<section section-type="section-one" id="H0393A2022A304F86BA47A77B3C94D3E3" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Prescott Marine Mammal Stranding Program Amendments of 2004</short-title></quote>.</text></section> 
<section id="HA063C826E33A4D3DAAB5EF6F91686447" display-inline="no-display-inline"><enum>2.</enum><header>Amendment references</header><text display-inline="no-display-inline">Except as otherwise expressly provided, whenever in this Act an amendment or repeal is expressed in terms of an amendment to, or repeal of, a section or other provision, the reference shall be considered to be made to such section or other provision of the Marine Mammal Protection Act of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/16/1361">16 U.S.C. 1361 et seq.</external-xref>).</text></section> 
<section id="HE8FE6AF7BED3444EBA2BD3F6F90006E"><enum>3.</enum><header>Authorizations of appropriations for John H. Prescott Marine Mammal Rescue Assistance Grant Program</header> 
<subsection id="HC44F664927784BFEB05300C8C2C1A241"><enum>(a)</enum><header>Grant program</header><text>Section 408(h) (<external-xref legal-doc="usc" parsable-cite="usc/16/1421f-1">16 U.S.C. 1421f–1(h)</external-xref>) is amended by striking <quote>fiscal years 2001 through 2003</quote> and inserting <quote>fiscal years 2005 through 2009</quote>.</text></subsection> 
<subsection id="HC3339A4DD6DC4D37A9FF38D24E319BA5"><enum>(b)</enum><header>Marine mammal unusual mortality event fund</header><text>Section 409(3) (<external-xref legal-doc="usc" parsable-cite="usc/16/1421g">16 U.S.C. 1421g(3)</external-xref>) is amended by striking <quote>$500,000 for fiscal year 1993</quote> and inserting <quote>$125,000 for each of fiscal years 2005 through 2009</quote>.</text></subsection> 
<subsection id="H89F368F6E63347929921B4DD51971221"><enum>(c)</enum><header>Administrative costs and expenses</header><text>Section 408 (<external-xref legal-doc="usc" parsable-cite="usc/16/1421f-1">16 U.S.C. 1421f–1</external-xref>) is amended—</text> 
<paragraph id="HEEC0A8759A1F4E0FBE78F3CD5F4CB15"><enum>(1)</enum><text>by adding at the end of subsection (a)(1) the following: <quote>All funds available to implement this section shall be distributed to eligible stranding network participants for the purposes set forth in this paragraph, except as provided in subsection (f).</quote>; and</text></paragraph> 
<paragraph id="H85AABD867F644F03A0EB87DAD3627DF4"><enum>(2)</enum><text>by amending subsection (f) to read as follows:</text>

<subsection id="H03B104583DC14C4D92DAEFF1D68BFD4D"><enum>(f)</enum><header>Administrative costs and expenses</header><text>Of the amounts available each fiscal year to carry out this section, the Secretary may expend not more than 6 percent or $80,000, whichever is greater, to pay the administrative costs and administrative expenses to implement the grant program under subsection (a). Any such funds retained by the Secretary for a fiscal year for such costs and expenses that are not used for such costs and expenses before the end of the fiscal year shall be provided as grants under subsection (a).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H3F428453F0AA4FCC8208DBAC8822D00"><enum>(d)</enum><header>Contributions</header><text>Section 408 (<external-xref legal-doc="usc" parsable-cite="usc/16/1421f-1">16 U.S.C. 1421f–1</external-xref>) is further amended by adding at the end the following:</text>

<subsection id="HC8B915EDA1A146408679694189D56CDD"><enum>(b)</enum><header>Obsolete reference to section</header><text>Section 118(c)(3)(A)(i) (<external-xref legal-doc="usc" parsable-cite="usc/16/1387">16 U.S.C. 1387(c)(3)(A)(i)</external-xref>) is amended by striking <quote>, except that</quote> and all that follows through <quote>is valid</quote>.</text></subsection></section>

<subsection id="HE29EBE91A41A415090FE8306956945FA"><enum>(a)</enum><header>In general</header><text>Section 101(a)(6) (<external-xref legal-doc="usc" parsable-cite="usc/16/1371">16 U.S.C. 1371(a)(6)</external-xref>) is amended by redesignating subparagraph (B) as subparagraph (C), and by inserting after subparagraph (A) the following:</text>

<subparagraph indent="up1" id="HB151A5BF54054024AA2F61159CB2B62C"><enum>(B)</enum><text>A marine mammal product may be exported from the United States if the product—</text> 
<clause id="HCDEFA4CCBDC348E9A05018CB6BC4B35"><enum>(i)</enum><text>is legally possessed, and exported by, a citizen of the United States for noncommercial purposes in conjunction with travel outside the United States and the product is imported into the United States by the same person upon the termination of travel;</text></clause> 
<clause id="H5C0103EB0BDE492491A34EB2FFBDE2C0"><enum>(ii)</enum><text>is legally possessed, and exported by, a person that is not a citizen of the United States for noncommercial purposes;</text></clause> 
<clause id="HF6C4916087F64525A5696DD8D782B84D"><enum>(iii)</enum><text>is legally possessed and exported as part of a cultural exchange, by an Indian, Aleut, or Eskimo residing in Alaska; or</text></clause> 
<clause id="HAE91C14A59B94C3880C091B7A13F9720"><enum>(iv)</enum><text>is owned by a Native inhabitant of Russia, Canada, or Greenland and is exported for noncommercial purposes—</text> 
<subclause id="HE6828D908DFC4E50A7003E2663007DC0"><enum>(I)</enum><text>in conjunction with, and upon the completion of, travel within the United States; or</text></subclause> 
<subclause id="H007E5FA2B30D4047A234E61B00247822"><enum>(II)</enum><text>as part of a cultural exchange with an Indian, Aleut, or Eskimo residing in Alaska.</text></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H54E2D225E88C49FAA5289E04B78E60EF"><enum>(b)</enum><header>Conforming amendment</header><text>Section 101(a)(6)(A)(i) (<external-xref legal-doc="usc" parsable-cite="usc/16/1371">16 U.S.C. 1371(a)(6)(A)(i)</external-xref>) is amended by inserting <quote>for noncommercial purposes</quote> after <quote>United States</quote> the first place it appears.</text></subsection></section>

<subsection id="H94331264176A49249316DCEC00F31902"><enum>(a)</enum><header>In general</header><text>Section 118 (<external-xref legal-doc="usc" parsable-cite="usc/16/1387">16 U.S.C. 1387</external-xref>) is amended as follows:</text> 
<paragraph id="H9F092C26F94E44E28B2EF28270E753F"><enum>(1)</enum><text>In subsection (a) by striking <quote>commercial</quote> each place it appears in paragraphs (1) and (5).</text></paragraph> 
<paragraph id="H4D710AE6F4D646A39D4F5426E1F2ECEE"><enum>(2)</enum><text>In subsection (c)(1) by striking so much as precedes subparagraph (B) and inserting the following:</text>

<clause id="HCC65679F7EE2432DA712AB057074C06E"><enum>(i)</enum><text>commercial and recreational fisheries that have frequent incidental mortality and serious injury of marine mammals;</text></clause> 
<clause id="H720642002E1F4C92A062D800972D7107"><enum>(ii)</enum><text>commercial and recreational fisheries that have occasional incidental mortality and serious injury of marine mammals; or</text></clause> 
<clause id="H186AE1EA25A943AE89C8B1630071AB55"><enum>(iii)</enum><text>commercial fisheries that have a remote likelihood of or no known incidental mortality or serious injury of marine mammals;</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph>

The Secretary may develop and implement a take reduction plan for any other marine mammal stocks which interact with a fishery listed under subsection (c)(1)(A)(i) which the Secretary determines, after notice and opportunity for public comment, has a high level of mortality and serious injury across a number of such marine mammal stocks.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HD5B33841334543249513B22EE79DAEA5"><enum>(14)</enum><text>In subsection (f)(2)—</text>

<subsection id="H9C81472F600849AB899CADADA55F29B2"><enum>(k)</enum><header>Research on nonlethal removal and control</header> 
<paragraph display-inline="yes-display-inline" id="HD772B19C9687417780AB8D919731B077"><enum>(1)</enum><text>The Secretary shall conduct research on the nonlethal removal and control of nuisance pinnipeds. The research shall include a review of measures that have been taken to effect such removal and control, the effectiveness of these measures, and the development of new technologies to deter nuisance pinnipeds.</text></paragraph> 
<paragraph indent="up1" id="H6E737F3BA83349B5B2E49E1484BFE1B8"><enum>(2)</enum><text>The Secretary shall include, among the individuals that develop the research program under this subsection, representatives of the commercial and recreational fishing industries.</text></paragraph> 
<paragraph indent="up1" id="HA9F3C323310D4F7DB568F7AE4D6700A1"><enum>(3)</enum><text>The Secretary is encouraged, where appropriate, to use independent marine mammal research institutions in developing and in conducting the research program.</text></paragraph> 
<paragraph indent="up1" id="HD15E113C7E4F4605A111EC7B52B610E1"><enum>(4)</enum><text>The Secretary shall, by December 31 of each year, submit an annual report on the results of research under this subsection to the Committee on Resources of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate.</text></paragraph></subsection> 
<subsection id="HC8B702CB68B5493A00DEBB458CC55343"><enum>(l)</enum><header>Qualified nonlethal control projects</header><text></text> 
<paragraph id="H77AEC3631960468100ABBA598D97D782"><enum>(1)</enum><header>In general</header><text>The Secretary may, to the extent amounts are available to carry out this subsection, provide a grant to any eligible applicant to carry out a qualified nonlethal control project in accordance with this subsection.</text></paragraph> 
<paragraph id="HA82699F5C9B14707A0DAC2D918BC8B84"><enum>(2)</enum><header>Applications</header><text>The Secretary shall—</text> 
<subparagraph id="HB2E3A57680554EDDA47EFEBC23C79D21"><enum>(A)</enum><text>publish guidelines for and solicit applications for grants under this subsection not later than 6 months after the date of enactment of this subsection; and</text></subparagraph> 
<subparagraph id="H344E855E1068456BA2FD494733767315"><enum>(B)</enum><text>receive, review, evaluate, and approve applications for grants under this subsection. </text></subparagraph></paragraph> 
<paragraph id="H2A12D7046B434B7F00777EFF44EAC3E8"><enum>(3)</enum><header>Eligible applicant</header><text>To be an eligible applicant for purposes of paragraph (1), an applicant must—</text> 
<subparagraph id="H556C4554FF934C47AC1F4EFECAF0B5F1"><enum>(A)</enum><text>be a State, local government, or interstate or regional agency; and</text></subparagraph> 
<subparagraph id="H36D772DDB38E4C5F002D35CC1CCA90DC"><enum>(B)</enum><text>have adequate personnel, funding, and authority to carry out and monitor or maintain a nonlethal control of nuisance pinnipeds project.</text></subparagraph></paragraph> 
<paragraph id="H50C96E376634476ABCF4A3E8382C83A2"><enum>(4)</enum><header>Qualified control project</header><text>To be a qualified control project under this subsection, a project must—</text> 
<subparagraph id="H8C81D96FC4DA4E2286A03249A657FEF2"><enum>(A)</enum><text>by humane and nonlethal means, remove, deter, and control nuisance pinnipeds in areas where they are a recurrent and persistent threat to public health and safety; and</text></subparagraph> 
<subparagraph id="H321DA0665B7A4ABCA7D392473DB600FC"><enum>(B)</enum><text>encourage public notice, education, and outreach on project activities in the affected community.</text></subparagraph></paragraph> 
<paragraph id="H6F661FCEB7D042CEB86140F7B744659F"><enum>(5)</enum><header>Grant duration</header><text>Each grant under this subsection shall be to provide funding for the Federal share of the cost of a project carried out with the grant for up to 2 fiscal years.</text></paragraph> 
<paragraph id="HAFE4FD02C367424399F0DE2F1ECA00B0"><enum>(6)</enum><header>Reporting by grantee</header> 
<subparagraph id="H15B9B255B9F249D581D0483710F43372"><enum>(A)</enum><header>In general</header><text>A grantee carrying out a control project with a grant under this subsection shall report to the Secretary at the expiration of the grant. </text></subparagraph> 
<subparagraph id="H279FD8D53FE845DBB26FC9737FC0EB00"><enum>(B)</enum><header>Report contents</header><text>Each report under this subsection shall include specific information on the methods and techniques used to control nuisance pinniped species in the project area, and on the ensuing results.</text></subparagraph></paragraph> 
<paragraph id="H220EAC65C3AC43D3ADC21D13337B92FD"><enum>(7)</enum><header>Cost sharing</header><text></text> 
<subparagraph id="H32B3132D9F3D4FDBAAC8F3411355840"><enum>(A)</enum><header>Federal share</header><text>Except as provided in paragraphs (2) and (3), the Federal share of the cost of a project carried out with a grant under this subsection shall not exceed 75 percent of such cost.</text></subparagraph> 
<subparagraph id="H6B6A6584C8DA436E86B44E1F268D3C81"><enum>(B)</enum><header>Application of in-kind contributions</header><text>The Secretary may apply to the non-Federal share of costs of a control project carried out with a grant under this subsection the fair market value of services or any other form of in-kind contribution to the project made by non-Federal interests that the Secretary determines to be an appropriate contribution equivalent to the monetary amount required for the non-Federal share of the activity. </text></subparagraph> 
<subparagraph id="HC2E94EC532AE4ED900BC23FF4C441C64"><enum>(C)</enum><header>Derivation of non-federal share</header><text>The non-Federal share of the cost of a control project carried out with a grant under this subsection may not be derived from a Federal grant program or other Federal funds. </text></subparagraph></paragraph> 
<paragraph id="HB476DE48642A47A8904DA2C2F5547637"><enum>(8)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to the Secretary $1,500,000 for each of fiscal years 2005 through 2009.</text></paragraph>

<subparagraph id="HDC135CC1813B461F84C0532ED923715"><enum>(B)</enum><text>the progeny of a marine mammal excluded from coverage under this Act by section 102(e).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="HC11A34102C964D68958E541142EA58EB" display-inline="no-display-inline" section-type="subsequent-section"><enum>11.</enum><header>Tropical Treaty conforming amendment</header><text display-inline="no-display-inline">Subsection (c) of the Dolphin Protection Consumer Information Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1385">16 U.S.C. 1385</external-xref>) is amended in paragraph (2) by striking <quote>160 degrees west longitude</quote> and inserting <quote>150 degrees west longitude</quote>.</text></section>

<clause id="H549F7906AA1C44788B00FCCF4BB0D2A4"><enum>(ii)</enum><text>for the purpose of scientific research or enhancing the survival or recovery of a species or stock, unless the receiving facility meets standards that are comparable to the requirements that a person must meet to receive a permit under this subsection for that purpose.</text></clause></subparagraph> 
<subparagraph id="HABAFDF756E4341F3AFBCEEDF28EAA62" indent="up1"><enum>(B)</enum><text>The Secretary may not require or request, through comity or any other means, that any marine mammal or its progeny remain subject to the jurisdiction of the United States when located in waters or on lands that are subject to the jurisdiction of another country.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H35324EDF5EA640D6BD10CABBBC055D38"><enum>(3)</enum><text>Subsection (c)(10) is amended—</text> 
<subparagraph id="H5EA6644F2522456698DA3110D9D642A4"><enum>(A)</enum><text>in the first sentence by inserting <quote>held within the lands and waters of the United States</quote> after <quote>marine mammals</quote> each place it appears;</text></subparagraph> 
<subparagraph id="H48487E51E16546CF9DFB98C17922AA1E"><enum>(B)</enum><text>by inserting after the first sentence the following: <quote>The Secretary shall update the inventory on an annual basis.</quote>; and </text></subparagraph>

<subsection id="H6090E796CDE54AEDAE72B2D7AD3439E6"><enum>(b)</enum><header>Review and report regarding inventory</header><text></text> 
<paragraph id="H743B69945A314CC5B08537AF2C4B89DE"><enum>(1)</enum><header>Review</header><text>The Secretaries of Commerce and the Interior shall, by not later than 12 months after date of the enactment of this Act, jointly conduct a review of the inventory maintained under section 104(c)(10) of the Marine Mammal Protection Act of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/16/1374">16 U.S.C. 1374(c)(10)</external-xref>), the use of the information in the inventory, and the costs, benefits, and issues associated with the development of an online inventory.</text></paragraph> 
<paragraph id="HA59533792F1D4102BFAE390098BF01B"><enum>(2)</enum><header>Consultation</header><text>In conducting the review, the Secretary shall consult and solicit input from persons who are required to provide information for the inventory.</text></paragraph> 
<paragraph id="H039118F999304A23B6448E010006FF2E"><enum>(3)</enum><header>Report</header><text>The Secretary shall submit a report to Committee on Resources of the House of Representatives and the Committee on Commerce, Science and Transportation of the Senate on the findings of the review under this subsection. The report shall include the following:</text> 
<subparagraph id="HB0F99650F67846188FDE75FBFBD97035"><enum>(A)</enum><text>Recommendations on whether the inventory should be maintained by the Secretary or by another person under contract. </text></subparagraph> 
<subparagraph id="H19D07D0BCE4F4D1BA56D4891C6A09208"><enum>(B)</enum><text>How the Secretary would oversee maintenance of the inventory carried out under contract. </text></subparagraph> 
<subparagraph id="H12CDA263084C4D3A88571C7E6BE884D"><enum>(C)</enum><text>How public access and access by Federal agencies to the inventory can be maintained if the inventory is maintained under contract. </text></subparagraph> 
<subparagraph id="HAF00CDF268C447D0819F7C75CBDC94F7"><enum>(D)</enum><text>How the Secretary can minimize duplication on the information the Secretary receives from public display facilities and reduce the paper work burden on those facilities. </text></subparagraph> 
<subparagraph id="HE8899B6C28A24B348F8012FA402F5453"><enum>(E)</enum><text>An estimate of the cost of maintaining the inventory.</text></subparagraph> 
<subparagraph id="H0FD0A910921D46AD92F77F00BE74D9BE"><enum>(F)</enum><text>A description of how the Secretary will ensure the secure maintenance of the data in the inventory.</text></subparagraph> 
<subparagraph id="H58AE7BC9F8A0402FBD12B48503AA7136"><enum>(G)</enum><text>An analysis of the potential that online availability of the information in the inventory could adversely affect the safety of the animals.</text></subparagraph></paragraph></subsection></section> 
<section id="H74ADBEA499B74C9095E4851F4EA2FC14" display-inline="no-display-inline" section-type="subsequent-section"><enum>13.</enum><header>Fisheries gear development</header><text display-inline="no-display-inline">Section 111 (<external-xref legal-doc="usc" parsable-cite="usc/16/1381">16 U.S.C. 1381</external-xref>) is amended as follows:</text> 
<paragraph id="HD99D02E1F43D4988007D430043C9CB9F"><enum>(1)</enum><text>Subsection (a) is amended to read as follows:</text>

<subparagraph id="H0FAC5DFD26DA456799B2424061F609FC"><enum>(A)</enum><text>carry out a program of research and development for the purpose of devising improved fishing methods and gear so as to reduce to the maximum extent practicable the incidental taking of marine mammals in connection with fishing operations; and</text></subparagraph> 
<subparagraph id="H29A06FF82F9C4B8F95C95727C5FCFF63"><enum>(B)</enum><text>make every practicable effort to develop, evaluate, and make available to owners and operators of fishing vessels such gear and fishing method improvements as quickly as possible.</text></subparagraph></paragraph> 
<paragraph id="H2DF559B67D194ED3AA681F54F48B2D8E"><enum>(2)</enum><header>Coordination with other countries</header><text>The Secretary may coordinate with other countries to foster gear technology transfer initiatives to reduce to the maximum extent practicable the incidental mortality and serious injury of marine mammals throughout the full extent of their range.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H3372D6B6E5A6480791CC81FD52CB0089"><enum>(2)</enum><text>By adding at the end the following:</text> 
<quoted-block id="H0BFEDCC117A9457D811C49D22632F6AB"> 
<subsection id="HC50B741166E940E28E7C9469F087B07"><enum>(e)</enum><header>Gear research mini-grant program</header> 
<paragraph id="HA29C1FD9ABF14CDB00FE5C5648729BE9"><enum>(1)</enum><header>In general</header><text>Subject to the availability of appropriations, the Secretary may establish a grant program to provide financial assistance for developing, manufacturing, testing, or designing new types of fishing gear designed to reduce to the maximum extent practicable the incidental taking (including incidental mortality and serious injury) of marine mammals.</text></paragraph> 
<paragraph id="H5E9497A55F8441AEBC6D7B64EA468CA4"><enum>(2)</enum><header>Grant amount and purposes</header><text>The amount of a grant under this subsection may not exceed $20,000.</text></paragraph> 
<paragraph id="HC6879C32F43540BB84C71717FA8131C2"><enum>(3)</enum><header>Grant applications</header><text>To receive a grant under this section, an applicant must submit an application in such form and manner as the Secretary may prescribe.</text></paragraph> 
<paragraph id="H4EAB4D00695C4BA2ABD760FBCF008FA7"><enum>(4)</enum><header>Consultation regarding criteria</header><text>The Secretary shall consult with the Secretary of the Interior and the Marine Mammal Commission regarding the development of criteria for the awarding of grants under this subsection.</text></paragraph> 
<paragraph id="HEFF462C7BE5548DD8C240940D33CED00"><enum>(5)</enum><header>Administrative costs</header><text>Of amounts available each fiscal year to carry out this subsection, the Secretary may expend not more than $40,000 to pay the administrative expenses necessary to carry out this subsection.</text></paragraph>

<subsection id="H03DB3B87B4CE4EFCB0DF1C074E58DB60"><enum>(c)</enum><header>Use of Alaska Native organizations for enforcement</header><text>Section 107(a) (<external-xref legal-doc="usc" parsable-cite="usc/16/1377">16 U.S.C. 1377(a)</external-xref>) is amended by inserting <quote>, or of an Alaska Native organization for purposes of enforcing this title pursuant to a harvest management plan with the organization under section 119</quote> after <quote>Federal agency</quote>.</text></subsection> 
<subsection id="H134522162BFA4144811F01BDBA593EF6"><enum>(d)</enum><header>Marine mammal comanagement agreements in Alaska</header><text>Section 119 (<external-xref legal-doc="usc" parsable-cite="usc/16/1388">16 U.S.C. 1388</external-xref>) is amended—</text>

<subsection id="H595F059AC4EC4E54002CDC11F044854E"><enum>(a)</enum><header>In general</header><text>The Secretary may enter into cooperative management agreements with Alaska Native organizations to conserve and manage any stock of marine mammals and provide comanagement of subsistence use by Alaska Natives. Such agreements may include a harvest management plan governing Alaska Native subsistence use for those stocks or species covered by the cooperative management agreement.</text></subsection> 
<subsection id="HA5B0354E76744B34A6A155F4B5D17030"><enum>(b)</enum><header>Management plan requirements</header><text>A harvest management plan under this section with an Alaska Native organization shall—</text> 
<paragraph id="HAB5CA53B69E2468CAE54CBD4CD737C22"><enum>(1)</enum><text>apply only to Alaska Natives, as defined in section 101(b);</text></paragraph> 
<paragraph id="H92028387E4F44DB2A15BA1ADF19F8F04"><enum>(2)</enum><text>identify the signatories to the plan, and the stock or species and geographic area covered by the plan;</text></paragraph> 
<paragraph id="H64570D298C364EE6B1E45B37E64EBAB4"><enum>(3)</enum><text>be based on biological information and traditional ecological knowledge;</text></paragraph> 
<paragraph id="H22BB05F8CC24438186B100E5033337F5"><enum>(4)</enum><text>provide for a sustainable harvest of each stock or species covered by the plan, and is designed to prevent populations of such stocks and species from becoming depleted;</text></paragraph> 
<paragraph id="H3A2D8B65561848B2BF7CFFE1D4F4F757"><enum>(5)</enum><text>have a clearly defined process and authority for enforcement and implementation of any management prescriptions under the plan; and</text></paragraph> 
<paragraph id="HCB8453464C804D2691EBEF4C30F80000"><enum>(6)</enum><text>specify the duration of the plan and set forth procedures for periodic review and termination of the plan.</text></paragraph></subsection> 
<subsection id="H0CC84B7354E34F13BCDB9100BECDBE3D"><enum>(c)</enum><header>Implementing regulations and ordinances</header> 
<paragraph id="H164498C4D20D470E88B18961D4EAEA4D"><enum>(1)</enum><header>In general</header><text>An Alaska Native organization may adopt regulations and ordinances that apply to Alaska Natives exclusively and that are consistent with, and necessary to implement and enforce, a harvest management plan entered into by the organization under this section.</text></paragraph> 
<paragraph id="H663EBC943F214D3890CDA10535855000"><enum>(2)</enum><header>Depleted stocks</header><text>A regulation or ordinance adopted pursuant to this subsection for a depleted stock shall apply only to the extent the regulation or ordinance is consistent with regulations issued by the Secretary under sections 101(b) and 103 that apply to such stock.</text></paragraph></subsection> 
<subsection id="H4A0E702F176C405491B4D64180B2E235"><enum>(d)</enum><header>Prohibition</header><text>It is unlawful for any Alaska Native within the geographic area to which a harvest management plan under this section applies, to take, transport, sell, or possess a marine mammal in violation of any regulation or ordinance adopted by an Alaska Native organization to implement and enforce a harvest management plan.</text></subsection> 
<subsection id="HF94969C72675464A00A9DECF86CD07A2"><enum>(e)</enum><header>Grants</header><text>Agreements entered into under this section may include a grant to Alaska Native organizations for, among other purposes—</text> 
<paragraph id="HEC6429FC58CA47C29BD967E816CBAD00"><enum>(1)</enum><text>collecting and analyzing data on marine mammal populations;</text></paragraph> 
<paragraph id="H2C4892E2D54348CD95D8E88CFF18A45"><enum>(2)</enum><text>monitoring the harvest of marine mammals for subsistence and handicraft uses;</text></paragraph> 
<paragraph id="HA56924C6D6EA4B469696EF4F65357997"><enum>(3)</enum><text>participating in marine mammal research conducted by the Federal Government, the State of Alaska, academic institutions, and private organizations; and</text></paragraph> 
<paragraph id="H5134DFE266AF45E9B230A00127178DDA"><enum>(4)</enum><text>developing marine mammal comanagement structures with Federal and State agencies, and implementing, and enforcing any harvest management plan included in the agreement.</text></paragraph></subsection> 
<subsection id="H83ACF90C7C544F37966CB8995C7FEE99"><enum>(f)</enum><header>Opportunity for advance notice and comment regarding proposed regulations</header><text>Before proposing any regulation under section 101(b) relating to the taking of a stock of marine mammals that is the subject of a harvest management plan under this section, the Secretary shall—</text> 
<paragraph id="HE724C878C2074AEA8701BC01164F8C08"><enum>(1)</enum><text>solicit recommendations for such proposed regulation from each Alaska Native organization engaged in harvest management of the species or stock pursuant to this section; and</text></paragraph> 
<paragraph id="HFBCA3CA88A424AC59EA8491F967E98D9"><enum>(2)</enum><text>provide to each such organization—</text> 
<subparagraph id="H726C40451BDC40A994EE39D2A3B43B8D"><enum>(A)</enum><text>each draft of the proposed regulation;</text></subparagraph> 
<subparagraph id="H1F1BDCEDD281470093E64473C766692C"><enum>(B)</enum><text>an analysis of how the proposed regulation would achieve the goal of being the least restrictive measures upon subsistence use of the stock and the conservation goals of the Act; and</text></subparagraph> 
<subparagraph id="HB676A6D039B8462FBEEA443E3DBB003D"><enum>(C)</enum><text>an opportunity to comment on the proposed regulation prior to publication of any proposed regulations in the Federal Register.</text></subparagraph></paragraph></subsection> 
<subsection id="H34DEED694CF74D0CA2ABF5B79CC83313"><enum>(g)</enum><header>Public notice</header><text>The Secretary shall publish each harvest management plan entered into under this section.</text></subsection> 
<subsection id="H8B7718DBECE34F7DBCDB08CC2143A987"><enum>(h)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated for the purposes of carrying out this section—</text> 
<paragraph id="H8D9DBB55E4CE439BAB331B75759E60F7"><enum>(1)</enum><text>to the Secretary of the Interior, $3,000,000 for each of fiscal years 2005 through 2009; and</text></paragraph> 
<paragraph id="HAC21E33FE3404BCEB08810B6B6F04F1"><enum>(2)</enum><text>to the Secretary of Commerce, $3,000,000 for each of fiscal years 2005 through 2009.</text></paragraph></subsection> 
<subsection id="H0FF63F4C029C4548BEBAAAD4BFEC94C"><enum>(i)</enum><header>FACA exemption</header><text>The <act-name parsable-cite="FACA">Federal Advisory Committee Act</act-name> (5 App. U.S.C.) shall not apply with respect to the provision of any advice or recommendations to the Secretary by any Alaska Native organization (including any scientific review group associated with such an organization), or the obtaining of any advice or recommendations by the Secretary from such an organization, for the purpose of formulation or implementation of a cooperative management agreement under this section.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section> 
<section id="HA2E39B53C97B4E9E81FB0796AC86D140" display-inline="no-display-inline" section-type="subsequent-section"><enum>17.</enum><header>Annual report requirement</header><text display-inline="no-display-inline">Section 103 (<external-xref legal-doc="usc" parsable-cite="usc/16/1373">16 U.S.C. 1373(f)</external-xref>) is amended—</text> 
<paragraph id="HFCC046B9CE4149A7A10083BFD2CA13CB"><enum>(1)</enum><text>in subsection (f) in the first sentence, by inserting <quote>and notwithstanding <external-xref legal-doc="public-law" parsable-cite="pl/104/66">Public Law 104–66</external-xref>,</quote> after <quote>thereafter</quote>; and</text></paragraph> 
<paragraph id="HEDBA3BD080214657BF2DBC16E6AF672E"><enum>(2)</enum><text>by adding at the end the following:</text>

<subsection id="H108AFC8633984FB99489E0C430CF18B2"><enum>(g)</enum><text>The head of each Federal agency that conducts and provides funds for research on marine mammals shall report annually to the Committee on Resources of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate on funding provided and research conducted regarding marine mammals during the preceding year.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section>
