<official-title>To amend the Homeland Security Act of 2002 to clarify the mission and responsibilities of the Department of Homeland Security with respect to the protection of civil rights and civil liberties, and for other purposes.</official-title>

<section id="HA97BF5C1195545F98BAE9E1E723893F0" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Homeland Security Civil Rights and Civil Liberties Protection Act of 2004</short-title></quote>.</text> </section> 
<section id="HC47C61DA6CD949C7B575C3996B1D1F00" section-type="subsequent-section" display-inline="no-display-inline"><enum>2.</enum><header>Mission of Department of Homeland Security</header><text display-inline="no-display-inline">Section 101(b)(1) of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/111">6 U.S.C. 111(b)(1)</external-xref>) is amended—</text> 
<paragraph id="H5F30DB6850FE43D1A96456A62DBE4600"><enum>(1)</enum><text>in subparagraph (F), by striking <quote>and</quote> after the semicolon;</text></paragraph> 
<paragraph id="H429B2D4F5B3F46BABD27FFE722E66C4F"><enum>(2)</enum><text>by redesignating subparagraph (G) as subparagraph (H); and</text></paragraph> 
<paragraph id="H1DD4227A21CF499BBFB61500E4001EBE"><enum>(3)</enum><text>by inserting after subparagraph (F) the following:</text>

<subparagraph id="H14854A86CE784694ACB567FF898D0DA"><enum>(G)</enum><text>ensure that the civil rights and civil liberties of persons are not diminished by efforts, activities, and programs aimed at securing the homeland; and</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="HB23E951D06DB4B40B62480066954271D"><enum>3.</enum><header>Officer for civil rights and civil liberties</header><text display-inline="no-display-inline">Section 705(a) of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/345">6 U.S.C. 345(a)</external-xref>) is amended—</text> 
<paragraph id="HB36695D924554E44A82E370300581673"><enum>(1)</enum><text display-inline="yes-display-inline">in the matter preceding paragraph (1), by inserting <quote>report directly to the Secretary and shall</quote> after <quote>who shall</quote>;</text></paragraph> 
<paragraph id="H9854C6F1FF6E4BD08CCE5D3E009C93B8"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (1)–</text> 
<subparagraph id="H6FD65C65735F4B52ACCF7090AFD58E00"><enum>(A)</enum><text>by striking <quote>alleging</quote> and inserting <quote>concerning</quote>;</text></subparagraph> 
<subparagraph id="H915C9E20378545D084FDC7705DDE78A4"><enum>(B)</enum><text>by striking <quote>racial and ethnic</quote>;</text></subparagraph> 
<subparagraph id="H38B3EA93EA45458BB44E7C11E8A59080"><enum>(C)</enum><text>by inserting <quote>on the basis of race, ethnicity, or religion,</quote> after <quote>profiling</quote>; and</text></subparagraph> 
<subparagraph id="HF768DC38FE284E7EAF2237BBAFC3635E"><enum>(D)</enum><text>by striking <quote>and</quote> after the semicolon at the end;</text></subparagraph></paragraph> 
<paragraph id="HB24792D882F74ACBB0AA9B92C2B0096"><enum>(3)</enum><text>in paragraph (2), by striking the period at the end and inserting a semicolon; and</text></paragraph> 
<paragraph id="H6DC47BFCFCB940BD94F59618C20000E4"><enum>(4)</enum><text>by adding at the end the following:</text>

<paragraph id="HA95951D6C82A455F819BE52CCFE7D1C4"><enum>(3)</enum><text>assist the Secretary, directorates, and offices of the Department to develop, implement, and periodically review Department policies and procedures to ensure that the protection of civil rights and civil liberties is appropriately incorporated into Department programs and activities;</text></paragraph> 
<paragraph id="H808BE299CA864B558300DAD6C79F85B1"><enum>(4)</enum><text>oversee compliance with constitutional, statutory, regulatory, policy, and other requirements relating to the civil rights and civil liberties of individuals affected by the programs and activities of the Department;</text></paragraph> 
<paragraph id="H8B35DFC8C31341208F87D9B21814103B"><enum>(5)</enum><text>coordinate with the official appointed under section 222 to ensure that—</text> 
<subparagraph id="H61AB162FAE374C1386EB236D92856760"><enum>(A)</enum><text>programs, policies, and procedures involving civil rights, civil liberties, and privacy considerations are addressed in an integrated and comprehensive manner; and</text></subparagraph> 
<subparagraph id="H40D15BDB49BB469E9E9502B88CB049DB"><enum>(B)</enum><text>the Congress receives appropriate reports regarding such programs, policies, and procedures; and</text></subparagraph></paragraph> 
<paragraph id="H570107D3C2BF4B9A95E8A4DB3EE83408"><enum>(6)</enum><text>investigate complaints and information indicating possible abuses of civil rights or civil liberties, unless the Inspector General of the Department determines that any such complaint or information should be investigated by the Inspector General.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="H47B697C152B34502AA133DB600C6B21F"><enum>4.</enum><header>Protection of civil rights and civil liberties by Office of Inspector General</header> 
<subsection id="HAAC918E3BF3A4AE0A22DADD14DB42BAC"><enum>(a)</enum><header>Designation and functions of senior official</header><text>The Homeland Security Act of 2002 (<external-xref legal-doc="public-law" parsable-cite="pl/107/296">Public Law 107–296</external-xref>) is amended by inserting after section 812 the following:</text> 
<quoted-block style="OLC" id="H9C45F3BC56A9481A9C14728600D19FB0" display-inline="no-display-inline"> 
<section id="H760B9C8EA9194D7E92608FF407948B70"><enum>813.</enum><header>Protection of civil rights and civil liberties by Office of Inspector General</header> 
<subsection id="H523DF66D742C4765BFA7F4BE476D2DA6"><enum>(a)</enum><header>Designation of senior official</header><text>The Inspector General of the Department of Homeland Security shall designate a senior official within the Office of Inspector General who is a career member of the civil service at the equivalent to the GS–15 level or a career member of the Senior Executive Service, to perform the functions described in subsection (b).</text></subsection> 
<subsection id="H766CD51DC41A44C8B75600E8F8502F9"><enum>(b)</enum><header>Functions</header><text>The senior official designated under subsection (a) shall–—</text> 
<paragraph id="HDBF19C1E9869436083CCCC004900C53C"><enum>(1)</enum><text>coordinate the activities of the Office of Inspector General with respect to investigations of abuses of civil rights or civil liberties;</text></paragraph> 
<paragraph id="H128B6772779E4C7D8F51B674DAB0E000"><enum>(2)</enum><text>receive and review complaints and information from any source alleging abuses of civil rights and civil liberties by employees or officials of the Department of Homeland Security or by employees or officials of independent contractors or grantees of the Department;</text></paragraph> 
<paragraph id="H7920EC8AAE20410A90EA98D37869032B"><enum>(3)</enum><text>initiate investigations of alleged abuses of civil rights or civil liberties by employees or officials of the Department of Homeland Security or by employees or officials of independent contractors or grantees of the Department;</text></paragraph> 
<paragraph id="H54F9136203054B188CF6D07C4603B6D4"><enum>(4)</enum><text>ensure that personnel within the Office of Inspector General receive sufficient training to conduct effective civil rights and civil liberties investigations;</text></paragraph> 
<paragraph id="H30ED024B7F8740B6A2F475C4164EEAFC"><enum>(5)</enum><text>consult with the Officer for Civil Rights and Civil Liberties of the Department of Homeland Security regarding—</text> 
<subparagraph id="H868865128E44486889CDF03956992B7F"><enum>(A)</enum><text>alleged abuses of civil rights or civil liberties; and</text></subparagraph> 
<subparagraph id="HCA4D81F32ECD4EFBBF2D679522D320FB"><enum>(B)</enum><text>any policy recommendations regarding civil rights and civil liberties that may be founded upon an investigation by the Office of Inspector General;</text></subparagraph></paragraph> 
<paragraph id="HC6B2061F0C534387AEE2E8B49CE32FBB"><enum>(6)</enum><text>provide the Officer for Civil Rights and Civil Liberties with information regarding the outcome of investigations of alleged abuses of civil rights and civil liberties;</text></paragraph> 
<paragraph id="H757B703312DE42CA9ECFA70000FE3DC6"><enum>(7)</enum><text>refer civil rights and civil liberties matters that the Inspector General decides not to investigate to the Officer for Civil Rights and Civil Liberties;</text></paragraph> 
<paragraph id="HFB0A9494B21444B2B639EA6800B2503C"><enum>(8)</enum><text>ensure that the Office of the Inspector General publicizes and provides convenient public access to information regarding—</text> 
<subparagraph id="HFF7DAC7071C740C1A70083E4CD1DEB1"><enum>(A)</enum><text>the procedure to file complaints or comments concerning civil rights and civil liberties matters; and</text></subparagraph> 
<subparagraph id="HE415BD8B79794626B82E13D07FAAAF7"><enum>(B)</enum><text>the status of investigations initiated in response to public complaints; and</text></subparagraph></paragraph> 
<paragraph id="HE6497F98E02B47E29007B5F772203DCA"><enum>(9)</enum><text>inform the Officer for Civil Rights and Civil Liberties of any weaknesses, problems, and deficiencies within the Department relating to civil rights or civil liberties.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H6C88E87333E5435A8EEB780020644BC3"><enum>(b)</enum><header>Clerical amendment</header><text>The table of contents in section 1(b) of such Act is amended by inserting after the item relating to section 812 the following:</text>

<paragraph id="H09B392C781EB4C338E5450F4967BF300"><enum>(1)</enum><text>in the matter preceding paragraph (1), by inserting <quote>, who shall report directly to the Secretary,</quote> after <quote>in the Department</quote>;</text></paragraph> 
<paragraph id="HBB352FEFFCDE46D9B0E8DD3F6A0E15"><enum>(2)</enum><text>in paragraph (4), by striking <quote>and</quote> after the semicolon at the end;</text></paragraph> 
<paragraph id="H4766016796674A5FB25CC0D8593708C6"><enum>(3)</enum><text>by redesignating paragraph (5) as paragraph (6); and</text></paragraph>
