<official-title>To amend title 39, United States Code, to provide for free mailing privileges for personal correspondence and parcels sent by family members from within the United States to members of the Armed Forces serving on active duty in Iraq or Afghanistan.</official-title>

<section id="HA66A5B78951A47A18CD062D3B73F20A2" section-type="section-one"><enum>1.</enum> <header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote>Mailing Support to Troops Act of 2004</quote>.</text></section> 
<section id="H38560769A6C24D80B10673A046715AF"><enum>2.</enum><header>Free mailing privileges</header> <text display-inline="no-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/39/34">Chapter 34</external-xref> of title 39, United States Code, is amended by adding at the end the following:</text>

<section id="HBB0BD773B93445B1AAF0B206C9B7DBA5"><enum>3407.</enum><header>Free postage for personal correspondence and parcels sent by family members to members of the Armed Forces of the United States serving in Iraq or Afghanistan</header> 
<subsection id="H2C609B546FE34AA8B1A1D505788D5DC0"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Any mail matter to which this section applies may be mailed free of postage if such mail matter—</text> 
<paragraph id="H5A74A0A90FE94144B3EC2A0CFD7AAFD"><enum>(1)</enum><text>is addressed to an individual who—</text> 
<subparagraph id="HE6292058E6AE4B369D50CC411853005F"><enum>(A)</enum><text>is a member of the Armed Forces of the United States on active duty (as defined in <external-xref legal-doc="usc" parsable-cite="usc/10/101">section 101</external-xref> of title 10); and</text></subparagraph> 
<subparagraph id="HAD43AD8C1695412E982EA8CCAEED2416"><enum>(B)</enum> 
<clause id="H3AA3284A109B44A1A4EBD5824CC9C6EB" display-inline="yes-display-inline"><enum>(i)</enum><text>is serving in Iraq or Afghanistan; or</text></clause> 
<clause id="H22D058A79FC14C130049289901C17F1D" indent="up1"><enum>(ii)</enum><text>is hospitalized at a facility under the jurisdiction of the Armed Forces of the United States as a result of a disease or injury incurred as a result of service in Iraq or Afghanistan; and</text></clause></subparagraph></paragraph> 
<paragraph id="H23F0294761284059BAA996F287242DC5"><enum>(2)</enum><text display-inline="yes-display-inline">is sent—</text> 
<subparagraph id="HC0C166F7505E446CB62E53CE7D54B1B0"><enum>(A)</enum><text>by a family member (as defined in <external-xref legal-doc="usc" parsable-cite="usc/37/411h">section 411h</external-xref> of title 37) of the individual referred to in paragraph (1); and</text></subparagraph> 
<subparagraph id="HFB18DDF2C87C42F700B8957787CB58A"><enum>(B)</enum><text>from within an area served by a United States post office.</text></subparagraph> </paragraph> </subsection> 
<subsection id="H8BCEE83ECC1F4484A9B930B6C900FD53"><enum>(b)</enum><header>Applicability</header><text display-inline="yes-display-inline">The free mailing privilege made available by this section—</text> 
<paragraph id="H65EAD1698A2F4F578FA5DB6439978E12"><enum>(1)</enum><text>shall apply with respect to—</text> 
<subparagraph id="HF829098A259B40E40049740635B3D118"><enum>(A)</enum><text>letter mail or sound- or video-recorded communications having the character of personal correspondence; and</text></subparagraph> 
<subparagraph id="H7FCA548B3F2C4FBEBBB39921FCB5BEE4"><enum>(B)</enum><text>parcels not exceeding the maximum size allowed by the Postal Service and the Department of Defense for parcels sent to members of the Armed Forces serving in Iraq or Afghanistan; and</text></subparagraph></paragraph> 
<paragraph id="H093B499994274A40A0E3EF23EC05DFE"><enum>(2)</enum><text>shall not apply with respect to mail matter that contains any advertising.</text></paragraph> </subsection> 
<subsection id="HF6EF30545984480F99DF59FE84744171"><enum>(c)</enum><header>Rate of postage</header><text>Any mail matter mailed under this section shall be mailed at the equivalent rate of postage which assures that such mail matter will be sent by the most economical means practicable.</text></subsection> 
<subsection id="H45976125DF124EC0873EE9757DE67D12"><enum>(d)</enum><header>Marking</header><text>All mail matter mailed under this section shall bear, in the upper right-hand corner of the address area, the words <quote>Free Matter for Member of the Armed Forces of the United States</quote> or words to that effect specified by the Postal Service.</text></subsection> 
<subsection id="HCBC53E3A835F4A7D94499E6C17529245"><enum>(e)</enum><header>Regulations</header><text>Not later than 30 days after the date of the enactment of this section, the Postal Service shall, in consultation with the Secretary of Defense, prescribe any regulations necessary to carry out this section.</text> </subsection> 
<subsection id="HF637510F6D53422B004F283B53119DE2"><enum>(f)</enum><header>Duration</header><text display-inline="yes-display-inline">The free mailing privilege made available by this section shall apply with respect to mail matter sent during the 1-year period beginning on the date on which the regulations under subsection (e) take effect.</text> </subsection> </section><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H4076C06A268047B4873B26CE09B161FE"><enum>3.</enum><header>Funding</header> 
<subsection id="HC502D77D72DC4E009B079726B1F68457"><enum>(a)</enum><header>In general</header><text>Sections <external-xref legal-doc="usc" parsable-cite="usc/39/2401">2401(c)</external-xref> and <external-xref legal-doc="usc" parsable-cite="usc/39/3627">3627</external-xref> of title 39, United States Code, are amended by striking <quote>3406</quote> and inserting <quote>3407</quote>.</text></subsection> 
<subsection id="HAC5BD0327C864DFF8B1E7ED2EA6B7CDC"><enum>(b)</enum><header>Air transportation</header> 
<paragraph id="H2D8CFBD32D4649C68B8DE0AF96EEC72E"><enum>(1)</enum><header>In general</header><text><external-xref legal-doc="usc" parsable-cite="usc/39/2401">Section 2401</external-xref> of title 39, United States Code, is amended by redesignating subsections (d) through (g) as subsections (e) through (h), respectively, and by inserting after subsection (c) the following:</text>

<subsection id="HE6526D3615FE45DEB0846EF238572793"><enum>(d)</enum><text>There are authorized to be appropriated to the Postal Service each year a sum determined by the Postal Service to be equal to the expenses incurred by the Postal Service in providing air transportation for mail sent to members of the Armed Forces of the United States free of postage under section 3407, not including the expense of air transportation that is provided by the Postal Service at the same postage rate or charge for mail which is not addressed to an Armed Forces post office.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H02757E9720B445A990069C2D721E5581"><enum>(2)</enum><header>Amendment to prevent duplicative funding</header><text><external-xref legal-doc="usc" parsable-cite="usc/39/3401">Section 3401(e)</external-xref> of title 39, United States Code, is amended—</text> 
<subparagraph id="H79D5DB64702643E08FD7AEBFDBD3F36"><enum>(A)</enum><text>by striking <quote>transportation or (2)</quote> and inserting <quote>transportation, (2)</quote>; and </text></subparagraph> 
<subparagraph id="H56DC576E966949D3A7A479471466756E"><enum>(B)</enum><text>by striking <quote>office.</quote> and inserting <quote>office, or (3) for which amounts are authorized to be appropriated to the Postal Service under section 2401(d).</quote>.</text></subparagraph></paragraph> </subsection></section> 
<section id="H7944A55EA9FB417A9D88B6D0F668966"><enum>4.</enum><header>Technical and conforming amendments</header> 
<subsection id="H5F93FE14C7194B148DA2FA154F75701"><enum>(a)</enum><header>Annual budget</header><text><external-xref legal-doc="usc" parsable-cite="usc/39/2009">Section 2009</external-xref> of title 39, United States Code, is amended in the next to last sentence by striking <quote>(b) and (c)</quote> and inserting <quote>(b), (c), and (d)</quote>.</text></subsection> 
<subsection id="H96B2AE1FDA1245A1926F228B5E80A8D"><enum>(b)</enum><header>Comprehensive plan references</header><text>Sections <external-xref legal-doc="usc" parsable-cite="usc/39/2803">2803(a)</external-xref> and <external-xref legal-doc="usc" parsable-cite="usc/39/2804">2804(a)</external-xref> of title 39, United States Code, are amended by striking <quote>2401(g)</quote> and inserting <quote>2401(f)</quote>.</text></subsection> 
<subsection id="HE83E5B87E3994150BFD971449DB22DD5" display-inline="no-display-inline"><enum>(c)</enum><header>Chapter analysis</header><text>The analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/39/34">chapter 34</external-xref> of title 39, United States Code, is amended by adding at the end the following:</text>
