<section id="idC5361AADF2A54AB1A249ABA1D338C299" section-type="section-one"><enum>1.</enum><header>Short title</header> <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Oil Spill Prevention and Liability Act of 2004</short-title></quote>.</text> </section>
<section id="IDe160f164720543f886917fe4d0c5443a"><enum>2.</enum><header>Definition of responsible party</header><text display-inline="no-display-inline">Section 1001(32) of the Oil Pollution Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/33/2701">33 U.S.C. 2701(32)</external-xref>) is amended by striking subparagraph (A) and inserting the following:</text> 
<quoted-block display-inline="no-display-inline" id="id18D0CD3FCDD541D3A194A9CF1EAD0B76" style="OLC"> 
<subparagraph id="idDBBC789C0D6348099F3029FC06778C15"><enum>(A)</enum><header>Vessels</header> 
<clause id="id2ABBCDA36D624E13B210069A45AC6AC2"><enum>(i)</enum><header>In general</header><text>In the case of a vessel other than a single-hull tank vessel, any person that owns, operates, or demise charters the vessel.</text> </clause>
<clause id="idCA7DAF367ADF43A28A984F85C9B9C688"><enum>(ii)</enum><header>Single-hull tank vessels</header><text>In the case of a single-hull tank vessel, any person that—</text> 
<subclause id="idF9449BC1BCEF4FA79A0C0B95B5E6CDF8"><enum>(I)</enum><text>owns, operates, or demise charters the vessel; or</text> </subclause>
<subclause id="id2512EAA9D0874161B72FB292997C94B3"><enum>(II)</enum><text>by contract or agreement, through an agent, or otherwise, arranges for the shipment in a single-hull tank vessel of oil owned or possessed by the person or any other person.</text> </subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block> </section>
<section id="idFCC2531720534CE39FA06296953643BE"><enum>3.</enum><header>Limits on liability</header> 
<subsection id="ID701629ec726842be977e1f7e61d20d96"><enum>(a)</enum><header>Increase in liability limits</header><text>Section 1004(a) of the Oil Pollution Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/33/2704">33 U.S.C. 2704(a)</external-xref>) is amended—</text> 
<paragraph id="idC02958155BC449B5B064D63F9A3CAF59"><enum>(1)</enum><text>in paragraph (1)—</text> 
<subparagraph id="id34F6594FFA6E44EB80D020BF34DDE529"><enum>(A)</enum><text>by striking <quote>for a tank vessel, the greater of—</quote> and inserting <quote>for a double-hull tank vessel, after December 31, 2004, the greater of—</quote>;</text> </subparagraph>
<subparagraph id="id851EE91577504569892743D63C0E7936"><enum>(B)</enum><text>in subparagraph (A), by striking <quote>$1,200</quote> and inserting <quote>$2,400</quote>; and</text> </subparagraph>
<subparagraph id="idBD186EF1B2D847F7825C89656DD7DAF2"><enum>(C)</enum><text>in subparagraph (B)—</text> 
<clause id="IDf1ffefe1353d4789856fd75f320ee050"><enum>(i)</enum><text>in clause (i), by striking <quote>$10,000,000</quote> and inserting <quote>$20,000,000</quote>; and</text> </clause>
<clause id="ID60632ecdf99e48a09121a2324eea0619"><enum>(ii)</enum><text>in clause (ii), by striking <quote>$2,000,000</quote> and inserting <quote>$4,000,000</quote>;</text> </clause></subparagraph></paragraph>
<paragraph id="idD333C9D524024178B0455270BB7EC89B"><enum>(2)</enum><text>by redesignating paragraphs (2) through (4) as paragraphs (3) through (5), respectively;</text> </paragraph>
<paragraph id="id8154134BF0AD40DEB80FA40B7A7BCB75"><enum>(3)</enum><text>by inserting after paragraph (1) the following:</text>

<paragraph id="idBAD4CB4747B34E1B90524DA751CDAAFA"><enum>(2)</enum><text>for a single-hull tank vessel—</text> 
<subparagraph id="idFEF6E55725C94FEEBEA54A23332A76DA"><enum>(A)</enum><text>during the period beginning January 1, 2005, and ending December 31, 2005, the greater of—</text> 
<clause id="idF039F1D525244965B270BAB5B931857A"><enum>(i)</enum><text>$2,400 per gross ton; or</text> </clause>
<clause id="id4BE40A12B22B41B5B88DB27DE9682674"><enum>(ii)(I) in the case of a vessel of greater than 3,000 gross tons, $20,000,000; or</enum> 
<subclause id="idA4E8684EB0BE4CE4A6441CA75309CADC" indent="up1"><enum>(II)</enum><text>in the case of a vessel of 3,000 gross tons or less, $4,000,000;</text> </subclause></clause></subparagraph>
<subparagraph id="id4D95982AD6614425BAE5D59B67D82A2E"><enum>(B)</enum><text>during the period beginning January 1, 2006, and ending December 31, 2006, the greater of—</text> 
<clause id="idE373097DC76647B0BEB0302BBC555831"><enum>(i)</enum><text>$3,600 per gross ton; or</text> </clause>
<clause id="idBB47CD6DD513473B8F1100E9D313C0DC"><enum>(ii)(I) in the case of a vessel of greater than 3,000 gross tons, $30,000,000; or</enum> 
<subclause commented="no" display-inline="no-display-inline" id="idCAA74E462CC941E8934E793B65927F8A" indent="up1"><enum>(II)</enum><text>in the case of a vessel of 3,000 gross tons or less, $6,000,000;</text> </subclause></clause></subparagraph>
<subparagraph id="id74CE75D365344BE4AF977ECD4C289376"><enum>(C)</enum><text>during the period beginning January 1, 2007, and ending December 31, 2007, the greater of—</text> 
<clause id="id26DC4D8B83C34DBE95CEAD74FEB1D012"><enum>(i)</enum><text>$4,800 per gross ton; or</text> </clause>
<clause id="id4E6596A976854D2083D537F6E2EB9CF2"><enum>(ii)(I) in the case of a vessel of greater than 3,000 gross tons, $40,000,000; or</enum> 
<subclause commented="no" display-inline="no-display-inline" id="id62E194CE9AE245DAA15062B6E7D4760F" indent="up1"><enum>(II)</enum><text>in the case of a vessel of 3,000 gross tons or less, $8,000,000;</text> </subclause></clause></subparagraph>
<subparagraph id="id855AA654BC114C9681636A587068F692"><enum>(D)</enum><text>during the period beginning January 1, 2008, and ending December 31, 2008, the greater of—</text> 
<clause id="id6BC03574EB0F4F97AFBE87E9AF6C32A8"><enum>(i)</enum><text>$6,000 per gross ton; or</text> </clause>
<clause id="id7D9DA6C1B36A4313858FD75BFF0705EE"><enum>(ii)(I) in the case of a vessel of greater than 3,000 gross tons, $50,000,000; or</enum> 
<subclause commented="no" display-inline="no-display-inline" id="idC15C22CC5FC64C2BB6FD7D1E62934C76" indent="up1"><enum>(II)</enum><text>in the case of a vessel of 3,000 gross tons or less, $10,000,000;</text> </subclause></clause></subparagraph>
<subparagraph id="idC2B0370A08E44BACA4AB9C98F0BE915C"><enum>(E)</enum><text>during the period beginning January 1, 2009, and ending December 31, 2009, the greater of—</text> 
<clause id="id366033FB1A3E42E4BC87BBC437327F73"><enum>(i)</enum><text>$7,200 per gross ton; or</text> </clause>
<clause id="idAD90A4DEB82949699E8F7C8AD53CC6F1"><enum>(ii)(I) in the case of a vessel of greater than 3,000 gross tons, $60,000,000; or</enum> 
<subclause commented="no" display-inline="no-display-inline" id="idFBA62F705848405B8CFF12431B430509" indent="up1"><enum>(II)</enum><text>in the case of a vessel of 3,000 gross tons or less, $12,000,000; and</text> </subclause></clause></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="idC0CD059DF48043638665D03E90E0ECA1"><enum>(F)</enum><text>after December 31, 2009, the maximum amount permitted under the Constitution;</text> </subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block> </paragraph>
<paragraph id="ID64da73f694af45b28157ceaabf3aa287"><enum>(4)</enum><text>in paragraph (3) (as redesignated by paragraph (2))—</text> 
<subparagraph id="idF0462DF931334CE1A6F65766E0E24857"><enum>(A)</enum><text>by striking <quote>$600</quote> and inserting <quote>$1,200</quote>; and</text> </subparagraph>
<subparagraph id="ID9be453c8cd334f81897d4fd5df90f7dc"><enum>(B)</enum><text>by striking <quote>$500,000</quote> and inserting <quote>$1,000,000</quote>;</text> </subparagraph></paragraph>
<paragraph id="IDa64a072cc65b44ecbabde1df58857e4a"><enum>(5)</enum><text>in paragraph (4) (as redesignated by paragraph (2)), by striking <quote>$75,000,000</quote> and inserting <quote>$150,000,000</quote>; and</text> </paragraph>
<paragraph id="IDf583073956894bafb48c6a69464da142"><enum>(6)</enum><text>in paragraph (5) (as redesignated by paragraph (2)), by striking <quote>$350,000,000</quote> and inserting <quote>$700,000,000</quote>.</text> </paragraph></subsection>
<subsection id="IDaaaabbb64bea4a2b98f62199dd4a937b"><enum>(b)</enum><header>Adjustment of liability limits</header><text>Section 1004(d) of the Oil Pollution Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/33/2704">33 U.S.C. 2704(d)</external-xref>) is amended—</text> 
<paragraph id="id79C353DB6B034292941FB657357BB53D"><enum>(1)</enum><text>by striking paragraphs (1) and (2) and inserting the following:</text> 
<quoted-block display-inline="no-display-inline" id="id26393C664BB94A37951280B52D712A14" style="OLC"> 
<paragraph id="id2EB94F240DB54648B1AE8D60EE2913D5"><enum>(1)</enum><header>Deepwater ports and associated vessels</header><text>The Secretary may establish a limit of liability of less than $700,000,000, but not less than $100,000,000, for the transportation of oil by vessel to deepwater ports (as defined in section 3 of the Deepwater Port Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/33/1502">33 U.S.C. 1502</external-xref>).</text> </paragraph><after-quoted-block>; and</after-quoted-block></quoted-block> </paragraph>
<paragraph id="idF71EBD871CC24EBD9FFF6B4A7A9E64C8"><enum>(2)</enum><text>by redesignating paragraphs (3) and (4) as paragraphs (2) and (3), respectively.</text> </paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="IDd9d7e119404f46f4bd59445533b17040"><enum>(c)</enum><header>Adjustment for inflation</header><text>Paragraph (2) of section 1004(d) of the Oil Pollution Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/33/2704">33 U.S.C. 2704(d)</external-xref>) (as redesignated by subsection (b)(2)) is amended—</text> 
<paragraph commented="no" display-inline="no-display-inline" id="id018D24CAD87740DBA8C59B34916ED0DD"><enum>(1)</enum><text>by striking <quote>The President</quote> and inserting <quote>The Secretary of the department in which the Coast Guard is located, in consultation with the Administrator of the Environmental Protection Agency and the Secretary of the Interior,</quote>; and</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="id7F66C73FA2A44563AD5722C75C457B21"><enum>(2)</enum><text>by striking <quote>significant</quote>.</text> </paragraph></subsection></section>
<section commented="no" display-inline="no-display-inline" id="idF243AED04AEB4724AD93917AAD8C56D1"><enum>4.</enum><header>Carriage of liquid bulk dangerous cargoes</header> 
<subsection commented="no" display-inline="no-display-inline" id="idF98A1C0ADF8845589EEAB26D9538A814"><enum>(a)</enum><header>Conditions for entry to ports in the United States</header><text>Section 9 of the Ports and Waterways Safety Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1228">33 U.S.C. 1228</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="idEC7160580D0845C1B9D3AC1558C05BFF" style="OLC"> 
<subsection id="id779688C6B0DF4E2AB0088888D0AE0A3C"><enum>(c)</enum><header>Risk of severe harm</header><text>Not later than January 1, 2006, the Secretary of the department in which the Coast Guard is located shall promulgate regulations under which the owner or operator of a port on the navigable waters of the United States may, after December 31, 2009, place restrictions on the entry into port of a tank vessel shipment presenting a risk of severe harm to the port or port region.</text> </subsection><after-quoted-block>.</after-quoted-block></quoted-block> </subsection>
<subsection commented="no" display-inline="no-display-inline" id="id55DC6156A90E481380E9AF0DBA53DB28"><enum>(b)</enum><header>Inspection and examination</header><text><external-xref legal-doc="usc" parsable-cite="usc/46/3714">Section 3714(a)</external-xref> of title 46, United States Code, is amended by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="id9422CC29FB9649A4A616109BD13E69AD" style="OLC"> 
<paragraph commented="no" display-inline="no-display-inline" id="id92CC25D88FE0492A97E22DF60694B1B5"><enum>(6)</enum><text>In addition to the inspections required under paragraphs (1) and (2), each single-hull tank vessel that is more than 15 years of age shall undergo an annual inspection in accordance with the Condition Assessment Scheme of the Marine Environment Protection Committee of the International Maritime Organization, adopted by Resolution 94(46) on April 27, 2001, as determined in accordance with regulations promulgated by the Secretary.</text> </paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </subsection></section>
<section commented="no" display-inline="no-display-inline" id="id7DF80258F06E4C9C9F5D2324B1B415A5"><enum>5.</enum><header>Study</header> 
<subsection commented="no" display-inline="no-display-inline" id="id3397575F1626468582CEA2A5594A6C60"><enum>(a)</enum><header>Administration</header><text>The Commandant of the Coast Guard shall offer to enter into a contract with the National Academy of Sciences to conduct a study to assess the total economic cost of oil spills, and the types of costs resulting from oil spills, in the United States.</text> </subsection>
<subsection commented="no" display-inline="no-display-inline" id="idB410E8C4F99C4D2A84BD5ECFBD9FDFF2"><enum>(b)</enum><header>Report</header><text>Not later than 1 year after the date of enactment of this Act, the Commandant of the Coast Guard shall submit to Congress a report describing the results of the study.</text> </subsection></section>
<section commented="no" display-inline="no-display-inline" id="id75321A98176340818E8FEF133CBB64F0"><enum>6.</enum><header>Effective date</header> 
<subsection commented="no" display-inline="no-display-inline" id="id1BE282F8081B44359C7C9FF3D4F0FC84"><enum></enum><text>This Act and the amendments made by this Act take effect on January 1, 2005.</text> </subsection></section>
