<official-title>To enhance and provide to the Oglala Sioux Tribe and Angostura Irrigation Project certain benefits of the Pick-Sloan Missouri River basin program.</official-title>

<section changed="added" section-type="section-one" id="H2B20487399F3416D89A114D83D52C688"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Oglala Sioux Tribe Angostura Irrigation Project Modernization and Development Act</short-title></quote>.</text></section> 
<section changed="added" id="H9422BDD3CD52483FA82E1E102FEEFB82"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text> 
<paragraph changed="added" id="HBA2FF4F5D8EB4F57A1DD272E86A59388"><enum>(1)</enum><text>Congress approved the Pick-Sloan Missouri River basin program by passing the Act of December 22, 1944 (commonly known as the <quote>Flood Control Act of 1944</quote>) (<external-xref legal-doc="usc" parsable-cite="usc/33/701-1">33 U.S.C. 701–1 et seq.</external-xref>)—</text> 
<subparagraph changed="added" id="H5271358C26A24201B989F00022A7C2A"><enum>(A)</enum><text>to promote the economic development of the United States;</text></subparagraph> 
<subparagraph changed="added" id="H6EA2DF973DFE4AED97190404483CE8E8"><enum>(B)</enum><text>to provide for irrigation in regions north of Sioux City, Iowa;</text></subparagraph> 
<subparagraph changed="added" id="H3829D06A8A484638821FB89BD4004DA3"><enum>(C)</enum><text>to protect urban and rural areas from devastating floods of the Missouri River; and</text></subparagraph> 
<subparagraph changed="added" id="HC62B0DCB76A44E5D98FE72065CDB347C"><enum>(D)</enum><text>for other purposes;</text></subparagraph></paragraph> 
<paragraph changed="added" id="HD1E98B63C14543B8BBA03F984C317E66"><enum>(2)</enum><text>the Angostura Unit—</text> 
<subparagraph changed="added" id="H825131DEBA724561A9F8C79F8995BC"><enum>(A)</enum><text>is a component of the Pick-Sloan program; and</text></subparagraph> 
<subparagraph changed="added" id="H3E104C274FEC4BCF8DD562AF1BCF00F9"><enum>(B)</enum><text>provides for—</text> 
<clause changed="added" id="H20EDB11B531A44499700E146E63A21F"><enum>(i)</enum><text>irrigation of 12,218 acres of productive farm land in South Dakota; and</text></clause> 
<clause changed="added" id="HCD2351FBB6834982826DE0BFD3A23304"><enum>(ii)</enum><text>substantial recreation and fish and wildlife benefits;</text></clause></subparagraph></paragraph> 
<paragraph changed="added" id="H16CA398F13F5410F8F516E004F50DC54"><enum>(3)</enum><text>the Commissioner of Reclamation has determined that—</text> 
<subparagraph changed="added" id="H07BA45C19406490781389DAEC8E4EAC4"><enum>(A)</enum><text>the national economic development benefits from irrigation at the Angostura Unit total approximately $3,410,000 annually; and</text></subparagraph> 
<subparagraph changed="added" id="H41E53C68F61D4557985D5CB19157142"><enum>(B)</enum><text>the national economic development benefits of recreation at Angostura Reservoir total approximately $7,100,000 annually;</text></subparagraph></paragraph> 
<paragraph changed="added" id="H689C593BFF51477889B3CA83F1FD2166"><enum>(4)</enum><text>the Angostura Unit impounds the Cheyenne River 20 miles upstream of the Pine Ridge Indian Reservation in South Dakota;</text></paragraph> 
<paragraph changed="added" id="H7436CDC9C36F40B0A20276889BB7A2A3"><enum>(5)</enum> 
<subparagraph display-inline="yes-display-inline" id="H91FE248FBB2A4AB0A4633DDF00E900"><enum>(A)</enum><text>the Reservation experiences extremely high rates of unemployment and poverty; and</text></subparagraph> 
<subparagraph changed="added" indent="up1" id="H9C1F72C71A6747E8A8B2BBA8C92CFDC8"><enum>(B)</enum><text>there is a need for economic development on the Reservation;</text></subparagraph></paragraph> 
<paragraph changed="added" id="H0A280367EE084DF889995BD4B8CAA1B4"><enum>(6)</enum><text>the national economic development benefits of the Angostura Unit do not extend to the Reservation;</text></paragraph> 
<paragraph changed="added" id="HDA2990B863C04E598F3664253650BF1E"><enum>(7)</enum><text>the Angostura Unit may be associated with negative affects on water quality and riparian vegetation in the Cheyenne River on the Reservation;</text></paragraph> 
<paragraph changed="added" id="HAE4CF51D2DBD46E98BD777E3ABBA4F86"><enum>(8)</enum><text>modernization of the irrigation facilities at the Angostura Unit would—</text> 
<subparagraph changed="added" id="HD127368A89104AA9A47016AB666E007C"><enum>(A)</enum><text>enhance the national economic development benefits of the Angostura Unit; and</text></subparagraph> 
<subparagraph changed="added" id="H41E11FAEB26941C9A164C87022CBC1FE"><enum>(B)</enum><text>result in improved water efficiency and environmental restoration benefits on the Reservation; and</text></subparagraph></paragraph> 
<paragraph changed="added" id="HF73A6ACDF1E84882B47788C0DAC45125"><enum>(9)</enum><text>the establishment of a trust fund for the Oglala Sioux Tribe would—</text> 
<subparagraph changed="added" id="H1E2FA263CDB0457A9C9F4B69DF5DFD"><enum>(A)</enum><text>produce economic development benefits for the Reservation comparable to the benefits produced at the Angostura Unit; and</text></subparagraph> 
<subparagraph changed="added" id="H93D5245AB6A349B5A96BCDCAB63F099E"><enum>(B)</enum><text>provide resources that are necessary for restoration of the Cheyenne River corridor on the Reservation.</text></subparagraph></paragraph></section> 
<section changed="added" id="H774844131E644EDDA777FAC35F6C3CC"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> 
<paragraph changed="added" id="H41DCDAFBA082431CA98D20504353B1B2"><enum>(1)</enum><header>Angostura Unit</header><text>The term <term>Angostura Unit</term> means the irrigation unit of the Angostura irrigation project developed under the Act of August 11, 1939 (<external-xref legal-doc="usc" parsable-cite="usc/16/590y">16 U.S.C. 590y et seq.</external-xref>).</text></paragraph> 
<paragraph changed="added" id="H03DA7E9DCB1E4C73008E4ECCE0F57427"><enum>(2)</enum><header>Fund</header><text>The term <term>Fund</term> means the Oglala Sioux Tribal Development Trust Fund established by section 201(a).</text></paragraph> 
<paragraph changed="added" id="H715C77CC03BD428988A75D47FAC2C54C"><enum>(3)</enum><header>Pick-Sloan program</header><text>The term <term>Pick-Sloan program</term> means the Pick-Sloan Missouri River basin program approved under the Act of December 22, 1944 (commonly known as the <quote>Flood Control Act of 1944</quote>) (<external-xref legal-doc="usc" parsable-cite="usc/33/701-1">33 U.S.C. 701–1 et seq.</external-xref>).</text></paragraph> 
<paragraph changed="added" id="HB3593A66A7FD469CB9E945FC574FAC1"><enum>(4)</enum><header>Plan</header><text>The term <term>plan</term> means the development plan developed by the Tribe under section 201(f).</text></paragraph> 
<paragraph changed="added" id="H93FF244A753D49B59818A056DE3EAE56"><enum>(5)</enum><header>Reservation</header><text>The term <term>Reservation</term> means the Pine Ridge Indian Reservation in the State.</text></paragraph> 
<paragraph changed="added" id="H3E951F8D097C4388ABEF77BA3D00DEFE"><enum>(6)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph> 
<paragraph changed="added" id="HE8C047FDF6AC485CB9F3D75B9FA0FB1"><enum>(7)</enum><header>Tribe</header><text>The term <term>Tribe</term> means the Oglala Sioux Tribe of South Dakota.</text></paragraph> 
<paragraph changed="added" id="HF5059E3638E84A91A226F5A2BD62BCA"><enum>(8)</enum><header>Tribal Council</header><text>The term <term>Tribal Council</term> means the governing body of the Tribe.</text></paragraph></section> 
<title changed="added" id="H14BFBA8089BC460C862FA1A1DBFF5ECE"><enum>I</enum><header>Modernization</header> 
<section changed="added" id="H2F8A47ACC4194494ADE62B1FEAB451EA"><enum>101.</enum><header>Modernization of facilities at Angostura Unit</header> 
<subsection changed="added" id="H0C39C32FB2E14986B9BD5838AB4DF4D"><enum>(a)</enum><header>In general</header><text>The Secretary shall carry out the modernization and improvement of the facilities at the Angostura Unit as described in the Improved Efficiencies Alternative included in the report entitled <quote>Final Environmental Impact Statement, Angostura Unit Contract Negotiation and Water Management (August 2002)</quote>.</text></subsection> 
<subsection changed="added" id="H230A44E650B84D3BB16CCE07001858BF"><enum>(b)</enum><header>Nonreimbursability</header><text>The cost of the modernization and improvement of the facilities at the Angostura Unit shall be carried out on a nonreimbursable basis.</text></subsection></section> 
<section changed="added" id="H196D3D0D428246C4859D6C9D13F91D57"><enum>102.</enum><header>Delivery of water to Pine Ridge Indian Reservation</header><text display-inline="no-display-inline">The Secretary shall provide for the delivery of the water saved through the modernization and improvement of the facilities of the Angostura Unit to be used for fish and wildlife purposes and environmental restoration on the Reservation.</text></section> 
<section changed="added" id="HB164EBE7D40F422F85EA1FA1BC2E23C4"><enum>103.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There is authorized to be appropriated to carry out section 101 $4,660,000, to remain available until expended.</text></section></title> 
<title changed="added" id="H479A32218FAD464E8C55852F16EB98D9"><enum>II</enum><header>Development</header> 
<section changed="added" id="H3878EC8905234BEB9C8F3100C0B8F1BB"><enum>201.</enum><header>Oglala Sioux Tribal Development Trust Fund</header> 
<subsection changed="added" id="H69CE26F8E1E74DA59B5099E6D0E757A5"><enum>(a)</enum><header>Oglala Sioux Tribal Development Trust Fund</header><text>There is established in the Treasury of the United States a fund to be known as the <quote>Oglala Sioux Tribal Development Trust Fund</quote>, consisting of any amounts deposited in the Fund under this title.</text></subsection> 
<subsection changed="added" id="HE96B3D84CD7D4B9A9F7B2965D3253C99"><enum>(b)</enum><header>Funding</header><text>On the first day of the 11th fiscal year that begins after the date of enactment of this Act, the Secretary of the Treasury shall, from the General Fund of the Treasury, deposit in the Fund—</text> 
<paragraph changed="added" id="H0584A283A76942B6AA2188E215F3685B"><enum>(1)</enum><text>$92,500,000; and</text></paragraph> 
<paragraph changed="added" id="HCC15016826374F2E929535368504A0C8"><enum>(2)</enum><text>the amount that equals the amount of interest that would have accrued on the amount described in paragraph (1) if that amount had been invested in interest-bearing obligations of the United States on the first day of the first fiscal year that begins after the date of enactment of this Act and compounded annually thereafter.</text></paragraph></subsection> 
<subsection changed="added" id="H034B392C56FF4D63B62C20F9E8E2AEA3"><enum>(c)</enum><header>Investment of trust Fund</header> 
<paragraph changed="added" id="H22AA31A7DDE947ADB068D184AB4BC657"><enum>(1)</enum><header>In general</header><text>The Secretary of the Treasury shall invest such portion of the Fund as is not, in the judgment of the Secretary of the Treasury, required to meet current withdrawals.</text></paragraph> 
<paragraph changed="added" id="HE4DC8AB755484DE6B36425E700F0F7D5"><enum>(2)</enum><header>Eligible obligations</header><text>Notwithstanding any other provision of law, the Secretary of the Treasury shall invest the amounts deposited under subsection (b) and the interest earned on those amounts only in interest-bearing obligations of the United States issued directly to the Fund.</text></paragraph> 
<paragraph changed="added" id="HA7DB4662BBC8477CA214AA1F6FBAF600"><enum>(3)</enum><header>Interest</header><text>The Secretary of the Treasury shall deposit interest resulting from such investments into the Fund.</text></paragraph></subsection> 
<subsection changed="added" id="H47136EE4DC1646DABE73124B4B6D002B"><enum>(d)</enum><header>Payment of interest to Tribe</header> 
<paragraph changed="added" id="H33EB1F7308E44BE18761644750ED6875"><enum>(1)</enum><header>Withdrawal of interest</header><text>Beginning on the first day of the 11th fiscal year after the date of enactment of this Act and, on the first day of each fiscal year thereafter, the Secretary of the Treasury shall transfer the aggregate amount of interest deposited into the Fund for the fiscal year to the Secretary for use in accordance with paragraph (3).</text></paragraph> 
<paragraph changed="added" id="H625DCFBAAA23477EB210946D33391819"><enum>(2)</enum><header>Availability</header><text>Each amount transferred under paragraph (1) shall be available without fiscal year limitation.</text></paragraph> 
<paragraph changed="added" id="H1B186A1BE9714E60A3C20000C93B90F8"><enum>(3)</enum><header>Payments to Tribe</header> 
<subparagraph changed="added" id="HCB3DDB527F1B43B88E9F976B4944EEBE"><enum>(A)</enum><header>In general</header><text>The Secretary shall use the amounts transferred under paragraph (1) only for the purpose of making payments to the Tribe, as such payments are requested by the Tribe pursuant to tribal resolution.</text></subparagraph> 
<subparagraph changed="added" id="H594037C967A349EA939C6B7019BB90A4"><enum>(B)</enum><header>Limitation</header><text>Payments may be made by the Secretary of the Interior under subparagraph (A) only after the Tribe has adopted a plan under subsection (f).</text></subparagraph> 
<subparagraph changed="added" id="H93B044A0E46C4394A5005E0851A3F539"><enum>(C)</enum><header>Use of payments by Tribe</header><text>The Tribe shall use the payments made under subparagraph (B) only for carrying out projects and programs under the plan prepared under subsection (f).</text></subparagraph></paragraph></subsection> 
<subsection changed="added" id="H9C93E7F3E6484E61B03B3114A5984DF5"><enum>(e)</enum><header>Limitation on transfers and withdrawals</header><text>Except as provided in subsections (c) and (d)(1), the Secretary of the Treasury shall not transfer or withdraw any amount deposited under subsection (b).</text></subsection> 
<subsection changed="added" id="HC1734BEC278C401ABC339B6B721203FD"><enum>(f)</enum><header>Development plan</header> 
<paragraph changed="added" id="HD2395F890BB24957BDD0AE654B469DCE"><enum>(1)</enum><header>In general</header><text>Not later than 18 months after the date of enactment of this Act, the governing body of the Tribe shall prepare a plan for the use of the payments to the Tribe under subsection (d).</text></paragraph> 
<paragraph changed="added" id="H42680FA86A8E4EDEAA7484D26F7078BA"><enum>(2)</enum><header>Contents</header><text>The plan shall provide for the manner in which the Tribe shall expend payments to the Tribe under subsection (d) to promote—</text> 
<subparagraph changed="added" id="HDB66030257C24228853FF4F55326BEEC"><enum>(A)</enum><text>economic development;</text></subparagraph> 
<subparagraph changed="added" id="HC75D1BE81B6944C2A335F0DB4F001230"><enum>(B)</enum><text>infrastructure development;</text></subparagraph> 
<subparagraph changed="added" id="HFA253E19C3D14C1C9CE7FDD1A583B0A8"><enum>(C)</enum><text>the educational, health, recreational, and social welfare objectives of the Tribe and members of the Tribe; or</text></subparagraph> 
<subparagraph changed="added" id="HB922F6261F7644578CBFF052F8F179B2"><enum>(D)</enum><text>any combination of the activities described in subparagraphs (A) through (C).</text></subparagraph></paragraph> 
<paragraph changed="added" id="H34EB416380F54A4000004C8BE201AFF9"><enum>(3)</enum><header>Plan review and revision</header> 
<subparagraph changed="added" id="H5D4CC23A9AE943A69FBE73AFC6D7CA00"><enum>(A)</enum><header>In general</header><text>The Tribal Council shall make available for review and comment by the members of the Tribe a copy of the plan before the plan becomes final, in accordance with procedures established by the Tribal Council.</text></subparagraph> 
<subparagraph changed="added" id="HFC4AEAA494B740B3B4261097FDB00047"><enum>(B)</enum><header>Updating of plan</header> 
<clause changed="added" id="H65A8F560C61048D4820717A3F585318F"><enum>(i)</enum><header>In general</header><text>The Tribal Council may, on an annual basis, revise the plan to update the plan.</text></clause> 
<clause changed="added" id="H08CDC2F2E03B405C9DBE45CAEDB82E2"><enum>(ii)</enum><header>Review and comment</header><text>In revising the plan, the Tribal Council shall provide the members of the Tribe opportunity to review and comment on any proposed revision to the plan.</text></clause></subparagraph> 
<subparagraph changed="added" id="H3AAD44FB09CE4D5CBBAC16705DE9B653"><enum>(C)</enum><header>Consultation</header><text>In preparing the plan and any revisions to update the plan, the Tribal Council shall consult with the Secretary and the Secretary of Health and Human Services.</text></subparagraph></paragraph> 
<paragraph changed="added" id="H8E238883A46E4EB68DFBC3966C6DE9A9"><enum>(4)</enum><header>Audit</header> 
<subparagraph changed="added" id="HEECDD040DC9149248985E729423FEE43"><enum>(A)</enum><header>In general</header><text>The activities of the Tribe in carrying out the plan shall be audited as part of the annual single-agency audit that the Tribe is required to prepare pursuant to the Office of Management and Budget circular numbered A–133.</text></subparagraph> 
<subparagraph changed="added" id="H8A8B9541594A4ED4A8A8A9B6A1009099"><enum>(B)</enum><header>Determination by auditors</header><text>The auditors that conduct the audit under subparagraph (A) shall—</text> 
<clause changed="added" id="H28E8EE1F4F6744B1BCA7F98BCC2BDA3"><enum>(i)</enum><text>determine whether funds received by the Tribe under this section for the period covered by the audit were expended to carry out the plan in a manner consistent with this section; and</text></clause> 
<clause changed="added" id="H65F0E3BA9774493A97ECCF0000D034F4"><enum>(ii)</enum><text>include in the written findings of the audit the determination made under clause (i).</text></clause></subparagraph> 
<subparagraph changed="added" id="H46B8ADC33DAD4429A48BB4D823E58D84"><enum>(C)</enum><header>Inclusion of findings with publication of proceedings of Tribal Council</header><text>A copy of the written findings of the audit described in subparagraph (A) shall be inserted in the published minutes of the Tribal Council proceedings for the session at which the audit is presented to the Tribal Council.</text></subparagraph></paragraph></subsection> 
<subsection changed="added" id="H47539E3E528A4617AA412E40D9C4C877"><enum>(g)</enum><header>Prohibition of per capita payments</header><text>No portion of any payment made under this title may be distributed to any member of the Tribe on a per capita basis.</text></subsection></section> 
<section changed="added" id="HE885A93A89DE434498E1E9104602BCD"><enum>202.</enum><header>Eligibility of Tribe for certain programs and services</header><text display-inline="no-display-inline">No payment made to the Tribe under this title shall result in the reduction or denial of any service or program with respect to which, under Federal law—</text> 
<paragraph changed="added" id="HBE5E1DE5621C4DB2B76976901B005509"><enum>(1)</enum><text>the Tribe is otherwise entitled because of the status of the Tribe as a federally recognized Indian tribe; or</text></paragraph> 
<paragraph changed="added" id="HDC6507AA6ECE41D690BC00B2857184A7"><enum>(2)</enum><text>any individual who is a member of the Tribe is entitled because of the status of the individual as a member of the Tribe.</text></paragraph></section> 
<section changed="added" id="H84B01355920E47359D3DF035627C1592"><enum>203.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There are authorized to be appropriated such sums as are necessary to pay the administrative expenses of the Fund.</text></section> 
<section changed="added" id="HB7E68016FE624094ADD4BB7F31C175A7"><enum>204.</enum><header>Water rights</header><text display-inline="no-display-inline">Nothing in this Act—</text> 
<paragraph changed="added" id="H1B7CF2F19691487084F250402570052E"><enum>(1)</enum> 
<subparagraph display-inline="yes-display-inline" id="H24778CB4808B4D7CA21C5E2F5995E0B8"><enum>(A)</enum><text>affects any rights, benefits, privileges or claims (including water rights or claims to water rights) of the Tribe, whether located within or without the external boundaries of the Reservation, based on treaty, Executive order, agreement, Act of Congress, aboriginal title, the Winters doctrine (Winters v. United States, 207 U.S. 564 (1908)), or otherwise; or</text></subparagraph> 
<subparagraph changed="added" indent="up1" id="H864FBB935068454C00A4AD6DD71FACDD"><enum>(B)</enum><text>validates or invalidates any assertion of the existence, nonexistence or extinguishment of any water rights, or claims to water rights, held by the Tribe or any other Indian tribe or individual Indian under Federal or State law; or</text></subparagraph></paragraph> 
<paragraph changed="added" id="H89B6776FF0714B9F93B6ADBB2CCF1524"><enum>(2)</enum><text>affects any other water rights in existence on the date of enactment of this Act held by any person or entity.</text></paragraph></section></title>
