(C)</enum><header>Withholding of
				fees during controversy</header><text>During the pendency of any proceeding
				under this subsection, the Copyright Royalty Judges shall have the discretion
				to authorize the Librarian of Congress to proceed to distribute any amounts
				that are not in controversy.</text>
							</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="ID6D3F36A820BE4F3C8BBDBA6D8F352B60"><enum>(2)</enum><text>in subsection
			 (c)(1)(F)(i), in the last sentence, by striking <quote>arbitrary</quote> and
			 inserting <quote>arbitration</quote>.</text>
				</paragraph></subsection><subsection id="ID2BC4B3699EB548EBA544833C7E04192C"><enum>(f)</enum><header>Digital Audio
			 Recording Devices</header><text><external-xref legal-doc="usc" parsable-cite="usc/17/1007">Section 1007</external-xref> of title 17, United States Code,
			 is amended—</text>

				</paragraph></subsection><subsection id="IDAD28709D01614255A67E6FE4C4857D92"><enum>(g)</enum><header>Removal of
			 Inconsistent Provisions</header><text>The amendments contained in subsection
			 (h) of section 5 of the Copyright Royalty and Distribution Reform Act of 2004
			 shall be deemed never to have been enacted.</text>
			</subsection><subsection id="ID173054BF62104F3583EFE811C5F1BE4D"><enum>(h)</enum><header>Effective
			 Date</header><text>Section 6(b)(1) of the Copyright Royalty and Distribution
			 Reform Act of 2004 (<external-xref legal-doc="public-law" parsable-cite="pl/108/419">Public Law 108–419</external-xref>) is amended by striking <quote>commenced
			 before the date of enactment of this Act</quote> and inserting <quote>commenced
			 before the effective date provided in subsection (a)</quote>.</text>
			</subsection></section><section changed="deleted" committee-id="HJU00" id="IDB4256AA7E7BE4D4FA3A2948D10A08A7E" reported-display-style="strikethrough"><enum>5.</enum><header>Effective
			 date</header><text display-inline="no-display-inline">This Act and the
			 amendments made by this Act shall be effective as if included in the Copyright
			 Royalty and Distribution Reform Act of 2004.</text>
		</section><section changed="added" committee-id="HJU00" id="id0E51CD6353BE42BDB20AB04423A12595" reported-display-style="italic"><enum>5.</enum><header>Partial distribution of
			 royalty fees</header><text display-inline="no-display-inline">Section
			 801(b)(3)(C) of title 17, United States Code, is amended—</text>
			<paragraph id="id6C4D25404F0C428382EF58F4F0F526C6"><enum>(1)</enum><text>by
			 striking all that precedes clause (i) and inserting the following:</text>
				<quoted-block changed="added" display-inline="no-display-inline" id="id4C28D65AF65A4D10A4D493EEAA07CC30" reported-display-style="italic" style="OLC">
					<subparagraph id="id9ED1853DC7EC4361A810D75367CC082C" indent="up1"><enum>(C)</enum><text>Notwithstanding section
				804(b)(8), the Copyright Royalty Judges, at any time after the filing of claims
				under section 111, 119, or 1007, may, upon motion of one or more of the
				claimants and after publication in the Federal Register of a request for
				responses to the motion from interested claimants, make a partial distribution
				of such fees, if, based upon all responses received during the 30-day period
				beginning on the date of such publication, the Copyright Royalty Judges
				conclude that no claimant entitled to receive such fees has stated a reasonable
				objection to the partial distribution, and all such
				claimants—</text>
					</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
			</paragraph><paragraph changed="added" committee-id="HJU00" id="id7036C56634D74D28BFB98BAC0FFB63EA" reported-display-style="italic"><enum>(2)</enum><text>in clause (i), by
			 striking <quote>such</quote> and inserting <quote>the</quote>.</text>
			</paragraph></section><section changed="added" committee-id="HJU00" id="idA42189B0052640B3836606E27F239820" reported-display-style="italic"><enum>6.</enum><header>Effective date</header>
			<subsection id="id77A5A7131D894D32AEE880FC613DEB92"><enum>(a)</enum><header>In
			 general</header><text>Except as provided under subsection (b), this Act and the
			 amendments made by this Act shall be effective as if included in the Copyright
			 Royalty and Distribution Reform Act of 2004.</text>
			</subsection><subsection id="id03EA306BDB16415A8AAAE40AC6015B61"><enum>(b)</enum><header>Partial distribution of royalty
			 fees</header><text>Section 5 shall take effect on the date of enactment of this
			 Act.</text>
