<official-title>To provide that members of the Armed Forces and Selected Reserve may transfer certain educational assistance benefits to dependents, and for other purposes.</official-title>

<section id="H5B21C9B96B3C49229BF7E95C83007BF8" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote>Servicemembers’ Flexible Educational Assistance Act</quote>. </text></section> 
<section id="H5377FAAEBBF6497EA033CF6CD0D7B425"><enum>2.</enum><header>Transfer of entitlement to basic educational assistance</header> 
<subsection id="H3E7FA06784714663A9D23FF1177BDEDF"><enum>(a)</enum><header>All-volunteer force educational assistance program</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/30">Chapter 30</external-xref> of title 38, United States Code, is amended—</text> 
<paragraph id="H73C651280DA3453FA1A670036E7C1D70"><enum>(1)</enum><text>in the table of contents by striking the item relating to section 3020 and inserting the following:</text>

<toc-entry level="section">3020. Transfer of entitlement to basic educational assistance</toc-entry></toc><after-quoted-block>;</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HC19EB68A7C6A4A5097A06F731E811420"><enum>(2)</enum><text>in section 3018—</text> 
<subparagraph id="H99268608514A4A2400033D1DD1EB2DE9"><enum>(A)</enum><text>in subsection (c) by inserting <quote>or (e)</quote> after <quote>subsection (b)(1)</quote>; and</text></subparagraph> 
<subparagraph id="H11E10CD2818A45E783B6A206CF8BF034"><enum>(B)</enum><text>by adding at the end the following new subsection:</text>

<subsection id="H24063ACD5DE44110B2A5C76E59957338"><enum>(e)</enum><text>An individual who made an election under section 3011(c)(1) or 3012(d)(1) may withdraw such election not later than one year after the date of enactment of this subsection if—</text> 
<paragraph id="H788F92B560FE41418986920075736F7F"><enum>(1)</enum><text>the period described in section 3031 that is applicable to such individual has not expired; and</text></paragraph> 
<paragraph id="HB8C37888287F40A0ACAA9555DA660C3"><enum>(2)</enum><text>such individual elects to transfer entitlement to educational assistance under section 3020.</text></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="HA0C59AE2EA6B427FA2B5C16BB3D3DF7C"><enum>(3)</enum><text>by amending section 3020 to read as follows:</text> 
<quoted-block style="USC" id="HB9E6BE8E70A946E9A95F9DECD12E83AF" display-inline="no-display-inline"> 
<section id="HFF9D39B2CDED485B811444098010DECA"><enum>3020.</enum><header>Transfer of entitlement to basic educational assistance</header> 
<subsection id="HD04CB564A6434AC181D49767F9B44FCD"> <enum>(a)</enum> <header>In General</header> <text display-inline="yes-display-inline">An individual who is entitled to basic educational assistance under this subchapter may elect to transfer to one or more of the dependents specified in subsection (b) a portion of such individual’s entitlement to such assistance. An individual transferring entitlement under this section shall submit written notice to the Secretary concerned not later than the expiration date of the period described in section 3031 that is applicable to such individual. </text> </subsection> 
<subsection id="H2F66AECE69A24F9FA84DCA2485A04F13"> <enum>(b)</enum> <header>Eligible Dependents</header> <text>An individual may transfer entitlement under this section as follows:</text> 
<paragraph id="H9598E1CB30704859AC81980400AF7B64"> <enum>(1)</enum> <text>To the individual’s spouse.</text> </paragraph> 
<paragraph id="H04528DB0E01E47B48B7C92FEC7E930F"> <enum>(2)</enum> <text>To one or more of the individual’s children.</text> </paragraph> 
<paragraph id="H330414BD9B3F4FE093A9E5FE236B7CF"> <enum>(3)</enum> <text>To a combination of the individuals referred to in paragraphs (1) and (2).</text> </paragraph> </subsection> 
<subsection id="HA1CB13BF6BE44AD7A1F7ABAB00F7AFA6"> <enum>(c)</enum> <header>Designation of Transferee</header> <text>An individual transferring entitlement under this section shall—</text> 
<paragraph id="H0BC2BB653F7544AFBAD2A61F2800CA31"> <enum>(1)</enum> <text>designate the dependent or dependents to whom such entitlement is being transferred;</text> </paragraph> 
<paragraph id="HF94CA78AF6DC4B1498009023C11D6998"> <enum>(2)</enum> <text>designate the number of months of such entitlement to be transferred to each such dependent; and</text> </paragraph> 
<paragraph id="HCA949BA68EFE4DD793B9DE7616A29328"> <enum>(3)</enum> <text>specify the period for which the transfer shall be effective for each such dependent.</text> </paragraph> </subsection> 
<subsection id="HB3119A8B67D04B549C3D63930079FE93"> <enum>(d)</enum> <header>Revocation and Modification</header><text>An individual transferring entitlement under this section may modify or revoke at any time the transfer of any unused portion of the entitlement so transferred. The modification or revocation of the transfer of entitlement under this subsection shall be made by the submittal of written notice of the action to both the Secretary concerned and the Secretary of Veterans Affairs.</text> </subsection> 
<subsection id="H3CAB867F1BFF4871B6BC216DD7197994"> <enum>(e)</enum> <header>Commencement of Use</header> <text display-inline="yes-display-inline">If the dependent to whom entitlement is transferred under this section is a child, the use of the transferred entitlement may not commence until the child—</text> 
<paragraph id="H026C8AE77ED648EBB0DA0DF6CCEFE3"> <enum>(1)</enum> <text>completes the requirements of a secondary school diploma (or equivalency certificate); or</text> </paragraph> 
<paragraph id="H5F98B134B0F54D86B13192F51EAE1501"> <enum>(2)</enum> <text>attains 18 years of age.</text></paragraph></subsection> 
<subsection id="H77E276C9AD5943E7B91DC392161B2ED0"><enum>(f)</enum><header>Time limitation for use of eligibility and entitlement</header><text>Notwithstanding section 3031, and subject to subsection (c)(3), a dependent to whom entitlement is transferred under this section may use such entitlement not later than the expiration date of a 20-year period beginning on the commencement date of the period described in section 3031 that is applicable to the individual who transferred such entitlement to the dependent.</text> </subsection> 
<subsection id="H067821E610814681001D6C85AB0398A9"> <enum>(g)</enum> <header>Additional Administrative Matters</header> 
<paragraph id="H478B316BD39D4F3BBA2D69D697873754" display-inline="yes-display-inline"> <enum>(1)</enum> <text>The use of any entitlement transferred under this section shall be charged against the entitlement of the individual making the transfer at the rate of one month for each month of transferred entitlement that is used.</text> </paragraph> 
<paragraph id="HA7C232522B55473D9F3913C8E5793FE6" indent="up1"> <enum>(2)</enum> <text>Except as provided under subsections (c)(2) and (3) and (f), and subject to paragraph (5) of this subsection, a dependent to whom entitlement is transferred under this section is entitled to basic educational assistance under this subchapter in the same manner as the individual from whom entitlement was transferred.</text> </paragraph> 
<paragraph id="HE38A1CB528454B65B19E90499C729FE2" indent="up1"> <enum>(3)</enum> 
<subparagraph id="H56BB255DBB3842A8BFC9945BE0101C4D" display-inline="yes-display-inline"> <enum>(A)</enum> <text>Subject to subparagraph (B), the monthly rate of educational assistance payable to a dependent to whom entitlement is transferred under this section shall be the monthly amount payable under sections 3015 and 3022 to the individual making the transfer.</text> </subparagraph> 
<subparagraph id="H3D8B6BEFC05444769EF13DA364597295" indent="up1"> <enum>(B)</enum> <text>The monthly rate of assistance payable to a dependent under subparagraph (A) shall be subject to the provisions of section 3032, except that the provisions of subsection (a)(1) of that section shall not apply even if the individual making the transfer to the dependent under this section is on active duty during all or any part of enrollment period of the dependent in which such entitlement is used.</text> </subparagraph> </paragraph> 
<paragraph id="H7F2BF3654CAA489992E7842C38209F27" indent="up1"> <enum>(4)</enum> <text>The death of an individual transferring entitlement under this section shall not affect the use of the transferred entitlement by the dependent to whom entitlement is transferred.</text> </paragraph> 
<paragraph id="HB2A530DBE4AA4E5DAC47581DD86DDAC8" indent="up1"> <enum>(5)</enum> <text>Notwithstanding subsection (f) and section 3031, a child to whom entitlement is transferred under this section may not use any entitlement so transferred after attaining the age of 26 years.</text> </paragraph> 
<paragraph id="H18736D18AC744D3081A87F5C1400EC2F" indent="up1"> <enum>(6)</enum> <text>Except as provided in subsection (e), the purposes for which a dependent to whom entitlement is transferred under this section may use such entitlement shall include the pursuit and completion of the requirements of a secondary school diploma (or equivalency certificate).</text> </paragraph> </subsection> 
<subsection id="HCF9B6A482C16408686F371DF7F01D7B2"> <enum>(h)</enum> <header>Overpayment</header><text>In the event of an overpayment of basic educational assistance with respect to a dependent to whom entitlement is transferred under this section, the dependent and the individual making the transfer shall be jointly and severally liable to the United States for the amount of the overpayment for purposes of section 3685.</text> </subsection> 
<subsection id="H38E1183D1E204391AD54C6734545FDD9"> <enum>(i)</enum> <header>Regulations</header> <text>The Secretaries concerned shall prescribe regulations for purposes of this section. </text> </subsection> 
<subsection id="H7455517F6D8B44B3A36CB1FC56E74BDF"> <enum>(j)</enum> <header>Annual Report</header><text>Not later than January 31 of each calendar year (beginning in 2006), the Secretary of Defense, in consultation with the other Secretaries concerned, shall submit to the Committee on Armed Services and the Committee on Veterans’ Affairs of the House of Representatives and the Committee on Armed Services and the Committee on Veterans’ Affairs of the Senate a report on the number of individuals transferring entitlement to educational assistance under this section during the preceding fiscal year.</text> </subsection> 
<subsection id="H887B1024D7014EE0A10096E028763819"> <enum>(k)</enum> <header>Secretary Concerned Defined</header> <text>Notwithstanding section 101(25), in this section the term <term>Secretary concerned</term> means—</text> 
<paragraph id="H8C29D7E038BF4DA385B1A1F4FFBABE00"> <enum>(1)</enum> <text>the Secretary of the Army with respect to matters concerning the Army;</text> </paragraph> 
<paragraph id="H8479AC1054B64CB6A2C11575F4468B88"> <enum>(2)</enum> <text>the Secretary of the Navy with respect to matters concerning the Navy or the Marine Corps;</text> </paragraph> 
<paragraph id="HD170791825D34877A0BE3F1147A91926"> <enum>(3)</enum> <text>the Secretary of the Air Force with respect to matters concerning the Air Force; and</text> </paragraph> 
<paragraph id="H3A746E42088A4737BDD1FF0000C0201E"> <enum>(4)</enum> <text>the Secretary of Defense with respect to matters concerning the Coast Guard, or the Secretary of Homeland Security when it is not operating as a service in the Navy.</text> </paragraph> </subsection></section><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HF833923A76B24339A94D605456E4366E"><enum>(4)</enum><text display-inline="yes-display-inline">in section 3031(a) by inserting <quote>in section 3020 and</quote> after <quote>Except as provided</quote>.</text></paragraph> </subsection> 
<subsection id="H13D81ED7BC4A40288EDAA8FE3BB92DB7"><enum>(b)</enum><header>Educational assistance for members of the selected reserve</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/1606">Chapter 1606</external-xref> of title 10, United States Code, is amended—</text> 
<paragraph id="H954239B529C84EAE9FE9E5D8C7BC9E82"><enum>(1)</enum><text>in the table of sections by adding at the end the following new item:</text>

<toc-entry level="section">16138. Transfer of entitlement to educational assistance</toc-entry></toc><after-quoted-block>;</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HF745C26C2D4448A59F6948859831DFE6"><enum>(2)</enum><text>in section 16133(a) by inserting <quote>and section 16138</quote> after <quote>subsection (b)</quote>;</text></paragraph> 
<paragraph id="H65BE12985D5A481F9424AE7740203BA3"><enum>(3)</enum><text>in section 16137 by inserting <quote>Each such report shall also include the number of members of the Selected Reserve of the Ready Reserve of each armed force transferring entitlement to educational assistance under section 16138.</quote> after <quote>those fiscal years.</quote>; and </text></paragraph> 
<paragraph id="H42B52D2294564F8EAD2800A00003F2B"><enum>(4)</enum><text>by adding at the end the following new section:</text>

<section id="H1D9909E4B0FD4D23A4E0AB252475A2C6" display-inline="no-display-inline" section-type="subsequent-section"><enum>16138.</enum><header>Transfer of entitlement to educational assistance</header> 
<subsection id="HC500A35A78544FE587ECC705ABDF7B5"> <enum>(a)</enum> <header>In General</header> <text display-inline="yes-display-inline">An individual who is entitled to educational assistance under this chapter may elect to transfer to one or more of the dependents specified in subsection (b) a portion of such individual’s entitlement to such assistance. An individual transferring entitlement under this section shall submit written notice to the Secretary concerned not later than the expiration date of the period described in section 16133 that is applicable to such individual. </text> </subsection> 
<subsection id="H517C8EF0D3EB49EBA9D8ED6B54FDE85"> <enum>(b)</enum> <header>Eligible Dependents</header> <text>An individual may transfer entitlement under this section as follows:</text> 
<paragraph id="H777DD21B36D84E0BA0CDDB00458BDF19"> <enum>(1)</enum> <text>To the individual’s spouse.</text> </paragraph> 
<paragraph id="HBBF6F8417CC4473682BC1286FB2CDB14"> <enum>(2)</enum> <text>To one or more of the individual’s children.</text> </paragraph> 
<paragraph id="HEC7C5074E30049B2A1F65F1EC91EDB7"> <enum>(3)</enum> <text>To a combination of the individuals referred to in paragraphs (1) and (2).</text> </paragraph> </subsection> 
<subsection id="HDF06CD89D5294C0E939DDAFB5F692952"> <enum>(c)</enum> <header>Designation of Transferee</header> <text>An individual transferring entitlement under this section shall—</text> 
<paragraph id="H4ED2975FC7454846AAA6F600104097F2"> <enum>(1)</enum> <text>designate the dependent or dependents to whom such entitlement is being transferred;</text> </paragraph> 
<paragraph id="H03F8422E3ECB48E2B51112AFA49B4FC7"> <enum>(2)</enum> <text>designate the number of months of such entitlement to be transferred to each such dependent; and</text> </paragraph> 
<paragraph id="H71F9825FFADD4B44A7F5871378A829A"> <enum>(3)</enum> <text>specify the period for which the transfer shall be effective for each such dependent.</text> </paragraph> </subsection> 
<subsection id="H0C7D33B6A06A4FC59825668DA1A389D9"> <enum>(d)</enum> <header>Revocation and Modification</header><text>An individual transferring entitlement under this section may modify or revoke at any time the transfer of any unused portion of the entitlement so transferred. <paragraph id="HDE8C48B19A194CFD9DD70007BBEFA8B"> <enum>(1)</enum> <text>completes the requirements of a secondary school diploma (or equivalency certificate); or</text> </paragraph> 
<paragraph id="H279AA52F2B4B4848B9BEA4BDFD83E5A7"> <enum>(2)</enum> <text>attains 18 years of age.</text></paragraph></subsection> 
<subsection id="HCA2A82EFD0B445A7BABDB742E5CA55B5"><enum>(f)</enum><header>Time limitation for use of eligibility and entitlement</header><text>Notwithstanding section 16133, and subject to subsection (c)(3), a dependent to whom entitlement is transferred under this section may use such entitlement not later than—</text> 
<paragraph id="H7823933044D24AA89DBD5F6D96FFD1EF"><enum>(1)</enum><text>the expiration date of a 20-year period beginning on the commencement date of the period prescribed by section 16133(a)(1) that is applicable to the individual who transferred such entitlement to the dependent; or</text></paragraph> 
<paragraph id="HB32A2968D00C46D1A6081FB21B99C7FB"><enum>(2)</enum><text>the date that is 10 years after the date the individual who transferred such entitlement to the dependent is separated from the Selected Reserve,</text> </paragraph><continuation-text continuation-text-level="subsection">whichever occurs first.</continuation-text></subsection> 
<subsection id="HA5ACE93A7ED746E2B9274FA3C1CFC42E"> <enum>(g)</enum> <header>Additional Administrative Matters</header> 
<paragraph id="HE713524CE21F4A4D98CDC1ADD7B38F6" display-inline="yes-display-inline"> <enum>(1)</enum> <text>The use of any entitlement transferred under this section shall be charged against the entitlement of the individual making the transfer at the rate of one month for each month of transferred entitlement that is used.</text> </paragraph> 
<paragraph id="H58C16395A675444DB300BB1E9C4900E0" indent="up1"> <enum>(2)</enum> <text>Except as provided under subsections (c)(2) and (3) and (f), and subject to paragraph (5) of this subsection, a dependent to whom entitlement is transferred under this section is entitled to educational assistance under this chapter in the same manner as the individual from whom entitlement was transferred.</text> </paragraph> 
<paragraph id="HF9136AB5BEE44E89827F8DDA1D2BC44" indent="up1"> <enum>(3)</enum><text>The monthly rate of educational assistance payable to a dependent to whom entitlement is transferred under this section shall be the monthly amount payable under section 16131 to the individual making the transfer.</text> </paragraph> 
<paragraph id="HBBBF5031B6884660A306856BF200CA4C" indent="up1"> <enum>(4)</enum> <text>The death of an individual transferring entitlement under this section shall not affect the use of the transferred entitlement by the dependent to whom entitlement is transferred.</text> </paragraph> 
<paragraph id="HD41E945455AA4DB1801B3F63B25FC965" indent="up1"> <enum>(5)</enum> <text>Notwithstanding subsection (f) and section 16133, a child to whom entitlement is transferred under this section may not use any entitlement so transferred after attaining the age of 26 years.</text> </paragraph> 
<paragraph id="H89557F8F11E84E238E74AB8600D6BA9" indent="up1"> <enum>(6)</enum> <text>Except as provided in subsection (e), the purposes for which a dependent to whom entitlement is transferred under this section may use such entitlement shall include the pursuit and completion of the requirements of a secondary school diploma (or equivalency certificate).</text> </paragraph> </subsection> 
<subsection id="H90AF1FC76C1044ABA2A9708C5CE5CC45" display-inline="no-display-inline"> <enum>(h)</enum> <header>Overpayment</header><text>In the event of an overpayment of basic educational assistance with respect to a dependent to whom entitlement is transferred under this section, the dependent and the individual making the transfer shall be jointly and severally liable to the United States for the amount of the overpayment for purposes of <external-xref legal-doc="usc" parsable-cite="usc/38/3685">section 3685</external-xref> of title 38.</text> </subsection> 
<subsection id="H738D053297C74CAA99EE937E611D15F1"> <enum>(i)</enum> <header>Regulations</header> <text>The Secretaries concerned shall prescribe regulations for purposes of this section. </text> </subsection> 
<subsection id="H8269F297056649B79FF88B6BA2D0552D"> <enum>(j)</enum> <header>Secretary Concerned Defined</header> <text>Notwithstanding section 101(a)(9), in this section the term <term>Secretary concerned</term> means—</text>

<paragraph id="H2A4E4A924AB543B4AA50551B4000AEE6"> <enum>(2)</enum> <text>the Secretary of the Navy with respect to matters concerning the Navy or the Marine Corps;</text> </paragraph> 
<paragraph id="H0F926EB5942F4949BA0245D5E2642CE5"> <enum>(3)</enum> <text>the Secretary of the Air Force with respect to matters concerning the Air Force; and</text> </paragraph> 
<paragraph id="H451BE0448A6F4D429B54A73D68ABE5ED"> <enum>(4)</enum> <text>the Secretary of Defense with respect to matters concerning the Coast Guard, or the Secretary of Homeland Security when it is not operating as a service in the Navy.</text> </paragraph> </subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> </subsection></section> 
<section id="H87F28C03AACC4973A0F7EAA83E00B51D"><enum>3.</enum><header>Program of education</header> 
<subsection id="H8B952099BA2C424292A56D8955FC00B5"><enum>(a)</enum><header>All-volunteer force educational assistance program</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/30">Chapter 30</external-xref> of title 38, United States Code, is amended—</text> 
<paragraph id="H4A22CB34C70A441FA8BC5C37562529F2"><enum>(1)</enum><text>in section 3014(a) by striking <quote>an approved program of education</quote> and inserting <quote>a program of education of the individual’s choosing</quote>; and</text></paragraph> 
<paragraph id="H35014E7793454B22A4FDE296F3331FA3"><enum>(2)</enum><text display-inline="yes-display-inline">in sections 3014A(b)(1), 3015(a)(1), 3015(a)(2), 3015(b)(1), 3015(b)(2), 3015(g)(1), 3015(g)(2), 3016(b), 3016(c), 3022(a)(1), 3022(a)(2), and 3034(a)(3) by striking <quote>an approved program</quote> each place it appears and inserting <quote>a program</quote>. </text> </paragraph></subsection> 
<subsection id="H84DE29E87B884893A618F9EE89EBE083"><enum>(b)</enum><header>Educational assistance for members of the selected reserve</header><text><external-xref legal-doc="usc" parsable-cite="usc/10/16131">Section 16131</external-xref> of title 10, United States Code, is amended—</text>

<section id="H15EC23A29855423EAF84D5BFB0896C74" section-type="subsequent-section"><enum>4.</enum><header>Service in the Selected Reserve</header> 
<subsection id="HF7CB60720D0542F3AD51FECCE8B498E8"><enum>(a)</enum><header>Credit for 24 months of active duty service</header><text>Sub<external-xref legal-doc="usc" parsable-cite="usc/38/3012">section 3012</external-xref> of title 38, United States Code, is amended—</text> 
<paragraph id="HB06B87B55CFE4BDFB8E449934148A8EC"><enum>(1)</enum><text>in subsection (a)—</text> 
<subparagraph id="H105C2EBE4EF54C57BF73A91810F0C24C"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (1)(A)(i) by striking <quote>an obligated period</quote> and all that follows through <quote>in the Armed Forces</quote> and inserting <quote>for a cumulative period of at least 24 months of obligated active duty in the Armed Forces during any 6-year period</quote>;</text></subparagraph> 
<subparagraph id="H8731320BFE30444786A8F986D567518F"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraphs (1)(B)(i) and (1)(C)(iii)(I) by striking <quote>at least two years of continuous active duty in the Armed Forces</quote> each place it appears and inserting <quote>for a cumulative period of at least 24 months of active duty in the Armed Forces during any 6-year period</quote>; and</text></subparagraph> 
<subparagraph id="HD7A40BBF3CD2467F8559B72C5B5626C2"><enum>(C)</enum><text>in paragraphs (1)(B)(ii) and (1)(C)(iii)(II) by striking <quote>two years</quote> each place it appears and inserting <quote>24 months</quote>; and</text></subparagraph></paragraph> 
<paragraph id="H5176F57517804A7E8977DC4311E4A740"><enum>(2)</enum><text>in subsection (b)(1)(A)—</text> 
<subparagraph id="HC2269837796E41AEB5CB60267EA83FC"><enum>(A)</enum><text>by striking <quote>two years of service</quote> and inserting <quote>24 months of service</quote>; and</text></subparagraph> 
<subparagraph id="H9515160C2BF6449BBC11C03C36E87150"><enum>(B)</enum><text>by striking <quote>during such two years</quote> and inserting <quote>during such service</quote>.</text></subparagraph></paragraph></subsection> 
<subsection id="HE483A7E13DC74309B4BE6BE964FFF6BB"><enum>(b)</enum><header>Conforming amendment</header><text><external-xref legal-doc="usc" parsable-cite="usc/38/3013">Section 3013(b)</external-xref> of title 38, United States Code, is amended by striking <quote>continuous</quote>.</text></subsection></section>
