<enum>I</enum><header>Improved security for driver licenses and State identity documents</header>
<section id="H3EB4947AC2634E19967653C4977DD683"><enum>101.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title, the following definitions apply:</text>
<paragraph id="H493637897E674E5BB5DED9B100F5C46"><enum>(1)</enum><header>Driver’s license</header><text>The term <term>driver’s license</term> means a motor vehicle operator’s license, as defined in <external-xref legal-doc="usc" parsable-cite="usc/49/30301">section 30301</external-xref> of title 49, United States Code.</text></paragraph>
<paragraph id="HBB9A437768B64B258C5100CAEA34DF1F"><enum>(2)</enum><header>Identification card</header><text>The term <term>identification card</term> means a personal identification card, as defined in <external-xref legal-doc="usc" parsable-cite="usc/18/1028">section 1028(d)</external-xref> of title 18, United States Code, issued by a State.</text></paragraph>
<paragraph id="H018DF5958344458DABC09E66C3385C24"><enum>(3)</enum><header>State</header><text>The term <term>State</term> means a State of the United States, the District of Columbia, Puerto Rico, the Virgin Islands, Guam, American Samoa, the Northern Mariana Islands, the Trust Territory of the Pacific Islands, and any other territory or possession of the United States.</text></paragraph>
<paragraph id="H13C9FF8AA8744C4AA4A1374DB43392A4"><enum>(4)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Homeland Security.</text></paragraph></section>
<section id="H155C7EE56E53427A96A9551C59AA1804"><enum>102.</enum><header>Minimum document requirements and issuance standards for Federal recognition</header>
<subsection id="HB3768A48393D42F5BA02D3581F58D6D8"><enum>(a)</enum><header>Minimum standards for Federal use</header>
<paragraph id="H89963F88D7B44444B3797BFB8DAEB008"><enum>(1)</enum><header>In general</header><text>Beginning 3 years after the date of enactment of this Act, a Federal agency may not accept, for any official purpose, a driver’s license or identification card issued by a State to any person unless the State is meeting the requirements of this section.</text></paragraph>
<paragraph id="H44C228B18D3544F1844486DB94DF6403"><enum>(2)</enum><header>State certifications</header><text>The Secretary shall determine whether a State is meeting the requirements of this section based on certifications made by the State to the Secretary. Such certifications shall be made at such times and in such manner as the Secretary, with the concurrence of the Secretary of Transportation, may prescribe by regulation.</text></paragraph></subsection>
<subsection id="HBB628CE6AF1A498D87BA41AF720262EE"><enum>(b)</enum><header>Minimum document requirements</header><text>To meet the requirements of this section, a State shall include, at a minimum, the following data elements and features on each driver’s license and identification card issued to a person by the State:</text>
<paragraph id="HB394317298BB49FCB653E6D1005D84B8"><enum>(1)</enum><text>The person’s full legal name.</text></paragraph>
<paragraph id="HCD3001C6897244C5927CE953ABDF2CBF"><enum>(2)</enum><text>The person’s date of birth.</text></paragraph>
<paragraph id="HDFD67BB61A7C4CE88B6572D1856F40BB"><enum>(3)</enum><text>The person’s gender.</text></paragraph>
<paragraph id="H460266533E124805BE96D468EF810639"><enum>(4)</enum><text>The person’s driver license or identification card number.</text></paragraph>
<paragraph id="H04EE97328FBB42A39CBC7CBD2E2350B"><enum>(5)</enum><text>A photograph of the person.</text></paragraph>
<paragraph id="H4C0B16BEE88B49E191AD96E23ED76371"><enum>(6)</enum><text>The person’s address of principal residence.</text></paragraph>
<paragraph id="H4BF495F7C7354665A34FAA44015447DC"><enum>(7)</enum><text>The person’s signature.</text></paragraph>
<paragraph id="HE363495D9DC448EFBFF85FA39A88822"><enum>(8)</enum><text>Physical security features designed to prevent tampering, counterfeiting, or duplication of the document for fraudulent purposes.</text></paragraph>
<paragraph id="HD8A565535CED48B39555598E6B16EB8B"><enum>(9)</enum><text>A common machine-readable technology, with defined minimum data elements, that will facilitate the capture of driver’s license and identification card information by law enforcement officers.</text></paragraph></subsection>
<subsection id="H9568B2533D6943ADAFD2E4AF1CACBF68"><enum>(c)</enum><header>Minimum issuance standards</header>
<paragraph id="H14BF615C6B7140BFAEB9003EB666ECCC"><enum>(1)</enum><header>In general</header><text>To meet the requirements of this section, a State shall require, at a minimum, presentation and verification of the following data elements before issuing a driver’s license or identification card to a person:</text>
<subparagraph id="H70BD07F4E9B24D24A33717D555CB80BC"><enum>(A)</enum><text>A photo identity document, except that a nonphoto identity document is acceptable if it includes both the person’s full legal name and date of birth.</text></subparagraph>
<subparagraph id="HB1D7F37807444057AAECD381D3C66590"><enum>(B)</enum><text>Documentation showing the person’s date of birth.</text></subparagraph>
<subparagraph id="HFA3E1390ABF649EF801FA71BA48BF12"><enum>(C)</enum><text>Proof of the person’s social security number or verification that the person is not eligible for a social security number.</text></subparagraph>
<subparagraph id="H330705D512DE439DBF78DE7F58ADF1B6"><enum>(D)</enum><text>Documentation showing the person’s name and address of principal residence.</text></subparagraph></paragraph>
<paragraph id="H96C6D64B53C94176A6DBB3F5E9F56C1"><enum>(2)</enum><header>Verification of documents</header><text>To meet the requirements of this section, a State shall implement the following procedures:</text>
<subparagraph id="H0ACA2039988C4F9B8BB9DEAA6FB88483"><enum>(A)</enum><text>Before issuing a driver’s license or identification card to a person, the State shall verify, with the issuing agency, the issuance, validity, and completeness of each document used to provide information required to be presented by the person under paragraph (1).</text></subparagraph>
<subparagraph id="H1210EABC25FA4EBCAEA6E8B434E2712"><enum>(B)</enum><text>The State shall not accept any foreign document, other than an official passport, to satisfy a requirement of paragraph (1).</text></subparagraph></paragraph></subsection>
<subsection id="HAE6774E67A3D474DBEE31E7FBBB6A295"><enum>(d)</enum><header>Other requirements</header><text>To meet the requirements of this section, a State shall adopt the following practices in the issuance of driver licenses and identification cards:</text>
<paragraph id="H57466CB263BA465CB660656119C5F19D"><enum>(1)</enum><text>Employ technology to capture digital images of identity source documents so that the images can be retained in electronic storage in a transferable format.</text></paragraph>
<paragraph id="H3A1A7594F4A648B88197C6200331E4D"><enum>(2)</enum><text>Retain paper copies of source documents for a minimum of 7 years or images of source documents presented for a minimum of 10 years.</text></paragraph>
<paragraph id="HCD4E7E2C0A7F4348A0B3B9487165167D"><enum>(3)</enum><text>Subject each person applying for a driver’s license or identification card to mandatory facial image capture.</text></paragraph>
<paragraph id="H34CA146A9F3A4A97A5796BF2D2103199"><enum>(4)</enum><text>Establish an effective procedure to confirm or verify a renewing applicant’s information.</text></paragraph>
<paragraph id="HB438A975770D4B64B93E353536A0DB22"><enum>(5)</enum><text>Confirm with the Social Security Administration a social security number presented by a person using the full social security number. In the event that a social security number is already registered to or associated with another person to which any State has issued a driver’s license or identification card, the State shall resolve the discrepancy and take appropriate action.</text></paragraph>
<paragraph id="HB60A913E941D43619763D78E012364ED"><enum>(6)</enum><text>Refuse to issue a driver’s license or identification card to a person holding a driver’s license issued by another State without confirmation from the other State that the person is terminating or has terminated the driver’s license.</text></paragraph>
<paragraph id="H2291DFF780EA46789110C0603CC5288B"><enum>(7)</enum><text>Ensure the physical security of locations where driver licenses and identification cards are produced and the security of document materials and papers from which driver licenses and identification cards are produced.</text></paragraph>
<paragraph id="HA989E47DB9BC48338000E88E594E87A5"><enum>(8)</enum><text>Subject all persons authorized to manufacture or produce driver licenses and identification cards to appropriate security clearance requirements.</text></paragraph>
<paragraph id="H761F94BD2D0E4E76BD2F018EEF9059F4"><enum>(9)</enum><text>Establish fraudulent document recognition training programs for appropriate employees engaged in the issuance of driver licenses and identification cards.</text></paragraph></subsection></section>
<section id="H3E23E33ABC87492EBCAB87A2000380A0"><enum>103.</enum><header>Linking of databases</header>
<subsection id="HA6469FCDAB84496582989D246E71CCCE"><enum>(a)</enum><header>In general</header><text>To be eligible to receive any grant or other financial assistance made available under this Act, a State shall participate in the interstate compact regarding sharing of driver license data, known as the <quote>Driver License Agreement</quote>, in order to provide electronic access by a State to information contained in the motor vehicle databases of all other States.</text></subsection>
<subsection id="H18AD46931CAB4657A6C199008908AD18"><enum>(b)</enum><header>Requirements for information</header><text>A State motor vehicle database shall contain, at a minimum, the following information:</text>
<paragraph id="HCC75F26F0F9F44C5BF17C3217CDD8D8"><enum>(1)</enum><text>All data fields printed on driver licenses and identification cards issued by the State.</text></paragraph>
<paragraph id="H00BA0DC045644E8787EB05E977D43F6C"><enum>(2)</enum><text>Motor vehicle driver histories, including motor vehicle violations, suspensions, and points on licenses.</text></paragraph></subsection></section>
<section id="HDC4312C3F78945619961A94F34A9966C"><enum>104.</enum><header>Trafficking in authentication features for use in false identification documents</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/18/1028">Section 1028(a)(8)</external-xref> of title 18, United States Code, is amended by striking <quote>false authentication features</quote> and inserting <quote>false or actual authentication features</quote>.</text></section>
<section id="H3EA47B55A73F4F0F8898CA35E6C29661"><enum>105.</enum><header>Grants to States</header>
<subsection id="HBDF6F13A7A964777A8204C44B48BF637"><enum>(a)</enum><header>In general</header><text>The Secretary may make grants to a State to assist the State in conforming to the minimum standards set forth in this title.</text></subsection>
<subsection id="HA95D8076A44346F895009F65C823FDBF"><enum>(b)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to the Secretary for each of the fiscal years 2005 through 2009 such sums as may be necessary to carry out this title.</text></subsection></section>
<section id="H9CE9971CEF7249008266CBFFAC2C9CF6"><enum>106.</enum><header>Authority</header>
<subsection id="HE738B68F5B28497BB15DB0E082E66C1F"><enum>(a)</enum><header>Participation of Secretary of Transportation and States</header><text>All authority to issue regulations, certify standards, and issue grants under this title shall be carried out by the Secretary, with the concurrence of the Secretary of Transportation and in consultation with the States.</text></subsection>
<subsection id="HA64B312C311E464E99F6C7DD958EF898"><enum>(b)</enum><header>Extensions of deadlines</header><text>The Secretary may grant an extension to the deadline established by section 102(a)(1) with respect to the driver licenses and identification cards issued by a State if the State submits to the Secretary, in writing, an adequate justification, as determined by the Secretary, for the extension.</text></subsection></section>
<enum>II</enum><header>Identity security of vital records</header>
<section id="H5734F248A1224996B1E1721500EFE492"><enum>201.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title, the following definitions apply:</text>
<paragraph id="H0C39AF48A1A846ECBCD3AD18224D251C"><enum>(1)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Homeland Security.</text></paragraph>
<paragraph id="HCB93BE7A36F64D6585B2C04685B6DFCE"><enum>(2)</enum><header>Birth certificate</header><text>The term <term>birth certificate</term> means a certificate of birth—</text>
<subparagraph id="H32235065A9AA4E9AA1F7778E2D01A1F1"><enum>(A)</enum><text>for an individual (regardless of where born)—</text>
<clause id="H5C72D947B1E243899085F48CD83E84C1"><enum>(i)</enum><text>who is a citizen or national of the United States at birth; and</text></clause>
<clause id="HFC5DBD03AAB74544A43C78B5A06F8E74"><enum>(ii)</enum><text>whose birth is registered in the United States; and</text></clause></subparagraph>
<subparagraph id="HCF5420FB77B54EED8C49A2FF3400CABC"><enum>(B)</enum><text>that—</text>
<clause id="H083735CF0BAD4C0B8E3672CB795134BA"><enum>(i)</enum><text>is issued by a Federal, State, or local government agency or authorized custodian of record and produced from birth records maintained by such agency or custodian of record; or</text></clause>
<clause id="H19910486364A49B39F5412B6E59291CB"><enum>(ii)</enum><text>is an authenticated copy, issued by a Federal, State, or local government agency or authorized custodian of record, of an original certificate of birth issued by such agency or custodian of record.</text></clause></subparagraph></paragraph></section>
<section id="HC756071F2C4B4A9C91EA816D6D1DC84"><enum>202.</enum><header>GAO study of the security of birth certificates</header>
<subsection id="H096F81485A1F4A32BC85FE8BD995F7A4"><enum>(a)</enum><header>Study</header><text>The Comptroller General shall conduct a study of the security of birth certificates and other birth documentation used by States as proof of identity. Such study shall include—</text>
<paragraph id="H6D83109E8AAA41E800D9639ECCCE5384"><enum>(1)</enum><text>an assessment of the parties involved in the issuance of birth certificates and other birth documentation within the United States;</text></paragraph>
<paragraph id="H3D8BF2CC3D194CA4AB74D36CD2236F21"><enum>(2)</enum><text>an assessment of the physical security features of domestic birth certificates and other domestic birth documentation;</text></paragraph>
<paragraph id="H2A0E58DCBC3949FEBFBD34E6A474AD25"><enum>(3)</enum><text>an evaluation of fraudulent activity, both domestic and foreign, of domestic birth certificates and other domestic birth documentation used to acquire driver’s licenses or State-issued identification cards; and</text></paragraph>
<paragraph id="H0311EE0C12B94632A18BFE87FB54B67C"><enum>(4)</enum><text>an evaluation of methods used by Federal agencies, States and other parties involved in the issuance of domestic birth certificates and other domestic birth documentation to reduce fraudulent activity, both domestic and foreign.</text></paragraph></subsection>
<subsection id="HC36680EA582447ACA0D5CA136D6200A2"><enum>(b)</enum><header>Report</header><text>Not later than 1 year after the date of the enactment of this Act, the Comptroller General shall submit to Congress a report on the study conducted under subsection (a). The report shall include recommendations regarding measures needed to improve both the physical security of birth certificates and other birth documentation and the process used by parties issuing such documents, including the establishment of minimum standards if necessary, to reduce fraudulent activity.</text></subsection></section>
<section id="H1A9225E41DE6424DA6C27F628BCB002D"><enum>203.</enum><header>Eliminating duplication of vital records</header>
<subsection id="H40B30B667E674ACCA86B092E7E20BD65"><enum>(a)</enum><header>Assistance in matching birth and death records</header>
<paragraph id="HB37B95BF33974A38981D3FC5F5A0006D"><enum>(1)</enum><header>Grants</header><text>The Secretary, in coordination with other appropriate Federal agencies, shall make grants to States to assist them in—</text>
<subparagraph id="H5675CBAFDDB4495191E7BC41109BB000"><enum>(A)</enum><text>computerizing their birth and death records;</text></subparagraph>
<subparagraph id="HD12123447731417B895EE9C506F21BA"><enum>(B)</enum><text>developing the capability to match birth and death records within each State and among the States; and</text></subparagraph>
<subparagraph id="HB8215192D0B440B09800F5933BB46F"><enum>(C)</enum><text>noting the fact of death on the birth certificates of deceased persons.</text></subparagraph></paragraph>
<paragraph id="HC893474BD10A431FBAF2B07E00A7C630"><enum>(2)</enum><header>Allocation of grants</header><text>The Secretary shall make grants to States under this subsection based on the proportion that the estimated annual average number of birth and death records created by a State applying for a grant bears to the estimated annual average number of birth and death records originated by all States.</text></paragraph></subsection>
<subsection id="H1BB0A807C9764806B4C0572B483400DC"><enum>(b)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to the Secretary for each of the fiscal years 2005 through 2009 such sums as may be necessary to carry out this section.</text></subsection></section>
