<official-title>To prohibit United States voluntary and assessed contributions to the United Nations if the United Nations imposes any tax or fee on any United States person or continues to develop or promote proposals for such a tax or fee.</official-title>

<section section-type="section-one" id="HF11FC2F7FE6B4C7A98DF827EDA2DA166" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Prohibition on United Nations Taxation Act of 2005</short-title></quote>.</text></section> 
<section id="H14E57AD5485347D4AC9662EC241E2C30"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">The Congress finds that—</text> 
<paragraph id="HBCA60D2EF7E44E0ABDCC78004FE0A76"><enum>(1)</enum><text>in 1948, the average United States family with children paid only three percent of its income in Federal taxes;</text></paragraph> 
<paragraph id="H32C8ADB404F647B8BC6B1393F06E02B8"><enum>(2)</enum><text>in 1996, the average United States family with children paid almost 24 percent of its income in Federal taxes;</text></paragraph> 
<paragraph id="H9D0A85FC2E5F406CB11767A759210084"><enum>(3)</enum><text>United Nations officials have made numerous and repeated proposals to provide financing for the United Nations outside the scrutiny of member states of the United Nations, including borrowing from international financial institutions, assuming control of bonds issued by member states, and imposing taxes on an extensive range of transactions, goods, and services;</text></paragraph> 
<paragraph id="H45D2FB1914EE44FA8CA3D77B912E0207"><enum>(4)</enum><text>the 1994 <quote>Human Development Report</quote> of the United Nations Development Program stated that <quote>[i]t is appropriate that the proceeds of an international tax be devoted to international purposes and be placed at the disposal of international institutions.</quote>;</text></paragraph> 
<paragraph id="H85CF3C9D9A334BC095753398EE40F62D"><enum>(5)</enum><text>on January 14, 1996, United Nations Secretary General Boutros Boutros-Ghali stated that an international tax would mean that <quote>[he would] not be under the daily financial will of the member states.</quote>;</text></paragraph> 
<paragraph id="H3D58D3F392134D27A117A1B53173F7C"><enum>(6)</enum><text>United States taxpayers have paid approximately $30,000,000,000 to the United Nations since 1945;</text></paragraph> 
<paragraph id="H407F1BF7D5644D6CB48E4D05C5EECDF3"><enum>(7)</enum><text>the United Nations and its organizations are replete with mismanagement, waste, corruption, and inefficiency, which cost United States taxpayers millions of dollars each year;</text></paragraph> 
<paragraph id="H227A8751066C4ED69628390449EC26F5"><enum>(8)</enum><text>the power to tax is an attribute of sovereignty;</text></paragraph> 
<paragraph id="HDC81D9E179C04D7AB91CEB5C7593C760"><enum>(9)</enum><text>the United Nations does not have the attributes of sovereignty and is not a sovereign power; and</text></paragraph> 
<paragraph id="H1C3C8FC85B9245D18B00A4304A4D277"><enum>(10)</enum><text>the United Nations has no legal authority to impose taxes on United States citizens.</text></paragraph></section> 
<section id="H9BB8D035E52141AC8157FC3E7991072B"><enum>3.</enum><header>Prohibitions regarding taxation and borrowing</header> 
<subsection id="H14887FE38E624FC38EA82BB05823B706"><enum>(a)</enum><header>Prohibition on imposition of global taxation or multilateral bank borrowing</header><text display-inline="yes-display-inline">The United States shall not pay any voluntary or assessed contribution to the United Nations or any of its specialized or affiliated agencies (including the United Nations Development Program) if the United Nations—</text> 
<paragraph id="HBF55DF243B6E4BBC86D81E544193A8B"><enum>(1)</enum><text>attempts to implement or impose any taxation or fee on any United States person; or</text></paragraph> 
<paragraph id="H7FF3E9DC49A841A3A238F6EBF77F08E9"><enum>(2)</enum><text>attempts to borrow funds from the International Bank for Reconstruction and Development (commonly referred to as the <quote>World Bank</quote>), the International Monetary Fund, or any other similar or regional international financial institution.</text></paragraph></subsection> 
<subsection id="HBA7C684AF1274C15A27BEB08B6A86289"><enum>(b)</enum><header>Prohibition on continued development and promotion of global taxation proposals</header><text display-inline="yes-display-inline">The United States shall not pay any voluntary or assessed contribution to the United Nations or any of its specialized or affiliated agencies (including the United Nations Development Program) unless the President certifies in writing to the Congress not less than 15 days before such payment that the United Nations or any of its specialized or affiliated agencies is not engaged in any effort to develop, advocate, promote, or publicize any proposal concerning taxation or fees on any United States person in order to raise revenue for the United Nations or any of its specialized or affiliated agencies.</text></subsection> 
<subsection id="H3D5EE48D868547AE87795E2962B2BBF"><enum>(c)</enum><header>Statutory construction</header><text display-inline="yes-display-inline">Payments prohibited under this Act include any disbursement to the United Nations or to any of its specialized or affiliated agencies pursuant to any obligation agreed to by the United States on or before the date of the enactment of this Act.</text></subsection></section> 
<section id="HB4128BADE7144694945478A939E44EC4"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline">As used in this Act:</text> 
<paragraph id="H1F190BAB857D450F952D959C816759B5"><enum>(1)</enum><text>The term <term>person</term> has the meaning given such term in <external-xref legal-doc="usc" parsable-cite="usc/26/7701">section 7701(a)(1)</external-xref> of the Internal Revenue Code of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/26/7701">26 U.S.C. 7701(a)(1)</external-xref>).</text></paragraph> 
<paragraph id="HAD9192D0144B427691CE1E73DFEBAC0"><enum>(2)</enum><text>The term <term>taxation or fees on any United States person</term> includes any tax or fee assessed against any United States person on a per capita basis or on a transaction or user basis, including any tax or fee on international air travel, foreign exchange transactions, the mails, or extraction or use of natural resources.</text></paragraph></section> 
<section id="HEE8CDA159D5142FD8BA89B80DC70EBB2"><enum>5.</enum><header>Effective date</header><text display-inline="no-display-inline">This Act shall take effect on the date of the enactment of this Act.</text></section>
