<official-title>To respond to the illegal production, distribution, and use of methamphetamines in the United States, and for other purposes.</official-title>

<section id="HC703C16419494930B8B3664546B98CB0" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Combat Meth Act</short-title></quote>.</text></section> 
<title id="H3CEEFAA06CA645458136DD8194137C9"><enum>I</enum><header>Grant program for combating methamphetamine repeat offenders</header> 
<section id="HB9AF7F97CADF4A76B02D5BC706DC90EF"><enum>101.</enum><header>Grant program for combating methamphetamine repeat offender</header> 
<subsection id="H6D658747AB814B798B23F837EAB6B7B8"><enum>(a)</enum><header>Grant program</header><text>The Attorney General shall carry out a program to provide grants to qualified States for combating the problem of methamphetamine abuse with a specific focus on the prosecution of repeat offenders.</text></subsection> 
<subsection id="H15294BD704914C6184558BB2C464F5BF"><enum>(b)</enum><header>Qualified state</header><text>For purposes of this section, the term <term>qualified State</term> means a State that—</text> 
<paragraph id="H6B6E4A71E1E74CA28C3E45AB21E80461"><enum>(1)</enum><text>as reported by the National Clandestine Laboratory Database, had more than 200 methamphetamine lab seizures in 2003; and</text></paragraph> 
<paragraph id="HC12CA8CBFDD24FEBA807BAA028464501"><enum>(2)</enum><text display-inline="yes-display-inline">has a law that provides that possession and/or distribution of 5 grams or more of methamphetamine, its salts, isomers, or salts of its isomers, or 50 grams or more of a mixture or substance containing a detectable amount of methamphetamine, its salts, isomers, or salts of its isomers, qualifies for a mandatory minimum sentence without the possibility of probation or parole of 5 to 40 years for a first offense, 10 years to life for a second offense, and life for a third offense.</text></paragraph></subsection> 
<subsection id="H6478D7D451CD4CD9A36617116D2DFB09"><enum>(c)</enum><header>Distribution of grant amounts</header><text>The Attorney General shall distribute grants authorized under subsection (a) to 2 States.</text></subsection> 
<subsection id="H5B933B5E4D1743BAB421B62507829DC3"><enum>(d)</enum><header>Administration</header><text>The Attorney General shall prescribe requirements, including application requirements, for grants under the program under subsection (a).</text></subsection> 
<subsection id="H638317ADC4EA4DFF923D5F4F3E3D5809"><enum>(e)</enum><header>Authorization of appropriations</header> 
<paragraph id="H0B30AA56272247B992E5D103F626001D"><enum>(1)</enum><header>In general</header><text>There is authorized to be appropriated $10,000,000 for fiscal years 2005 and 2006 to carry out this section.</text></paragraph> 
<paragraph id="H5DEE6F00039C4542AB304CD4E15D0084"><enum>(2)</enum><header>Availability</header><text>Amounts appropriated pursuant to the authorization of appropriations in paragraph (1) shall remain available until expended.</text></paragraph></subsection></section></title> 
<title id="HCC85DF33792E40B886B7B8FEB49B57E5"><enum>II</enum><header>Enforcement</header> 
<section id="H9CD636E81C354B98A7265C773FE244EB"><enum>201.</enum><header>Authorization of appropriations relating to COPS grants</header> 
<subsection id="H0F974D4F86204B30882BE0369E591422"><enum>(a)</enum><header>In general</header><text>In addition to any other funds authorized to be appropriated for fiscal year 2005 for grants under part Q of title I of the <act-name parsable-cite="OCCSS">Omnibus Crime Control and Safe Streets Act of 1968</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/3796dd">42 U.S.C. 3796dd et seq.</external-xref>), known as the COPS program, there is authorized to be appropriated $20,000,000 for such purpose to provide training to State and local prosecutors and law enforcement agents for investigation and prosecution of methamphetamine offenses.</text></subsection> 
<subsection id="HE302C8E00FE64C86BEDA22F1E116CFE6"><enum>(b)</enum><header>Rural Set-Aside</header><text>Of amounts made available pursuant to subsection (a), $5,000,000 shall be available only for prosecutors and law enforcement agents for rural communities.</text></subsection> 
<subsection changed="not-changed" commented="no" display-inline="no-display-inline" id="HEB4217CC09624001A023C5F405D987B"><enum>(c)</enum><header>DEA reimbursement</header><text>Of amounts made available pursuant to subsection (a), $2,000,000 shall be available only to reimburse the Drug Enforcement Administration for existing training expenses and shall remain available until expended.</text></subsection></section> 
<section id="H785E523557E24FCFB224270045A07CBA"><enum>202.</enum><header>Authorization of appropriations relating to the clandestine laboratory training</header><text display-inline="no-display-inline">In addition to any other funds authorized to be appropriated for fiscal year 2005 for the facilities and personnel used to operate the Clandestine Laboratory Training Facility of the Drug Enforcement Administration, located in Quantico, Virginia, there is authorized to be appropriated $10,000,000 for such purpose (but to include not more than 20 additional full-time positions) to provide training to law enforcement personnel of all the States, the District of Columbia, the Commonwealth of Puerto Rico, and the territories and possessions of the United States.</text></section> 
<section id="HF09C93791DBF4249994CAECC5E00785D"><enum>203.</enum><header>Expansion of methamphetamine hot spots program to include personnel and equipment for enforcement, prosecution, and cleanup</header><text display-inline="no-display-inline">Section 1701(d) of the <act-name parsable-cite="OCCSS">Omnibus Crime Control and Safe Streets Act of 1968</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/3796dd">42 U.S.C. 3796dd(d)</external-xref>) is amended—</text> 
<paragraph id="HF9AD7FA564B54DFABAA1599ECF9078E"><enum>(1)</enum><text>in paragraph (11) by striking <quote>and</quote> at the end;</text></paragraph> 
<paragraph id="HD5222948D98548D59EAFBA95B31D6938"><enum>(2)</enum><text>in paragraph (12) by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph> 
<paragraph id="HCC79F21DF0DF47ADA4F1016DB717C35D"><enum>(3)</enum><text>by adding at the end the following:</text>

<paragraph changed="not-changed" commented="no" display-inline="no-display-inline" id="H05F071B1EE644B9C93483E4DCF061452"><enum>(13)</enum><text>hire personnel and purchase equipment to assist in the enforcement and prosecution of methamphetamine offenses and the cleanup of methamphetamine-affected areas.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section changed="not-changed" commented="no" display-inline="no-display-inline" id="H710A30C0DB5249C68CD0EB2033E24DA"><enum>204.</enum><header>Special United States attorney’s program</header> 
<subsection changed="not-changed" commented="no" display-inline="no-display-inline" id="H1D0B4C9210694E428890289FE5AEDAE"><enum>(a)</enum><header>In general</header><text>The Attorney General shall allocate any amounts appropriated pursuant to the authorization under subsection (a) for the hiring and training of special assistant United States attorneys.</text></subsection> 
<subsection changed="not-changed" commented="no" display-inline="no-display-inline" id="HB2456528A8704AFAB5AD4B79B09D6842"><enum>(b)</enum><header>Use of funds</header><text>The funds allocated under subsection (a) shall be used to—</text> 
<paragraph changed="not-changed" commented="no" display-inline="no-display-inline" id="H1750BDD67B4F448B0099195D1F3514FF"><enum>(1)</enum><text>train local prosecutors in techniques used to prosecute methamphetamine cases, including the presentation of evidence related to the manufacture of methamphetamine;</text></paragraph> 
<paragraph changed="not-changed" commented="no" display-inline="no-display-inline" id="HC15A9D673B3442EE995CA6CD7DED369"><enum>(2)</enum><text>train local prosecutors in Federal and State laws involving methamphetamine manufacture or distribution;</text></paragraph> 
<paragraph changed="not-changed" commented="no" display-inline="no-display-inline" id="HB54C1E7F660B4D94A67BCAC66CB643DA"><enum>(3)</enum><text>cross-designate local prosecutors as special assistant United States attorneys; and</text></paragraph> 
<paragraph changed="not-changed" commented="no" display-inline="no-display-inline" id="H0E82683F4CF24F7D95B3D623943F35F"><enum>(4)</enum><text>hire additional local prosecutors who—</text> 
<subparagraph changed="not-changed" commented="no" display-inline="no-display-inline" id="H5DD6695109FE4BC58BE5A15DF66D2C75"><enum>(A)</enum><text>with the approval of the United States attorney, shall be cross-designated to prosecute both Federal and State methamphetamine cases;</text></subparagraph> 
<subparagraph changed="not-changed" commented="no" display-inline="no-display-inline" id="H9FB6E27A7FA747F2986809D6D9045D70"><enum>(B)</enum><text>shall be assigned a caseload that whether in State court or Federal court gives the highest priority to cases in which—</text> 
<clause changed="not-changed" commented="no" display-inline="no-display-inline" id="HDFD09BE1EB8D446CBE924200A163ABC"><enum>(i)</enum><text>charges related to methamphetamine manufacture or distribution are submitted by law enforcement for consideration; and</text></clause> 
<clause changed="not-changed" commented="no" display-inline="no-display-inline" id="H7E9D52ACC79A4144A13D683506D38E4C"><enum>(ii)</enum><text>the defendant has been previously convicted for a crime related to methamphetamine manufacture or distribution.</text></clause></subparagraph></paragraph></subsection> 
<subsection changed="not-changed" commented="no" display-inline="no-display-inline" id="H288C306CA55C495F00044E91933B4E60"><enum>(c)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated $5,000,000 for fiscal years 2005 and 2006 to carry out the provisions of this section.</text></subsection></section></title> 
<title id="HF8A246A3C507444D9C7906EABA5B3DF6"><enum>III</enum><header>Education, prevention, and treatment</header> 
<section id="HEBE5D81AFBC54526ADBFFBCE4BA98E91"><enum>301.</enum><header>Grants for services for children of substance abusers</header> 
<subsection id="H82E6EEA6CBB14AD8B9BF76312CA58C29"><enum>(a)</enum><header>In General</header><text display-inline="yes-display-inline">Section 519 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/290bb-25">42 U.S.C. 290bb–25</external-xref>), as transferred and inserted pursuant to subsection (b), is amended—</text> 
<paragraph id="HF96EB4F2BF07455F97BF60DCC6D585E3"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (b), by inserting after paragraph (8) the following:</text> 
<quoted-block display-inline="no-display-inline" id="H7294C29650A44295B1C1C8F4C8CF0300" style="OLC"> 
<paragraph id="H7BCB3C3470094B1C90D2DE96A2AA2736"><enum>(9)</enum><text>Development of drug endangered children rapid response teams that will intervene on behalf of children exposed to methamphetamine as a result of residing or being present in a home-based clandestine drug laboratory.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H89CF57C7447547CE973752D7BC31BBF"><enum>(2)</enum><text>in subsection (o)—</text> 
<subparagraph id="HFB994E6EF5454329A5EB005EF02F1FD0"><enum>(A)</enum><text>by striking <quote>For the purpose</quote> and inserting the following:</text>

<subsection id="H9F653CBF97EE48A8A87656D1031D291B"><enum>(b)</enum><header>Technical amendments</header> 
<paragraph id="H601D61A9D8C346E8A3C244E21ED677CD"><enum>(1)</enum><header>In general</header><text>Section 3106 of <external-xref legal-doc="public-law" parsable-cite="pl/106/310">Public Law 106–310</external-xref> (114 Stat. 1175) is amended—</text> 
<subparagraph id="HFEAF161A17E949F0B7FDBDE780AE7C04"><enum>(A)</enum><text>by striking <quote>399D</quote> each place such terms appears and inserting <quote>399A</quote>; and</text></subparagraph> 
<subparagraph id="H4BA282A537014856A64F5C14543588B"><enum>(B)</enum><text>in subsection (m)(3), by striking <quote>after section 518</quote> and inserting <quote>after section 517</quote>. </text></subparagraph></paragraph> 
<paragraph id="H18F8804C00DC4C86997FDD1E2730FAE6"><enum>(2)</enum><header>Rule of construction</header><text>In section 3106 of <external-xref legal-doc="public-law" parsable-cite="pl/106/310">Public Law 106–310</external-xref> as amended by paragraph (1), each reference to section 399A of the Public Health Service shall be considered to be a reference to such section 399A as redesignated by section 502(1) of such Public Law (114 Stat. 1115).</text></paragraph></subsection> </section> 
<section id="H7D737B09A3C541DFA0C3094CC18F93EC"><enum>302.</enum><header>Local grants for treatment of methamphetamine abuse and related conditions</header><text display-inline="no-display-inline">Subpart 1 of part B of title V of the <act-name parsable-cite="PHSA">Public Health Service Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/290bb">42 U.S.C. 290bb et seq.</external-xref>) is amended—</text> 
<paragraph id="H8D6BBCB970014E47B7F3E3F48E138295"><enum>(1)</enum><text>by redesignating the section 514 that relates to methamphetamine and appears after section 514A as section 514B; and</text></paragraph> 
<paragraph id="H045CC57191EB4039B9981E69A4F9B0A7"><enum>(2)</enum><text>by inserting after section 514B (as so redesignated) the following section:</text>

<section id="H3070E99C898442649BB900E5E4A37DA8"><enum>514C.</enum><header>Local grants for treatment of methamphetamine abuse and related conditions</header><text display-inline="yes-display-inline">The Secretary may make grants to political subdivisions of States and to nonprofit private entities for the purpose of providing treatment for methamphetamine abuse.</text></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="HE000FE387F084AC0936C44005092168E"><enum>303.</enum><header>Methamphetamine precursor monitoring grants</header> 
<subsection id="HDFF3D78EE7B2430D9752F70122F5AD81"><enum>(a)</enum><header>Grants authorized</header><text>The Attorney General, acting through the Bureau of Justice Assistance, may award grants to States to establish methamphetamine precursor monitoring programs.</text></subsection> 
<subsection id="H391DFC546E5C4EEFB3E8E96BDBE66C05"><enum>(b)</enum><header>Purpose</header><text>The purpose of the grant program established under this section is to—</text> 
<paragraph id="HE7A906AF117A4D18864D1FDA9DA46513"><enum>(1)</enum><text>prevent the sale of methamphetamine precursors, such as pseudoephedrine, to individuals in quantities so large that the only reasonable purpose of the purchase would be to manufacture methamphetamine;</text></paragraph> 
<paragraph id="H3CB9518A41B5475A0079766750701098"><enum>(2)</enum><text>educate businesses that legally sell methamphetamine precursors of the need to balance the legitimate need for lawful access to medication with the risk that those substances may be used to manufacture methamphetamine; and</text></paragraph> 
<paragraph id="HFA5A618DC0924070B397925EE515CBA5"><enum>(3)</enum><text>recalibrate existing prescription drug monitoring programs designed to track the sale of controlled substances to also track the sale of pseudoephedrine in any amount greater than 6 grams.</text></paragraph></subsection> 
<subsection id="H8F7C2E57B84F412300315FE22B632C72"><enum>(c)</enum><header>Use of grant funds</header><text>Grant funds awarded to States under this section may be used to—</text> 
<paragraph id="H21EF51D717AD4AF381D1541ED0D8E0DD"><enum>(1)</enum><text>implement a methamphetamine precursor or prescription drug monitoring program, including hiring personnel and purchasing computer hardware and software designed to monitor methamphetamine precursor purchases;</text></paragraph> 
<paragraph id="H677CE4AEDFD94309BD77006C5713E5B8"><enum>(2)</enum><text>expand existing methamphetamine precursor or prescription drug monitoring programs to accomplish the purposes described in subsection (b);</text></paragraph> 
<paragraph id="H06015836D1F842D4AB312904C5D431B2"><enum>(3)</enum><text>pay for training and technical assistance for law enforcement personnel and employees of businesses that lawfully sell substances, which may be used as methamphetamine precursors;</text></paragraph> 
<paragraph id="HFC854BFCBA2A41A891C2F61CA03E4C5"><enum>(4)</enum><text>improve information sharing between adjacent States through enhanced connectivity; or</text></paragraph> 
<paragraph id="H7C8C9BDF73A946B4B67CB4FBC6D9B926"><enum>(5)</enum><text>make grants to subdivisions of the State to implement methamphetamine precursor monitoring programs.</text></paragraph></subsection> 
<subsection id="H325C53056E6E42ECB688E0CFE4FA7E97"><enum>(d)</enum><header>Application</header><text>Any State desiring a grant under this section shall submit an application to the Attorney General at such time, in such manner, and containing such information as the Director may require.</text></subsection> 
<subsection id="HC0719E5F270745719B5305E8FBA8754B"><enum>(e)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to the Attorney General $1,000,000 for the fiscal years 2005 and 2006, to be used to carry out the provisions of this section.</text></subsection></section></title>
