<subsection id="HEA1439D0FB3340BF83D63F3B11F933ED"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 7(a) of the <act-name parsable-cite="SBA">Small Business Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(a)</external-xref>) is amended by adding at the end the following new paragraph:</text> 
<quoted-block act-name="Small Business Act" id="H5DA189B27E704AAD87A0AA7FB5319403"> 
<paragraph indent="up1" id="HE590B181F574485BA45157F9E4CF8927"><enum>(31)</enum><header>Combination financing</header> 
<subparagraph id="HD3B03CEEB50D48F9A48EB97F3DEB00D4"><enum>(A)</enum><header>Definitions</header><text>As used in this paragraph—</text> 
<clause id="H6A2C3A1421644B319CB5C729444D52D6"><enum>(i)</enum><text>the term <term>combination financing</term> means financing comprised of a loan guaranteed under this subsection and a commercial loan; and</text></clause> 
<clause id="H1D62D699857B43B186D583B78B9718F5"><enum>(ii)</enum><text>the term <term>commercial loan</term> means a loan that is part of a combination financing and no portion of which is guaranteed by the Federal Government.</text></clause></subparagraph> 
<subparagraph id="H5389814BDD9249EAB31E83BBF265E899"><enum>(B)</enum><header>Applicability</header><text>This paragraph applies to a loan guarantee obtained by a small business concern under this subsection, if the small business concern also obtains a commercial loan.</text></subparagraph> 
<subparagraph id="H095310ACEA5C471589DA883F0000AB28"><enum>(C)</enum><header>Commercial loan amount</header><text>In the case of any combination financing, the amount of the commercial loan which is part of such financing shall not exceed the gross amount of the loan guaranteed under this subsection which is part of such financing.</text></subparagraph> 
<subparagraph id="H9250A43A66864551A34636B2F329C9A6"><enum>(D)</enum><header>Commercial loan provisions</header><text>The commercial loan obtained by the small business concern—</text> 
<clause id="H10C53A51FDDE4D9385FD09DD3C006BA5"><enum>(i)</enum><text>may be made by the participating lender that is providing financing under this subsection or by a different lender;</text></clause> 
<clause id="H4FDDEFD76CE74AC889CE4419F6CF0525"><enum>(ii)</enum><text>may be secured by a senior lien; and</text></clause> 
<clause id="H933355D9D8AB496A98E398259037122E"><enum>(iii)</enum><text>may be made by a lender in the Preferred Lenders Program, if applicable.</text></clause></subparagraph> 
<subparagraph id="H2D24F3561EED4451BFE46012908199E2"><enum>(E)</enum><header>Commercial loan fee</header><text>A one-time fee in an amount equal to 0.7 percent of the amount of the commercial loan shall be paid to the Administrator if the commercial loan has a senior credit position to that of the loan guaranteed under this paragraph. Any fee under the preceding sentence shall be paid by the participating lender and shall not be charged to the borrower.</text></subparagraph> 
<subparagraph id="H142106CA6FBE4D18A460B7CCA9C66CA0"><enum>(F)</enum><header>Deferred participation loan security</header><text>A loan guaranteed under this paragraph may be secured by a subordinated lien.</text></subparagraph> 
<subparagraph id="H0B11BCEF8FB642A2A351099470219ECF"><enum>(G)</enum><header>Completion of application processing</header><text>The Administrator shall complete processing of an application for combination financing under this paragraph pursuant to the program authorized by this subsection as it was operating on October 1, 2003.</text></subparagraph> 
<subparagraph id="HCC4704A8883D4910B085A31BA99DD759"><enum>(H)</enum><header>Business loan eligibility</header><text>Any standards prescribed by the Administrator relating to the eligibility of small business concerns to obtain combination financing under this subsection which are in effect on September 1, 2004, shall apply with respect to combination financings made under this paragraph. Any modifications to such standards by the Administrator after such date shall not unreasonably restrict the availability of combination financing under this paragraph relative to the availability of such financing before such modifications.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H9BA036499833408485E5D1D6A3C0DAEC"><enum>(b)</enum><header>Effective date</header><text>The amendment made by subsection (a) shall take effect on October 1, 2004.</text></subsection></section> 
<section id="H318513F3543940E0ABFB646B847E0889"><enum>102.</enum><header>Loan guarantee fees</header> 
<subsection id="HE83B9EDACAEB4E49B4DC79FC49457CD"><enum>(a)</enum><header>In general</header><text>Section 7(a)(23)(A) of the <act-name parsable-cite="SBA">Small Business Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(a)(23)(A)</external-xref>) is amended to read as follows:</text> 
<quoted-block act-name="Small Business Act" id="H727865DEFA864E6CA545FDDC7B55B029"> 
<subparagraph indent="up1" id="HA4129BE62C5340009D387D4E9DF2CAEF"><enum>(A)</enum><header>Percentage</header><text>With respect to each loan guaranteed under this subsection, the Administrator shall, in accordance with such terms and procedures as the Administrator shall establish by regulation, assess and collect an annual fee in an amount equal to 0.36 percent of the outstanding balance of the deferred participation share of the loan.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HCB6A9114E16A4E778F14C2045D885635"><enum>(b)</enum><header>Guarantee fees</header><text>Paragraph (18) of subsection (a) of section 7 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(a)(18)</external-xref> is amended to read as follows:</text> 
<quoted-block style="OLC" id="H9B58905D40C84B09824CBF037000B442" display-inline="no-display-inline"> 
<paragraph id="H25EC4C5475F8468BA69EA71C7200E79E"><enum>(18)</enum><header>Guarantee fees</header><text>With respect to each loan guaranteed under this subsection (other than a loan that is repayable in 1 year or less), the Administration shall collect a guarantee fee, which shall be payable by the participating lender, and may be charged to the borrower, as follows:</text> 
<subparagraph id="HDE805C5E1C394B7381004299E1531F93"><enum>(A)</enum><text>A guarantee fee equal to 1 percent of the deferred participation share of a total loan amount that is not more than $150,000. </text></subparagraph> 
<subparagraph id="HFF5138489BC64178B800000040DFD49F"><enum>(B)</enum><text>A guarantee fee equal to 2.5 percent of the deferred participation share of a total loan amount that is more than $150,000, but not more than $700,000.</text></subparagraph> 
<subparagraph id="HADA8CDB5D27A4BA284BD78CB5E145114"><enum>(C)</enum><text>A guarantee fee equal to 3.5 percent of the deferred participation share of a total loan amount that is more than $700,000.</text></subparagraph> 
<subparagraph id="H1F8133D714D14A29AA91AD140F5A59D"><enum>(D)</enum><text>In addition to the fee under subparagraph (C), a guarantee fee equal to 0.25 percent of the amount, if any, by which the deferred participation share of the loan exceeds $1,000,000.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> </section> 
<section id="HA9D66A8971B04D28A71930A26CE73E73" section-type="subsequent-section" display-inline="no-display-inline"><enum>103.</enum><header>Express loans</header> 
<subsection id="H5261D2418EE04A67A77B4268B9B9B87"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 7(a) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(a)</external-xref>), as amended by section 101, is further amended by adding at the end the following new paragraph:</text> 
<quoted-block style="OLC" id="HCF3B71D434ED4F62AEB4E665EE03D342" display-inline="no-display-inline"> 
<paragraph id="HDB9B686E52684D81B2B2F970B740EB8B"><enum>(32)</enum><header>Express loans</header> 
<subparagraph id="H791D3591EC4146719BCF02255176F35E"><enum>(A)</enum><header>Definitions</header><text>As used in this paragraph:</text> 
<clause id="HD5429D69243A438984EB0D1E99B5179"><enum>(i)</enum><text>The term <quote>express lender</quote> means any lender authorized by the Administrator to participate in the Express Loan Program.</text></clause> 
<clause id="H9CAE57213F8B4DFC88C74558194598F4"><enum>(ii)</enum><text>The term <quote>express loan</quote> means any loan made pursuant to this paragraph in which a lender utilizes to the maximum extent practicable its own loan analyses, procedures, and documentation.</text></clause> 
<clause id="H96AA04CF36B4431C9B9E3BD9B8ACF512"><enum>(iii)</enum><text>The term <quote>Express Loan Program</quote> means the program for express loans established by the Administrator under paragraph (25)(B), as in existence on April 5, 2004, with a guaranty rate of not more than 50 percent.</text></clause></subparagraph> 
<subparagraph id="HE8121C8FCBA74848B5B3234D5DA2FB4C"><enum>(B)</enum><header>Restriction to express lender</header><text>The authority to make an express loan shall be limited to those lenders deemed qualified to make such loans by the Administrator. Designation as an express lender for purposes of making an express loan shall not prohibit such lender from taking any other action authorized by the Administrator for that lender pursuant to this subsection.</text></subparagraph> 
<subparagraph id="H6BF5A54D808B46C7A931469E029209A5"><enum>(C)</enum><header>Grandfathering of existing lenders</header><text>Any express lender shall retain such designation unless the Administrator determines that the express lender has violated the law or regulations promulgated by the Administrator or modifies the requirements to be an express lender and the lender no longer satisfies those requirements.</text></subparagraph> 
<subparagraph id="H47276DBF42054093B7CFB8304F00DF3D"><enum>(D)</enum><header>Maximum loan amount</header><text>The maximum loan amount under the Express Loan Program is $2,000,000.</text></subparagraph> 
<subparagraph id="H14E25630B93E44FE856C62B3006DF895"><enum>(E)</enum><header>Option to participate</header><text>Except as otherwise provided in this paragraph, the Administrator shall take no regulatory, policy, or administrative action, without regard to whether such action requires notification pursuant to paragraph (24), that has the effect of—</text> 
<clause id="HAC72136C6E61476DB21E7DA8D0092201"><enum>(i)</enum><text>requiring a lender to make an express loan pursuant to subparagraph (D);</text></clause> 
<clause id="H6F81EF0AC34F47D883E4B000B4D4009F"><enum>(ii)</enum><text>limiting or modifying any term or condition of deferred participation loans made under this subsection (other than express loans) unless the Administrator imposes the same limit or modification on express loans;</text></clause> 
<clause id="H1075783D93A145BE8897488DF4024391"><enum>(iii)</enum><text>transferring or re-allocating staff, staff responsibilities, resources, or funding, if the result of such transfer or re-allocation would be to increase the average loan processing, approval, or disbursement time above the averages for those functions as of October 1, 2003, for loan guarantees approved under this subsection by employees of the Administration or through the Preferred Lenders Program; or</text></clause> 
<clause id="HE74A9A400F8C456AA6C38881C34BF28"><enum>(iv)</enum><text>otherwise providing any incentive or disincentive which encourages lenders or borrowers to make or obtain loans under the Express Loan Program instead of under the general loan authority of this subsection.</text></clause></subparagraph> 
<subparagraph id="H9B8607BD45034ADC902379DA72F2FC2E"><enum>(F)</enum><header>Collection and reporting of data</header><text>For all loans in excess of $250,000 made pursuant to the authority set forth in subparagraph (D), the Administrator shall, to the extent practicable, collect data on the purpose for each such loan. The Administrator shall report monthly to the Committee on Small Business and Entrepreneurship of the Senate and the Committee on Small Business of the House of Representatives on the number of such loans and their purposes.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HA27A04DCCC844068AD5EB9C21305EF91"><enum>(b)</enum><header>Effective date</header><text>The amendment made by subsection (a) shall take effect on October 1, 2004.</text></subsection></section> 
<section id="H88C3A79C39F0497492473FF300F0906F"><enum>104.</enum><header>Deferred participation loan standards</header> 
<subsection id="H90BD66F5CC024FCAA9E57417A16E8F5C"><enum>(a)</enum><header>In general</header><text>Section 7(a) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(a)</external-xref>), as amended by section 101 and section 103, is further amended by adding at the end the following new paragraph:</text> 
<quoted-block style="OLC" id="H0E2904C015D141DABDE7B99BABEA8E" display-inline="no-display-inline"> 
<paragraph id="HC63715720E0F4AC68B5CA4DB40C878EE"><enum>(33)</enum><header>Deferred participation loan standards</header><text>Deferred participation loans made on or after October 1, 2004, under this subsection shall have the same terms and conditions (including maximum gross loan amounts and collateral requirements) as were applicable to loans made under this subsection on October 1, 2003, except as otherwise provided in paragraph (18)(D), paragraph (31), or paragraph (32) and subject to the $1,500,000 limitation on the total amount outstanding and committed in paragraph (3)(A), as in effect on October 1, 2004. This paragraph shall not preclude the Administrator from taking such action as necessary to maintain the loan program carried out under this subsection, subject to appropriations.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H956670978E62440A8E8D03C985E43C45"><enum>(b)</enum><header>Effective date</header><text>The amendment made by subsection (a) shall take effect on October 1, 2004.</text></subsection></section> 
<section id="HD57C50A355C64701BDA6ACEBACD4377B"><enum>105.</enum><header>Increase in guarantee amount and institution of associated fee</header> 
<subsection id="H8BD159F6D78548909269137F03D2D48C"><enum>(a)</enum><header>Increase in amount permitted to be outstanding and committed</header><text>Section 7(a)(3)(A) of the <act-name parsable-cite="SBA">Small Business Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(a)(3)(A)</external-xref>) is amended by striking <quote>$1,000,000</quote> and inserting <quote>$1,500,000</quote>.</text></subsection> 
<subsection id="H60084F8B2F85448CA70025287DCE90C3"><enum>(b)</enum><header>Effective date</header><text>The amendment made by subsection (a) shall take effect on October 1, 2004.</text> </subsection></section> 
<section id="HE595A04C494847A397E7785395CA9C71" section-type="subsequent-section" display-inline="no-display-inline"><enum>106.</enum><header>Debenture size</header><text display-inline="no-display-inline">Section 502(2) of the <act-name parsable-cite="SBIA">Small Business Investment Act of 1958</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/15/696">15 U.S.C. 696(2)</external-xref>) is amended to read as follows:</text>

<paragraph id="H4DE05ADF6C4C4E57B592BBF48742411B"><enum>(2)</enum><header>Maximum amount</header> 
<subparagraph id="H4408A921600E44520087A0DCFEB589AD"><enum>(A)</enum><header>In general</header><text>Loans made by the Administration under this section shall be limited to—</text> 
<clause id="HC04AEE4D85A34FD799E600CC0000DC10"><enum>(i)</enum><text>$1,500,000 for each small business concern if the loan proceeds will not be directed toward a goal or project described in subparagraph (B) or (C);</text></clause> 
<clause id="H3278CBDA3F874A15AC23221370054E2C"><enum>(ii)</enum><text>$2,000,000 for each small business concern if the loan proceeds will be directed toward 1 or more of the public policy goals described under section 501(d)(3); and</text></clause> 
<clause id="HF21A256DD00A430FBA952CE32D004FF"><enum>(iii)</enum><text>$4,000,000 for each project of a small manufacturer.</text></clause></subparagraph> 
<subparagraph id="HCD332B49B2D6485984C8B9C351D21286"><enum>(B)</enum><header>Definition</header><text>As used in this paragraph, the term ‘small manufacturer’ means a small business concern—</text> 
<clause id="H010A2B14C2F44807BD0162AA29CB3701"><enum>(i)</enum><text>the primary business of which is classified in sector 31, 32, or 33 of the North American Industrial Classification System; and</text></clause> 
<clause id="HB97BFA79AC4C4D28A0338CDAD4AE783E"><enum>(ii)</enum><text>all of the production facilities of which are located in the United States.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H8D6C8F9A4EF141DEAA15671515EB1919" section-type="subsequent-section" display-inline="no-display-inline"><enum>107.</enum><header>Job requirements</header><text display-inline="no-display-inline">Section 501 of the Small Business Investment Act of 1958 (<external-xref legal-doc="usc" parsable-cite="usc/15/695">15 U.S.C. 695</external-xref>) is amended by adding at the end the following new subsection:</text> 
<quoted-block style="OLC" id="HC44A3D1503B94434AF415800F05DAD4C" display-inline="no-display-inline"> 
<subsection id="H240D98E860454022B55953F800DE3DE3"><enum>(e)(1)</enum><text>A project meets the objective set forth in subsection (d)(1) if the project creates or retains one job for every $50,000 guaranteed by the Administration, except that the amount is $100,000 in the case of a project of a small manufacturer.</text> 
<paragraph id="HB2827E5A4DA841719DA7C57903BF16D7" indent="up1"><enum>(2)</enum><text>Paragraph (1) does not apply to a project for which eligibility is based on the objectives set forth in paragraph (2) or (3) of subsection (d), if the development company's portfolio of outstanding debentures creates or retains one job for every $50,000 guaranteed by the Administration.</text></paragraph> 
<paragraph id="HBE96F9861806430EAED9B293EE001DB5" indent="up1"><enum>(3)</enum><text>For projects in Alaska, Hawaii, State-designated enterprise zones, empowerment zones and enterprise communities, labor surplus areas, as determined by the Secretary of Labor, and for other areas designated by the Administrator, the development company's portfolio may average not more than $75,000 per job created or retained.</text></paragraph> 
<paragraph id="HE43CFEF31C08427C94C4376065E478F" indent="up1"><enum>(4)</enum><text>Loans for projects of small manufacturers shall be excluded from calculations under paragraph (2) or (3).</text></paragraph> 
<paragraph id="HEF758469B58A4D01B212E59FB771B41" indent="up1"><enum>(5)</enum><text>Under regulations prescribed by the Administrator, the Administrator may waive any requirement of this subsection (other than paragraph (4)).</text></paragraph> 
<paragraph id="H181AA4C48BDD41EB8B99798F55C9474C" indent="up1"><enum>(6)</enum><text display-inline="yes-display-inline">As used in this subsection, the term ‘small manufacturer’ means a small business concern—</text>

<section id="HAAAFC69D10B446B4B36FEC8F1C01F1D" section-type="subsequent-section"><enum>108.</enum><header>Report regarding national database of small manufacturers</header> 
<subsection id="H36645BEAA7264B0294B18C07B97DEB40"><enum>(a)</enum><header>Study and report</header><text>The Administrator, in consultation with the association of small business development centers authorized by section 21(k) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/648">15 U.S.C. 648(k)</external-xref>), shall—</text> 
<paragraph id="HB7D3C7C4B4FF4A539C76B6FC67416E04"><enum>(1)</enum><text>study the feasibility of creating a national database of small manufacturers that institutions of higher education could access for purposes of meeting procurement needs; and</text></paragraph> 
<paragraph id="H1C2005005B4640BE99FF92E81375B24"><enum>(2)</enum><text>not later than one year after the date of the enactment of this Act, transmit a report to the Congress regarding the findings and conclusions of such study.</text></paragraph></subsection> 
<subsection id="H7C1AE8C515944289AD668DACCD7C6400"><enum>(b)</enum><header>Cost estimate</header><text>The report referred to in subsection (a)(2) shall include an estimate of the cost of creating and maintaining the database described in subsection (a)(1).</text></subsection> 
<subsection id="H05724891514744F4B0D8DF26DA5C2E58"><enum>(c)</enum><header>Definition</header><text>As used in this section, the term <quote>small manufacturer</quote> means a small business concern —</text>

<subsection id="H769E05DB0CDD4D61929800D2B159F9E8"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 7(a)(16) of the <act-name parsable-cite="SBA">Small Business Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(a)(16)</external-xref>) is amended to read as follows:</text>

<paragraph id="HEC78FE10A29D4797B094B67B006089C8"><enum>(16)</enum><header>International trade</header> 
<subparagraph id="H8A124942C4874D4187C7C9EBD8A2C545"><enum>(A)</enum><header>In general</header><text>If the Administrator determines that a loan guaranteed under this subsection will allow an eligible small business concern that is engaged in or adversely affected by international trade to improve its competitive position, the Administrator may make such loan to assist such concern in—</text> 
<clause id="H3BDA96BAB7284D12818BC485392CFD67"><enum>(i)</enum><text>the financing of the acquisition, construction, renovation, modernization, improvement, or expansion of productive facilities or equipment to be used in the United States in the production of goods and services involved in international trade; or</text></clause> 
<clause id="H305C07C4B9D347A092BCEF831BCB3D16"><enum>(ii)</enum><text>the refinancing of existing indebtedness that is not structured with reasonable terms and conditions.</text></clause></subparagraph> 
<subparagraph id="HA55B5278A4154C71BDE491E612CCF8BC"><enum>(B)</enum><header>Security</header><text>Each loan made under this paragraph shall be secured by a first lien position or first mortgage on the property or equipment financed by the loan or on other assets of the small business concern.</text></subparagraph> 
<subparagraph id="H080F006905C94B5BB3A7237FE98006D"><enum>(C)</enum><header>Engaged in international trade</header><text>For purposes of this paragraph, a small business concern is engaged in international trade if, as determined by the Administrator, the small business concern is in a position to expand existing export markets or develop new export markets.</text></subparagraph> 
<subparagraph id="HEE26E6726F04483CB060FF331C8E6C36"><enum>(D)</enum><header>Adversely affected by international trade</header><text>For purposes of this paragraph, a small business concern is adversely affected by international trade if, as determined by the Administrator, the small business concern—</text> 
<clause id="HC741147BE2AA4790BFD7001EA3E4586D"><enum>(i)</enum><text>is confronting increased competition with foreign firms in the relevant market; and</text></clause> 
<clause id="H5510893997A445C48E78D788A987793D"><enum>(ii)</enum><text>is injured by such competition.</text></clause></subparagraph> 
<subparagraph id="HCC4DF4662B8A4F17B4CCFBF966B6EDDD"><enum>(E)</enum><header>Findings by certain Federal agencies</header><text>For purposes of subparagraph (D)(ii) the Administrator shall accept any finding of injury by the International Trade Commission or any finding of injury by the Secretary of Commerce pursuant to chapter 3 of title II of the Trade Act of 1974.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H66ADF29102D0416E8BCF7865712098E5"><enum>(b)</enum><header>Limitation increase</header><text>Section 7(a)(3)(B) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(a)(3)(B)</external-xref>) is amended—</text> 
<paragraph id="H6C8D692623B44806BCCEB0EEB6B9A8DA"><enum>(1)</enum><text>by striking <quote>1,250,000</quote> and inserting <quote>1,750,000</quote>; and</text></paragraph> 
<paragraph id="HE7B27328E2694F3DB107D841565DD795"><enum>(2)</enum><text>by striking <quote>$750,000</quote> and inserting <quote>$1,250,000</quote>.</text></paragraph></subsection>

<paragraph id="HAE26DAAE4372415C8B1D9F4698808177"><enum>(2)</enum><header>Evaluation of program</header> 
<subparagraph id="H0D519466B5F642210016846E72E563DC"><enum>(A)</enum><header>Data collection and analysis</header><text>Each eligible intermediary receiving a grant under this section shall establish a system to collect and analyze information regarding the effectiveness of drug-free workplace programs established with assistance provided under this section through the intermediary, including information regarding any increase or decrease among employees in drug use, awareness of the adverse consequences of drug use, and absenteeism, injury, and disciplinary problems related to drug use. Such system shall conform to such requirements as the Administrator, after consultation with the Director of the Center for Substance Abuse and Prevention, may prescribe. Not more than 5 percent of the amount of each grant made under subsection (b) shall be used by the eligible intermediary to carry out this paragraph.</text></subparagraph> 
<subparagraph id="HA4716E02171B429800E883B967BAD327"><enum>(B)</enum><header>Method of evaluation</header><text>The Administrator, after consultation with the Director of the Center for Substance Abuse and Prevention, shall provide technical assistance and guidance to each eligible intermediary receiving a grant under subsection (b) regarding the collection and analysis of information to evaluate the effectiveness of drug-free workplace programs established with assistance provided under this section, including the information referred to in paragraph (1). Such assistance shall include the identification of additional information suitable for measuring the benefits of drug-free workplace programs to the small business concern and to the concern’s employees and the identification of methods suitable for analyzing such information.</text></subparagraph> </paragraph></subsection> <after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="HED0E3012AD854A3E00DFE0E7CB6D3262"><enum>215.</enum><header>Report to Congress</header><text display-inline="no-display-inline">Not later than March 31, 2006, the Administrator of the Small Business Administration, in consultation with the Secretary of Labor, the Secretary of Health and Human Services, and the Director of National Drug Control Policy, shall submit to the Congress a report that—</text> 
<paragraph id="H62DCD0086D4D4DC99D1674424EDDA87"><enum>(1)</enum><text>analyzes the information collected under section 27(c) of the Small Business Act;</text></paragraph>

<paragraph id="H5FD85608C7F9451BAB4F26D36F586B83"><enum>(3)</enum><text>evaluates the effectiveness of the drug-free workplace programs established with assistance under section 27 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/654">15 U.S.C. 654</external-xref>).</text></paragraph></section></subtitle></title>

<section id="HE58AB1E020604D5FA80239E26C1BD7F5" section-type="subsequent-section" display-inline="no-display-inline"><enum>501.</enum><header>Women-owned small business concerns; authorities of Administrator</header><text display-inline="no-display-inline">Subsections (m) and (n) of section 8 of the Small Business Act (15 U.S.C. 637 (m) and (n)) are amended to read as follows:</text>

<subsection id="HB0464E0576534A5EA835E99E33CCB29"><enum>(m)</enum><header>Procurement program for women-owned small business concerns</header> 
<paragraph id="HE742AA95DAD14617A3513DF473DB3C32"><enum>(1)</enum><header>Definitions</header><text>In this subsection, the following definitions apply:</text> 
<subparagraph id="HA37652748BFD4DD588F58D77388B0036"><enum>(A)</enum><header>Small business concern owned and controlled by women</header><text>The term <quote>small business concern owned and controlled by women</quote> has the meaning given such term in section 3(n), except that ownership shall be determined without regard to any community property law.</text></subparagraph></paragraph> 
<paragraph id="HBBE7CF441E784054A4AD3300F9C55109"><enum>(2)</enum><header>Authority to restrict competition</header><text>In accordance with this subsection, a contracting officer may restrict competition for any contract for the procurement of goods or services by the Federal Government to small business concerns owned and controlled by women, if—</text> 
<subparagraph id="H6FBD173C1B9B477EBE3D18A8304F62B0"><enum>(A)</enum><text>each of the concerns is not less than 51 percent owned by 1 or more women who are economically disadvantaged (and such ownership is determined without regard to any community property law);</text></subparagraph> 
<subparagraph id="HEEC0FC68709341A4A1C242BF001EDE23"><enum>(B)</enum><text>the contracting officer has a reasonable expectation that 2 or more small business concerns owned and controlled by women will submit offers for the contract;</text></subparagraph> 
<subparagraph id="H2E0E93956E5D4C25921F47D6E5E087FE"><enum>(C)</enum><text>the contract is for the procurement of goods or services with respect to an industry identified by the Administrator pursuant to paragraph (4);</text></subparagraph> 
<subparagraph id="HC205B17BA8FB4050ADEE6700EC0656EB"><enum>(D)</enum><text>the anticipated award price of the contract (including options) does not exceed—</text> 
<clause id="H6C12347A8CE5460ABDB501E93DE19AA"><enum>(i)</enum><text>$5,000,000, in the case of a contract assigned an industrial classification code in sector 31, 32, or 33 of the North American Industrial Classification System; or</text></clause> 
<clause id="HD03DFB97F09D40DEB1CDAEA8D6A11FBD"><enum>(ii)</enum><text>$3,000,000, in the case of all other contracts;</text></clause></subparagraph> 
<subparagraph id="H74B024F1A78F4AECBAB0259422A5E1BB"><enum>(E)</enum><text>in the estimation of the contracting officer, the contract award can be made at a fair and reasonable price; and</text></subparagraph> 
<subparagraph id="H1D37ABDDA4C144AEA6BADC4FC48187CF"><enum>(F)</enum><text>each of the concerns—</text> 
<clause id="HB9BCC7A4055049F1AF708DC3BD642B81"><enum>(i)</enum><text>is certified by a Federal agency or a State government as a small business concern owned and controlled by women;</text></clause> 
<clause id="H22958B9BB8714B9EA3009B9710937CD2"><enum>(ii)</enum><text>is certified by a national certifying entity approved by the Administrator as a small business concern owned and controlled by women; or</text></clause> 
<clause id="HD8E74EB74B274419ADECFFAF001189AC"><enum>(iii)</enum><text>certifies to the contracting officer that it is a small business concern owned and controlled by women and provides adequate documentation in accordance with standards established by the Administration to support such certification.</text></clause></subparagraph></paragraph> 
<paragraph id="HA596C92B575340BF9F3E46D8D80086F5"><enum>(3)</enum><header>Waiver</header><text>With respect to a small business concern owned and controlled by women, the Administrator may waive subparagraph (2)(A) if the Administrator determines that the concern is in an industry in which small business concerns owned and controlled by women are substantially underrepresented.</text></paragraph> 
<paragraph id="H7AB5FBCA99414F7B9211DB9267C7EB3C"><enum>(4)</enum><header>Identification of industries</header> 
<subparagraph id="HC882B828D5F54BDB8172C83BC3C52959"><enum>(A)</enum><header>In general</header><text>The Administrator shall conduct a study to identify industries in which small business concerns owned and controlled by women are underrepresented with respect to Federal procurement contracting.</text></subparagraph> 
<subparagraph id="HE439D71DE05B4CBDA76FF6A36585682D"><enum>(B)</enum><header>Deadline</header><text>Not later than 90 days after the date of the enactment of this subparagraph the Administrator shall—</text> 
<clause id="H9E0ADD509D1149EA8DC9E992E9053D1E"><enum>(i)</enum><text>ensure the completion of the study described in this paragraph;</text></clause> 
<clause id="H4A812A7CFC1D42938FFCF2CE06B9E16C"><enum>(ii)</enum><text>approve national certifying entities for the purposes of paragraph (2)(F)(ii); and</text></clause> 
<clause id="HBAB91B48B9D74FA5AD947BFB8DC8514C"><enum>(iii)</enum><text>make determinations in accordance with paragraph (3).</text></clause></subparagraph></paragraph> 
<paragraph id="H3BF01F5EAAD541AF9193B26380005D3F"><enum>(5)</enum><header>Enforcement; penalties</header> 
<subparagraph id="HBFBF8692C87446B1B922200092FD3FB4"><enum>(A)</enum><header>Verification of eligibility</header><text>In carrying out this subsection, the Administrator shall use existing procedures established by the Office of Hearings and Appeals relating to—</text> 
<clause id="H4292BF7378D34989B413D11C43315037"><enum>(i)</enum><text>the filing, investigation, and disposition by the Administration of any challenge to the eligibility of a small business concern to receive assistance under this subsection (including a challenge, filed by an interested party, relating to the veracity of a certification made or information provided to the Administration by a small business concern under paragraph (2)(F)); and</text></clause> 
<clause id="H8CEB4E8CD553488B93604CBB061F54A6"><enum>(ii)</enum><text>verification by the Administrator of the accuracy of any certification made or information provided to the Administration by a small business concern under paragraph (2)(F).</text></clause></subparagraph> 
<subparagraph id="H56BEF12601574D6EAD03AA401D9D7EC6"><enum>(B)</enum><header>Examinations</header><text>The procedures established under subparagraph (A) may provide for program examinations (including random program examinations) by the Administrator of any small business concern making a certification or providing information to the Administrator under paragraph (2)(F).</text></subparagraph> 
<subparagraph id="H920ED71E6939417397B04EB4E79F4F7"><enum>(C)</enum><header>Penalties</header><text>In addition to the penalties described in section 16(d), any small business concern that is determined by the Administrator to have misrepresented the status of that concern as a small business concern owned and controlled by women for purposes of this subsection, shall be subject to—</text> 
<clause id="HFFF773CFDA7D44F1ACE028FF22260718"><enum>(i)</enum><text><external-xref legal-doc="usc" parsable-cite="usc/18/1001">section 1001</external-xref> of title 18, United States Code; and</text></clause> 
<clause id="H9103015D88004E08A259A02E1269158B"><enum>(ii)</enum><text>sections 3729 through 3733 of title 31, United States Code.</text></clause></subparagraph></paragraph> 
<paragraph id="H5412CF85675A41B888BC4DBBFA84B93"><enum>(6)</enum><header>Provision of data</header><text>Upon the request of the Administrator, the head of any Federal department or agency shall promptly provide to the Administrator such information as the Administrator determines to be necessary to carry out this subsection.</text></paragraph></subsection> 
<subsection id="H85752B6288FE425A90673BDE56BD370"><enum>(n)</enum><header>Authorities of Administrator</header><text>In carrying out subsections 7(i), 8(a), and 8(b) the Administrator may do the following:</text> 
<paragraph id="H334A66CD93244F969E617B4F2F93F4E8"><enum>(1)</enum><text>Utilize, with their consent, the services and facilities of Federal agencies without reimbursement, and, with the consent of any State or political subdivision of a State, accept and utilize the services and facilities of such State or subdivision without reimbursement.</text></paragraph> 
<paragraph id="H10BB6B47D02A4246B2BCEDCF8F2862AF"><enum>(2)</enum><text>Accept voluntary and uncompensated services, notwithstanding <external-xref legal-doc="usc" parsable-cite="usc/31/1342">section 1342</external-xref> of title 31, United States Code.</text></paragraph> 
<paragraph id="H70FAA35B3C564C9388FD26F6C5BC7110"><enum>(3)</enum><text>Employ experts and consultants or organizations thereof as authorized by <external-xref legal-doc="usc" parsable-cite="usc/5/3109">section 3109</external-xref> of title 5, United States Code. No individual may be employed under the authority of this paragraph for more than 100 days in any fiscal year. No individual employed under this paragraph may be compensated at rates in excess of the daily equivalent of the highest rate payable under <external-xref legal-doc="usc" parsable-cite="usc/5/5332">section 5332</external-xref> of title 5, United States Code, including traveltime. Individuals employed under this paragraph may be allowed, while away from their homes or regular places of business, travel expenses (including per diem in lieu of subsistence) as authorized by <external-xref legal-doc="usc" parsable-cite="usc/5/5703">section 5703</external-xref> of title 5, United States Code for persons in the Government service employed intermittently. Contracts for employment under this paragraph may be renewed annually.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H1627D3537F164693A150574150123D37"><enum>502.</enum><header>Procurement center representatives</header><text display-inline="no-display-inline">Section 15(l) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/644">15 U.S.C. 644(l)</external-xref>) is amended—</text> 
<paragraph id="H6177BFA9EE5146ACBA5EE221B68BC3A6"><enum>(1)</enum><text>in the last sentence of paragraph (1), by striking <quote>to the representative referred to in subsection (k)(6)</quote> and inserting <quote>the traditional procurement center representative and the commercial market representative, with each position filled by a different individual, and each such representative having separate and distinct duties and responsibilities.</quote>; and</text></paragraph> 
<paragraph id="HC3E5146491FC4D40B5411EEA8B28BB65"><enum>(2)</enum><text>by adding at the end the following new paragraph:</text>

<title id="H37F4465F4ED64867895C33D13F740729"><enum>VI</enum><header>Miscellaneous Amendments to small business investment act of 1958</header> 
<section id="H7EB1003712444B439C28FBF2B4FBD086" section-type="subsequent-section"><enum>601.</enum><header>Amendment to definition of equity capital with respect to issuers of participating securities</header><text display-inline="no-display-inline">Section 303(g)(4) of the Small Business Investment Act of 1958 (15 U.S.C. 683 (g)(4)) is amended—</text> 
<paragraph id="H141E3EBCC8674E02A9E6FDF54B6CA351" display-inline="no-display-inline"><enum>(1)</enum><text>in the first sentence, by striking <quote>subsection</quote> and inserting <quote>Act</quote>; and</text></paragraph> 
<paragraph id="H5FD8D0B833534589B890ACAE97D73237"><enum>(2)</enum><text>in the second sentence, by striking <quote>contingent upon and limited to the extent of earnings</quote> and inserting <quote>from appropriate sources, as determined by the Administration</quote>.</text></paragraph></section> 
<section id="H60B7A3C9FC034E15B7DD07ABE536EC17" section-type="subsequent-section" display-inline="no-display-inline"><enum>602.</enum><header>Amendment to small business investment company aggregate limitations provision</header><text display-inline="no-display-inline">Section 306(a) of the Small Business Investment Act of 1958 (<external-xref legal-doc="usc" parsable-cite="usc/15/686">15 U.S.C. 686(a)</external-xref>) is amended by to read as follows:</text> 
<quoted-block style="OLC" display-inline="no-display-inline" id="HF41624FF134345629C9FCE638D9EC5EC"> 
<subsection id="H3AF14E04ACF24DC3A676E0A06147C417"><enum>(a)</enum><text>If a small business investment company has outstanding financing from the Administration, the aggregate amount of obligations and securities acquired and for which commitments may be issued by the company under this title for a single enterprise shall not, without the approval of the Administration, exceed the greater of 20 percent of the private capital of the company or 10 percent of the sum of:</text> 
<paragraph id="HB3BA860E4DC14CE7AE611793A3B0559F"><enum>(1)</enum><text>(1) the private capital of the company; </text></paragraph> 
<paragraph id="HC93BF1BA4873472F9E9BDE3000516E6F"><enum>(2)</enum><text> all leverage, whether or not outstanding, issued to the company; and</text></paragraph> 
<paragraph id="HF1973FF064BA4484ABD0079C00E720D0"><enum>(3)</enum><text>all unexercised commitments issued to the company by the Administration.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H3FED222A4C8546998F1300E0AA587EBF" section-type="subsequent-section"><enum>603.</enum><header>Investment of excess funds</header><text display-inline="no-display-inline">Section 308(b) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/687">15 U.S.C. 687(b)</external-xref>) is amended by striking the last sentence and inserting the following new sentence:</text> 
<quoted-block style="OLC" id="H9D9365F72A4941D5BF57852F07AB56F0" display-inline="yes-display-inline"><text display-inline="yes-display-inline">Such companies with outstanding financings are authorized to invest funds not needed for their operations—</text> 
<paragraph id="H9D066BEECA8A4E9ABBF900C9EC56A7DA"><enum>(1)</enum><text>in direct obligations of, or obligations guaranteed as to principal and interest by, the United States;</text></paragraph> 
<paragraph id="HD206E3C737E6448380F95355A482F09E"><enum>(2)</enum><text>in certificates of deposit or other accounts of federally insured banks or other federally insured depository institutions, if the certificates or other accounts mature or are otherwise fully available not more than 1 year after the date of the investment; or</text></paragraph> 
<paragraph id="H4138632F574A417580F66BBEE0417CF5"><enum>(3)</enum><text> in mutual funds, securities, or other instruments that consist of, or represent pooled assets of, investments described in paragraphs (1) or (2).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H387FDA0F827541EB9D6998AD76705251" section-type="subsequent-section" display-inline="no-display-inline"><enum>604.</enum><header>Clarification of maximum surety bond guarantee</header><text display-inline="no-display-inline">Section 411(a)(1) of the Small Business Investment Act of 1958 (<external-xref legal-doc="usc" parsable-cite="usc/15/694b">15 U.S.C. 694b(a)(1)</external-xref>) is amended by striking <quote>contract up to</quote> and inserting <quote>total work order or contract amount at the time of bond execution that does not exceed</quote>.</text></section> </title>
