<official-title>To amend the Internal Revenue Code of 1986 to allow a deduction from gross income for uncompensated education costs incurred by veterans’ survivors and dependents who are in receipt of educational assistance under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/35">chapter 35</external-xref> of title 38, United States Code.</official-title>

<section id="HDBB57348D2994B14A8721E00E796F9E1" section-type="section-one"><enum>1.</enum><header>Findings</header><text display-inline="no-display-inline">The Congress finds that—</text> 
<paragraph id="H4FAA6ABFEEE24C208FEE8B75D7C83DE4"><enum>(1)</enum><text display-inline="yes-display-inline">the United States owes a debt to those men and women who have lost their lives or have become completely and permanently disabled in the line of duty while defending the Nation in the war on terrorism;</text></paragraph> 
<paragraph id="HE703C870031A434700118B681B31AE3C"><enum>(2)</enum><text>the United States owes a debt to the families of these fallen heroes for their sacrifices; and </text></paragraph> 
<paragraph id="H615868484AE442BAA0A8F8ED05973E1"><enum>(3)</enum><text>one way to begin repaying this debt would be to ensure that the children of these fallen heroes have access to higher education.</text></paragraph></section> 
<section id="H82F5056CC111402CA13DBCEDFA62A398" section-type="subsequent-section" display-inline="no-display-inline"><enum>2.</enum><header>Deduction of education costs of veterans’ survivors and dependents</header> 
<subsection id="H64A5D84846DF453100AE78E5F3CBD4D1"><enum>(a)</enum><header>In general</header><text>Part VII of subchapter B of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/1">chapter 1</external-xref> of the Internal Revenue Code of 1986 (relating to additional itemized deductions for individuals) is amended by redesignating section 224 as section 225 and by inserting after section 223 the following new section:</text>

<section id="H8CEE12BF89B5446A00D2C4ED26CF93EF"><enum>224.</enum><header>Education costs of veterans’ survivors and dependents</header> 
<subsection id="H80CA9DBAE16048FFAE6EF22E4EF4AE13"><enum>(a)</enum><header>Deduction allowed</header><text display-inline="yes-display-inline">In the case of an individual, there shall be allowed as a deduction for the taxable year an amount equal to the amount paid by the taxpayer during the taxable year (for education furnished to the eligible person during any academic period beginning in such taxable year) for qualified education expenses.</text></subsection> 
<subsection id="H3BDFFB3EE2FB4715BAE5A4175C57404"><enum>(b)</enum><header>Eligible person</header><text>For purposes of subsection (a), the term <term>eligible person</term> has the meaning given such term by <external-xref legal-doc="usc" parsable-cite="usc/38/3501">section 3501(a)(1)</external-xref> of title 38, United States Code. </text></subsection> 
<subsection id="H99B951B89D4E4EBC848CD404ED00C8C7"><enum>(c)</enum><header>Qualified education expenses</header><text>For purposes of subsection (a)—</text> 
<paragraph id="H7960D57AD5894432A1572871136FC287"><enum>(1)</enum><header>In general</header><text>The term <term>qualified education expenses</term> means expenses for educational assistance to which the eligible person would be entitled for a month under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/35">chapter 35</external-xref> of title 38, United States Code, but for the maximum amount of educational assistance allowance payable for such month under section 3532 of such chapter.</text></paragraph> 
<paragraph id="H3C876C8A05D44FF99FFD00976E1D3584"><enum>(2)</enum><header>Coordination with other education-related benefits</header><text display-inline="yes-display-inline">The amount of qualified education expenses for any taxable year shall be reduced by the sum of—</text> 
<subparagraph id="H6407582EC06C4BE6BAB02E2194009D23"><enum>(A)</enum><text>the amount excluded from gross income under section 127, 135, 529, or 530 by reason of such expenses, and </text></subparagraph> 
<subparagraph id="H430CBE0968364E198F57715026047F00"><enum>(B)</enum><text>the amount of any scholarship, allowance, or payment described in section 25A(g)(2).</text></subparagraph></paragraph></subsection> </section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H666FE4B961654F7EA926F5982FA848F9"><enum>(b)</enum><header>Deduction allowed whether or not individual itemizes other deductions</header><text>Subsection (a) of section 62 of such Code is amended by inserting after paragraph (19) the following new paragraph: </text>

<subsection id="H9DCD73E8675446BB8BEDEB5E4B6F6986"><enum>(c)</enum><header>Clerical amendment</header><text>The table of sections for part VII of subchapter B of chapter 1 of such Code is amended by striking the last item and inserting the following new items: </text>
