<legis-type>A BILL</legis-type> 
<official-title>To amend title 39, United States Code, to provide that the procedures relating to the closing or consolidation of a post office be extended to the relocation or construction of a post office, and for other purposes.</official-title>

<section section-type="section-one" id="H3892E09DBDDE480B004C7B153200CE5F" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Post Office Community Partnership Act of 2005</short-title></quote>.</text></section> 
<section id="HC378C0CB76FA4C1E9C62AC1DBEAF808"><enum>2.</enum><header>Procedures relating to the proposed closing, consolidation, relocation, or construction of a post office</header> 
<subsection id="HE6A26D1FA3744D7A8F01A5ACC0EB98BF"><enum>(a)</enum><header>Applicability</header><text><external-xref legal-doc="usc" parsable-cite="usc/39/404">Section 404(b)</external-xref> of title 39, United States Code, is amended by redesignating paragraphs (2) through (5) as paragraphs (3) through (6), respectively, by striking <quote>(b)(1)</quote> and inserting <quote>(2)</quote>, and by inserting before paragraph (2) (as so redesignated) the following:</text>

<subsection id="H98F55718E5E348719114DFC25B90202E"><enum>(b)</enum> 
<paragraph display-inline="yes-display-inline" id="HDF8C76F5E17F43C486D6A5D18715046C"><enum>(1)</enum><text>This subsection shall apply in the case of any proposed closing, consolidation, relocation, or construction of a post office.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H0B019D824E6042850067EC001CB2E823"><enum>(b)</enum><header>Advance notice</header><text>Paragraph (2) of such section 404(b) (as so redesignated) is amended to read as follows:</text> 
<quoted-block id="H608B426608D7439C91A33000DC827CCA"> 
<paragraph indent="up1" id="H3BE872FC77A447BAA95158DBB3407032"><enum>(2)</enum> 
<subparagraph display-inline="yes-display-inline" id="H7387400A22F14A5C882E417140A7A3BE"><enum>(A)</enum><text>The Postal Service, before making a determination under subsection (a)(3) as to the necessity for a proposed action described in paragraph (1), shall, in order to ensure that local government officials and the persons who are (or would be) served by the post office involved will have an opportunity to present their views, provide adequate notice of its intention to take such action with respect to such post office at least 60 days before—</text> 
<clause indent="up1" id="H9716D4234B0D480281176E2299AC9C44"><enum>(i)</enum><text>in the case of the proposed construction of a post office, the date of the determination under subsection (a)(3); or</text></clause> 
<clause indent="up1" id="HE1EFD4F24CC64C89BF18573CB63E003C"><enum>(ii)</enum><text>in the case of an action other than the proposed construction of a post office, the proposed date of such action.</text></clause></subparagraph> 
<subparagraph indent="up1" id="HE80DC95BA7554F0F8D99C4DFE059D936"><enum>(B)</enum><text>The requirements of this paragraph shall not be considered met unless the notice—</text> 
<clause id="H73EC98D521F3490780E6E6BFCBDE682"><enum>(i)</enum><text>has, by the deadline specified in subparagraph (A)—</text> 
<subclause id="H4A1C84D1249B488FB099C8C1E762B400"><enum>(I)</enum><text>been hand delivered or delivered by mail to local government officials and the other persons required under subparagraph (A); and</text></subclause> 
<subclause id="HFEDAC027F6034B149D9DC7724961BCB"><enum>(II)</enum><text>been published once a week for at least 4 weeks in 1 or more newspapers regularly issued and of general circulation within the ZIP code areas which are (or would be) served by the post office involved; and</text></subclause></clause> 
<clause id="H1AA1B09FEFE644FCA05931BA507007A4"><enum>(ii)</enum><text>includes a description of the action proposed to be taken with respect to the post office involved, a summary of the reasons for the proposed action, and the date on which such action is proposed to be taken (or, if the construction of a post office is involved, the proposed timetable therefor).</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H8C294A30B8C74911BAB5FA742B59F66C"><enum>(c)</enum><header>Considerations</header><text>Paragraph (3) of such section 404(b) (as so redesignated) is amended—</text> 
<paragraph id="H301A7FE55FEC450889E58AEB31965F7"><enum>(1)</enum><text>in the matter before subparagraph (A), by striking <quote>to close or consolidate</quote> and inserting <quote>to take a proposed action with respect to</quote>;</text></paragraph> 
<paragraph id="HA74E3218192D450E8CFE2CD36398C6CD"><enum>(2)</enum><text>by striking <quote>such closing or consolidation</quote> each place it appears and inserting <quote>such action</quote>;</text></paragraph> 
<paragraph id="HEC01434A91C54A28AAD1005379AD18AE"><enum>(3)</enum><text>in subparagraph (A)(i), by striking the semicolon and inserting <quote>, taking into account (I) the extent to which the post office is part of a core downtown business area (if at all), and (II) the nature and the extent of any opposition within the community to the proposed action;</quote>;</text></paragraph> 
<paragraph id="HCB35C3AA387B4C658F320022A692569F"><enum>(4)</enum><text>in subparagraph (A)(ii), by striking <quote>Postal Service employed at such office;</quote> and inserting <quote>Postal Service;</quote>;</text></paragraph> 
<paragraph id="H9CAC4D3A09624D889308111FA85EE59C"><enum>(5)</enum><text>in subparagraph (A)(iv), by inserting <quote>quantified long-term</quote> before <quote>economic</quote>; and</text></paragraph> 
<paragraph id="H988088AF120B4092A4BFE098CB4B069C"><enum>(6)</enum><text>in subparagraph (A), by striking <quote>and</quote> at the end of clause (iv), by redesignating clause (v) as clause (viii), and by inserting after clause (iv) the following:</text> 
<quoted-block id="H89DB035BCCCC4A9A8EA805C2D3A9C300"> 
<clause indent="up1" id="HF2BF04F8D1D747539B35003BB9E6FA20"><enum>(v)</enum><text>any views or concerns expressed by any officials or other representatives of local government, including whether the proposed action is reasonable in light of local population projections;</text></clause> 
<clause indent="up1" id="H895109397CAD41ECB6C3FDCFE1F9516E"><enum>(vi)</enum><text>consistency with the size, scale, design, and general character of the surrounding community;</text></clause> 
<clause indent="up1" id="H8AF8522E2247400C002D65007C39806E"><enum>(vii)</enum><text>whether all reasonable alternatives to such action have been explored; and</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HE834DFD3F781438AA491FDB1C8A7A247"><enum>(d)</enum><header>Notice of determination</header><text>Paragraph (4) of such section 404(b) (as so redesignated) is amended—</text> 
<paragraph id="HAB0258F54B6C49F9ACBBD89794E8B10"><enum>(1)</enum><text>by striking <quote>to close or consolidate</quote> and inserting <quote>to take a proposed action (described in paragraph (1)) with respect to</quote>;</text></paragraph> 
<paragraph id="HA56F2A98AF2045549F4449DD227B1026"><enum>(2)</enum><text>by striking <quote>paragraph (2)</quote> and inserting <quote>paragraph (3)</quote>; and</text></paragraph> 
<paragraph id="H4286916E557942B49BB927C1194B8114"><enum>(3)</enum><text>by striking <quote>office.</quote> and inserting <quote>office (including by posting a copy of such determination in the post office or each post office serving the persons who will be affected by such action) and shall be transmitted to appropriate local officials.</quote>.</text></paragraph></subsection> 
<subsection id="HC5C481C484FC4236AEB06CE39F43585"><enum>(e)</enum><header>Additional requirements</header><text>Such section 404(b) is amended by adding at the end the following:</text> 
<quoted-block id="H4B50FDCB33A246779842F0D48BE7AD00"> 
<paragraph indent="up1" id="H47C95119FC364F45A8C9529485A623F1"><enum>(7)</enum><text>In any case in which a community has promulgated any procedures to address the relocation, closing, consolidation, or construction of buildings in the community, and the public participation requirements of those procedures are more stringent than those provided in this subsection, the Postal Service shall apply those procedures to the relocation, closing, consolidation, or construction of a post office in that community in lieu of applying the procedures established in this subsection.</text></paragraph> 
<paragraph indent="up1" id="H99A54E09291241CE80F934F85BEEAC4E"><enum>(8)</enum><text>In making a determination to relocate, close, consolidate, or construct any post office, the Postal Service shall comply with any applicable zoning, planning, or land use laws (including design guidelines, building codes, and all other provisions of law) to the same extent and in the same manner as if the Postal Service were not an establishment of the Government of the United States.</text></paragraph> 
<paragraph indent="up1" id="H70EDFC3FE8D84E76B77E1E00A6807656"><enum>(9)</enum><text>Nothing in this subsection shall be construed to apply to a temporary customer service facility to be used by the Postal Service for a period of less than 60 days.</text></paragraph> 
<paragraph indent="up1" id="HBE0CE7A0D3A14700A8C4CAA861E9F5F6"><enum>(10)</enum> 
<subparagraph display-inline="yes-display-inline" id="H69096D5DE66047FF9137446241D0EF07"><enum>(A)</enum><text>For purposes of this paragraph the term <term>emergency</term> means any occurrence that forces an immediate relocation from an existing facility, including natural disasters, fire, health and safety factors, and lease terminations.</text></subparagraph> 
<subparagraph indent="up1" id="H5FD5ACB3B7E94A08BF67F04CE755D715"><enum>(B)</enum><text>If the Postmaster General determines that there exists an emergency affecting a particular post office, the Postmaster General may suspend the application of this subsection, with respect to such post office, for a period not to exceed 180 days.</text></subparagraph> 
<subparagraph indent="up1" id="H2E0C783ADDE84762AB843184F28CA22B"><enum>(C)</enum><text>The Postmaster General may exercise the suspension authority under this paragraph with respect to a post office once for each discrete emergency affecting such post office.</text></subparagraph></paragraph> 
<paragraph indent="up1" id="HAA4D406E59A74B14B0593744625D7026"><enum>(11)</enum><text>The relocation, closing, consolidation, or construction of any post office shall be conducted in accordance with applicable provisions of the National Historic Preservation Act.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H82AB25672A6645E28CFD8FFFE7FE2896"><enum>(f)</enum><header>Technical and conforming amendments</header><text>Such section 404(b) is amended—</text> 
<paragraph id="H30489F11FFF34BD3894FF6EC235906BC"><enum>(1)</enum><text>in paragraph (5) (as so redesignated) by striking <quote>take no action to close or consolidate</quote> and inserting <quote>take no action described in paragraph (1) with respect to</quote>; and</text></paragraph> 
<paragraph id="H59096573CF4F4136BCC350E84294745D"><enum>(2)</enum><text>in paragraph (6) (as so redesignated)—</text> 
<subparagraph id="HD3CA3B4FFB3A48468E30A13B4DCD54A3"><enum>(A)</enum><text>by striking <quote>to close or consolidate</quote> and inserting <quote>to take any action described in paragraph (1) with respect to</quote>; and</text></subparagraph> 
<subparagraph id="H44C1D8E075634A11BAA4B4C206CE3116"><enum>(B)</enum><text>by striking <quote>paragraph (3)</quote> and inserting <quote>paragraph (4)</quote>.</text></subparagraph></paragraph></subsection></section>
