<official-title>To amend part A of title I of the Elementary and Secondary Education Act of 1965 to include hold-harmless provisions for local educational agencies that no longer meet the minimum eligibility criteria for targeted grants and education finance incentive grants, and for other purposes.</official-title>

<section id="HB39542B7464241E1B70300CDA0D12282" section-type="section-one"><enum>1.</enum><header>Hold-harmless provisions</header> 
<subsection id="H95D95E666E954AD89F74B2E42346D329"><enum>(a)</enum><header>Targeted grants</header><text>Paragraph (2) of section 1122(c) of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6332">20 U.S.C. 6332(c)</external-xref>) is amended—</text> 
<paragraph id="HC836DC53D71E44CE95F46FE7E9F2DBE9"><enum>(1)</enum><text>by striking <quote>If sufficient funds</quote> and inserting the following: </text> 
<quoted-block style="OLC" id="H01ECB25EAC984B6F9CF4C2F68742E3EC" display-inline="no-display-inline"> 
<subparagraph id="H8E7CD2A3091846C7AF3D47DC80BC3372"><enum>(A)</enum><header>Concentration grants</header><text>If sufficient funds</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HA4849C130B1347EEAB0069A94D52DAE"><enum>(2)</enum><text>by adding at the end the following:</text>

<subparagraph id="H454448B10F734B59AF848D740068B09F"><enum>(B)</enum><header>Targeted grants</header><text display-inline="yes-display-inline">Notwithstanding the inability of a local educational agency to meet the minimum eligibility criteria described in section 1125(a)(1) for a fiscal year, if sufficient funds are appropriated, the amount made available to the agency under section 1125 for that year shall be—</text> 
<clause id="H80C036B2FCDD4C84BF37F951006500B9"><enum>(i)</enum><text>if the agency met such minimum eligibility criteria and received a grant under section 1125 for the preceding fiscal year, not less than 67 percent of the amount of such grant; or</text></clause> 
<clause id="H9223E68BD45840039529B6700BCD9E6"><enum>(ii)</enum><text>if the agency met such minimum eligibility criteria and received a grant under section 1125 for the second preceding fiscal year (but not the preceding fiscal year), not less than 34 percent of the amount of such grant.</text></clause></subparagraph> 
<subparagraph id="H665E0628E4C14FCCA62E21CF2C905E09"><enum>(C)</enum><header>Education finance incentive grants</header><text>Notwithstanding the inability of a local educational agency to meet the minimum eligibility criteria described in section 1125A(c) for a fiscal year, if sufficient funds are appropriated, the amount made available to the agency under section 1125A for that year shall be—</text> 
<clause id="HA77CBF0B4B2A45EEBFAE04B200AF998B"><enum>(i)</enum><text>if the agency met such minimum eligibility criteria and received a grant under section 1125A for the preceding fiscal year, not less than 67 percent of the amount of such grant; or</text></clause> 
<clause id="HA52F37F1C3B043EAA9C4BF236B211D81"><enum>(ii)</enum><text>if the agency met such minimum eligibility criteria and received a grant under section 1125A for the second preceding fiscal year (but not the preceding fiscal year), not less than 34 percent of the amount of such grant.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H7818F8126323487FABB9A9D978ECA69"><enum>(b)</enum><header>Application</header><text>The amendments made by this section apply only with respect to funds appropriated for fiscal year 2005 or any subsequent fiscal year.</text></subsection></section>
