<official-title>To reduce certain special allowance payments and provide additional teacher loan forgiveness on Federal student loans.</official-title>

<section id="H5325702DD5D0405DA844741FC9D3C61" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Taxpayer-Teacher Protection Act of 2004</short-title></quote>.</text></section> 
<section id="HD72B5DA48DCE467FBF140015E500C714" section-type="subsequent-section" display-inline="no-display-inline"><enum>2.</enum><header>Reduction of special allowance payments for loans from the proceeds of tax exempt issues</header><text display-inline="no-display-inline">Section 438(b)(2)(B) (<external-xref legal-doc="usc" parsable-cite="usc/20/1087-1">20 U.S.C. 1087–1(b)(2)(B)</external-xref>) is amended—</text> 
<paragraph id="HB7895250AAF540558BDB681F754CA6DF"><enum>(1)</enum><text>in clause (i), by striking <quote>this division</quote> and inserting <quote>this clause</quote>; </text></paragraph> 
<paragraph id="HD362A42FB2CE422EA928F65EB7DE59C1"><enum>(2)</enum><text>in clause (ii), by striking <quote>division (i) of this subparagraph</quote> and inserting <quote>clause (i) of this subparagraph</quote>; </text></paragraph> 
<paragraph id="HB2AF0B3C4053463DBDA65FA41D9BB5C0"><enum>(3)</enum><text>in clause (iv), by inserting <quote>or refunded after September 30, 2004, and before October 1, 2005,</quote> after <quote>October 1, 1993,</quote>; and</text></paragraph> 
<paragraph id="H42060E4B984E4D8BBC6DF57269C309BC"><enum>(4)</enum><text>by adding at the end the following new clause:</text> 
<quoted-block style="OLC" id="H1C7EBB92085A4F7D850030ECB339008C" display-inline="no-display-inline"> 
<clause id="H6C8F2910275C4CF99700ABBF85F92152" indent="up2"><enum>(v)</enum><text>Notwithstanding clauses (i) and (ii), the quarterly rate of the special allowance shall be the rate determined under subparagraph (A), (E), (F), (G), (H), or (I) of this paragraph, or paragraph (4), as the case may be, for a holder of loans that—</text> 
<subclause id="H968B3DB2CA9241C09098B4D9EF97BB6"><enum>(I)</enum><text>were made or purchased with funds—</text> 
<item id="H651E6DAC736D47AFBF19B8FA995BD004"><enum>(aa)</enum><text>obtained from the issuance of obligations the income from which is excluded from gross income under the Internal Revenue Code of 1986 and which obligations were originally issued before October 1, 1993; or</text></item> 
<item id="H681A5AA937254885974906A1B063FC43"><enum>(bb)</enum><text>obtained from collections or default reimbursements on, or interest or other income pertaining to, eligible loans made or purchased with funds described in division (aa), or from income on the investment of such funds; and</text></item></subclause> 
<subclause id="H77F75357C7C34E64824B6042D9649D35"><enum>(II)</enum><text>are—</text> 
<item id="H0B1E7F4A55FE4764A1C5A8875F857D39"><enum>(aa)</enum><text>financed by such an obligation that has matured, or been retired or defeased;</text></item> 
<item id="H8AFF296AC5804CF58ECFD5655C6C8977"><enum>(bb)</enum><text>refinanced after September 30, 2004, and before October 1, 2005, with funds obtained from a source other than funds described in subclause (I) of this clause; or</text></item> 
<item id="HEDDB7311A25C4AC18912051E16F8E0AE"><enum>(cc)</enum><text display-inline="yes-display-inline">sold or transferred to any other holder after September 30, 2004, and before October 1, 2005.</text></item></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="HF73C5CE8C87740FA989C22396758ED9B"><enum>3.</enum><header>Loan forgiveness for teachers</header> 
<subsection id="H641B33585D4C479BBB5E44BE42D1BA23"><enum>(a)</enum><header>Implementing highly qualified teacher requirements</header> 
<paragraph id="HCBF70C4F40BB4752BFC7CB366B962BA4"><enum>(1)</enum><header>Amendments</header><text display-inline="yes-display-inline"></text> 
<subparagraph id="HCF2DCA5A9CCB44CD907D645871CDB3B9"><enum>(A)</enum><header>FFEL loans</header><text>Section 428J(b)(1) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1078-10">20 U.S.C. 1078–10(b)(1)</external-xref>) is amended—</text> 
<clause id="H27F1042E8B2448038825011EDBF91902"><enum>(i)</enum><text>in subparagraph (A), by inserting ‘‘and’’ after the semicolon; and </text></clause> 
<clause id="HB687C2904EBD43B8925095913FA9852C"><enum>(ii)</enum><text>by striking subparagraphs (B) and (C) and inserting the following:</text> 
<quoted-block style="OLC" id="H0C8A9A9C4FCB41FB84F2D60469CA32" display-inline="no-display-inline"> 
<subparagraph id="HA0850CCE16F6424CBEF698442C459FD1"><enum>(B)</enum><text display-inline="yes-display-inline">if employed as an elementary school or secondary school teacher, is highly qualified as defined in section 9101 of the Elementary Secondary Education Act of 1965; and</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph> 
<subparagraph id="H74C7021431964832B08B00D822009920"><enum>(B)</enum><header>Direct loans</header><text>Section 460(b)(1)(A) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1087j">20 U.S.C. 1087j(b)(1)(A)</external-xref>) is amended—</text> 
<clause id="HBA667B657E44459CB15C517282F4D03"><enum>(i)</enum><text>in clause (i), by inserting ‘‘and’’ after the semicolon; and </text></clause> 
<clause id="H7E1E8FBC06E144F88F3CB56D86FF691D"><enum>(ii)</enum><text>by striking clauses (ii) and (iii) and inserting the following:</text> 
<quoted-block style="OLC" id="HAD01608CF50B4313ACDB0628CC87DEB" display-inline="no-display-inline"> 
<clause id="H7501E790D8E444539F81C1B982B0500"><enum>(ii)</enum><text display-inline="yes-display-inline">if employed as an elementary school or secondary school teacher, is highly qualified as defined in section 9101 of the Elementary and Secondary Education Act of 1965; and</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph></paragraph> 
<paragraph id="HFB3CC0540CE3438CAEBF4C00F35E8C62"><enum>(2)</enum><header>Transition rule</header> 
<subparagraph id="HF8F1B9FFD0224003ADDF43AA2DDB4ED"><enum>(A)</enum><header>Rule</header><text>The amendments made by <internal-xref idref="HCBF70C4F40BB4752BFC7CB366B962BA4" legis-path="__.(a)(1)">paragraph (1) of this subsection</internal-xref> to sections 428J(b)(1) and 460(b)(1)(A) of the Higher Education Act of 1965 shall not be applied to disqualify any individual who, before the date of enactment of this Act, commenced service that met and continues to meet the requirements of such sections as such sections were in effect on the day before the date of enactment of this Act.</text></subparagraph> 
<subparagraph id="HB86B9DA1123E46E7008DB6CC32BA852F"><enum>(B)</enum><header>Rule not applicable to increased qualified loan amounts</header><text><internal-xref idref="HF8F1B9FFD0224003ADDF43AA2DDB4ED" legis-path="__.(a)(2)(A)">Subparagraph (A) of this paragraph</internal-xref> shall not apply for purposes of obtaining increased qualified loan amounts under sections 428J(c)(3) and 460(c)(3) of the Higher Education Act of 1965 as added by subsection (b) of this section. </text></subparagraph></paragraph></subsection> 
<subsection id="H6CBE9BA9976A42AD810500009DF8E79D"><enum>(b)</enum><header>Additional amounts eligible to be repaid</header> 
<paragraph id="HA7B64B7E9CA14FBE9D01667BAA25D5A2"><enum>(1)</enum><header>FFEL loans</header><text>Section 428J(c) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1078-10">20 U.S.C. 1078–10(c)</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block style="OLC" id="H0FE9E9149AE349A28DD648D777E613F8" display-inline="no-display-inline"> 
<paragraph id="H62085FB20984413492FC0040E71B1415"><enum>(3)</enum><header>Additional amounts for teachers in mathematics, science, or special education</header><text display-inline="yes-display-inline">Notwithstanding the amount specified in paragraph (1), the aggregate amount that the Secretary shall repay under this section shall be not more than $17,500 in the case of—</text> 
<subparagraph id="HD98787AFF59646DDBCA861474EC95C7C"><enum>(A)</enum><text>a secondary school teacher—</text> 
<clause id="H2109CB85AD8F4BE89700A78B00AB20D0"><enum>(i)</enum><text>who meets the requirements of subsection (b); and </text></clause> 
<clause id="H7245BFE40CC941809D133C84CFDFDD68"><enum>(ii)</enum><text>whose qualifying employment for purposes of such subsection is teaching mathematics or science on a full-time basis; and </text></clause></subparagraph> 
<subparagraph id="H719A5F58EB474221ACE7003FCAE71CDD"><enum>(B)</enum><text>an elementary school or secondary school teacher—</text> 
<clause id="HC1B4F44289DC45C5824B5498DC2E72C4"><enum>(i)</enum><text>who meets the requirements of subsection (b); </text></clause> 
<clause id="HF78355EAAF8E46DE00EC55EE9FCCBD2"><enum>(ii)</enum><text>whose qualifying employment for purposes of such subsection is as a special education teacher whose primary responsibility is to provide special education to children with disabilities (as those terms are defined in section 602 of the Individuals with Disabilities Education Act); and </text></clause> 
<clause id="H8D45F6E9DD7D4EFAAC83B15D7D003F24"><enum>(iii)</enum><text>who, as certified by the chief administrative officer of the public or non-profit private elementary school or secondary school in which the borrower is employed, is teaching children with disabilities that correspond with the borrower’s special education training and has demonstrated knowledge and teaching skills in the content areas of the elementary school or secondary school curriculum that the borrower is teaching.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H17AF2D6EA7174753894DB5BD69671299"><enum>(2)</enum><header>Direct loans</header><text>Section 460(c) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1087j">20 U.S.C. 1087j(c)</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block style="OLC" id="H9D02E463FA424F9A005FA3F416DD1BDC" display-inline="no-display-inline"> 
<paragraph id="H488D7B409E75479999775D5FA9239FB"><enum>(3)</enum><header>Additional amounts for teachers in mathematics, science, or special education</header><text display-inline="yes-display-inline">Notwithstanding the amount specified in paragraph (1), the aggregate amount that the Secretary shall cancel under this section shall be not more than $17,500 in the case of—</text> 
<subparagraph id="H2C1FDB47B71D47278FAF1C9305FC479C"><enum>(A)</enum><text>a secondary school teacher—</text> 
<clause id="H074B0A2192BF401983B046A890849BB4"><enum>(i)</enum><text>who meets the requirements of subsection (b)(1); and </text></clause> 
<clause id="H7CA47AF06765410BB1B8C0DE44B6AE44"><enum>(ii)</enum><text>whose qualifying employment for purposes of such subsection is teaching mathematics or science on a full-time basis; and </text></clause></subparagraph> 
<subparagraph id="H1CF54043AC764B34B641F73B424100E0"><enum>(B)</enum><text>an elementary school or secondary school teacher—</text> 
<clause id="H2B0B01A1FA704747B120B36F8746FC20"><enum>(i)</enum><text>who meets the requirements of subsection (b)(1); </text></clause> 
<clause id="H591D218F65AD440AA538D300F4D91497"><enum>(ii)</enum><text>whose qualifying employment for purposes of such subsection is as a special education teacher whose primary responsibility is to provide special education to children with disabilities (as those terms are defined in section 602 of the Individuals with Disabilities Education Act); and</text></clause> 
<clause id="H05F3990D23A14596A1B1FD791773272"><enum>(iii)</enum><text>who, as certified by the chief administrative officer of the public or non-profit private elementary school or secondary school in which the borrower is employed, is teaching children with disabilities that correspond with the borrower’s special education training and has demonstrated knowledge and teaching skills in the content areas of the elementary school or secondary school curriculum that the borrower is teaching.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H850B4EEA7A944AF1A3271702DABC4610"><enum>(3)</enum><header>Effective date</header><text>The amendments made by this subsection shall apply only with respect to eligible individuals who are new borrowers (as such term is defined in 103 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1003">20 U.S.C. 1003</external-xref>)) on or after October 1, 1998, and before August 16, 2005. </text></paragraph></subsection></section>
