		<official-title>To impose a 1-year cooling off period before a senior

		  Federal financial institutions examiner may be employed by the financial

		  institution examined by that person.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short

			 title</header>

			<text display-inline="no-display-inline">This Act may be cited as the

			 <quote>Bank Examiner Postemployment Protection Act</quote>.</text>

		</section><section id="id1B7CA156A37E45D283F516C9363522B6"><enum>2.</enum><header>One-year

			 postemployment restriction</header>

			<subsection id="id12883D51A9C046DCA632ABD5EF38B104"><enum></enum><text>Section 207 of

			 title 18, United States Code, is amended by adding at the end the following new

			 subsection:</text>

				<quoted-block display-inline="no-display-inline" id="id7E50524A16B144ED8284C643C6C3F8D2" style="OLC">

					<subsection id="id06149BCE4A2D445B80D63531FB876052"><enum>(m)</enum><header>One-year

				restrictions on Federal examiners of financial institutions</header>

						<paragraph id="idC0C521A2021247C9A3F2F3DE6B02233A"><enum>(1)</enum><header>In

				general</header><text>In addition to the restrictions set forth in subsections

				(a) and (b), any person who—</text>

							<subparagraph id="idE63F6D5E6AAA48149736E649A9714657"><enum>(A)</enum><text>was an officer or

				employee (including any special Government employee) of an appropriate Federal

				banking agency, a Federal reserve bank, or the National Credit Union

				Administration;</text>

							</subparagraph><subparagraph id="idF8B43E5D8DB44CB3A928C0668F4F7B1F"><enum>(B)</enum><text>served 1 or more

				months during the final 12 months of his or her employment with such agency or

				entity as a senior Federal examiner of a particular financial institution,

				including any holding company thereof, or in a functionally equivalent position

				with respect to a particular financial institution or holding company thereof;

				and</text>

							</subparagraph><subparagraph id="idF66CAF146CF74936BB770C443FD2BE72"><enum>(C)</enum><text>within 1 year

				after the termination of his or her service or employment with such agency or

				entity, knowingly accepts compensation as an employee, officer, director, or

				consultant from such financial institution or holding company, subsidiary, or

				affiliate,</text>

							</subparagraph><continuation-text continuation-text-level="paragraph">shall be

				punished as provided in section 216 of this title.</continuation-text></paragraph><paragraph id="idB829F7A73814431A809CAEF025976993"><enum>(2)</enum><header>Definitions</header><text>For

				purposes of this subsection_</text>

							<subparagraph id="id7D07446897F94285AE02D370DA63F58B"><enum>(A)</enum><text>the term

				<quote>appropriate Federal banking agency</quote> has the same meaning as in

				section 3 of the Federal Deposit Insurance Act;</text>

							</subparagraph><subparagraph id="idC7F7E865892840008586D3C8788CC1CF"><enum>(B)</enum><text>the term

				<quote>financial institution</quote> means a depository institution, as defined

				in section 3 of the Federal Deposit Insurance Act, an industrial bank described

				in section 2(c)(2)(H) of the Bank Holding Company Act of 1956, or a Federal

				credit union, as defined in section 101 of the Federal Credit Union Act.</text>

							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
