<official-title>To clarify the applicability of State law to national banks, and for other purposes.</official-title>

<section id="H4B5D73696B2F4CB99C11D7269BDB815F" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short Title</header><text display-inline="no-display-inline">This Act may be cited as the <quote>Preservation of Federalism in Banking Act</quote>.</text></section> 
<section id="HB2BBFFEA770E4BC2BA102334BC22519C"><enum>2.</enum><header>State Law Preemption Standards for National Banks Clarified</header> 
<subsection id="H9A7FF51D87EC4514AFAC8C1DB1006B2B"><enum>(a)</enum><header>In General</header><text>Chapter 1 of title LXII of the Revised Statutes of the United States (<external-xref legal-doc="usc" parsable-cite="usc/12/21">12 U.S.C. 21 et seq.</external-xref>) is amended by inserting after section 5136B the following new section:</text>

<section id="H83F68FD1FAAA4336A36F70DA54416B85"><enum>5136C.</enum><header>State Law Preemption Standards for National Banks and Subsidiaries Clarified</header> 
<subsection id="HC6D97B20A08F4F598F653811C9D2B6DA"><enum>(a)</enum><header>State Consumer Laws of General Application</header> 
<paragraph id="H8ABEC97833B24364884C45B05F8B5251" display-inline="no-display-inline"><enum>(1)</enum><header>In general</header><text>Notwithstanding any other provision of Federal law, any State consumer law of general application (including any law relating to unfair or deceptive acts or practices and any consumer fraud law) shall apply to any national bank.</text></paragraph> 
<paragraph id="H3C48D7E64C294E3CB6BCF3BEF459B52C"><enum>(2)</enum><header>National bank defined</header><text display-inline="yes-display-inline">For purposes of this section, the term <term>national bank</term> includes any Federal branch established in accordance with the International Banking Act of 1978.</text></paragraph></subsection> 
<subsection id="H86E8B31479A1413C848F59907113F4E"><enum>(b)</enum><header>State banking laws enacted pursuant to Federal law</header> 
<paragraph id="H43089119C1864D8786CBED6B2126B3D"><enum>(1)</enum><header>In general</header><text>Notwithstanding any other provision of Federal law and except as provided in paragraph (2), any State law that—</text> 
<subparagraph id="HD680C2853595482385835D00F9B98719"><enum>(A)</enum><text>is applicable to State banks; and</text></subparagraph> 
<subparagraph id="HFB997073C3CC4D87814FD641C81F903E"><enum>(B)</enum><text display-inline="yes-display-inline">was enacted pursuant to or in accordance with, and is consistent with, an Act of Congress, including the Gramm-Leach-Bliley Act and the Consumer Credit Protection Act, that permits States to exceed or supplement the requirements of any comparable Federal law,</text></subparagraph><continuation-text continuation-text-level="paragraph">shall apply to any national bank.</continuation-text></paragraph> 
<paragraph id="HC0DA7315869D44B1AF005400A298B9D"><enum>(2)</enum><header>Exceptions</header><text>Paragraph (1) shall not apply with respect to any State law if—</text> 
<subparagraph id="H524B2A2726364D2CB6F6685593CD58E5"><enum>(A)</enum><text>the State law discriminates against national banks; or</text></subparagraph> 
<subparagraph id="H18AF82B8F682465C80A7A7800F86D48"><enum>(B)</enum><text>the State law is inconsistent with other provisions of Federal law, but only to the extent of the inconsistency (as determined in accordance with the other provision of Federal law).</text></subparagraph></paragraph></subsection> 
<subsection id="H26D402181C8F4E1781AC33C430006545"><enum>(c)</enum><header>No negative implications for applicability of other state laws</header><text>No provision of this section shall be construed as altering or affecting the applicability, to national banks, of any State law which is not described in subsection (a) or (b).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HBC1ED1F249A54442A9F2442E5E002F74"><enum>(b)</enum><header>Denial of Preemption Not a Deprivation of a Civil Right</header><text display-inline="yes-display-inline">The preemption of any provision of the law of any State with respect to any national bank shall not be treated as a right, privilege, or immunity for purposes of section 1979 of the Revised Statutes of the United States (<external-xref legal-doc="usc" parsable-cite="usc/42/1983">42 U.S.C. 1983</external-xref>).</text></subsection> 
<subsection id="H35BFA9BC69F545C2B75F54CC88A72192" display-inline="no-display-inline"><enum>(c)</enum><header>Clerical Amendment</header><text>The table of sections for chapter 1 of title LXII of the Revised Statutes of the United States is amended by inserting after the item relating to section 5136B the following new item:</text>

<section id="H2BAE8DB64F9F457C8E391565B54B000"><enum>3.</enum><header>Visitorial Standards</header><text display-inline="no-display-inline">Section 5136C of the Revised Statutes of the United States (as added by <internal-xref idref="H2BAE8DB64F9F457C8E391565B54B000" legis-path="4.">section 2</internal-xref>(a) of this Act) is amended by adding at the end the following new subsection:</text> 
<quoted-block style="OLC" id="HD520718CF37C47AFA698F389C968153E" display-inline="no-display-inline"> 
<subsection id="HD7D3758A49E64CAD88906B3049002BE6"><enum>(d)</enum><header>Visitorial Powers</header><text display-inline="yes-display-inline">No provision of this title which relates to visitorial powers or otherwise limits or restricts the supervisory, examination, or regulatory authority to which any national bank is subject shall be construed as limiting or restricting the authority of any attorney general (or other chief law enforcement officer) of any State to bring any action in any court of appropriate jurisdiction—</text> 
<paragraph id="H9F621A473697475ABF369E2282B14448"><enum>(1)</enum><text>to enforce any applicable Federal or State law, as authorized by such law; or</text></paragraph> 
<paragraph id="H6F0B9E6C13A54D1BB65D825F0997D000"><enum>(2)</enum><text>on behalf of residents of such State, to enforce any applicable provision of any Federal or State law against a national bank, as authorized by such law, or to seek relief and recover damages for such residents from any violation of any such law by any national bank.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H7B72C2CD0A5A4D1C95C70168C9D058C9" display-inline="no-display-inline"><enum>4.</enum><header>Clarification of law applicable to State-chartered nondepository institution subsidiaries</header><text display-inline="no-display-inline">Section 5136C of the Revised Statutes of the United States (as added by <internal-xref idref="H9A7FF51D87EC4514AFAC8C1DB1006B2B" legis-path="3.(a)">section 2</internal-xref>(a) of this Act) is amended by inserting after subsection (d) (as added by section 3) the following new subsection:</text>

<subsection id="H8B0B64D3310F4BA19D006D8FE4CAC6B"><enum>(e)</enum><header>Clarification of law applicable to nondepository institution subsidiaries of national banks</header> 
<paragraph id="H04574E84959C4ED494CCDAD5438E4651"><enum>(1)</enum><header>In general</header><text>No provision of this title shall be construed as preempting the applicability of State law to any State-chartered nondepository institution subsidiary of a national bank, except to the extent the preemption is explicitly provided by an Act of Congress.</text></paragraph> 
<paragraph id="H99CF8765E18D468D80641D7B79C76B74"><enum>(2)</enum><header>Definitions</header><text>For purposes of this section, the following definitions shall apply:</text> 
<subparagraph id="H0F81128568434BAF89A653B8FEE6B8CE"><enum>(A)</enum><header>Depository institution, subsidiary</header><text>The terms <term>depository institution</term> and <term>subsidiary</term> have the same meanings as in section 3 of the Federal Deposit Insurance Act.</text></subparagraph> 
<subparagraph id="H223E51FC0B5A40DA88B88BC5FA98F789"><enum>(B)</enum><header>Nondepository institution</header><text>The term <term>nondepository institution</term> means any entity that is not a depository institution.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="HEB67131C193E468290A02400008DC2F3"><enum>5.</enum><header>Data Collection and Reporting</header> 
<subsection id="H4B400627534B490FA43BB0C391064853"><enum>(a)</enum><header>Collecting and Monitoring Consumer Complaints</header> 
<paragraph id="HAE14BF980C624DA6AACE007000A9055D"><enum>(1)</enum><header>In general</header><text>The Comptroller of the Currency shall record and monitor each complaint received directly or indirectly from a consumer regarding a national bank or any subsidiary of a national bank and record the resolution of the complaint.</text></paragraph> 
<paragraph id="H364944849F8347F7814843E88CB2F154"><enum>(2)</enum><header>Factors to be included</header><text>In carrying out the requirements of paragraph (1), the Comptroller of the Currency shall include—</text> 
<subparagraph id="H66727FEF3AC44E8F9D5C93C2E9E84500"><enum>(A)</enum><text>the date the consumer complaint was received;</text></subparagraph> 
<subparagraph id="H217649606C4240D092AB6E9411196B18"><enum>(B)</enum><text>the nature of the complaint;</text></subparagraph> 
<subparagraph id="H5C3CB1B02EF94E2EA0A0F25292F27E00"><enum>(C)</enum><text>when and how the complaint was resolved, including a brief description of the extent, and the results, of the investigation made by the Comptroller into the complaint, a brief description of any notices given and inquiries made to any other Federal or State officer or agency in the course of the investigation or resolution of the complaint, a summary of the enforcement action taken upon completion of the investigation, and a summary of the results of subsequent periodic reviews by the Comptroller of the extent and nature of compliance by such national bank or subsidiary with the enforcement action; and</text></subparagraph> 
<subparagraph id="HA107B0B115A243ECB364BEBD1BF1D6B5"><enum>(D)</enum><text>if the complaint involves any alleged violation of a State law (whether or not Federal law preempts the application of such State law to such national bank) by such bank, a cite to and a description of the State law that formed the basis of the complaint.</text></subparagraph></paragraph></subsection> 
<subsection id="HF289CB271C5B4C11AC30072100A116D"><enum>(b)</enum><header>Report to the Congress</header> 
<paragraph id="H6A28F77AA0234A82A189FFF166547CC3"><enum>(1)</enum><header>Periodic reports required</header><text>The Comptroller of the Currency shall submit a report semi-annually to the Congress on the consumer protection efforts of the Office of the Comptroller of the Currency.</text></paragraph> 
<paragraph id="HB2B24127D5904209A3FFDF6E239BCC35"><enum>(2)</enum><header>Contents of report</header><text>Each report submitted under paragraph (1) shall include the following:</text> 
<subparagraph id="HAB8915C6D4B54E93AC66D91EDE699ED6"><enum>(A)</enum><text>The total number of consumer complaints received by the Comptroller during the period covered by the report with respect to alleged violations of consumer protection laws by national banks and subsidiaries of national banks.</text></subparagraph> 
<subparagraph id="HFCCE34589FD741D8A025181FA6B73AF"><enum>(B)</enum><text>The total number of consumer complaints received during the reporting period that are based on each of the following:</text> 
<clause id="H5E9680C54AA74BF787E0FD5F64E186D"><enum>(i)</enum><text>Each title of the Consumer Credit Protection Act (reported as a separate aggregate number for each such title).</text></clause> 
<clause id="H82790758A1C54233B0009D44F0B8EB00"><enum>(ii)</enum><text>The Truth in Savings Act.</text></clause> 
<clause id="HA012E7420D404096AAA95734009075E0"><enum>(iii)</enum><text>The Right to Financial Privacy Act of 1978.</text></clause> 
<clause id="HB40E7AFBBE2446C4B2B6ACA0D90076DE"><enum>(iv)</enum><text>The Expedited Funds Availability Act.</text></clause> 
<clause id="HB6D17F9FFCEB4F6CBC5ED5D69B32A9F9"><enum>(v)</enum><text>The Community Reinvestment Act of 1977.</text></clause> 
<clause id="H9D3D80A20B7A4ADFBF96A8FD2939D13"><enum>(vi)</enum><text>The Bank Protection Act of 1968.</text></clause> 
<clause id="HE1AB61009BEE46B4A7EF34A799DE3E12"><enum>(vii)</enum><text>Title LXII of the Revised Statutes of the United States.</text></clause> 
<clause id="H8D1F128AACB04663A6B5A6160071E44D"><enum>(viii)</enum><text>The Federal Deposit Insurance Act.</text></clause> 
<clause id="H11906A1017084A9780FBE755C713766"><enum>(ix)</enum><text>The Real Estate Settlement Procedures Act of 1974.</text></clause> 
<clause id="HBD2F490FAE6F41428F688613142DF1A1"><enum>(x)</enum><text>The Home Mortgage Disclosure Act of 1975.</text></clause> 
<clause id="HD27E79CB97D044CE9FBB1EB72363FA7C"><enum>(xi)</enum><text>Any other Federal law.</text></clause> 
<clause id="H37CE18642DC146E58210F65036B5CECF"><enum>(xii)</enum><text>State consumer protection laws (reported as a separate aggregate number for each State and each State consumer protection law).</text></clause> 
<clause id="H28E62CD27B8B4BDFB94B296BDB400018"><enum>(xiii)</enum><text display-inline="yes-display-inline">Any other State law (reported separately for each State and each State law).</text></clause></subparagraph> 
<subparagraph id="HA0A16A0C2A8840DE9BF4C551AA81A9FF"><enum>(C)</enum><text>A summary description of the resolution efforts by the Comptroller for complaints received during the period covered, including—</text> 
<clause id="H2DCB0A991B1549398E6199C16C14F600"><enum>(i)</enum><text>the average amount of time to resolve each complaint;</text></clause> 
<clause id="H30C886053B1D4AEC97341E6B283EE299"><enum>(ii)</enum><text>the median period of time to resolve each complaint;</text></clause> 
<clause id="HF7FE68909C344DCAB000AB6D7969D6B0"><enum>(iii)</enum><text>the average and median time to resolve complaints in each category of complaints described in each clause of subparagraph (B); and</text></clause> 
<clause id="HF4C6F1D5021542D7AEDF595FD369C018"><enum>(iv)</enum><text>a summary description of the longest outstanding complaint during the reporting period and the reason for the difficulty in resolving such complaint in a more timely fashion.</text></clause></subparagraph></paragraph> 
<paragraph id="H5BEB08822B1B4E6F8903FD716708A1AD"><enum>(3)</enum><header>Disclosure of report on occ website</header><text display-inline="yes-display-inline">Each report submitted to the Congress under this subsection shall be posted, by the Comptroller of the Currency, in a timely fashion and maintained on the website of the Office of the Comptroller of the Currency on the World Wide Web.</text></paragraph></subsection></section>
