<official-title>To provide for immigration relief in the case of certain immigrants who are innocent victims of immigration fraud.</official-title>

<section id="HA16B3FC66730483B9351479397EA4F75" section-type="section-one"><enum>1.</enum><header>Immigration relief for innocent victims of immigration fraud</header> 
<subsection id="H481ECF69105F4DBA9B31FF1662AEEA00"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"></text> 
<paragraph id="H92613D338C3F4E318CC23077D1807B36"><enum>(1)</enum><header>Relief upon approval of application</header><text>If an alien, upon application to the Secretary of Homeland Security, establishes to the satisfaction of the Secretary that such alien is an eligible alien (as defined in subsection (b)) and is, but for the specified immigration fraud, admissible to the United States as an immigrant and is not removable from the United States, the Secretary shall provide immigration relief for such alien under subsection (c).</text></paragraph> 
<paragraph id="H467BC041C0EB45D0B5B7A8137787F64"><enum>(2)</enum><header>Relief pending approval</header><text display-inline="yes-display-inline">In the case of an eligible alien, the Secretary shall suspend any pending proceedings providing for revocation of adjustment of status, revocation of naturalization, or removal with respect to such eligible alien in order to provide such alien with a reasonable opportunity to apply for immigration relief under this section and during the pendency of the application for such relief.</text></paragraph></subsection> 
<subsection id="H01195EC42F65457EAF7D2E5C5EF24C9B"><enum>(b)</enum><header>Eligible alien, specified immigration fraud defined</header><text>For purposes of this section:</text> 
<paragraph id="HA4F2E2FB24D548E2B1CEE41B459E5CFA"><enum>(1)</enum><header>Eligible alien</header><text>The term <quote>eligible alien</quote> means an alien—</text> 
<subparagraph id="H12712445E6F64A76B5FB4386F9008B8C"><enum>(A)</enum><text display-inline="yes-display-inline">who obtained status as a nonimmigrant on or after January 1, 1980, and who, at the time of obtaining such status, was a national of the Republic of Korea;</text></subparagraph> 
<subparagraph id="HB6241E35DFC24958B78856EDEE3F4DBD"><enum>(B)</enum><text display-inline="yes-display-inline">who applied, before January 1, 1999, through one or more immigration brokers for adjustment of such status to that of the status of an alien lawfully admitted to the United States for permanent residence, and who applied through the Immigration and Naturalization office located in San Jose, California;</text></subparagraph> 
<subparagraph id="H9886C35893C248CC94426FC42F91ECEC"><enum>(C)</enum><text display-inline="yes-display-inline">whose application for adjustment of status described in subparagraph (B) was approved as a result of bribery by such immigration brokers of a supervisor of the Immigration and Naturalization Service for such office; and</text></subparagraph> 
<subparagraph id="H611268A702CD412EA221EA23954894B4"><enum>(D)</enum><text>who had no actual knowledge of such fraud at the time of such adjustment.</text></subparagraph></paragraph> 
<paragraph id="HD644C8CB1FDB4C7B9932C672A0CDD115"><enum>(2)</enum><header>Treatment of spouses and children</header><text>Such term includes an alien who obtained lawful permanent resident status as the spouse or child of an eligible alien described in paragraph (1). </text></paragraph> 
<paragraph id="H3353CC4C7CB04D7C9EB72E88AF2D35A0"><enum>(3)</enum><header>Specified immigration fraud</header><text>The term <quote>specified immigration fraud</quote> means the bribery described in paragraph (1)(C).</text></paragraph> </subsection> 
<subsection id="HB09A3AFD2ABC4E25008DCD39833FC529"><enum>(c)</enum><header>Form of immigration relief</header><text></text> 
<paragraph id="HC31ED550ADAA42E8B038D61562DF1DE9"><enum>(1)</enum><header>In general</header><text>If an application of an eligible alien under subsection (a) is approved, then—</text> 
<subparagraph id="HC1DE48C4C7814DAD83E12FE59786EA25"><enum>(A)</enum><text>the specified immigration fraud shall not be considered in determining the admissibility or removeability of such alien; and</text></subparagraph> 
<subparagraph id="H7C30961823BD4AFAAFC815770485FE73"><enum>(B)</enum><text>the Secretary shall provide for the restoration of the alien’s status as if the original adjustment of status described in subsection (b)(1)(C) had been lawful, in accordance with the succeeding provisions of this subsection.</text></subparagraph> </paragraph> 
<paragraph id="H79C2C86667DF41ADBDE98BB7BFA2CAEF"><enum>(2)</enum><header>Restoration of status to lawful permanent resident</header><text display-inline="yes-display-inline">In the case of an approved application for an alien whose adjustment of status to lawful permanent resident status was rescinded solely as a result of the specified immigration fraud, the Secretary shall vitiate such rescission and shall restore the status of such alien to that of an alien lawfully admitted for permanent residence. Such restoration shall be effective as of the date of such rescission.</text> </paragraph> 
<paragraph id="H98E7CC5DE5B94D19B4322EC558A4F85"><enum>(3)</enum><header>Restoration of naturalization</header><text display-inline="yes-display-inline">In the case of an eligible alien who has been naturalized as a citizen of the United States and whose naturalization was revoked solely as a result of the specified immigration fraud, the Secretary shall vitiate such revocation and shall restore such citizenship status to such alien. Such restoration shall be effective as of the date of such revocation.</text> </paragraph> 
<paragraph id="H4677C429EFC2413FA53955151C07804D"><enum>(4)</enum><header>Parole into the United States for eligible aliens who have departed</header><text>In the case of an eligible alien who has been removed, or has voluntarily departed, from the United States in connection with charges relating to specified immigration fraud, the Secretary shall parole such alien into the United States for the purpose of filing an application for immigration relief under this section.</text></paragraph></subsection> 
<subsection id="H04D837CD2114430CAD0860C9DEC28CF6"><enum>(d)</enum><header>Procedures and definitions</header> 
<paragraph id="HFAC078337AEA41DCA4EA34E103FA23CF"><enum>(1)</enum><header>Procedures for application</header><text>An alien seeking immigration relief under this section shall submit to the Secretary an application at such time, in such manner, and containing such information as the Secretary shall require. The Secretary shall not charge such alien a fee in connection with such application.</text></paragraph> 
<paragraph id="H7501E5C5BBC34DD891DAE36118ACD36"><enum>(2)</enum><header>No reduction in number of immigrant visas available</header><text>The Secretary of State shall not reduce the number of immigrant visas authorized to be issued under the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101 et seq.</external-xref>) if an application of an eligible alien for immigration relief under this section is approved.</text></paragraph> 
<paragraph id="HCEB5A5071C6343FAAF193EC19B165000"><enum>(3)</enum><header>Application of other definitions</header><text display-inline="yes-display-inline">For purposes of this section and except as otherwise specifically provided, the term <quote>Secretary </quote> means the Secretary of Homeland Security and the definitions contained in the Immigration and Nationality Act shall apply in the administration of this section. Nothing in this section shall be construed to repeal, amend, alter, modify, affect, or restrict the powers, duties, functions, or authority of the Secretary in the administration and enforcement of such Act or any other law relating to immigration, nationality, or naturalization. The fact that an alien may be eligible for immigration relief under this section shall not preclude such alien from seeking immigration relief under any other provision of law for which such alien may be eligible.</text></paragraph></subsection> </section>
