<official-title>To clarify that State tax incentives for business investment in equipment and facilities are a reasonable regulation of commerce and are not an undue burden upon interstate commerce.</official-title>

<section id="HD30165F2CCDA4E339FED619308155300" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Jobs Investment Act of 2004</short-title></quote>.</text></section> 
<section id="H0384813F05B44E64A7492845EBFCFF6" display-inline="no-display-inline"><enum>2.</enum><header>State tax incentives for investment in the acquisition, construction, installation, and rehabilitation of improvements, real estate, fixtures, equipment, and facilities</header> 
<subsection id="H8CB4743550C7453881176FC8FBAC2BD"><enum>(a)</enum><header>In general</header><text>A State may provide to any entity—</text> 
<paragraph id="H611E7D8C0D444A329270C68D25CE04D2"><enum>(1)</enum><text>a credit against any tax or fee owed to the State under a State law; or</text></paragraph> 
<paragraph id="HDB89CF8055E04833AC49DA3FB82D668B"><enum>(2)</enum><text>any other tax incentive, determined by the State to be appropriate, in an amount calculated under a formula determined by the State, for investment in the acquisition, construction, installation, and rehabilitation of improvements, real estate, fixtures, equipment, and facilities located in the State by the entity that receives such credit or such incentive.</text></paragraph></subsection> 
<subsection id="H41764AF7671D4F41A7C157A7AEBC4149"><enum>(b)</enum><header>Effect on interstate commerce</header><text>Any action taken by a State in accordance with this section with respect to a tax or fee payable, or incentive applicable, for any period beginning after the date of the enactment of this Act shall—</text> 
<paragraph id="HC846803DE1F44493A6A387D18BA49125"><enum>(1)</enum><text>be considered to be a reasonable regulation of commerce; and</text></paragraph> 
<paragraph id="H462040F9F0D84EB9BEBEB518310539BB"><enum>(2)</enum><text>not be considered an undue burden in interstate commerce or otherwise impair, restrain, or discriminate against interstate commerce.</text></paragraph></subsection></section>
