<official-title>To amend the Internal Revenue Code of 1986 to allow taxpayers to designate that part or all of any income tax refund be paid over for use in medical research conducted through the Department of Veterans Affairs.</official-title>

<section id="HC116EE79672F4601836E268BBFDBCC1C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Veterans Medical Research Assistance Voluntary Option Act of 2005</short-title></quote>.</text></section> 
<section id="HCC2A27A9DEA3427A8BE42F38303FD896" section-type="subsequent-section"><enum>2.</enum><header>Designation of income tax overpayments to Fund medical research</header> 
<subsection id="H93BB89B042764A6A8F5200FFD4D9CE05"><enum>(a)</enum><header>General rule</header><text>Subchapter A of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/61">chapter 61</external-xref> of the Internal Revenue Code of 1986 (relating to returns and records) is amended by adding at the end the following new part:</text>

<toc-entry level="section">Sec. 6097. Designation of income tax overpayments</toc-entry></toc> 
<section id="H0E9FB3686750406AA045E09020C7BA4D"><enum>6097.</enum><header>Designation of income tax overpayments</header> 
<subsection id="H570596DF32354D27824155EADD7B199C"><enum>(a)</enum><header>General rule</header><text>Every taxpayer who makes a return of the tax imposed by subtitle A for any taxable year may designate that a specified portion (not less than $1) of any overpayment of tax for such taxable year shall be used for medical research conducted through the Department of Veterans Affairs.</text></subsection> 
<subsection id="HB1954852706542B0AFB7CA8CFFA4F4E3"><enum>(b)</enum><header>Manner and time of designation</header><text>Any designation under subsection (a) for any taxable year shall be made—</text> 
<paragraph id="HC827B5ABE6ED46338BD6006B92E4D2FA"><enum>(1)</enum><text>at the time of filing the return of the tax imposed by subtitle A for such taxable year, and</text></paragraph> 
<paragraph id="HBB04BD83A42C4A0BB4B73019253F9BD8"><enum>(2)</enum><text>in such manner as the Secretary may by regulation prescribe, except that such designation shall be made either on the first page of the return or on the page bearing the taxpayer’s signature.</text></paragraph></subsection> 
<subsection id="HCA66E53A03FA4A8CAA639ECCE2151717"><enum>(c)</enum><header>Treatment of amounts designated</header><text>For purposes of this title, the amount designated by any taxpayer under subsection (a)—</text> 
<paragraph id="H9A47FBE8A7884DAF9D6E7FFB763E3237"><enum>(1)</enum><text>shall be treated as being refunded to such taxpayer as of the last date prescribed for filing the return of tax imposed by subtitle A (determined without regard to extensions) or, if later, the date the return is filed, and</text></paragraph> 
<paragraph id="HEA47893924364482B57BC646FC7CA32"><enum>(2)</enum><text>shall be treated as a contribution made by such taxpayer on such date to the United States.</text></paragraph></subsection></section></part><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HF09F201F0CB442889FBD9F477EB63D4"><enum>(b)</enum><header>Clerical amendment</header><text>The table of parts for subchapter A of chapter 61 of such Code is amended by adding at the end thereof the following new item:</text>

<subsection id="HBDE8E74A15EB4B33A95C606003989902"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall apply to taxable years beginning after December 31, 2004.</text></subsection></section> 
<section id="HFE75754576DD4BAA96EC00209727A491"><enum>3.</enum><header>Department of Veterans Affairs Medical and Prosthetic Research Gift Fund</header> 
<subsection id="H2BE453F989D8486E8BD9F658BFA4672E"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/83">Chapter 83</external-xref> of title 38, United States Code, is amended by adding at the end the following new section:</text>

<section id="HA9C365FA262D4A07B05134D2975FEF21"><enum>8306.</enum><header>Department of Veterans Affairs Medical and Prosthetic Research Gift Fund</header> 
<subsection id="H64B2986B04FE4F9D8DCC041C5CDA995C"><enum>(a)</enum><text>There is established in the Treasury of the United States an account to be known as the <quote>Department of Veterans Affairs Medical and Prosthetic Research Gift Fund</quote> (in this section referred to as the <quote>Fund</quote>), consisting of such amounts as may be transferred or credited to the account under this section.</text></subsection> 
<subsection id="HCB78E3AFCBD84E1BBDE2FC2674E4847D"><enum>(b)</enum><text>The Secretary of the Treasury shall, from time to time, transfer to the Fund the amounts designated under <external-xref legal-doc="usc" parsable-cite="usc/26/6097">section 6097</external-xref> of the Internal Revenue Code of 1986. Amounts that otherwise would be appropriated for the Department of Veterans Affairs may not be offset by the amount of such transfers to the Fund.</text></subsection> 
<subsection id="H4C98029390484EA38100583000A8C5C1"><enum>(c)</enum><text>Amounts in the Fund shall be available, as provided in appropriations Acts, for purposes of medical research conducted through the Veterans Health Administration.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H1DB6A113048E42AFA2A730F5B5001D42"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of such chapter is amended by adding at the end the following new item:</text>
