<official-title>To amend the Native American Housing Assistance and Self- Determination Act of 1996 and other Acts to improve housing programs for Indians.</official-title>

<section id="HD9313FCDADED49E583B71B01F4472C76" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Native American Housing Enhancement Act of 2004</short-title></quote>.</text></section> 
<section id="HF65AD4BC0B8B4884AFE9B94D3631D3D1"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text> 
<paragraph id="HD17F9AD6751B4A8692E28D94B780D7B6"><enum>(1)</enum><text>there exist—</text> 
<subparagraph id="H798A2CECAA6447C3BEF74B582C2197E1"><enum>(A)</enum><text>a unique relationship between the Government of the United States and the governments of Indian tribes; and</text></subparagraph> 
<subparagraph id="H95AD0BDCD2AE4658867C4673209D0022"><enum>(B)</enum><text>a unique Federal trust responsibility to Indian people;</text></subparagraph></paragraph> 
<paragraph id="H6840977875074E1BBC8DA3D9BBAAA25"><enum>(2)</enum><text>Native Americans experience some of the worst housing conditions in the country, with—</text> 
<subparagraph id="H3DDCB364F734458BB8D35D41A733E1E7"><enum>(A)</enum><text>32.6 percent of Native homes being overcrowded;</text></subparagraph> 
<subparagraph id="HE7FC968CD8B84336B41773FBACC05D38"><enum>(B)</enum><text>33 percent lacking adequate solid waste management systems;</text></subparagraph> 
<subparagraph id="H7A826DC9541B46C88279227425BF32FA"><enum>(C)</enum><text>8 percent lacking a safe indoor water supply; and</text></subparagraph> 
<subparagraph id="HA4985478B8A0422285A0EA69A52DBF44"><enum>(D)</enum><text>approximately 90,000 Native families who are homeless or underhoused;</text></subparagraph></paragraph> 
<paragraph id="H4B05A525BC1F42C3AF3DEB868D280044"><enum>(3)</enum><text>the poverty rate for Native Americans is twice that of the rest of the population of the United States;</text></paragraph> 
<paragraph id="H280A7E72A1E64EF692569146AB28C4C"><enum>(4)</enum><text>the population growth of Native Americans that began in the latter part of the 20th century increased the need for Federal housing services;</text></paragraph> 
<paragraph id="H7635C794127C4EBFBBCA36F206B7C973"><enum>(5)</enum> 
<subparagraph id="HDC0EEAB365934DE886F7275B41D04E17" display-inline="yes-display-inline"><enum>(A)</enum><text>under the requirements of the Native American Housing Assistance and Self-Determination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/25/4101">25 U.S.C. 4101 et seq.</external-xref>), members of Indian tribes are given preference for housing programs;</text></subparagraph> 
<subparagraph id="H5C357ECC17834C1388257E214794EE79" indent="up1"><enum>(B)</enum><text>a primary purpose of the Act is to allow Indian tribes to leverage funds with other Federal and private funds;</text></subparagraph> 
<subparagraph id="HC6D98DFDA2E340CFBCACF99541C42402" indent="up1"><enum>(C)</enum><text>the Department of Agriculture has been a significant funding source for housing for Indian tribes; and</text></subparagraph> 
<subparagraph id="H33CB0B3385BB47F28EABC86685397C60" indent="up1"><enum>(D)</enum><text>to allow assistance provided under the Act and assistance provided by the Secretary of Agriculture under other law to be combined to meet the severe housing needs of Indian tribes, the Housing Act of 1949 (<external-xref legal-doc="usc" parsable-cite="usc/42/1471">42 U.S.C. 1471 et seq.</external-xref>) should be amended to allow for the preference referred to in subparagraph (A) by granting an exemption from title VI of the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000d">42 U.S.C. 2000d et seq.</external-xref>) and title VIII of the Civil Rights Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/3601">42 U.S.C. 3601 et seq.</external-xref>) to tribes who comply with the Indian Civil Rights Act (title II of the Civil Rights Act of 1968; <external-xref legal-doc="usc" parsable-cite="usc/25/1301-1303">25 U.S.C. 1301-1303</external-xref>), or who are acting under the Native American Housing Assistance and Self-Determination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/25/4131">25 U.S.C. 4131(b)</external-xref>); and</text></subparagraph></paragraph> 
<paragraph id="H78957EB222894516BC2BCBD73B1ECBE2"><enum>(6)</enum><text>section 457 of the Cranston-Gonzales National Affordable Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/42/12899f">42 U.S.C. 12899f</external-xref>) should be amended to include Indian tribes, tribally designated housing entities, or other agencies that primarily serve Indians as eligible applicants for YouthBuild grants.</text></paragraph></section> 
<section id="H78DF7955EA1B456EA0E863C5B155E51"><enum>3.</enum><header>Treatment of program income</header><text display-inline="no-display-inline">Section 104(a)(2) of the Native American Housing Assistance and Self-Determination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/25/4114">25 U.S.C. 4114(a)(2)</external-xref>) is amended by inserting <quote>restrict access to or</quote> after <quote>not</quote>.</text></section> 
<section id="H84B815E29FC742BC93A7452CDBCFB2D2"><enum>4.</enum><header>Civil rights compliance</header><text display-inline="no-display-inline">Title V of the Housing Act of 1949 (<external-xref legal-doc="usc" parsable-cite="usc/42/1471">42 U.S.C. 1471 et seq.</external-xref>) is amended by adding at the end the following:</text>

<section id="HF211412EC98D45F9A9BC90006F38D6DA"><enum>544.</enum><header>Indian tribes</header> 
<subsection id="H4BF29894CFE54A56A5E2467E3DA8A876"><enum>(a)</enum><header>In general</header><text>Federally recognized Indian Tribes who exercise powers of self-government (or their instrumentalities) shall comply with the Indian Civil Rights Act (title II of the Civil Rights Act of 1968; <external-xref legal-doc="usc" parsable-cite="usc/25/1301-1303">25 U.S.C. 1301-1303</external-xref>) when receiving assistance under this title.</text></subsection> 
<subsection id="HCB2B576C8E854E230000DC03EB67DCFA"><enum>(b)</enum><header>Exemption</header><text>Title VI of the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000d">42 U.S.C. 2000d et seq.</external-xref>) and title VIII of the Civil Rights Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/3601">42 U.S.C. 3601 et seq.</external-xref>) shall not apply to—</text> 
<paragraph id="HBE7C1DE19C854B0E9500A1121CFE87DB"><enum>(1)</enum><text>tribes covered by the Indian Civil Rights Act (title II of the Civil Rights Act of 1968; <external-xref legal-doc="usc" parsable-cite="usc/25/1301-1303">25 U.S.C. 1301-1303</external-xref>); or</text></paragraph> 
<paragraph id="HB397B5C7445E4253AFD07871459F4251"><enum>(2)</enum><text>tribes acting under section 201(b) of the Native American Housing Assistance and Self-Determination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/25/4131">25 U.S.C. 4131(b)</external-xref>).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H0B4F629CFEC540089EEDF1DD75580038"><enum>5.</enum><header>Eligibility of Indian tribes for youthbuild grants</header><text display-inline="no-display-inline">Section 457(2) of the Cranston-Gonzales National Affordable Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/42/12899f">42 U.S.C. 12899f(2)</external-xref>) is amended—</text> 
<paragraph id="H66FF6727468B46759B1CDF02C786F789"><enum>(1)</enum><text>in subparagraph (F), by striking <quote>and</quote> at the end;</text></paragraph> 
<paragraph id="H40FD704B279A42D7B90737CE310ACB5"><enum>(2)</enum><text>by redesignating subparagraph (G) as sub-paragraph (H); and</text></paragraph> 
<paragraph id="H45C0AE413B724914983D7D36ABCDAF4"><enum>(3)</enum><text>by inserting after subparagraph (F) the following:</text> 
<quoted-block id="HBA90E74C925C4509BC1528D87EED40A3" style="OLC"> 
<subparagraph id="HC54E4D055ACB45C897F15507A47682ED"><enum>(G)</enum><text>an Indian tribe, tribally designated housing entity (as defined in section 4 of the Native American Housing Assistance and Self- Determination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/25/4103">25 U.S.C. 4103</external-xref>)), or other agency primarily serving Indians; and</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="H09E306AE5ED7425A00CA37DBB9CF3F07"><enum>6.</enum><header>Federal guarantees for financing for tribal housing activities</header><text display-inline="no-display-inline">Section 601 of the Native American Housing Assistance and Self-Determination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/25/4191">25 U.S.C. 4191</external-xref>) is amended by adding at the end the following new subsection:</text>

<subsection id="H6E531F164D394869913D37F3D8356B09"><enum>(d)</enum><header>Limitation on Percentage</header><text display-inline="yes-display-inline">A guarantee made under this title shall guarantee repayment of 95 percent of the unpaid principal and interest due on the notes or other obligations guaranteed.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section>
