<official-title>To provide certain enhancements to the Montgomery GI Bill Program for certain individuals who serve as members of the Armed Forces after the September 11, 2001, terrorist attacks, and for other purposes.</official-title>

<section id="H71E4EE5FFB364700A5918C74DC64E698" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>G.I. Bill Enhancement Act of 2004</short-title></quote>.</text></section> 
<section section-type="subsequent-section" id="HDB1EF5F7FBAE44FBAF2CD7808329DFCE" display-inline="no-display-inline"><enum>2.</enum><header>Exemption from payment of individual contributions under montgomery GI bill of individuals who serve as active duty members of the Armed Forces under Executive Order 13235</header> 
<subsection id="H24FCAE7EB96B497DA29979486D8FEC66"><enum>(a)</enum><header>Active duty program</header><text>Notwithstanding <external-xref legal-doc="usc" parsable-cite="usc/38/3011">section 3011(b)</external-xref> of title 38, United States Code, no reduction in basic pay otherwise required by such section shall be made in the case of a covered member of the Armed Forces.</text></subsection> 
<subsection id="H85C377AC0D9E4AE9AF19D95B2D536344"><enum>(b)</enum><header>Selected reserve program</header><text>Notwithstanding section 3012(c) of such title, no reduction in basic pay otherwise required by such section shall be made in the case of a covered member of the Armed Forces.</text></subsection> 
<subsection id="HFBA750327C4B4E3500911B847464F197"><enum>(c)</enum><header>Termination of on-going reductions in basic pay</header><text>In the case of a covered member of the Armed Forces who first became a member of the Armed Forces or first entered on active duty as a member of the Armed Forces before the date of the enactment of this Act and whose basic pay would, but for subsection (a) or (b) of this section, be subject to reduction under section 3011(b) or 3012(c) of such title for any month beginning on or after that date, the reduction of basic pay of such covered member of the Armed Forces under such section 3011(b) or 3012(c), as applicable, shall cease commencing with the first month beginning on or after that date.</text></subsection> 
<subsection id="H80D48B08709645B383D2C1C7D8F7DB34"><enum>(d)</enum><header>Refund of contributions</header> 
<paragraph display-inline="yes-display-inline" id="H49F1373CCC5C441DBFE5599BA6152649"><enum>(1)</enum><text>In the case of any covered member of the Armed Forces whose basic pay was reduced under section 3011(b) or 3012(c) of such title for any month beginning before the date of the enactment of this Act, the Secretary concerned shall pay to such covered member of the Armed Forces an amount equal to the aggregate amount of reductions of basic pay of such member of the Armed Forces under such section 3011(b) or 3012(c), as applicable, as of that date.</text></paragraph> 
<paragraph indent="up1" id="H11ECAD53108B48DBA2BF9E65E50165FD"><enum>(2)</enum><text>Any amount paid to a covered member of the Armed Forces under paragraph (1) shall not be included in gross income under the Internal Revenue Code of 1986.</text></paragraph> 
<paragraph indent="up1" id="H71903AD4590D42608484B34400EF3D47"><enum>(3)</enum><text>Amounts for payments under paragraph (1) shall be derived from amounts appropriated or otherwise made available to the Secretary concerned for military personnel in chapter 1 of title I of the Emergency Supplemental Appropriations Act for Defense and for the Reconstruction of Iraq and Afghanistan, 2004 (<external-xref legal-doc="public-law" parsable-cite="pl/108/106">Public Law 108–106</external-xref>; 117 Stat. 1209).</text></paragraph> 
<paragraph indent="up1" id="HCB981FF426924FF6B6DC17E1C5453E01"><enum>(4)</enum><text>In this subsection, the term <term>Secretary concerned</term> means—</text> 
<subparagraph id="H0076E161B3854189A0B4846BE1F8DE"><enum>(A)</enum><text>the Secretary of the Army, with respect to matters concerning the Army;</text></subparagraph> 
<subparagraph id="HF4CBA53D595246C99728487E80F6DA8B"><enum>(B)</enum><text>the Secretary of the Navy, with respect to matters concerning the Navy or the Marine Corps;</text></subparagraph> 
<subparagraph id="H8F47014256AB4AB0972EFEDDE5E359BA"><enum>(C)</enum><text>the Secretary of the Air Force, with respect to matters concerning the Air Force; and</text></subparagraph> 
<subparagraph id="H5930FD095D9B4908851E63B028CABB7"><enum>(D)</enum><text>the Secretary of Homeland Security, with respect to matters concerning the Coast Guard.</text></subparagraph></paragraph></subsection> 
<subsection id="HB36E89AA38CB4D808F4286DA18D60601"><enum>(e)</enum><header>Covered member of the Armed Forces defined</header><text>In this section, the term <term>covered member of the Armed Forces</term> means any individual who serves on active duty as a member of the Armed Forces during the period—</text> 
<paragraph id="HD475EE2F7612400FB8A6F3CA8EFB14CF"><enum>(1)</enum><text>beginning on November 16, 2001, the date of Executive Order 13235, relating to National Emergency Construction Authority; and</text></paragraph> 
<paragraph id="HB0FBFA019F0F4AD3815763F763555319"><enum>(2)</enum><text>ending on the termination date of the Executive order referred to in paragraph (1).</text></paragraph></subsection></section> 
<section id="H3460E42B6BCA4A50BA1200D5B3423FF"><enum>3.</enum><header>Opportunity for individuals who serve as active duty members of the Armed Forces under Executive Order 13235 to withdraw election not to enroll in montgomery GI bill</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/38/3018">Section 3018</external-xref> of title 38, United States Code, is amended—</text> 
<paragraph id="H688DA03A744442D9BCAB4820CA3C46E4"><enum>(1)</enum><text>by redesignating subsections (c) and (d) as subsection (d) and (e), respectively;</text></paragraph> 
<paragraph id="HE088830FCF4F45D18BF4F983EDC7EE3"><enum>(2)</enum><text>by inserting after subsection (b) the following new subsection (c):</text>

<subsection id="HA8FF93E6DC2D449FBAAD6083AD6216A7"><enum>(c)</enum> 
<paragraph display-inline="yes-display-inline" id="H05E7F7467528444CB60876B4A8063EFF"><enum>(1)</enum><text>Notwithstanding any other provision of this chapter, during the one-year period beginning on the date of the enactment of this subsection, an individual who—</text> 
<subparagraph indent="up1" id="H3EFE981936104EC2A4BB3F233CA7ECFE"><enum>(A)</enum><text>serves on active duty as a member of the Armed Forces during the period beginning on November 16, 2001, and ending on the termination date of Executive Order 13235, relating to National Emergency Construction Authority; and</text></subparagraph> 
<subparagraph indent="up1" id="H94F9297E099D470CB0B4BE59506C7E4E"><enum>(B)</enum><text>has served continuously on active duty without a break in service following the date the individual first becomes a member or first enters on active duty as a member of the Armed Forces,</text></subparagraph></paragraph><continuation-text continuation-text-level="subsection">shall have the opportunity, on such form as the Secretary of Defense shall prescribe, to withdraw an election under section 3011(c)(1) or 3012(d)(1) of this title not to receive education assistance under this chapter.</continuation-text> 
<paragraph indent="up1" id="H6F8D1BF4F4E145C7A505778438E2CA5"><enum>(2)</enum><text>An individual described paragraph (1) who made an election under section 3011(c)(1) or 3012(d)(1) of this title and who—</text> 
<subparagraph id="HB850BA14604C4F5687286E16B57CE9D5"><enum>(A)</enum><text>while serving on active duty during the one-year period beginning on the date of the enactment of this subsection makes a withdrawal of such election;</text></subparagraph> 
<subparagraph id="HF7F857E8247148888FA0AC651B8375C0"><enum>(B)</enum><text>continues to serve the period of service which such individual was obligated to serve;</text></subparagraph> 
<subparagraph id="HC55D75D8B79A48D78600B853A9AB1B36"><enum>(C)</enum><text>serves the obligated period of service described in subparagraph (B) or before completing such obligated period of service is described by subsection (b)(3)(B); and</text></subparagraph> 
<subparagraph id="H50B048E894C54636BFC426743392E454"><enum>(D)</enum><text>meets the requirements set forth in paragraphs (4) and (5) of subsection (b),</text></subparagraph></paragraph><continuation-text continuation-text-level="subsection">is entitled to basic educational assistance under this chapter.</continuation-text></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H5624684D2FEA4E0D86FEC13E219C6C2"><enum>(3)</enum><text>in subsection (e), as so redesignated, by inserting <quote>or (c)(2)(A)</quote> after <quote>(b)(1)</quote>.</text></paragraph></section>
