<section id="HBBBB1B5252834C698C39A8BA6DBBB567" section-type="section-one"><enum>1.</enum><header>Safe and secure storage of explosive materials by State and local law enforcement agencies</header> 
<subsection id="H02D6F16A351F4B81A1F2EECEFB0A624"><enum>(a)</enum><header>Reports on locations, types, and amounts of stored explosive materials</header> 
<paragraph id="HF7E243F6CC954393B99DA552A4A6C651"><enum>(1)</enum><header>Initial reports</header><text>Within 6 months after the date of the enactment of this Act, each State shall submit to the Attorney General a written report that specifies each location at which any law enforcement agency operating under State law stores or keeps explosive materials that have been shipped or transported in interstate or foreign commerce, and the types and amounts of such materials stored or kept at the location.</text></paragraph> 
<paragraph id="H09F61B5BBDB44BC892F5CC9CFAFC24C"><enum>(2)</enum><header>Subsequent reports</header><text>At such times as the Attorney General shall provide in regulations, each State shall submit to the Attorney General a written report that updates the most recent report submitted by the agency pursuant to this subsection.</text></paragraph></subsection> 
<subsection id="HBC43A600F96C407BBE00289DF16B932"><enum>(b)</enum><header>Regulations governing storage of explosive materials</header><text display-inline="yes-display-inline">Within 6 months after the date of the enactment of this Act, the Attorney General shall prescribe final regulations governing the storage and keeping by State and local law enforcement agencies of explosive materials that have been shipped or transported in interstate or foreign commerce. The regulations shall set forth the standards of public safety and security against theft which any place at which explosive materials that have been shipped or transported in interstate or foreign commerce are so stored or kept shall meet, and shall, at a minimum, require any such place to be subject to video surveillance or to have in operation an alarm system capable of notifying the agency of unauthorized entry.</text></subsection> 
<subsection id="H25309FCF60204AABB06B13341067A64B"><enum>(c)</enum><header>Inspection authority</header><text display-inline="yes-display-inline">The Attorney General may enter during business hours any place where a State or local law enforcement agency stores or keeps explosive materials that have been shipped or transported in interstate or foreign commerce, for the purpose of inspecting the explosive materials and determining whether the materials are being stored or kept in compliance with the regulations prescribed under subsection (b).</text></subsection> 
<subsection id="H047AAC8037AC4164A62C88E0DFA4A567"><enum>(d)</enum><header>Authority to impose penalty for noncompliance</header> 
<paragraph id="HB3406EFA6A474C84A5642FC6AA84C09"><enum>(1)</enum><header>Authority to reduce grants</header><text>If a State or local law enforcement agency fails to comply with this section or any regulation prescribed under this section, the Attorney General may reduce by 10 percent the funds that the agency would otherwise receive, or would otherwise be allocated, under any grant program of the Department of Justice.</text></paragraph> 
<paragraph id="H7623A0C8AD0C4F0A9BC820637D5BB11"><enum>(2)</enum><header>Reallocation of funds</header><text display-inline="yes-display-inline">Any funds that are not allocated to a State or local law enforcement agency by reason of paragraph (1) shall be reallocated to other State or local law enforcement agencies whose grants are not reduced by reason of paragraph (1).</text></paragraph></subsection></section> 
<section id="HC2F0686B765843F0ACDC0634D1D59705"><enum>2.</enum><header>Matching grants</header> 
<subsection id="H0E1616D3A6DE4AFD8DBA7F1800FADC59"><enum>(a)</enum><header>Application</header><text display-inline="yes-display-inline">A State or local law enforcement agency may submit to the Attorney General an application for a grant under this section, which shall contain—</text> 
<paragraph id="HF8909F6EC33F493594B320816B8273F2"><enum>(1)</enum><text>a good faith estimate of the total amount the agency will need to expend to comply with the regulations prescribed under section 1(b); and</text></paragraph> 
<paragraph id="H574C50FD01C24CB1996959F5823CC8B8"><enum>(2)</enum><text>a certification that the agency has obtained commitments to receive from State or local sources sums totalling not less than ½ of the amount referred to in paragraph (1), and will expend the sums to achieve such compliance.</text></paragraph></subsection> 
<subsection id="HFAD54A18E0254D5680893BDE00870958"><enum>(b)</enum><header>Grant authority</header><text display-inline="yes-display-inline">The Attorney General may make a grant under this section to an applicant therefor if—</text> 
<paragraph id="H1E16CC9DF144469D91463E2B85AB00E"><enum>(1)</enum><text>the application contains the information required by subsection (a)(1) of this section; and</text></paragraph> 
<paragraph id="HBF078C80B2394A8AA52DD3C6B56D8459"><enum>(2)</enum><text>the applicant has submitted to the Attorney General all reports required from the applicant by or under section 1(a).</text></paragraph></subsection> 
<subsection id="HCF2684C6A33F4CC682D9ECF0D9081803"><enum>(c)</enum><header>Amount of grant</header><text>The amount of the grant to be made to an applicant under this section shall not exceed ½ of the amount set forth in the application pursuant to subsection (a)(1).</text></subsection> 
<subsection id="H83EDF004C2FB4B639BDFAD1E46DAAB"><enum>(d)</enum><header>Use of grant</header><text>An applicant who receives a grant under this section shall use the grant only to cover the cost of complying with the regulations prescribed under section 1(b).</text></subsection> 
<subsection id="HB0A2915F3DC1463E9C2CEFE758C890C6"><enum>(e)</enum><header>Limitations on authorization of appropriations</header><text>For grants under this section, there are authorized to be appropriated to the Attorney General $10,000,000, without fiscal year limitation.</text></subsection></section> 
<section id="H91B6976467204BE29CB139434467BE14" display-inline="no-display-inline" section-type="subsequent-section"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> 
<paragraph id="HBA538CC632184B99004C77E6F945703"><enum>(1)</enum><header>Explosive materials</header><text>The term <quote>explosive materials</quote> has the meaning given in <external-xref legal-doc="usc" parsable-cite="usc/18/841">section 841(c)</external-xref> of title 18, United States Code.</text></paragraph> 
<paragraph id="HBDCC5355BF174697BCCF005D032832DF"><enum>(2)</enum><header>Law enforcement agency</header><text>The term <quote>law enforcement agency</quote> does not include any component of the National Guard. </text></paragraph> 
<paragraph id="HD331B9551C7648A781E04C8850C06034"><enum>(3)</enum><header>State</header><text>The term <quote>State</quote> includes the District of Columbia.</text></paragraph></section>
