<official-title>To amend title XVIII of the Social Security Act to clarify payment for clinical laboratory tests furnished by critical access hospitals under the Medicare Program.</official-title>

<section id="H145D3C692DBE44548C765E6F5914DF50" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Critical Access to Clinical Lab Services Act of 2005</short-title></quote>.</text></section> 
<section id="H92234D75EEB841AFA26DA57CDFC57101" section-type="subsequent-section"><enum>2.</enum><header>Clarification of payment for clinical laboratory tests furnished by critical access hospitals</header> 
<subsection id="HEE4A1C268E6D4241969D9843FA17B39F"><enum>(a)</enum><header>In general</header><text>Section 1834(g)(4) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(g)(4)</external-xref>) is amended—</text> 
<paragraph id="HD643317EC78745E39E8539DD223D4897"><enum>(1)</enum><text>in the heading, by striking <quote><header-in-text level="paragraph">no beneficiary cost-sharing for</header-in-text></quote> and inserting <quote><header-in-text level="paragraph">treatment of</header-in-text></quote>; and</text></paragraph> 
<paragraph id="H61BAB9566EF34C619CE284471C08ED14"><enum>(2)</enum><text>by adding at the end the following:</text> 
<quoted-block style="OLC" id="HE83E09E588324BD9A207F05933E8A5CB" display-inline="yes-display-inline"><text display-inline="yes-display-inline">For purposes of the preceding sentence and section 1861(mm)(3), clinical diagnostic laboratory services furnished by a critical access hospital shall be treated as being furnished as part of outpatient critical access services without regard to whether—</text> 
<subparagraph id="H7F10628B307D4560854B1C34C540C729"><enum>(A)</enum><text>the individual with respect to whom such services are furnished is physically present in the critical access hospital at the time the specimen is collected;</text></subparagraph> 
<subparagraph id="HCF22B14D54EB4C31AC20B83F4E7512AD"><enum>(B)</enum><text>such individual is registered as an outpatient on the records of, and receives such services directly from, the critical access hospital; or</text></subparagraph> 
<subparagraph id="HB0FD99A2BE8E4A239D121B1F99065290"><enum>(C)</enum><text>payment is (or, but for this subsection, would be) available for such services under the fee schedule established under section 1833(h).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H753E5E888A9946F4B65300482EF8379D"><enum>(b)</enum><header>Effective date</header><text>The amendments made by subsection (a) shall apply to cost reporting periods beginning on or after October 1, 2003.</text></subsection></section>
