<subsection id="H5C37BF76F4E8453D89B8B313FB5BC75E"><enum>(a)</enum><header>Establishment of program</header><text display-inline="yes-display-inline">Part IV of subtitle E of title 10, United States Code, is amended by inserting after chapter 1606 the following new chapter:</text>

<section id="H95182E9DD7C44A5385EFF31082F30865"><enum>16161.</enum><header>Purpose</header><text display-inline="no-display-inline">The purpose of this chapter is to provide educational assistance to members of the reserve components who have been called or ordered to active service in response to a war or national emergency declared by the President or the Congress, in recognition of the sacrifices that those members make in answering the call to duty.</text></section> 
<section id="H66FA184A6B7C462E82EB36492CBD68ED"><enum>16162.</enum><header>Educational assistance program</header> 
<subsection id="H728AC046F12245D1918D178FD4564E00"><enum>(a)</enum><header>Program establishment</header><text display-inline="yes-display-inline"> The Secretary of each military department, under regulations prescribed by the Secretary of Defense, and the Secretary of Homeland Security with respect to the Coast Guard when it is not operating as a service in the Navy, shall establish and maintain a program as prescribed in this chapter to provide educational assistance to members of the Ready Reserve of the armed forces under the jurisdiction of the Secretary concerned.</text></subsection> 
<subsection id="HF75E3F11CCF04E0480E446DF4DAE0F8"><enum>(b)</enum><header>Authorized education programs</header><text>Educational assistance may be provided under this chapter for pursuit of any program of education that is an approved program of education for purposes of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/30">chapter 30</external-xref> of title 38.</text></subsection> 
<subsection id="H15F9DF589F0E4719AD517B2526E7207"><enum>(c)</enum><header>Benefit amount</header> 
<paragraph id="H8B039CD54A454AFAB1C0D74BF537CF84" display-inline="yes-display-inline"><enum>(1)</enum><text>The educational assistance program established under subsection (a) shall provide for payment by the Secretary concerned, through the Secretary of Veterans Affairs, an educational assistance allowance to each member entitled to educational assistance under this chapter who is pursuing a program of education authorized under subsection (b).</text></paragraph> 
<paragraph id="H10A6F3565B9047EF81FE2BE1895143F" indent="up1"><enum>(2)</enum><text>The educational assistance allowance provided under this chapter shall be based on the applicable percent under paragraph (4) to the applicable rate provided under <external-xref legal-doc="usc" parsable-cite="usc/38/3015">section 3015</external-xref> of title 38 for a member whose entitlement is based on completion of an obligated period of active duty of three years. </text></paragraph> 
<paragraph id="H90F99190D6224FADBA31ACA9C430967C" indent="up1"><enum>(3)</enum><text>The educational assistance allowance provided under this section for a person who is undertaking a program for which a reduced rate is specified in <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/30">chapter 30</external-xref> of title 38, that rate shall be further adjusted by the applicable percent specified in paragraph (4).</text></paragraph> 
<paragraph id="H921F6FF534E94A6EA3218C3D29377625" indent="up1"><enum>(4)</enum><text>The adjusted educational assistance allowance under paragraph (2) or (3), as applicable, shall be—</text> 
<subparagraph id="HBCA0FCB8FBF2429F9C22191E22621177"><enum>(A)</enum><text>40 percent in the case of a member of a reserve component who performed active service for 90 consecutive days but less than one continuous year;</text></subparagraph> 
<subparagraph id="HDE56916D90EB495A00D0D31CD1C3F38B"><enum>(B)</enum><text>60 percent in the case of a member of a reserve component who performed active service for one continuous year but less than two continuous years; or</text></subparagraph> 
<subparagraph id="H38F2B0B4A44447308BA0404CFAE3A244"><enum>(C)</enum><text>80 percent in the case of a member of a reserve component who performed active service for two continuous years or more.</text></subparagraph></paragraph></subsection> 
<subsection id="H758830C7B2E9491D8192EF2FDBE2D0A1"><enum>(d)</enum><header>Maximum months of assistance</header> 
<paragraph id="HE7EBC75E490443FDB523A0ADCD8F4802" display-inline="yes-display-inline"><enum>(1)</enum><text>Subject to <external-xref legal-doc="usc" parsable-cite="usc/38/3695">section 3695</external-xref> of title 38, the maximum number of months of educational assistance that may be provided to any member under this chapter is 36 (or the equivalent thereof in part-time educational assistance).</text></paragraph> 
<paragraph id="HBB756CD016804E7FB75408ECF117EB3B" indent="up1"><enum>(2)</enum> 
<subparagraph id="HF29451795BB54D17BAC0BE58719BEEE9" display-inline="yes-display-inline"><enum>(A)</enum><text>Notwithstanding any other provision of this chapter or <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/36">chapter 36</external-xref> of title 38, any payment of an educational assistance allowance described in subparagraph (B) of this paragraph shall not—</text> 
<clause id="H2538576B7AF045D788873F1EFF19225F" indent="up1"><enum>(i)</enum><text>be charged against the entitlement of any individual under this chapter; or</text></clause> 
<clause id="HC640E95177274BBFAE8F345B5DD7D2E3" indent="up1"><enum>(ii)</enum><text>be counted toward the aggregate period for which <external-xref legal-doc="usc" parsable-cite="usc/38/3695">section 3695</external-xref> of title 38 limits an individual’s receipt of assistance.</text></clause></subparagraph> 
<subparagraph id="HB9804F2FA4E04AD1B68CE3DF6F9300C2" indent="up1"><enum>(B)</enum><text>The payment of the educational assistance allowance referred to in subparagraph (A) of this paragraph is the payment of such an allowance to the individual for pursuit of a course or courses under this chapter if the Secretary of Veterans Affairs finds that the individual—</text> 
<clause id="H3C872FE871F442F2B686872D26FCC209"><enum>(i)</enum><text>had to discontinue such course pursuit as a result of being ordered to serve on active duty under section 12301(a), 12301(d), 12301(g), 12302, or 12304 of this title; and</text></clause> 
<clause id="H362E476AB9A64795AFF3AF2C67F3DD8"><enum>(ii)</enum><text>failed to receive credit or training time toward completion of the individual’s approved educational, professional, or vocational objective as a result of having to discontinue, as described in clause (i), the individual’s course pursuit.</text></clause></subparagraph> 
<subparagraph id="H1C1531AD6ED046999B6300B716B0FA5" indent="up1"><enum>(C)</enum><text>The period for which, by reason of this subsection, an educational assistance allowance is not charged against entitlement or counted toward the applicable aggregate period under <external-xref legal-doc="usc" parsable-cite="usc/38/3695">section 3695</external-xref> of title 38 shall not exceed the portion of the period of enrollment in the course or courses for which the individual failed to receive credit or with respect to which the individual lost training time, as determined under subparagraph (B)(ii).</text></subparagraph></paragraph></subsection></section> 
<section id="H5AA3E77AB7E34A219DB8EF7CE0698810"><enum>16163.</enum><header>Eligibility for educational assistance</header> 
<subsection id="H1D308DF0513E4827857F5D3BB060EBF9"><enum>(a)</enum><header>Eligibility</header><text display-inline="yes-display-inline">On or after September 11, 2001, a member of a reserve component is entitled to educational assistance under this chapter if the member—</text> 
<paragraph id="H14DFAE3192F444228CA77FA5D45598E5"><enum>(1)</enum><text>served on active duty in support of a contingency operation for 90 consecutive days or more; or</text></paragraph> 
<paragraph id="H97829E6C74704646868E3585D9165D13"><enum>(2)</enum><text>in the case of a member of the Army National Guard of the United States or Air National Guard of the United States, performed full time National Guard duty under <external-xref legal-doc="usc" parsable-cite="usc/32/502">section 502(f)</external-xref> of title 32 for 90 consecutive days or more when authorized by the President or Secretary of Defense for the purpose of responding to a national emergency declared by the President and supported by Federal funds.</text></paragraph></subsection> 
<subsection id="HD3907C1318434CEA9EE364007D75A963"><enum>(b)</enum><header>Disabled members</header><text>Notwithstanding the eligibility requirements in subsection (a), a member who was ordered to active service as prescribed under subsection (a)(1) or (a)(2) but is released from duty before completing 90 consecutive days because of an injury, illness or disease incurred or aggravated in the line of duty shall be entitled to educational assistance under this chapter at the rate prescribed in section 16162(b)(2)(A) of this title.</text></subsection> 
<subsection id="HB3CD4D55DAD4457AB35B00B9B8B169D"><enum>(c)</enum><header>Written notification</header> 
<paragraph id="H6567C3AFE47A46BE8DE843E46BDFEB6F" display-inline="yes-display-inline"><enum>(1)</enum><text>Each member who becomes entitled to educational assistance under subsection (a) shall be given a statement in writing prior to release from active service that summarizes the provisions of this chapter and stating clearly and prominently the substance of sections 16165 and 16166 of this title as such sections may apply to the member.</text></paragraph> 
<paragraph id="H5B7329AFE4304F38AB7F60C8B861CA59" indent="up1"><enum>(2)</enum><text>At the request of the Secretary of Veterans Affairs, the Secretary concerned shall transmit a notice of entitlement for each such member to that Secretary.</text></paragraph></subsection> 
<subsection id="HA57DF9D7C4B648C1A833BE00FB59ADF9"><enum>(d)</enum><header>Bar from dual eligibility</header><text>A member who qualifies for educational assistance under this chapter may not receive credit for such service under both the program established by <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/30">chapter 30</external-xref> of title 38 and the program established by this chapter but shall make an irrevocable election (in such form and manner as the Secretary of Veterans Affairs may prescribe) as to the program to which such service is to be credited.</text></subsection> 
<subsection id="H507CA3A4B43F440D9B4FB7A964FDED7D"><enum>(e)</enum><header>Bar from duplication of educational assistance allowance</header> 
<paragraph id="H12F4CC69C8EF4D1F80D73AA875D75A2" display-inline="yes-display-inline"><enum>(1)</enum><text>Except as provided in paragraph (2), an individual entitled to educational assistance under this chapter who is also eligible for educational assistance under chapter 1606 of this title, chapter 30, 31, 32, or 35 of title 38, or under the Hostage Relief Act of 1980 (<external-xref legal-doc="public-law" parsable-cite="pl/96/449">Public Law 96–449</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/5/5561">5 U.S.C. 5561</external-xref> note) may not receive assistance under more than one such programs and shall elect (in such form and manner as the Secretary concerned may prescribe) under which program the member elects to receive educational assistance.</text></paragraph> 
<paragraph id="H447E7BD08A3E4C83AAD92EEAC6E400D7" indent="up1"><enum>(2)</enum><text>The restriction on duplication of educational assistance under paragraph (1) does not apply to the entitlement of educational assistance under section 16131(i) of this title.</text></paragraph></subsection></section> 
<section id="H12F5E35B9A81435796F2581E7E66E270"><enum>16164.</enum><header>Time limitation for use of entitlement</header> 
<subsection id="HE2578193ACFC4C3B9ED58C2686D91C00"><enum>(a)</enum><header>Duration of entitlement</header><text display-inline="yes-display-inline">Except as provided in subsection (b), a member remains entitled to educational assistance under this chapter while serving—</text> 
<paragraph id="HDC9C0A8FD88D434AA31CE04662F0D0B3"><enum>(1)</enum><text>in the Selected Reserve of the Ready Reserve, in the case of a member was called or ordered to active service while serving in the Selected Reserve; or</text></paragraph> 
<paragraph id="HB080403D0AE6404BA1008E83F911006D"><enum>(2)</enum><text>in the Ready Reserve, in the case of a member was ordered to active duty while serving in the Ready Reserve (other than the Selected Reserve).</text></paragraph></subsection> 
<subsection id="HF06FFA32CBD1440FA3465F977E62007E"><enum>(b)</enum><header>Duration of entitlement for disabled members</header> 
<paragraph id="HE1873368207E40FDBB3BBD37B8258832" display-inline="yes-display-inline"><enum>(1)</enum><text>In the case of a person who is separated from the Ready Reserve because of a disability which was not the result of the individual’s own willful misconduct incurred on or after the date on which such person became entitled to educational assistance under this chapter, such person’s entitlement to educational assistance expires at the end of the 10-year period beginning on the date on which such person became entitled to such assistance.</text></paragraph> 
<paragraph id="H46F378751E36480A974739E4F65C08EF" indent="up1"><enum>(2)</enum><text>The provisions of subsections (d) and (f) of <external-xref legal-doc="usc" parsable-cite="usc/38/3031">section 3031</external-xref> of title 38 shall apply to the period of entitlement prescribed by paragraph (1).</text></paragraph></subsection></section> 
<section id="H310A85A7AF79453CB34F94160878F983"><enum>16165.</enum><header>Termination of assistance</header><text display-inline="no-display-inline">Educational assistance may not be provided under this chapter, or if being provided under this chapter, shall be terminated—</text> 
<paragraph id="H8D0D5A1507EF4EBAB9FA5263DEC40500"><enum>(1)</enum><text>if the member is receiving financial assistance under section 2107 of this title as a member of the Senior Reserve Officers' Training Corps program; or</text></paragraph> 
<paragraph id="H3506C4AB1CB04882BEBEFA842EA88B50"><enum>(2)</enum><text>when the member separates from the Ready Reserve, as provided under section 16164(a)(1) or section 16164(a)(2), as applicable, of this title.</text></paragraph></section> 
<section id="H2D63F9E38B514A20A475328785510833"><enum>16166.</enum><header>Administration of program</header> 
<subsection id="H76AECF9CD0E64E8B95FB19265476FB18"><enum>(a)</enum><header>Administration</header><text display-inline="yes-display-inline">Educational assistance under this chapter shall be provided through the Department of Veterans Affairs, under agreements to be entered into by the Secretary of Defense, and by the Secretary of Homeland Security, with the Secretary of Veterans Affairs. Such agreements shall include administrative procedures to ensure the prompt and timely transfer of funds from the Secretary concerned to the Department of Veterans Affairs for the making of payments under this chapter.</text></subsection> 
<subsection id="HDB8091215D4841C591CEAB2022C2AC67"><enum>(b)</enum><header>Program management</header><text>Except as otherwise provided in this chapter, the provisions of sections 503, 511, 3470, 3471, 3474, 3476, 3482(g), 3483, and 3485 of title 38 and the provisions of subchapters I and II of chapter 36 of such title (with the exception of sections 3686(a), 3687, and 3692) shall be applicable to the provision of educational assistance under this chapter. The term <quote>eligible veteran</quote> and the term <quote>person</quote>, as used in those provisions, shall be deemed for the purpose of the application of those provisions to this chapter to refer to a person eligible for educational assistance under this chapter.</text></subsection> 
<subsection id="H9A8159170AC34B9ABF8075AE3D342293"><enum>(c)</enum><header>Flight training</header><text>The Secretary of Veterans Affairs may approve the pursuit of flight training (in addition to a course of flight training that may be approved under <external-xref legal-doc="usc" parsable-cite="usc/38/3680A">section 3680A(b)</external-xref> of title 38) by an individual entitled to educational assistance under this chapter if—</text> 
<paragraph id="HFB599828F18E411B900024CE00B97CAE"><enum>(1)</enum><text>such training is generally accepted as necessary for the attainment of a recognized vocational objective in the field of aviation;</text></paragraph> 
<paragraph id="HA1F14574E0384DCD968C44699274A0EF"><enum>(2)</enum><text>the individual possesses a valid private pilot certificate and meets, on the day the member begins a course of flight training, the medical requirements necessary for a commercial pilot certificate; and</text></paragraph> 
<paragraph id="H811DDE2E877846EAA417EBA4EE82A9EB"><enum>(3)</enum><text>the flight school courses meet Federal Aviation Administration standards for such courses and are approved by the Federal Aviation Administration and the State approving agency.</text></paragraph></subsection> 
<subsection id="HD8EA1CB423604A798786B28EF512B984"><enum>(d)</enum><header>Trust fund</header><text>Amounts for payments for benefits under this chapter shall be derived from the Department of Defense Education Benefits Fund under section 2006 of this title.</text></subsection></section></chapter><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H133058A324A046FFB3F3845E96DCB49"><enum>(b)</enum><header>Conforming amendments</header> 
<paragraph id="H0235EAFDC52D41A7B3C10046D5B88E1" display-inline="yes-display-inline"><enum>(1)</enum><text>Section 2006(b) of such title is amended—</text> 
<subparagraph id="H6790C4A584C74BFFBE645FEA03ACDB0" indent="up1"><enum>(A)</enum><text>in paragraph (1), by striking <quote>chapter 1606</quote> and inserting <quote>chapters 1606 and 1607, including funds provided by the Secretary of Homeland Security for education liabilities for the Coast Guard when it is not operating as a service in the Department of the Navy</quote>; and</text></subparagraph> 
<subparagraph id="HDAD85E22FE894812AB1CD84DA01BD58D" indent="up1"><enum>(B)</enum><text>in paragraph (2)(C), by striking <quote>for educational assistance under chapter 1606</quote> and inserting <quote>(including funds from the Department in which the Coast Guard is operating) for educational assistance under chapters 1606 and 1607</quote>. </text></subparagraph></paragraph> 
<paragraph id="H3DC804CA9A4444799CAFC9C8D58E193" indent="up1"><enum>(2)</enum><text><external-xref legal-doc="usc" parsable-cite="usc/38/3695">Section 3695(a)(5)</external-xref> of title 38, United States Code, is amended by inserting <quote>1607,</quote> after <quote>1606,</quote>.</text></paragraph></subsection> 
<subsection id="H4837E4249E2C4CEFBDF2A6F82B86A1F5"><enum>(c)</enum><header>Clerical amendment</header><text>The tables of chapters at the beginning of subtitle E of title 10, United States Code, and at the beginning of part IV of such subtitle, are amended by inserting after the item relating to chapter 1606 the following new item:</text>
