<official-title>To amend the Family and Medical Leave Act of 1993 and title 5, United States Code, to provide entitlement to leave to eligible employees whose spouse, son, daughter, or parent is a member of the Armed Forces who is serving on active duty in support of a contingency operation or who is notified of an impending call or order to active duty in support of a contingency operation, and for other purposes.</official-title>

<section section-type="section-one" id="HFA7886A4CE714D579EA0AE7FF98D2B8B" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote>Military Families Leave Act of 2004</quote>.</text></section> 
<section id="H5036B7CDF6E640AC807F61D122D79FF8"><enum>2.</enum><header>Leave for military families under the Family and Medical Leave Act of 1993</header> 
<subsection id="HEA8C70822D624A289CA12E71D5577E99"><enum>(a)</enum><header>Entitlement to leave</header><text>Section 102(a)(1) of the Family and Medical Leave Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/29/2612">29 U.S.C. 2612(a)(1)</external-xref>) is amended by adding at the end the following new subparagraph:</text>

<subparagraph id="H01EE8A368B534271BE4BC67120B3BFF"><enum>(E)</enum><text>Because of any qualifying exigency (as the Secretary may by regulation determine) arising out of the fact that the spouse, or a son, daughter, or parent of the employee is on active duty (or has been notified of an impending call or order to active duty) in the Armed Forces in support of a contingency operation.</text> </subparagraph> <after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HB0F8144A382D4D84AFA13CF5A4E56942"><enum>(b)</enum><header>Intermittent or reduced leave schedule</header><text>Section 102(b)(1) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/2612">29 U.S.C. 2612(b)(1)</external-xref>) is amended by inserting after the second sentence the following new sentence: <quote>Subject to subsection (e)(3) and section 103(f), leave under subsection (a)(1)(E) may be taken intermittently or on a reduced leave schedule.</quote>.</text></subsection> 
<subsection id="H0CEA581BD6BA428486D18E004660732D"><enum>(c)</enum><header>Substitution of paid leave</header><text>Section 102(d)(2)(A) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/2612">29 U.S.C. 2612(d)(2)(A)</external-xref>) is amended by striking <quote>or (C)</quote> and inserting <quote>(C), or (E)</quote>.</text></subsection> 
<subsection id="H575DE781B53A4BEBA22EEA7DDF18AFAE"><enum>(d)</enum><header>Notice</header><text>Section 102(e) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/2612">29 U.S.C. 2612(e)</external-xref>) is amended by adding at the end the following new paragraph:</text>

<paragraph id="HFD0EB83BC3534A58B77F46C089DB046"><enum>(3)</enum><header>Notice for leave due to active duty of family member</header><text>In any case in which the necessity for leave under subsection (a)(1)(E) is foreseeable based on notification of an impending call or order to active duty in support of a contingency operation, the employee shall provide such notice to the employer as is reasonable and practicable.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H2BC0EDE2E1B644968FAF9143A30000D2"><enum>(e)</enum><header>Certification</header><text>Section 103 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/2613">29 U.S.C. 2613</external-xref>) is amended by adding at the end the following new subsection:</text>

<subsection id="HB9E59033FB52468685454CF72574F200"><enum>(f)</enum><header>Certification for leave due to active duty of family member</header><text>An employer may require that a request for leave under section 102(a)(1)(E) be supported by a certification issued at such time and in such manner as the Secretary may by regulation prescribe. If the Secretary issues a regulation requiring such certification, the employee shall provide, in a timely manner, a copy of such certification to the employer.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H28E71F6257F4426A8EA93EEFC8140900"><enum>(f)</enum><header>Definition</header><text>Section 101 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/2611">29 U.S.C. 2611</external-xref>) is amended by adding at the end the following new paragraph:</text>

<paragraph id="HFD38AFA642BB4AE49136BFE5AE19D684"><enum>(14)</enum><header>Contingency operation</header><text>The term <quote>contingency operation</quote> has the same meaning given such term in <external-xref legal-doc="usc" parsable-cite="usc/10/101">section 101(a)(13)</external-xref> of title 10, United States Code.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> 
<section id="HC6C6E53F4AEA49D5B7B4F99FCED4CB41"><enum>3.</enum><header>Leave for military families under title 5</header> 
<subsection id="HD640325FBAD043A98ECFFE7E4D52AA32"><enum>(a)</enum><header>Entitlement to leave</header><text><external-xref legal-doc="usc" parsable-cite="usc/5/6382">Section 6382(a)(1)</external-xref> of title 5, United States Code, is amended by adding at the end the following new subparagraph:</text>

<subparagraph id="H2751A9842FA042C1B466AEAE7165BF7" indent="up1"><enum>(E)</enum><text>Because of any qualifying exigency (as defined under section 6387) arising out of the fact that the spouse, or a son, daughter, or parent, of the employee is on active duty (or has been notified of an impending call or order to active duty) in the Armed Forces in support of a contingency operation.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block> </subsection> 
<subsection id="HF27268128044442798598B9FF4967DEA"><enum>(b)</enum><header>Intermittent or reduced leave schedule</header><text>Section 6382(b)(1) of such title is amended by inserting after the second sentence the following new sentence: <quote>Subject to subsection (e)(3) and section 6383(f), leave under subsection (a)(1)(E) may be taken intermittently or on a reduced leave schedule.</quote>.</text></subsection> 
<subsection id="HB2F8680AD0CF4587917FBCE463588076"><enum>(c)</enum><header>Substitution of paid leave</header><text>Section 6382(d) of such title is amended by striking <quote>or (D)</quote> and inserting <quote>(D), or (E)</quote>. </text></subsection> 
<subsection id="HC6A660C9452D4726BEED6D35BDC52FED"><enum>(d)</enum><header>Notice</header><text>Section 6382(e) of such title is amended by adding at the end the following new paragraph:</text>

<subsection id="H38D8C25B8F5E455D8D4C225B5FFF0038"><enum>(e)</enum><header>Certification</header><text>Section 6383 of such title is amended by adding at the end the following new subsection:</text>

<subsection id="H43FB065F832A4DC1AB999F12306DBA7C"><enum>(f)</enum><text>An employing agency may require that a request for leave under section 6382(a)(1)(E) be supported by a certification issued at such time and in such manner as the employing agency may require.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection>

<paragraph id="H3F3A85429F65440F8952726FA17E1D15"><enum>(1)</enum><text>in paragraph (5)(B), by striking <quote>and</quote> at the end;</text></paragraph> 
<paragraph id="HD177DEF0654441E0AAD56447E43B869"><enum>(2)</enum><text>in paragraph (6)(B), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph>
