<official-title>To prohibit the use of remote control locomotives to carry hazardous materials, and for other purposes.</official-title>

<section id="HA59F560E1DEE4D97B2E94D7F3CF3B2C8" section-type="section-one"><enum>1.</enum><header>Findings</header><text display-inline="no-display-inline">The Congress finds the following:</text> 
<paragraph id="H0739DE2EB78948C28D00D1F67F1800A5"><enum>(1)</enum><text>In issuing remote control railroad operation guidelines in 2001, the Federal Railroad Administration noted that its <quote>first priority . . . is to ensure that these operations pose no threat to railroad workers or the general public</quote>.</text></paragraph> 
<paragraph id="HE85BE768345548C182EC08EA5E457E74"><enum>(2)</enum><text>The Nation’s freight rail system is relatively open to outside access when compared to the aviation system. Security is provided almost solely by private railroad carriers, and terrorists could easily gain access to a remote control locomotive or an operator control unit and then operate a remote control transmitter controlling a remote control locomotive.</text></paragraph> 
<paragraph id="H1925977D0D98419D9C12A101779BC944"><enum>(3)</enum><text>Remote control locomotives carrying hazardous materials in urban areas could be sabotaged or remote control locomotives could be used to cause intentional accidents with other trains, causing loss of life, release of hazardous materials, and the disruption of interstate and international commerce.</text></paragraph> 
<paragraph id="HDBA339CF7CDF4B8894D6C655D4E03BCC"><enum>(4)</enum><text>Therefore, the risk of terrorists hijacking remote control locomotive operations is far too great in situations where remote control locomotives are carrying hazardous materials.</text></paragraph></section> 
<section id="HD254FB18806048ABBFFB55BEB6E54E48"><enum>2.</enum><header>Remote control locomotive use</header> 
<subsection id="H75EB2D0686C3473E903402E82C07BD65"><enum>(a)</enum><header>Prohibition</header><text>No railroad carrier shall operate or cause to be operated on the general system of railroad transportation a remote control locomotive to carry hazardous materials.</text> </subsection> 
<subsection id="H5C2F10FDCD604E93B89DD432701F97BA"><enum>(b)</enum><header>Penalty</header> 
<paragraph id="HDF335E4C3DC1458A9293D34F7684A800" display-inline="yes-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">A railroad carrier that knowingly violates this section or a rule issued under this section is liable to the United States Government for a civil penalty of at least $5,000 but not more than $50,000 for each violation. A railroad carrier acts knowingly when—</text> 
<subparagraph id="HD1E0FB80A7404F6CB17224682E0572F1" indent="up1"><enum>(A)</enum><text>the railroad carrier has actual knowledge of the facts giving rise to the violation; or</text></subparagraph> 
<subparagraph id="H31DAFD0B0F0F48CFA16529F155EAEE95" indent="up1"><enum>(B)</enum><text>a reasonable railroad carrier acting in the circumstances and exercising reasonable care would have that knowledge.</text></subparagraph></paragraph> 
<paragraph id="H545027C5999943A6AA4706D9A829A2D2" indent="up1"><enum>(2)</enum><text>A separate violation occurs for each day the violation continues.</text></paragraph></subsection></section> 
<section id="H00C510960FDB475D923BF8F395B143D8"><enum>3.</enum><header>Remote control transmitter security</header> 
<subsection id="HF72C3D53FD9F4EE1B47C5B4BB71BF482"><enum>(a)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary of Transportation shall issue a rule requiring that—</text> 
<paragraph id="HB4F60C000DA84FB6A02EBA2F4F7ECE9"><enum>(1)</enum><text>railroad carriers inventory and maintain a continuous accounting of remote control transmitters;</text></paragraph> 
<paragraph id="H02A9A4418DE14D55839659093EF3E3EF"><enum>(2)</enum><text>such transmitters be assigned only to personnel with proper identification and authorization to use such devices; and</text></paragraph> 
<paragraph id="HD2A98C7AE2AD4DCBB38E04CAB4DDA800"><enum>(3)</enum><text>such transmitters be kept in a secure location (under lock and key) when not in use.</text></paragraph></subsection> 
<subsection id="H87C92444211B4A8D86D83396C3009C16"><enum>(b)</enum><header>Penalty</header><text>A railroad carrier that violates the rule issued under subsection (a) shall be liable to the United States Government for a civil penalty of at least $5,000 for each occurrence.</text></subsection></section>
<section id="HB64D225F3FCC4FD5ACDF3D419E9FE314" display-inline="no-display-inline" section-type="subsequent-section"><enum>4.</enum><header>Remote control locomotive security</header> 
<subsection id="H4BAB3734B42C4D76BE65EF468CA0B457"><enum>(a)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary of Transportation shall issue a rule requiring that the manual operational control area of any remote control locomotive be kept under lock and key when such locomotive is operated without personnel of the railroad carrier present.</text> </subsection> 
<subsection id="H3DAAABE1327C42DC8CF8B092D8FA0000"><enum>(b)</enum><header>Penalty</header><text>A railroad carrier that violates the rule issued under subsection (a) shall be liable to the United States Government for a civil penalty of at least $5,000 for each occurrence.</text></subsection></section> 
<section id="H70F7728DD562436BA1B4BF86C4B376B3"><enum>5.</enum><header>Civil penalties</header> 
<subsection id="HCC370FA2BDD24175007C4F2536873D18"><enum>(a)</enum><header>Hearing requirement</header><text>The Secretary of Transportation may find that a railroad carrier has violated this Act only after notice and an opportunity for a hearing. The Secretary shall impose a civil penalty under this Act by giving the railroad carrier written notice of the amount of the penalty.</text></subsection> 
<subsection id="HFC6B715B74884B8B00003DA517F1A859"><enum>(b)</enum><header>Penalty consideration</header><text>In determining the amount of a civil penalty under this Act, the Secretary shall consider—</text> 
<paragraph id="H296A61D3EBAF44F88BA2D6C64E373656"><enum>(1)</enum><text>the nature, circumstances, extent, and gravity of the violation;</text></paragraph> 
<paragraph id="H344AC99CB3BD409DA57CBB8FD9FD0600"><enum>(2)</enum><text>with respect to the violator, the degree of culpability, any history of prior violations, the ability to pay, and any effect on the ability to continue to do business; and</text></paragraph> 
<paragraph id="HEB1A1B09F3604815005E755137F7CCDA"><enum>(3)</enum><text>other matters that justice requires.</text></paragraph></subsection> 
<subsection id="H3DF800AA555643109877DB975BE9791B"><enum>(c)</enum><header>Civil actions to collect</header><text>The Attorney General may bring a civil action in an appropriate district court of the United States to collect a civil penalty under this Act.</text></subsection></section> 
<section id="H874DFD4957D341C6BC5665215D165887"><enum>6.</enum><header>Criminal penalty</header> 
<subsection id="HD41D0FF1795A48FF8837EC4DAA601E21"><enum>(a)</enum><header>In general</header><text>A railroad carrier knowingly violating this Act shall be fined under title 18, United States Code, imprisoned for not more than 5 years, or both; except that the maximum amount of imprisonment shall be 10 years in any case in which the violation involves the release of a hazardous material that results in death or bodily injury to any person.</text></subsection> 
<subsection id="H28872B8DA7C24C14AECC9EAC9435278"><enum>(b)</enum><header>Knowing violations</header><text>For purposes of this section—</text> 
<paragraph id="H8A39AF4F053F42CBB3C331689543465C"><enum>(1)</enum><text display-inline="yes-display-inline">a railroad carrier acts knowingly when—</text> 
<subparagraph id="HB13BD880501148C19D69004FDE7519C1"><enum>(A)</enum><text display-inline="yes-display-inline">the railroad carrier has actual knowledge of the facts giving rise to the violation; or</text></subparagraph> 
<subparagraph id="H01A121B839FF4C6DAA57B1D2D26F5DE7"><enum>(B)</enum><text display-inline="yes-display-inline">a reasonable railroad carrier acting in the circumstances and exercising reasonable care would have that knowledge; and</text></subparagraph></paragraph> 
<paragraph id="HA1A81AAEC77E4CF5BF5C52D5280923D1"><enum>(2)</enum><text>knowledge of the existence of a statutory provision, or a regulation or a requirement issued by the Secretary of Transportation, is not an element of an offense under this Act.</text></paragraph></subsection> </section> 
<section id="H8A70F1E98B0D4EFFBBF3FCB22531B00"><enum>7.</enum><header>Definitions</header><text display-inline="no-display-inline">For purposes of this Act—</text> 
<paragraph id="H33C7A4C5C0004E589F9F293CF8A952E1"><enum>(1)</enum><text>the term <quote>hazardous material</quote> has the meaning given that term in <external-xref legal-doc="usc" parsable-cite="usc/49/5102">section 5102(2)</external-xref> of title 49, United States Code;</text></paragraph> 
<paragraph id="H5E7FD4D680E34E45B682F09979C500C4"><enum>(2)</enum><text>the term <quote>railroad carrier</quote> has the meaning given that term in <external-xref legal-doc="usc" parsable-cite="usc/49/20102">section 20102</external-xref> of title 49, United States Code; </text></paragraph> 
<paragraph id="H5D9C3CADBD4C4069ABC922A875995DB"><enum>(3)</enum><text>the term <quote>remote control locomotive</quote> means a locomotive which, through use of a radio transmitter and receiver system, can be operated by a person not physically located at the controls within the confines of the locomotive cab, but does not include a locomotive that is remotely controlled from the lead locomotive of the same train; and</text></paragraph> 
<paragraph id="H4AF6333C296648E19D4410CE16EF925C"><enum>(4)</enum><text>the term <quote>remote control transmitter</quote> means the transmitter component of a remote control locomotive system. </text></paragraph></section>
