<section id="H873653AE72A84927A10373A7B41E9BB" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Iran Nuclear Proliferation Prevention Act</short-title></quote>.</text></section> 
<section id="H9E6A480318594118AB0386708344F800"><enum>2.</enum><header>Prohibition on nuclear trade with Iran</header> 
<subsection id="H219942190E7240D6BE5E2871FB62421B"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Chapter 11 of the Atomic Energy Act of 1954 is amended by adding at the end the following new section:</text>

<section id="H89B73493831F4C87BA57ABD808F92311"><enum>135.</enum><header>Prohibition on nuclear trade with Iran’s nuclear suppliers</header> 
<subsection id="H9FA78BF5FC294E23927F8000045B2078"><enum>(a)</enum><header>Prohibitions</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this Act, any international arrangement or any agreement for cooperation made pursuant to this Act, or any other provision of law, no license, approval, or authorization for the export or reexport, or transfer, or retransfer, whether directly or indirectly, of any—</text> 
<paragraph id="HB282A689607C47E599927904C6C3E5E3"><enum>(1)</enum><text>special nuclear material,</text></paragraph> 
<paragraph id="H83EF578DFB5E4FF5A6F4F4C69EBE1112"><enum>(2)</enum><text>source material,</text></paragraph> 
<paragraph id="H5B054A0AC4D64832A68100AF29D6234"><enum>(3)</enum><text>byproduct material,</text></paragraph> 
<paragraph id="H68471D6EDD5C452F84F3126784DCDD39"><enum>(4)</enum><text>production facility,</text></paragraph> 
<paragraph id="HF6F26DC16A27439DA9D5D032CA7B86CD"><enum>(5)</enum><text>utilization facility,</text></paragraph> 
<paragraph id="H2C56BDA051AF43E197053000A378A1CE"><enum>(6)</enum><text>items or components which are designed or intended to be used in a production or utilization facility, or with respect to which there is a risk of diversion for use in such a facility,</text></paragraph> 
<paragraph id="HB3CEC6997A35430E8987A2999B007017"><enum>(7)</enum><text>items or components which are designed or intended for use in the construction of a production or utilization facility,</text></paragraph> 
<paragraph id="H4207F9FA3EDB41B09DD418E331BFCA63"><enum>(8)</enum><text>items and assistance requiring any authorization, licensing, or other approval pursuant to this Act, or</text></paragraph> 
<paragraph id="H8E8C8C5558F04C94841447B41E544F00"><enum>(9)</enum><text>any nuclear-related items on the Commerce Control List maintained under part 774 of title 15, Code of Federal Regulations (or any successor to such list),</text></paragraph><continuation-text continuation-text-level="subsection">may be made to any country that the President determines has, since January 1, 2004, provided to the Islamic Republic of Iran any special nuclear material, source material, byproduct material, production facility, utilization facility, or items, components, or technologies which are or can be used in a production or utilization facility or in (or to develop, test, or manufacture) a nuclear explosive device.</continuation-text></subsection> 
<subsection id="HD8227A5EFA8343299C1F478DE4B02F6F"><enum>(b)</enum><header>Exceptions</header><text>Subsection (a) shall not apply to exports, reexports, transfers, or retransfers of radiation monitoring technologies, surveillance equipment, seals, cameras, tamper-indication devices, nuclear detectors, monitoring systems, or equipment necessary to safely store, transport, or remove hazardous materials, whether such items, services, or information are regulated by the Department of Energy, the Department of Commerce, or the Nuclear Regulatory Commission, except to the extent that such technologies, equipment, seals, cameras, devices, detectors, or systems are available for use in the design or construction of nuclear reactors or nuclear weapons.</text></subsection> 
<subsection id="HAB5451D704AC4D258BDEB059529925B8"><enum>(c)</enum><header>Waivers</header><text>The President may waive the application of subsection (a) to a country if the President determines and certifies to the Congress that the waiver will not result in any increased risk that the Islamic Republic of Iran will acquire nuclear weapons, nuclear reactors, or any materials or components of nuclear weapons and that—</text> 
<paragraph id="H5DB2835DA3F04691A43D9DD3B3498500"><enum>(1)</enum><text>the government of such country has not, within the preceding 12-month period, provided any material support to the Islamic Republic of Iran in acquiring nuclear materials, nuclear reactors, or any technology or component which is or could be used to manufacture a nuclear explosive device;</text></paragraph> 
<paragraph id="HC72F64810679430AB52155C5B88BA379"><enum>(2)</enum><text>in the judgment of the President, the government of such country has provided adequate, verifiable assurances that it will cease all further exports or transfers of nuclear-weapons-usable technology or material, and has put in place and enforced effective export controls on transfers or exports of such technology or material by nongovernmental entities;</text></paragraph> 
<paragraph id="H8E7813F2FC3A4F699DC731271135E02D"><enum>(3)</enum><text>the waiver is in the vital national security interest of the United States; or</text></paragraph> 
<paragraph id="HEB7A8EFD7F7444AEB1DC1C8F9977C934"><enum>(4)</enum><text>the waiver is essential to prevent or respond to a serious radiological hazard in the country receiving the waiver that may or does threaten public health and safety.</text></paragraph></subsection> 
<subsection id="H1F83C198AEE1447DAB00000086AA56A3"><enum>(d)</enum><header>Cooperative Threat Reduction Programs</header><text>This section shall not apply to any license, approval, or authorization which the President determines is necessary to implement Cooperative Threat Reduction Programs. For purposes of this subsection, Cooperative Threat Reduction Programs are the programs specified in section 1501(b) of the National Defense Authorization Act for Fiscal Year 1997 (<external-xref legal-doc="public-law" parsable-cite="pl/104/201">Public Law 104–201</external-xref>; 110 Stat. 2731; <external-xref legal-doc="usc" parsable-cite="usc/50/2362">50 U.S.C. 2362</external-xref> note).</text></subsection> 
<subsection id="H237DBF83FD594467B3E04F9B60C8E10"><enum>(e)</enum><header>Application</header><text>This section shall apply with respect to any license, approval, or authorization described in subsection (a) which is made, or required to be made, on or after the date of the enactment of this section.</text></subsection></section> <after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H3E5B74C48D2B4082962D7C606B012F3B"><enum>(b)</enum><header>Conforming amendment</header><text>The table of contents of the Atomic Energy Act of 1954 is amended by inserting after the item relating to section 134 the following new item:</text>

<toc-entry level="section">Sec. 135. Prohibition on nuclear trade with Iran’s nuclear suppliers</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block> </subsection></section> 
<section id="HBE71C547E19E4F3F89A98E57E4595098"><enum>3.</enum><header>Report to Congress</header><text display-inline="no-display-inline">Not later than 6 months after the date of the enactment of this Act, the President shall submit a report to the Congress containing the following information:</text> 
<paragraph id="H95260E1843254D9B00D472A473344EE1"><enum>(1)</enum><text>A complete list of missile and nuclear materials and technology provided to Iran by any entity in the People’s Republic of China, including the Chinese Government, or by the government of, or any other entity in, any other country. </text></paragraph> 
<paragraph id="H4F1FAE63DA4F45958FCFCC187D724003"><enum>(2)</enum><text>An estimate and assessment of the current status of efforts by Iran to acquire nuclear explosives and their delivery vehicles.</text></paragraph> 
<paragraph id="HCFAA38DC790A4DF2885E939CB1756421"><enum>(3)</enum><text>An assessment of the extent to which the agreement recently reached between the Islamic Republic of Iran and the governments of Great Britain, France, and Germany could effectively limit further efforts by Iran to acquire nuclear explosives.</text></paragraph> 
<paragraph id="H4F0B8B89516041F48EBB4600D740D07D"><enum>(4)</enum><text>An evaluation of the basis for and credibility of claims recently set forth by an Iranian resistance group that Iran may be enriching uranium at a secret facility unknown to United Nations weapons inspectors.</text></paragraph> 
<paragraph id="H4FEAE36DF4C64C358C2FC16767CD907"><enum>(5)</enum><text>Whether the United States has provided United Nations and International Atomic Energy Agency (IAEA) weapons inspectors with full access to the intelligence that forms the basis for any conclusion that Iran is actively pursuing a nuclear weapons program.</text></paragraph> 
<paragraph id="HF3ADFADB5CC84372B6F2464C8750ED8E"><enum>(6)</enum><text>The steps the United States is taking to ensure that the United Nations and IAEA inspectors receive full access to all suspected Iranian nuclear sites and that the United States works together with the international community to ensure that Iran provides such inspectors with full cooperation in their efforts to verify that Iran has complied with its obligations under the Treaty on the Non-Proliferation of Nuclear Weapons and the agreement referred to in paragraph (3).</text></paragraph></section>
